Newport Gardens Apartment, L.P. V. Surles May 2024

Newport Gardens Apartment, L.P. V. Surles

All Decisions

The landlord commenced a nonpayment proceeding against the tenant, alleging rent arrears. The tenant moved to dismiss the petition, arguing that the predicate rent demand was defective for failing to clearly specify the alleged arrears period and including non-itemized, non-rent charges. The court agreed that the rent demand did not comply with statutory requirements and was too confusing to inform the tenant of the actual amount owed. As a result, the court granted the tenant's motion and dismissed the nonpayment petition without prejudice to the landlord re-filing with a proper rent demand. The court also ordered the landlord to correct …

Essays On Intellectual Property Strategy, Byung Uk (Charlie) An

Olin Business School Graduate Student Theses and Dissertations

Different forms of institutions have been devised by human beings throughout history, either as informal constraints or formal rules. Although emerging in various forms, institutions play a pivotal role in structuring interactions in our societies. These institutional assets significantly affect firms’ environment and have a substantial impact on the economic growth of different regions and countries. This dissertation is about one of the important institutions, intellectual property (IP). IP has been designed to address the fundamental challenges in protecting innovative ideas and knowledge. That is, Arrow’s information paradox ─ for an idea to be evaluated, one has to disclose the …

High Stakes: Analyzing The Legal And Law Enforcement Challenges Of Mississippi's Medical Marijuana Industry, Brighton Bensley May 2024

High Stakes: Analyzing The Legal And Law Enforcement Challenges Of Mississippi's Medical Marijuana Industry, Brighton Bensley

Honors Theses

Despite opposition from law enforcement and government officials, Mississippi citizens overwhelmingly voted in favor of establishing a medical marijuana program in 2020. The passing of Senate Bill 2095 (or the Mississippi Medical Cannabis Act) marks a significant shift in the state’s drug policy and is a rare example of my home state at the forefront of an emerging industry. My thesis examines the effects of the Mississippi Medical Cannabis Act by providing an overview of the challenges it creates for the state’s law enforcement agencies and legal community. By analyzing local news stories, public statements from officials, and studies from …

Ten Thousand Ai Systems Typing On Keyboards: Generative Ai In Patent Applications And Preemptive Prior Art

Vanderbilt Journal of Entertainment & Technology Law

Generative AI makes it possible to create unlimited amounts of text at essentially zero cost. While this technology has many benefits, it can also be used in ways that undermine the goals of the patent system. This Article identifies policy solutions to address the potentially anti-innovative application of generative AI in several patent-related contexts. First, it examines the use of AI to publish massive online databases of preemptive prior art intended to foreclose patentability. This Article argues that computer-generated invention descriptions published without any substantive nexus to human understanding of their contents should not count as “printed publications” under US …

No Sword, No Shield, No Problem: Ai In Pro Se Section 1983 Suits, Michaela Calhoun May 2024

No Sword, No Shield, No Problem: Ai In Pro Se Section 1983 Suits, Michaela Calhoun

University of Colorado Law Review Forum

Originating during the Reconstruction era, 42 U.S.C. 1983 emerged as a legislative tool to safeguard individuals’ constitutional rights and liberties. Initially designed to combat state-sanctioned violence, its efficacy has been eroded over time by subsequent judicial and legislative action. Unfortunately, the current state of Section 1983 falls short of this envisioned role, particularly for incarcerated individuals who find themselves navigating the complexities of the federal court system as pro se litigants.

Faced with a landscape devoid of resources, incarcerated individuals struggle to realize their constitutional rights, further perpetuating their collective status as a second-class citizenry—a status imposed by their own …

Interpretive Divergence In The New York Court Of Appeals, Ethan J. Leib May 2024

Interpretive Divergence In The New York Court Of Appeals, Ethan J. Leib

Journal of Legislation

This Article focuses attention on the New York Court of Appeals, which is decidedly formalist about contract interpretation but decidedly contextualist about statutory interpretation. It explores some recent exemplary cases to show where the New York Court of Appeals tends to land in what turns out to be, for this court at least, two different battlefields in the law of interpretation. Finding that there is “interpretive divergence” between statutory and contract cases, the Article then reflects on the practice of divergence more generally, revisiting assumptions about why anyone might have thought harmonization was sensible in the first place.

Housing As A Determinant Of Health: Exploring The Role Of Housing And Homelessness Organizations In Increasing Access To Resources And Overcoming Barriers To Adequate And Healthy Homes, Jennifer C. Martin May 2024

Housing As A Determinant Of Health: Exploring The Role Of Housing And Homelessness Organizations In Increasing Access To Resources And Overcoming Barriers To Adequate And Healthy Homes, Jennifer C. Martin

Master's Theses

Across the United States, there are a multitude of barriers that stand in the way of obtaining adequate housing and additional resources that can assist with accessing housing. These barriers disproportionately impact low-income individuals and communities (Gold, 2016), and further contribute to inequity by negatively impacting the health of these individuals and communities (Swope & Hernández, 2019; Taylor, 2018). The current study explores housing organizations’ potential role in overcoming these barriers by focusing on the work of one housing organization in the Greater New Haven and Fairfield Counties of Connecticut: New Reach. 17 participants enrolled in New Reach programs were …

Generative Ai In Education From The Perspective Of Students, Educators, And Administrators, Aashish Ghimire

All Graduate Theses and Dissertations, Fall 2023 to Present

This research explores how advanced artificial intelligence (AI), like the technology that powers tools such as ChatGPT, is changing the way we teach and learn in schools and universities. Imagine AI helping to summarize thick legal documents into something you can read over a coffee break or helping students learn how to code by offering personalized guidance. We looked into how teachers feel about using these AI tools in their classrooms, what kind of rules schools have about them, and how they can make learning programming easier for students. We found that most teachers are excited about the possibilities but …

Sexual Exploitation: The Crisis And Eradicative Solution, Tonnie Adams Bracey

Nonprofit and NGO Studies Student Projects

French writer Jean-Baptiste Alphonse Karr wrote, “The more things change, the more they stay the same.” I find this to be true in our current era of the digital age. Although technology has gifted a newly improved and vast method of making worldwide connections and broadening our perceptions and views, a change in how we communicate has conveniently presented itself, but the historic pattern of how we handle these new advancements have indeed stayed the same.
Smart phones are a mainstream vessel employing the world with a plethora of information while giving all sorts of people access to individual’s lives …

Ethics In Law And The Effects On Mental Health: An Interview Study, Kaitlyn Nyffeler May 2024

Ethics In Law And The Effects On Mental Health: An Interview Study, Kaitlyn Nyffeler

Theses/Capstones/Creative Projects

On August 2, 1983, The American Bar Association Model Rules of Professional Conduct were adopted by the House of Delegates. This set of rules provides legal professionals with the guidance needed to uphold the rule of law and to preserve justice. In this set of rules, lawyers learn the duties of confidentiality, client relations, diligence, and the overall conduct owed to the courts. Furthermore, these duties can be demanding and oftentimes challenging. Therefore, this study examined the different ethical rules as they apply to lawyers and how these demands can impact their mental health. Interviews were conducted with six lawyers …

I Hope This Email Finds You Well: The Eleventh Circuit Addresses The Standard Of Review For Incarcerated Persons’ Outgoing Emails, Olivia Greenblatt

Mercer Law Review

An unfortunate and inevitable aspect of incarceration is separation from the outside world. The various constraints on communication exemplify one of the many ways through which incarceration creates this divide. Maintaining the connections that incarcerated people have with their loved ones and communities is essential for fostering a vital support system, facilitating the exchange of information, aiding in successful reintegration, and reducing recidivism upon release. Unfortunately, instead of encouraging and safeguarding this communication, prisons often curtail it through restrictive methods: visitation is limited, phone calls are costly, physical mail involves a time-consuming and intrusive process, and now, email is being …

The Least Known Celebration Of America's Founding Principles—Law Day, The Honorable Katharine H. Parker, Anthony Petrosino

Fordham Law Review

Every year since May 1, 1958, the United States has recognized Law Day. Codified in 1961, it is “a special day of celebration” for Americans to reaffirm “their loyalty to the United States” and rededicate themselves “to the ideals of equality and justice under law in their relations with each other and with other countries.” Its purpose is to “cultivat[e] . . . respect for law that is so vital to the democratic way of life.” It tasks the President with issuing an annual proclamation calling for “public officials to display the flag of the United States on all Government …

Prison Parts: The Theological-Ethical Problem Of Using Prisoners As Living Organ Donors, Eryn Reyes Leong May 2024

Prison Parts: The Theological-Ethical Problem Of Using Prisoners As Living Organ Donors, Eryn Reyes Leong

Say Something Theological: The Student Journal of Theological Studies

This paper is a theological and ethical reflection of Massachusetts House Bill 2333, which would reduce prison sentences on the condition that state prisoners donate bone marrow or an organ. Looking specifically at agency and bodily integrity as the two facets of imago Dei that are implicated by House Bill 2333, I address the crucial question: Does House Bill 2333 distort the dignity of prisoners as imago Dei by incentivizing living prisoners to donate their body parts in exchange for freedom? Using Margaret A. Farley’s justice framework articulated in Just Love: A Framework for Christian Sexual Ethics (2006), this paper: …

The study adopted a post-positivist paradigm, and the data was collected through virtual interviews conducted on Zoom who are in contact with veterans through their employment or personal lives. The barriers mentioned in this study are the type of individual struggles that each veteran faces, the lack of communication between programs assisting veterans, veterans unaware of their services, veterans who have been incarcerated, the type of discharge the service member obtained, and programs being shorthanded. Additionally, the researcher included preferable options for veterans that included The Housing …
