Further Research On Profitable Globalization And The Ethical Dilemma Of U.S. Job Loss, James G. Hendee
Further Research On Profitable Globalization And The Ethical Dilemma Of U.S. Job Loss, James G. Hendee
Senior Honors Theses and Projects
In theory, profitable globalization practices in developed, industrialized countries share a symbiotic relationship with cheaper offshore human resources in third-world, poor, or underdeveloped nations. A short case study of Wal-Mart Stores, Inc. is given, which examines Wal-mart’s increased use of the cheaper Chinese workforce. By seeking out a lower cost labor force in a yet developing country, an ethical dilemma arises in that the business in the industrialized nation must ignore or disregard the job loss this decision creates within the borders of the home nation. Political and philosophical differences have led opponents to create an anti-thesis known as anti-globalization. …

Multijurisdictional Adr Practice: Lessons For Litigators, Kristen M. Blankley, Emily E. Root, John Minter
Cardozo Journal of Conflict Resolution
This article attempts to give an overview of the problem facing litigators in their increasingly global practice, as well as the steps that litigators can take to act in compliance with legal and ethical guidelines. Accordingly, this article is divided into two broad areas. First, this article will discuss what activities constitute the practice of law and which jurisdiction's law should govern, focusing on whether ADR practices constitute the practice of law. Second, if the litigator is engaged in the practice of law, this article considers what actions the litigator should take in order to comply with the applicable ethical …
Coping With Combat Claims: An Analysis Of The Foreign Claims Act's Combat Exclusion, Jordan Walerstein
Coping With Combat Claims: An Analysis Of The Foreign Claims Act's Combat Exclusion, Jordan Walerstein
Cardozo Journal of Conflict Resolution
The purpose of this Note is to show that, although the FCA has positively impacted U.S. military operations, the so-called "combat exclusion" severely hampers its effectiveness. Therefore, Congress should eliminate the distinction between combat and noncombat claims and adopt a unified, permanent claims system to adjudicate all claims made by civilians against U.S. military forces operating overseas. Part II of this Note explores the origins of the "combat exclusion" in international law, and Part III traces the history of civilian compensation through World War I and World War II. Part IV surveys U.S. military use of the FCA and ad …
Educational Workshops On Settlement And Dispute Resolution: Another Tool For Self-Represented Litigants In Family Court, Jim Hilbert
Faculty Scholarship
This article outlines the need to help self-represented litigants (SLRs or pro se parties) understand more about how they might resolve their disputes through settlement. The article discusses the remarkable growth in the number of people representing themselves in the legal system, particularly in family court. To supplement the existing support system for SLRs, the article proposes including settlement and negotiation educational workshops for SRLs so that they can better understand 1) the prominent role of settlement in our legal system, 2) their power within the settlement process, and 3) some fundamental guidance on how they might approach settlement negotiations. …

2009 Survey Of Books Related To Women And The Law: Review: Locked Up, Overlooked: Women Behind Bars: The Crisis Of Women In The U.S. Prison System, Giovanna Shay
Faculty Scholarship
The Author reviews journalist Silja Talvi’s Women Behind Bars: The Growing Crisis of Women in the U.S. Prison System (“Women Behind Bars”) which presents an engaging overview of issues affecting incarcerated women. It succinctly illustrates some of the important connections involving the War on Drugs, racial disparity, and the high rate of substance abuse and physical and sexual abuse among incarcerated women. Each of the chapters could be assigned on its own to a class or reading group. While Talvi states that she is not trying to write a scholarly book, as a contribution to public discourse, Women Behind Bars …

Pro Bono Publico In A Parellel Universe: The Meaning Of Pro Bono In Solo And Small Law Firms, Leslie Levin
Faculty Articles and Papers
The organized bar is increasingly providing pro bono legal assistance to the more than fifty million people of limited means in the United States.' In 2008, the 200 highest grossing law firms in the United States contributed a record 5.57 million hours of pro bono service to individuals and organizations that could not afford to hire lawyers. These large firms now have well-organized pro bono programs that enjoy considerable administrative support. But the lawyers in large firms (over 100 lawyers) comprise only about 16% of the lawyers in private practice. Solo and small firm (two to five) lawyers, who comprise …
