This is a non-payment case in which the tenant, who lives in a rent-stabilized HDFC apartment, owed over $40,000 in rent arrears. The landlord sought to evict the tenant, but the court granted the tenant's motion for a stay of eviction. The court found that the tenant had been paying his ongoing rent and that he had applied for rental assistance from the Department of Social Services. The court also found that the landlord would not be penalized by a further stay of the eviction. Key Legal Points: 1) A tenant's ongoing payment of rent can be a factor in …

Previous literature supports the importance of corporate social responsibility (CSR) by demonstrating its effects on various aspects of firm performance. However, the extent to which CSR contributes to social well-being, its original objective, has rarely been examined. The current research investigates the impact of customers’ perceived CSR of service firms on customer happiness. Two studies confirm our proposition that perceived CSR increases customer happiness by enhancing perceptions of warmth and competence associated with the service company. Furthermore, we examine how the type of service moderates this effect. Specifically, we find that the indirect effects of CSR on customer happiness through …

“Zealous” Professional Ethics: The Transcendence Of Natural Law, Legal Positivism, And The Ethical Stage In The U.S. Legal Ethics System And The Moral Dilemma That Surround Zealous Representation, Sudarsanan Sivakumar, Marshall Maina
St. Mary's Journal on Legal Malpractice & Ethics
The zealous pursuit of law has its own ideals and dogma that sets it apart from the other rules in the Model Rules of Professional Conduct. Decades after many enactments and amendments, there still exists many debates considering its operation as to whether an attorney owes a duty toward society over the representation of the client. This is a Delphi method that has made even the best seasoned ‘Justiciar’ and ‘Legislator’ unable to find the proper guidelines to implement upon the Legal Superstructure. The Model Rules of Professional Conduct attempt to clear the fog around the existing principle of Zealous …

The Ethical Lawyer: Beyond The Rules, Nick Badgerow
St. Mary's Journal on Legal Malpractice & Ethics
Does being a lawyer mean more than the mere pursuit of a client’s cause and resulting (hoped for) financial success and professional standing, while avoiding discipline? This article invites a consideration of what it means to be a true “professional” in the practice of law. First, the article explores the definition of the term “professional,” and proceeds to examine the obligations undertaken by lawyers (a) in their oath of admission, and (b) in codes of professional conduct. However, the author posits, should not the true professional aspire to more than the mere compliance with these minimum standards? In answer, the …

Landlord's claim for non-payment and eviction dismissed due to insufficient notice to tenant regarding termination of subsidy and tenancy rights. Key Legal Points: VAWA notice not provided with termination or eviction notices, violating federal law. Notices lacked information about tenant's right to meet with manager, violating HUD regulations. Lack of proper predicate notice rendered landlord's case unviable.

Gentrification And Nonprofit Activities For Neighborhood Development In Baltimore, Maryland And Houston, Texas, Jesseca E. Lightbourne, Aminata Sillah, Julius A. Nukpezah
Journal of Public Management & Social Policy
This study examines the role of community-based nonprofit organizations in neighborhood revitalization/community development and their impact on the level of housing services. The neighborhoods in the study represent certain universalities of gentrification in older communities, and therefore selected for the study. By going beyond the profitability of gentrification, this study examines the social costs associated with gentrification through the lens of nonprofit organizations using quantitative data from Baltimore, Maryland and Houston, Texas. Taking into account nonprofit organizations as important actors in the gentrification field, this study contributes to the understanding of the social cost of gentrification and how community-based nonprofit …
