The Constitutional Right Not To Cooperate - Local Sovereignty And The Federal Immigration Power, Huyen Pham

This article examines an important but up to now, still unexplored area in the federalism debate: May the federal government require local governments to cooperate with the enforcement of immigration law or other federal scheme? Or may local governments constitutionally refuse to provide that cooperation?

I use immigration law enforcement as a case study to argue that the current legal framework, which allows the federal government to mandate local cooperation, ignores the significant federalism harms that federal cooperation laws impose. The advance of technology has influenced marketing in a number of ways that have ethical implications. Growth in use of the Internet and e-commerce has placed electronic "cookies," spyware, spam, RFIDs, and data mining at the forefront of the ethical debate. Some marketers have minimized the significance of these trends. This overview paper examines these issues and introduces the two articles that follow. It is hoped that these entries will further the important "marketing and technology" ethical debate.

Unconscionable Contracting For Indigent Defense: Using Contract Theory To Invalidate Conflict Of Interest Clauses In Fixed-Fee Contracts, Jacqueline Mcmurtie

Indigent defense remains in crisis and yet constitutional challenges to promote systemic change have met with mixed success. This Article explores the new strategy of applying contract theory and principles to challenge indigent defense contracts that violate the canons of professional responsibility. This Article begins by discussing the author's experience working on cases of indigent defendants whose convictions were overturned through the efforts of the Innocence Project Northwest. The erroneous convictions were facilitated by the indigent defense contract in place at the time of the convictions. An analysis of the Chama, New Mexico community and market area. Socioeconomic data, including population growth and selected demographic, economic, and housing characteristics are described. The author discusses the significant economic challenges facing Chama, which are due to its isolated, rural location; lack of exporting industries; and need for investment in infrastructure. Chamas only major industry is tourism, primarily the Cumbres & Toltec Scenic Railroad. Using a location quotient analysis, the author discusses the area's pull factors and leakages in retail and services. He concludes with three recommendations for diversifying the local economy: establishing a base (export-oriented) industry in agriculture, …

An analysis of economic conditions in Springer, New Mexico, commissioned for its MainStreet economic development program. The MainStreet Service Area and regional market area are described and illustrated. Demographic, income, and housing data for Springer, Colfax County, and the Northeast County Region (Colfax, Harding, Mora, San Miguel and Union counties) are analyzed. Using location quotients and pull factors, the author assesses the local economys strengths and weaknesses, and then lists several recommendations for revitalizing the area. Research Note: All But One: Solo Dissents On The Modern Supreme Court Of Canada, Christine M. Joseph

It can be argued that the exercise of solo dissent on the Supreme Court of Canada is judicial disagreement at its apex-a single judge sitting on the highest court in the nation breaking away from his or her colleagues who have purportedly "gotten it wrong." By examining the practice of solo dissent in the Supreme Court of Canada over the last three decades, this research note provides insight into this unique form of judicial disagreement.
