The Nation's Urban Land Grant Law School: Ensuring Justice In The 21st Century, Katherine S. Broderick

Journal Articles

FOR ten years I have had the honor and the privilege to serve as dean of the University of the District of Columbia David A. Clarke School of Law (UDC-DCSL), a diverse and progressive law school bent on training advocates for justice. I was delighted to accept when Dean Douglas Ray of the University of Toledo College of Law invited me to write about our unique mission and curriculum and our extraordinary cadre of social justice-driven faculty, staff, and administrators who have stayed the course through a stormy history to deliver a very different law school experience to a very …

A Market In Litigation Risk, Jonathan T. Molot Jan 2009

A Market In Litigation Risk, Jonathan T. Molot

University of Chicago Law Review

Why do people hate litigation? Corporate America, in particular, complains that litigation is too expensive, time consuming, and unpredictable. But these are not distinguishing features of litigation. When a company launches a new product or enters into a new business line, it may face a process that is just as expensive, time consuming, and risky as litigation. The company will invest time and money in product development and market research and will bear the risk that the product ultimately will fail and its efforts will result in a loss. What makes litigation seem so daunting, and distinguishes litigation risk from …

A Shift Toward Gender Equality In Prosecutions: Realizing Legitimate Enforcement Of Crimes Committed Against Women In Municipal And International Criminal Law, Tamara F. Lawson

Articles

A new era of law enforcement has emerged recognizing the importance of punishing gender-specific violence. This first wave of "gender-sensitive prosecutors" has changed the way crimes against women are handled in the criminal justice system. The enactment of gender neutralizing laws and policies has dramatically improved the enforcement of crimes against women and attempts to end the era of impunity. This Article addresses the changes in prosecutions and further considers international human rights treaties that require gender equality in law enforcement.

In criminal law, it is the willingness of a prosecutor to exercise his or her discretionary authority to file …

10 Tips For Getting Jurors To Talk, Maureen A. Howard Jan 2009

10 Tips For Getting Jurors To Talk, Maureen A. Howard

Articles

“Jury selection” is a misnomer because lawyers don’t actually get to “select” ideal jurors; they get a limited opportunity to “deselect” the worst prospective jurors. The goal of voir dire is to identify these jurors by uncovering their attitudes, beliefs, opinions, preconceptions, biases, and prejudices. To accomplish this, a lawyer has a difficult task: she must foster an honest, intimate conversation among strangers in a very public, formal environment.

Even honest jurors may give misleading answers during voir dire due to nervousness, inattention, faulty memory, or misunderstanding. The formal courtroom atmosphere can have a chilling effect at odds with the …

Constitutional Challenges In The 21st Century, S. B. Sinha Jan 2009

Constitutional Challenges In The 21st Century, S. B. Sinha

National Law School of India Review

In this illuminating piece, learned Supreme Court Judge, Justice S.B. Sinha examines the diversity of constitutional challenges facing the Supreme Court in the post-liberalization era. While acknowledging the importance of adhering to the constitutional design of separation of powers, Justice Sinha justifies and elucidates the need for a pro-active judiciary to ensure good governance. He provides an analytical elaboration on the legal dimensions of globalization by critically looking at the judicial approach towards "emerging actors" like multinational corporations. He further illustrates on the impact and influence of globalization on crucial essential public services and the apex court's response to the …

Ten Years After Burrow V. Arce: The Current State Of Attorney Fee Forfeiture., Jeffrey A. Webb, Blake W. Stribling

St. Mary's Law Journal

“Extreme [attorney] misconduct may warrant an extreme remedy.” Fee forfeiture certainly constitutes an extreme remedy, at least compared to the ordinary remedy for violation of a legal duty. But neither the degree to which the remedy is extreme nor how extreme the misconduct must first be before the forfeiture becomes appropriate is apparent in light of the Texas Supreme Court’s decision in Burrow v. Arce. Understanding the confusion which has arisen with regard to Burrow’s impact depends in large measure on a thorough evaluation of (1) the basis for the court’s determinations relating to forfeiture, (2) the sources from which …

The Public Value Of Settlement, Samuel Issacharoff, Robert H. Klonoff Jan 2009

The Public Value Of Settlement, Samuel Issacharoff, Robert H. Klonoff

Faculty Articles

The article focuses on the claim of author Owen M. Fiss against the public value of civil settlement. It stresses the concern of Fiss on settlement in class actions and other aggregate cases. For Fiss, settlements are problematic due to some reasons including the plaintiffs' relative lack of power, the incapability of settlement to ensure ongoing court involvement, and the failure of settlement to achieve justice. Also emphasized is the tradeoff between the quotidian concern of dispute resolution for the minor annoyances of every life and the public values of the important cases.

Starting Out: Changing Patterns Of First Jobs For Michigan Law School Graduates, Terry K. Adams, David L. Chambers

Articles

In the early 1950s, the typical graduate of Michigan Law began his career working as an associate in a law firm with four other lawyers and earned about $5,000 in his first year. Surprising to us today, in his new job he would have earned slightly less than other classmates whose first jobs were in government. Fifty years later, in the early 2000s, the typical graduate still started out as an associate in a law firm, but the firm she worked for had more than 400 lawyers. She earned about $114,000 in her first year, about three times as much …

Statutory Standing And The Tyranny Of Labels, Radha A. Pathak Jan 2009

Statutory Standing And The Tyranny Of Labels, Radha A. Pathak

Oklahoma Law Review

Constitutional and prudential standing doctrines have received an abundance of scholarly consideration. Statutory standing, in contrast, has remained largely unexplored. The Supreme Court’s use of the term is relatively consistent and unobjectionable, but the meaning that many lower courts ascribe to it is anything but innocuous. This article develops a conceptual framework for understanding the different ways in which different courts conceive of statutory standing. Using the Employee Retirement Income Security Act of 1974 (“ERISA”) as a paradigmatic example, it attempts to illustrate the pernicious effects that often result from common misconceptions of statutory standing in disputes involving purely private …
