Rethinking Immigration Enforcement, Peter L. Markowitz
Rethinking Immigration Enforcement, Peter L. Markowitz
Florida Law Review
As the nation turns the page away from the dark chapter of President Trump’s relentless assault on immigrants, it is time to take stock of the nation’s unprecedented immigration enforcement regime. During its relatively short existence, the Immigration and Customs Enforcement agency (ICE) has deported more than twice as many people as were deported in the entire previous history of the United States. The human and fiscal costs of ICE’s mass deportation agenda are astronomical, and there is almost universal agreement across the political spectrum that the United States’ immigration enforcement apparatus is badly broken. That, however, is where the …
The Role Of Marriage In The Internal Revenue Code, Theodore P. Seto
The Role Of Marriage In The Internal Revenue Code, Theodore P. Seto
Florida Tax Review
This Article offers a new descriptive account of the role of marriage in the federal tax system. It first outlines an economic frame that explains both why marriage is economically valuable—marriage produces large amounts of untaxed surplus—and why its legal structure is as it is—drawing on both Coase and the theory of numerus clausus. The Article then suggests that most federal tax rules that turn on marriage can be understood as solutions to one of two interrelated problems: “entanglement” and “relative indifference.” By “entanglement,” I refer to the fact that the daily activities of spouses are commonly so intertwined as …

Taxing Zero, Hillel Nadler
Taxing Zero, Hillel Nadler
Florida Tax Review
“Zero-price” transactions—in which goods or services are provided at a cash price of zero—are an increasingly important feature of economic life. Consumers can search the web, use email, listen to music and even trade stocks, all without paying anything out of pocket. But zero-price transactions are not free: for-profit businesses provide products at zero price because they get something valuable from consumers in return. Consumers pay with their time, attention or private information. Zero-price transactions are not giveaways; they are a form of barter exchange.
Under federal income tax principles, barter exchanges are taxable: both parties to the transaction are …

All Decisions
In this holdover proceeding, the landlord erroneously alleged that the tenant, a rent-stabilized tenant, was a licensee. After sanctions were imposed against landlord's counsel, the landlord moved to discontinue the proceeding. The court granted the motion but also issued an Order to Correct outstanding housing code violations and permitted the tenant to amend their answer to include counterclaims, a significant victory for the tenant given the initial flawed legal position of the landlord.
Gossip Girl Meets The Elites Of Gallaudet University: An Analysis On The Depiction Of College Student Development In North American Television, Mary Tran
MAGIS: Student Development Journal
This paper analyzes two popular North American television shows, Deaf U and Gossip Girl in the context of 6 different student development theories (3 per television show). This paper also explores common themes between the television shows, as well as critiques of the student development theories and critiques of the television shows. Towards the end of the paper, the author evaluates her own development according to the 6 different student development theories, offers insight into how popular media can impact youth's perception of college given her experience as a first-generation college student, and key considerations for student affairs professionals.
