The Colonia And The Landfill: Colonias Development Council V. Rhino Environmental Services, Inc., Kristina Fisher
The Colonia And The Landfill: Colonias Development Council V. Rhino Environmental Services, Inc., Kristina Fisher
Student Thesis Honors (1996-2008)
On July 18, 2005, the New Mexico Supreme Court handed down a groundbreaking decision in Colonias Development Council v. Rhino Environmental Services, Inc., requiring the New Mexico Environment Department (NMED) to take environmental justice criteria into consideration during solid waste facility permitting decisions. When the New Mexico Supreme Court overruled the agency and required it to consider the social impact and regional proliferation of waste sites in its Solid Waste Act permitting decisions, it signaled a substantial shift in the interpretation of New Mexico environmental law. In the aftermath of Rhino, the agency revised its Solid Waste Act regulations to …

Economic Hardship And Historic Preservation Of Non-Profits: Balancing Individual Burden With Community Benefit, Christine Faller
Economic Hardship And Historic Preservation Of Non-Profits: Balancing Individual Burden With Community Benefit, Christine Faller
Georgetown Law Historic Preservation Papers Series
This paper will examine how a number of jurisdictions treat the takings standard for non-profit organizations, and will suggest ways of clarifying and improving the law. Part I discusses Penn Central, which sets the high national standard to for takings claims. This section also discusses how local governments have incorporated that standard into historic preservation laws as economic hardship claims. Part II analyzes how some jurisdictions make a distinction between commercial and non-profit owners in takings claims, and what claimants must demonstrate to succeed in making a claim. Part III concludes by examining the competing rationales supporting and opposing the …

Preserving Sacred Places: Free Exercise And Historic Preservation In The Context Of Third Church Of Christ, Scientist, Washington, Dc, Bryan Stockton
Georgetown Law Historic Preservation Papers Series
This paper will analyze the tension between the historic preservation of sacred places and the free exercise of religion as seen through the recent controversy surrounding the landmarking of Third Church of Christ, Scientist, in Washington, D.C. Assuming Third Church would bring a free exercise and RLUIPA challenge if the District denied a demolition permit, this paper will examine how such a suit would likely fail.
After describing the factual background, the paper will evaluate questions of standing and ripeness. The mere fact of landmarking does not create a cause of action recognized by District of Columbia courts, so any …

The Changing Role Of Physicians In Disaster Management And Hospital Incident Command, F. Matthew Mihelic, M. David Stockton, Stephen A. Cole, Gregory H. Blake
Faculty Publications
Recent changes in governmental policy toward disaster medicine and hospital incident command foreshadow a significant change in the role that physicians will play in disaster preparedness and response. The distinct discipline of Disaster Medicine has received authoritative recognition and promotion in the recent Homeland Security Presidential Directive 21, and recently established guidelines for incident command within hospitals have included a new position designated as “Medical/Technical Specialist(s)” that will assist the Incident Commander in disaster-related decision-making. This is a multidisciplinary position, and its functions can be filled by one or more individuals. As physician training and competency in Disaster Medicine increases, …

Human Services Data Standards: Current Progress And Future Vision In Crisis Response, Nancy C. Shank, Brian Sokol, Michelle L. Hayes, Christina Vetrano
Human Services Data Standards: Current Progress And Future Vision In Crisis Response, Nancy C. Shank, Brian Sokol, Michelle L. Hayes, Christina Vetrano
University of Nebraska Public Policy Center: Publications
Interorganizational coordination is crucial among human services providers responsible for responding to both personal and widespread crises. Too often, however, agencies providing disaster relief, shelter, and connection to other social service systems operate in information silos. Moreover, organizations that assist the same people may be duplicating services or ineffectively providing services to those in need. In the past, there has been no easy way for human service organizations to share information about clients, resources, and services. Over the last decade, distinct initiatives have begun to standardize data collection, storage, and transmission standards within human service domains. This paper describes several …
