Locked Out: Locke V. Davey And The Broken Promise Of Equal Access, Richard F. Duncan Aug 2006

Locked Out: Locke V. Davey And The Broken Promise Of Equal Access, Richard F. Duncan

Nebraska College of Law: Faculty Publications

This Article analyzed Chief Justice Rehnquist's Footnote Three dictum, and concluded that the Promise Scholarship Program in Davey was clearly designed to encourage Promise Scholars to choose from an infinitely broad array of subjects, viewpoints, and courses of study that make up the marketplace of ideas of higher education in the State of Washington. Since the exclusion of devotional theology majors from the Program was clearly based on the viewpoint from which theology is taught and studied, and since it is clear that government may not discriminate on the basis of viewpoint--even in the context of a funding program--if the …

Evolution Or Revolution In The Labor Movement : Business Unionism Versus Social Unionism., Jo Ann Shumate 1958- Aug 2006

Evolution Or Revolution In The Labor Movement : Business Unionism Versus Social Unionism., Jo Ann Shumate 1958-

Electronic Theses and Dissertations

This is a study of the American labor movement, particularly how national labor policy is enacted at the local level. Specific differences between business unionism and social movement unionism, as defined in the literature, are combined and analyzed. Local unions are compared and contrasted in order to explore which will be more effective in the growth of the labor movement of the 21st century. This is a case study of three different types of local unions: craft, service sector, and public sector. In-depth interviews were conducted with two to three officials from each union. The questions covered five topics which …

A Tale Of Two Stadiums: Comparing The Economic Impact Of Chicago’S Wrigley Field And U.S. Cellular Field, Victor Matheson, Robert Baade, Mimi Nikolova Aug 2006

A Tale Of Two Stadiums: Comparing The Economic Impact Of Chicago’S Wrigley Field And U.S. Cellular Field, Victor Matheson, Robert Baade, Mimi Nikolova

Economics Department Working Papers

Supporters of sports stadium construction often defend taxpayer subsidies for stadiums by suggesting that sports infrastructure can serve as an anchor for local economic redevelopment. Have such promises of economic rejuvenation been realized? The City of Chicago provides an interesting case study on how a new stadium, U. S. Cellular Field, has been integrated into its southside neighborhood in a way that may well have limited local economic activity. This economic outcome stands in stark contrast to Wrigley Field in northern Chicago which continues to experience a synergistic commercial relationship with its neighborhood.

A Course In Forensic Accounting, Yelena Kleyman Aug 2006

A Course In Forensic Accounting, Yelena Kleyman

Honors College Theses

The origins of the accounting profession are rooted deep into history. The basic concepts of accounting were changing as years and centuries passed by. Nonetheless, a concept exists which did not experience major modifications over time -- fraud. Fraud existed centuries ago, as well as it exists today, and unfortunately, may exist years from now. However, in recent years forensic accounting has been expanding in order to change this pattern. This discipline created a new branch in the accounting profession, generating a growing demand for forensic accountants. Forensic accounting is currently taught in many American universities; however, Pace University is …

Peace Is Not The Absence Of Conflict: A Response To Professor Rogers' Article: "Fit And Function In Legal Ethics", Kirsten D. Weisenberger Jul 2006

Peace Is Not The Absence Of Conflict: A Response To Professor Rogers' Article: "Fit And Function In Legal Ethics", Kirsten D. Weisenberger

ExpressO

This paper takes the theoretical model Professor Catherine Rogers developed in her article “Fit and Function in Legal Ethics: Developing a Code of Conduct for International Arbitration,” 23 MICH. J. INT’L L. 341 (2002) as the starting point for an original argument that conflicts of laws analysis should be used to determine which legal ethics rules should apply to lawyers practicing international arbitration. The argument is supported by the new ABA Model Rules of Professional Conduct rule on choice of law explicitly applies conflicts of laws analysis to lawyers practicing in the multijurisdictional settings. This paper analyses the new ABA …

The Continued Resonance And Challenge Of The “Ius Commune” In Modern European Contract Law, Martin J. Doris Jul 2006

The Continued Resonance And Challenge Of The “Ius Commune” In Modern European Contract Law, Martin J. Doris

International Journal of Legal Information

The need for a more consistent and coherent European contract law is a current priority of the EC institutions. Despite decades of pointillistic legal harmonization, cross border transactions within the Internal market of the European Union continue to take place in the shadow of divergent procedural and substantive law rules, differing legal cultures and significant linguistic diversities. Whilst national contract law systems function more or less efficiently internally, it is their partial non-compatibility with other Member States’ private laws that provokes isolated distortions on the market. As a consequence, the European Commission has presented its ‘Common Frame of Reference’ research …

Report To The Nebraska Supreme Court On Indigent Defense Systems And Fee Structures, Nebraska Minority Justice Committee Jul 2006

Report To The Nebraska Supreme Court On Indigent Defense Systems And Fee Structures, Nebraska Minority Justice Committee

University of Nebraska Public Policy Center: Publications

On May 18, 2005 the Nebraska Supreme Court adopted the following resolution: “The Minority and Justice Implementation Committee shall study indigency attorney fee structures statewide and report and make recommendations, if any, to the Supreme Court regarding indigency fees throughout the State of Nebraska.”

The Nebraska Supreme Court’s resolution was influenced by a certain county’s attempt to establish a flat fee for court appointed attorneys. The legal profession’s concern with this policy is that such a drastic rate reduction would likely encourage attorneys to spend less time on court appointed cases, and discourage more experienced attorneys from accepting court appointments …
