Access To Justice: Report On Selected Reform Initiatives In Canada, Canadian Judicial Council Jun 2008

Access To Justice: Report On Selected Reform Initiatives In Canada, Canadian Judicial Council

Canadian Forum on Civil Justice

When the Sub-committee on Access to Justice (Trial Courts) first met we confirmed that we are concerned with access to justice, and in particular with mounting costs in the justice system. While Subcommittee members are aware of important initiatives designed to respond to the issue of costs at the trial level, it was felt that it would be helpful to know more about what is happening across the country so that we can identify promising practices to reduce costs. To that end we agreed that the starting point for the work of the Subcommittee is to develop a focused inventory …

Lawyers As Quasi-Public Actors, W. Bradley Wendel Jun 2008

Lawyers As Quasi-Public Actors, W. Bradley Wendel

Cornell Law Faculty Publications

This paper was written for a panel on access to justice at the 100th anniversary conference of the Law Society of Alberta, Canada. In it I argue that the debate over access to justice, which in the United States generally means pro bono representation provided by individual lawyers, cannot be divorced from broader theoretical debates about the lawyer's role. My claim is that lawyers are quasi-public actors, in the sense that they have some responsibility to aim directly at justice in their representation of clients, and cannot rely only on indirect strategies to ensure that justice is served. The argument …

Judges, Lawyers, And A Predictive Theory Of Legal Complexity, Benjamin H. Barton Jun 2008

Judges, Lawyers, And A Predictive Theory Of Legal Complexity, Benjamin H. Barton

Scholarly Works

This Article uses public choice theory and the new institutionalism to discuss the incentives, proclivities, and shared backgrounds of lawyers and judges. In America every law-making judge has a single unifying characteristic, each is a former lawyer. This shared background has powerful and unexplored effects on the shape and structure of American law. This Article argues that the shared characteristics, thought-processes, training, and incentives of Judges and lawyers lead inexorably to greater complexity in judge-made law. These same factors lead to the following prediction: judge-created law will be most complex in areas where a) elite lawyers regularly practice; b) judges …

The Civil Justice System And The Public Justice For Nunavummiut: Partnerships For Solutions, Travis Anderson, Mary Stratton Jun 2008

The Civil Justice System And The Public Justice For Nunavummiut: Partnerships For Solutions, Travis Anderson, Mary Stratton

Canadian Forum on Civil Justice

As part of the Civil Justice System and the Public (CJSP), a national collaborative research project, we first visited Iqaluit in June 2003. At that time the Research Coordinator met with key contacts in the Nunavut justice and social service community to talk about the research and make plans for conducting the field research. As a result of these initial meetings, the CJSP team made contact with Inuit services in Ottawa. In July 2003, during the Ontario phase of the CJSP research, we met Inuit service providers and several Nunavummiut who were at that time living in Ottawa.1 In September …

Reaching Out With Research: Engaging Community In Mapping Legal Service Accessibility, Effectiveness And Unmet Needs, Mary Stratton Jun 2008

Reaching Out With Research: Engaging Community In Mapping Legal Service Accessibility, Effectiveness And Unmet Needs, Mary Stratton

Canadian Forum on Civil Justice

Emerging international research demonstrates that high economic and social costs accrue when individuals cannot access timely and effective resolutions to legal problems. Canadian research also shows that most people lack knowledge and understanding of legal rights, legal processes and services, and experience significant barriers when attempting to seek legal information and assistance. Within the Canadian justice community there is strong interest in engaging all relevant stakeholders in collaborative processes of research and policy development. This paper discusses how community-based mapping research can facilitate such engagement in compiling evidence that informs the development of legal processes and services that are more …

Vico's "Ingenious Method" And Legal Education, Francis J. Mootz Iii Jun 2008

Vico's "Ingenious Method" And Legal Education, Francis J. Mootz Iii

Chicago-Kent Law Review

Recent calls to reform legal education have culminated in the 2007 Carnegie Report, which is attracting substantial attention and promises to have tremendous influence on American law schools. In this article I survey these calls for reform and argue that they should be put into a broader historical, philosophical and ethical perspective. Three hundred years ago the Italian humanist, Giambattista Vico, delivered his famous oration that serves as the focal point for this symposium, On the Study Methods of Our Time. This oration lamented the rise of Cartesian critical philosophy at the expense of the cultivation of imagination, prudence, …

Ethical Exploitation Of The Unrepresented Consumer, The, Victoria J. Haneman Jun 2008

Ethical Exploitation Of The Unrepresented Consumer, The, Victoria J. Haneman

Missouri Law Review

This article begins in Section I with a brief overview of the debt industry. Section II describes the circumstances of an unrepresented defendant in the adversarial system of justice. The conventional codes of professional responsibility are weighed against a broader framework of normative ethics in Section III. Section IV illustrates how the particulars of the debt-buying setting are emblematic of broader issues. Two solutions are then discussed in Section V: One broadly targets the failure of attorneys' ethical codes to account for the collapse of the adversarial myth in cases involving unrepresented litigants; the other is a more tailored solution …

Tesla, Marconi, And The Great Radio Controversy: Awarding Patent Damages Without Chilling A Defendant's Incentive To Innovate, Christopher A. Harkins Jun 2008

Tesla, Marconi, And The Great Radio Controversy: Awarding Patent Damages Without Chilling A Defendant's Incentive To Innovate, Christopher A. Harkins

Missouri Law Review

The true life story of Nikola Tesla reads like a fiction novel worthy of Hollywood in a tale of the great radio controversy. Who did invent radio? Marconi is often credited with the invention, while a discouraged Tesla mostly watched from the sidelines - his contributions and further innovations to radio being silenced during the height of radio's most rapid growth. While Tesla's bizarre personal life may read like a novel by Jules Verne and F. Scott Fitzgerald, this much can be learned from the facts and folklore of the radio controversy: simultaneous discovery and independent development ought to mitigate …

Personal Management Skills: Getting The Most Out Of Every Day, Gary A. Munneke

Elisabeth Haub School of Law Faculty Publications

What are the personal management skills that lawyers need to possess (or develop, as the case may be), here is a short list: organization, time management, financial management, facility with technology, people skills, an ability to communicate, personal marketing skills and career skills. Although future columns will add flesh to the bones of these personal management skills, a skeletal overview may help to understand what this article is talking about.

Access To Justice For The Poor: The Singapore Judiciary At Work, Gary Chan Kok Yew Jun 2008

Access To Justice For The Poor: The Singapore Judiciary At Work, Gary Chan Kok Yew

Washington International Law Journal

This Article examines the concrete efforts and programs of the Singapore judiciary to maintain and enhance access to justice for the poor. This examination is undertaken via overlapping economic, procedural, and institutional approaches. The Article will examine three main contentions. First, that the Singapore judiciary’s concrete efforts in maintaining and promoting access to justice for the poor have been fairly comprehensive and pro-active. Second, that abstract constitutional discourse on the right of access to justice and the associated rights of legal representation and legal aid are virtually absent in Singapore. Thus, the judicial practice for enhancing access to justice for …

The Transition From Unincorporated Community To Municipality In The South Valley, Joshua M. Akers Jun 2008

The Transition From Unincorporated Community To Municipality In The South Valley, Joshua M. Akers

BBER Publications

The South Valley is a diverse area at the heart of the rural-urban interface in the Middle Rio Grande Valley. The proposition of forming a municipality in this area is full of possibility and rife with challenges. It is the intent of this report to offer some assistance with the process of incorporation and to offer an examination, however brief and incomplete, of issues of concern that will accompany any incorporation. The report consists of three parts: a historical review of incorporation in New Mexico and the Southwestern United States; an examination of geographical, social and political issues unique to …
