Ultra Vires Review Of Federal Agency Action Made Simple(R), Richard W. Murphy
Ultra Vires Review Of Federal Agency Action Made Simple(R), Richard W. Murphy
Utah Law Review
The law governing ultra vires review seeking injunctive relief to challenge statutory violations by federal agencies is a mess. Although administrative law generally limits judicial review to final actions, a substantial body of caselaw holds that this type of ultra vires review can reach interlocutory actions, vastly expanding judicial reach. Although administrative law now insists that federal courts must exercise independent judgment when reviewing agency statutory interpretations, caselaw limits this type of ultra vires review to correcting only the most spectacular statutory violations. In addition, caselaw ignores or garbles the problem of determining which types of plaintiffs qualify to invoke …

Microsimulation Of Infectious Disease Transmission Considering Virus Release, Transmission, And Action, Zhiming Fang, Shengdong Yuan, Ge Huang, Jingqian Yang, Zhongyi Huang
Journal of System Simulation
Abstract: Existing infection risk assessment methods mostly evaluate infection probability through mathematical models or simulation, but they lack analysis of the relationship between air circulation and individual infection probability. This study proposed a risk prediction model for infectious disease transmission based on indoor air circulation. At the microscopic scale, the space was discretized into grid points. By integrating CFD numerical simulation, the entire process of virus droplet release, transmission, and action was fully simulated. The simulation results show that in an obstacle-free room, the error between the total indoor viral load predicted by the model under windless and low wind …

Perceived Neighborhood Cohesion And Well-Being During The Covid-19 Pandemic In The U.S., Jennifer W. Robinette, Brooke Jenkins, Nicole-Marie Duran, David A. Frederick
Psychology Faculty Articles and Research
The U.S. entered a “second pandemic” characterized by depression and loneliness after the initial outbreak of COVID-19. These psychological consequences have driven researchers to identify protective factors during this crisis. The present study tested whether perceived neighborhood cohesion, or that neighbors trust and count on one another, related to fewer depressive symptoms and less loneliness as the pandemic unfolded. Two waves of data were collected online from the same adults in April and October, 2020 (N = 1,928). People who reported greater neighborhood cohesion had fewer depressive symptoms (b = −1.01, p < 0.001) and were less lonely (b = −0.20, p < 0.001), even when considering other pandemic-related risk factors. The association between cohesion and loneliness was even stronger 6 months into the pandemic (b = …

The field of single-cell biology is growing rapidly, generating large amounts of data from a variety of species, disease conditions, tissues, and organs. Coordinated efforts such as CZI CELLxGENE, HuBMAP, Broad Institute Single Cell Portal, and DISCO allow researchers to access large volumes of curated datasets, including more than just scRNA-seq data. These resources have created an opportunity to build and expand the computational biology ecosystem to develop tools necessary for data reuse and for extracting novel biological insights. We highlight achievements made so far, areas where further development is needed, and specific challenges that need to be overcome.

Background: The common polymorphism rs9939609 of the fat mass and obesity gene (FTO) has been associated with increased susceptibility to obesity, but this association appears to be modified by diet. High protein diets have been shown to reduce weight and may increase the formation of circulating advanced glycation end products (AGEs). Obesity, on the other hand, is also associated with increased formation of AGEs, leading to oxidative stress and inflammation. Objectives: This study was designed to investigate the impact of a high-protein and low-calorie (HPLC) diet on anthropometric indices and circulating AGEs levels associated with the FTO variant rs9939609 among …

BACKGROUND: Health information exchange (HIE) supports clinical decision-making in emergency medicine settings. Despite evidence and policies that encourage the adoption of HIE, use by clinicians is limited. Moreover, few studies examine HIE use years after adoption by hospitals or clinics.
OBJECTIVE: This study aims to examine the perceptions and use of a mature, operational HIE system by emergency department clinicians years after its implementation.
METHODS: We interviewed 21 clinicians in various roles (eg, attending physician and nurse practitioner) across multiple health systems that participate in a statewide HIE network. We asked questions about their use of the HIE system and …

School of Biological and Marine Sciences
Tank bromeliads are found in rainforests across the Neotropics and harbour diverse invertebrate communities between their leaf axes. Various factors influence the invertebrate species richness and differences in composition in bromeliad phytotelmata, most notably, habitat size. However, there has been little work on invertebrate communities in bromeliads in western Amazonia or at different heights in the canopy. We collected 63 epiphytic bromeliads (Aechmea hoppii (Harms) L.B.Sm, A. nidularioides L.B.Sm) on the eastern edge of the Tropical Andes Biodiversity Hotspot in Ecuador and explored which biological and physical variables explained the differences in invertebrate composition among bromeliads. We extracted a total …

Background: Inherited retinal diseases (IRDs) are a group of disorders often resulting in progressive vision loss, ultimately leading to blindness. A significant portion of their genetic causes remain unresolved, partly due to undiscovered disease-associated genes or variants. This study aimed to identify novel genetic links to IRDs.
Methods: All patients underwent comprehensive ophthalmological evaluation, including retinal imaging (fundus autofluorescence and macular optical coherence tomography) and electroretinogram testing. Whole exome sequencing and whole genome sequencing were performed on patients with clinically unsolved IRD, and data were analysed using an in-house pipeline to identify causal variants. Subsequently, Sanger sequencing was performed to …

Clinical Course And Treatment Outcomes In Solid-Basaloid Adenoid Cystic Carcinoma Of The Breast: A Systematic Review And Case Report, Stephanie Kim, Kyle Sheth, Xiaoying Yu, Laura Porterfield, Elizabeth M Vaughan
Faculty, Staff and Students Publications
Background: Adenoid Cystic Carcinoma (ACC) is a rare, indolent subtype of triple-negative breast cancer, accounting for < 0.1 % of cases. The solid-basaloid subtype (SBACC), comprising approximately one-quarter of breast ACCs, has a poorer prognosis. While ACC is typically managed with surgery and is chemo-resistant, SBACC is more aggressive and often treated with chemotherapy and, more recently, immunotherapy-though supporting evidence remains limited.
Aim: To assess clinical characteristics and treatment outcomes of SBACC of the breast.
Methods: This study presents a case of breast SBACC and a systematic review of five databases (inception-September 10, 2024). Eligible studies reported clinical course, treatment, and outcomes. Exclusions included duplicates, non-SBACC focus, animal studies, and those lacking clinical or with only pathological data. Descriptive statistics were used for binary and categorical variables. Risk of bias was assessed using JBI tools, following PRISMA 2020 guidelines. The review is registered in PROSPERO.

The Symbiotic Harm Of A Criminal Record, Ericka B. Adams, Elsa Y. Chen, Sarah E. Lageson
The Symbiotic Harm Of A Criminal Record, Ericka B. Adams, Elsa Y. Chen, Sarah E. Lageson
Faculty Research, Scholarly, and Creative Activity
Having a criminal record significantly alters a person’s life chances, decreasing their opportunities for employment, housing, student loans, voting, public benefits, and more. The collateral consequences of criminal convictions, or the civil restrictions that follow criminal convictions, are well documented. However, because individuals are connected to families and communities, it is impossible to isolate the effects of punishment to only the persons holding criminal records. Instead, the effects of criminal records might be best understood as a set of symbiotic harms, marked by relational and interdependent effects. Drawing on semi-structured interviews with 59 expungement-eligible persons and 69 community representatives, this …

Socio-Scientific Issue-Based Challenge To Students' Chemical Literacy, Suratman S. Naim, La Kolo
Jurnal Pendidikan: Teori, Penelitian, dan Pengembangan
Chemistry has an important role in global challenges. Chemistry learning has not integrated an interdisciplinary approach to improving students' chemical literacy, enabling them to provide solutions to socio-scientific and environmental problems through the application of chemical concepts. This study aimed to determine the effect of the socio-scientific issues-based challenge strategy on students' chemical literacy. This study used a quantitative methods design with an embedded model. The sample consisted of tenth-grade students of SMA Negeri 1 East Halmahera in the 2025/2026 academic year from two sample classes. The experimental class was taught with the socio-scientific issues-based challenges strategy, while the control …

The Big Bang Theory’S Blurred (Tele)Vision Of Scientific Ethics: Some Thoughts For Educators Who Want To Change The Channel, Lee-Anne Broadhead, Sean J. Howard
Dialogue: The Interdisciplinary Journal of Popular Culture and Pedagogy
This article investigates the way the popular American television program The Big Bang Theory represents the pursuit of scientific knowledge and reflects on the cultural and educational implications of the show’s contradictory problematization and valorization of the reductionist method at the core of modern Eurocentric science. Drawing on story-lines relating to military research, animal experimentation, and pharmaceutical drug trials, we consider the show’s precarious balance of implicit critique (the consistent exposé of systematically violent, often unethical research) and overt celebration (the presentation of science as “cool,” and its practitioners as flawed but endearing). This tension, we argue, enhances the show’s …

Financial And Behavioral Health For Helping Professionals, Jeffrey Anvari-Clark
Books
This open access book brings together decades of research and practice on the intersections among financial and behavioral health concerns. By framing financial health as comprised of financial precarity, financial efficacy, and financial well-being, this new addition to the field of behavioral health helps readers understand and address the surge of interest in financial health and wellness from a holistic, psychosocial perspective. The text explores not only how financial difficulties impose hardship on individuals, couples, and families, but also how these concerns shape our feelings, perceptions, attitudes, and behaviors and thereby our health. Case examples throughout illustrate the concepts and …
