Choosing Sides: On The Manipulation Of Civil Litigation, Yotam Kaplan, Ittai Paldor May 2024

Choosing Sides: On The Manipulation Of Civil Litigation, Yotam Kaplan, Ittai Paldor

Vanderbilt Law Review

Our litigation system is broken. Scholars have long warned that professional litigants, such as debt-collecting firms, insurance companies, and commercial landlords, enjoy immense and unfair advantages over private individuals. What has gone unnoticed is professional litigants’ ability to manipulate their litigatory position—that is, to choose whether they will litigate as plaintiffs or defendants. Extant literature assumes that the parties’ litigatory positions are determined by the substance of the dispute: the party seeking a remedy is the plaintiff, and the party objecting to the award of a remedy is the defendant. We show that, in reality, professional litigants have both the …

Disaster management is a critical component of national development, particularly in the aftermath of natural disasters. This research was conducted in the wake of the disaster with the primary objective of evaluating the legal protection and human rights afforded to survivors residing in Petobo Village, which has been designated as a red zone due to the severity of the disaster. The study uncovered significant damage to …

Haskins V. Gutierrez

All Decisions

This holdover proceeding, based on a 90-day termination notice, was dismissed without prejudice. The tenant successfully argued that the termination notice failed to mention her Section 8 voucher, a crucial detail required by law. The court emphasized that such notices must accurately describe the tenancy, including any Section 8 status, to fulfill regulatory requirements. As the notice was deficient and could not be amended, the petition was dismissed.

Fieldbridge Assoc. Llc V. Rivers

All Decisions

In a non-payment proceeding in a rent-stabilized property, the court denied the tenant's motion for summary judgment, ruling that the landlord could sue for rent arrears based on the actual lease agreements rather than solely relying on the last registered rent with the DHCR. The court emphasized that the essence of the agreement between landlord and tenant, as reflected in the lease, governed the rent due, not just the last registered amount. The decision highlights the importance of lease terms in determining rent obligations in rent-stabilized properties.

All Decisions

The landlord sued the tenant in a holdover proceeding, claiming the tenant created a nuisance by allowing unauthorized people to live in the recreation room. Questioning The Legitimacy Of The Expedited Removal Process – The Tall Task Of Protecting The Constitutional Rights Of One Of America’S Most Marginalized Groups, Jacob J. Bourquin Apr 2024

Questioning The Legitimacy Of The Expedited Removal Process – The Tall Task Of Protecting The Constitutional Rights Of One Of America’S Most Marginalized Groups, Jacob J. Bourquin

Cleveland State Law Review

This Note explores the origin and development of 8 U.S.C. § 1225—a heavily debated facet of the United States’ immigration law. Section 1225, colloquially referred to as the “expedited removal process,” has been interpreted to permit low-level immigration officers to summarily remove certain “arriving” noncitizens from the United States without affording them the procedural due process protections guaranteed under the Fifth Amendment of the United States Constitution to all individuals present in the United States. This Note posits that the current interpretation of § 1225, particularly the interpretation of “is arriving,” and application of the expedited removal process is inconsistent …

Lincoln Sponsor Llc V. Wellington

All Decisions

In this non-payment case, the tenant moved to amend her answer and to dismiss the petition due to a defective rent demand. The court granted the motion to amend, noting the absence of prejudice to the landlord and the potential merit in the proposed defenses. Regarding the motion to dismiss, the court found the rent demand lacking clarity and specificity, particularly concerning additional charges, and dismissed the petition without prejudice, emphasizing the importance of compliance with RPAPL 711.

Regulatory Body Shops, Bridget C.E. Dooling, Rachel Augustine Potter Apr 2024

Regulatory Body Shops, Bridget C.E. Dooling, Rachel Augustine Potter

Duke Law Journal

Agencies do not always write their own rules. Contractors assist agencies in nearly all tasks relating to rulemaking, including reviewing public comments, conducting specialized research, and writing regulatory text. Despite perceptions that contractors’ roles are entirely ministerial, the reality is that contractors fulfill many more functions in the rulemaking process than is commonly understood, including everything right “up to pushing the big red policymaking button,” as one agency employee put it. The use of contractors in rulemaking fits within a broader pattern of increased government reliance on service contractors. Scholars have documented a bevy of governance concerns relating to ethics, …

Educating Deal Lawyers For The Digital Age, Heather Hughes Apr 2024

Educating Deal Lawyers For The Digital Age, Heather Hughes

Scholarly Articles in Law Reviews & Journals

Courses and programs that address law and emerging technologies are proliferating in U.S. law schools. Technology-related issues pervade the curriculum. This Essay presents two instances in which new technologies present challenges for deal lawyers. It explores how exposing students to closing opinions practice can prepare them to engage these challenges. Both examples involve common commercial contexts and lessons relevant to students of business associations and of the Uniform Commercial Code. The first, which deals with enforceability opinion letters, presents technical legal difficulties arising from recent developments in law and technology. The second, involving complex doctrines at the heart of financial …

Sexual Health Education Scope And Sequence, Sara Wadsworth Apr 2024

Sexual Health Education Scope And Sequence, Sara Wadsworth

Honors Projects

Based on a significant amount of prior research, comprehensive sexuality education (CSE) has been identified to be the most effective method of teaching sexual health education (SHAPE America, 2021; World Health Organization, 2023). Comprehensive sexual health education improves healthy behaviors and outcomes, provides useful information, and is positively perceived by students (Gardner, 2015; Kirby, 2002; Robinson et al., 2022). However, the United States’ current sexual health education has not implemented this ideal method, which is shown through state laws, students’ experiences, underdeveloped skills and flawed understanding of concepts, and – most importantly – a lack of resources for teachers (Foley, …

Work-Based Learning Experiences And Students With Intellectual Disabilities: A Qualitative Case Study, Jessy Logan Richard Apr 2024

Work-Based Learning Experiences And Students With Intellectual Disabilities: A Qualitative Case Study, Jessy Logan Richard

Doctoral Dissertations and Projects

The purpose of this embedded single-case study was to understand how participation in work-based learning experiences (WBLE) prepares students with intellectual disabilities (ID) for successful post-school competitive employment. The theory guiding this study was Kolb’s experiential learning theory, as it systematically explains the four stages of learning that learners go through during WBLE. This embedded single-case study investigated the experience of 12 work site supervisors supervising students with an ID while participating in WBLE at a restaurant and a hotel and one student who participated in the WBLE. Data were collected using individual interviews, document analysis, and focus groups. The …

Parental Kidnapping And Domestic Violence: The Need To Reform And Enforce State Action, Anna Ratterman Apr 2024

Parental Kidnapping And Domestic Violence: The Need To Reform And Enforce State Action, Anna Ratterman

Georgia Criminal Law Review

When civil family issues intersect with criminal acts, the civil and criminal systems fail to effectuate a complete remedy. Specifically, there are few effective protections for victims of domestic violence during the pendency of domestic relations proceedings. Given the complicated gender dynamics and inequalities that have developed throughout history, it is unsurprising that the criminal and civil systems have failed to prioritize prosecution of crimes against women. Current criminal laws fail to treat domestic violence and parental kidnapping as serious crimes and instead adopt the view that domestic disputes are private issues to be handled within the family. In turn, …

How Social Movements Have Influenced Child Custody Standards Over Time, Victoria Miller Apr 2024

How Social Movements Have Influenced Child Custody Standards Over Time, Victoria Miller

Honors Theses

Child custody standards have evolved over time due to societal attitude shifts regarding gender roles. The stereotypes present within the decision-making process of child custody laws have been challenged repeatedly in order to attack sexism within the laws. Child custody decisions are important for the child and family in question, because whichever parental guardian has custody over the child has the legal authority to make life changing choices for the child. These choices can include education, religion, and the environment the child grows and develops in. Parental choices can affect a child's mental and physical well-being, which makes it crucial …
