Not So Firmly Settled: How The Inconsistent Jurisprudence Of The Firm Resettlement Bar Serves As A Tool For Asylum Seeker Exclusion, Caroline V. Garrido

The firm resettlement bar to asylum, designed to limit protections to those without refuge elsewhere, has become a source of inconsistency, confusion, and exclusion in U.S. asylum law. Circuit courts have adopted two different approaches for determining whether an asylum seeker has firmly resettled in a third country. Despite the Board of Immigration Appeals’ attempt to unify these approaches through the introduction of a burden-shifting framework, courts remain divided, and there is no clear guidance on what constitutes firm resettlement. A True Fact Should Not Be Controversial: Analyzing The Zauderer Standard And Defining “Uncontroversial”, Edina Hartstein

In Zauderer v. Office of Disciplinary Counsel, the U.S. Supreme Court recognized an exception to the compelled speech doctrine that allowed the government to regulate commercial speech if it was “purely factual and uncontroversial.” However, the Court failed to define what it meant for a disclosure to be “purely factual” or what it meant to be “uncontroversial.” This lack of clarity led to lower courts inconsistently applying the Zauderer standard. Under the current federal sentencing regime, district courts exercise immense amounts of discretion when sentencing. Though strict adherence to the U.S. Sentencing Commission Guidelines (the “Guidelines”) was once mandatory, courts must now use these Guidelines as an advisory starting point and make a series of fact-specific determinations when sentencing a defendant. Though judicial discretion in this realm aids in preventing undue reliance on Guidelines-range recommendations that can lack nuance, it also invites bias.

Burnout has become increasingly prevalent in contemporary society, affecting not only those in the workplace but also students across various educational settings. The current study investigates whether the pervasive social expectancies to be constantly available and productive contribute to the onset and maintenance of academic burnout among university students. Using a 13-week longitudinal design and a random-intercept cross-lagged panel model, we examined the bidirectional association between social expectancies to be constantly available and productive and academic burnout. Our findings indicate that heightened social expectancies predict increases in emotional exhaustion and feelings of inadequacy in the following week. Furthermore, emotional exhaustion, …

Objective: To ascertain the construct validity and reliability of a self-administered web-based assessment of intrinsic capacity (IC). Design: Cross-sectional data analysis of a prospective cohort study. Contextual stress experiences in early adolescents may predict distinct trajectories of depressive symptoms and anxiety across the course of adolescence. Data from 604 Mexican-origin adolescents collected from 2012 to 2020 (54% female; Mage = 12.92, SD = 0.92) showed that youth with high stress levels in multiple domains (Broadly Stressed) and those with high stress in language brokering domain only (Language Brokering Stressed) had similar levels of internalizing symptoms in early adolescence, and both groups reported higher stress than youth experiencing occasional levels of stress across domains (Occasionally Environmentally Stressed). As the adoption of LLMs becomes more widespread in software coding ecosystems, a pressing issue has emerged: does the generated code contain social bias and unfairness, such as those related to age, gender, and race? This issue concerns the integrity, fairness, and ethical foundation of software applications that depend on the code generated by these models but are underexplored in the literature. Digital technologies are shaping many aspects of cultural heritage, but very little research has examined the implications of digital transformation. Drawing on concepts from Fairclough’s three-dimensional critical discourse analysis, this research examines the discourse using seven online dialogues (available on the UNESCO website) between 18 professionals who have different backgrounds and cultures to identify social practices related to the digital transformation of cultural heritage. We identify four digital transformation discourse types in professional dialogues: documentation, management, interpretation, and interaction. Teaching self-efficacy is a critical factor in instructional success. Little research has been conducted on how academic librarians perceive their own teaching abilities. This study introduces and validates the Librarian Teaching Self-Efficacy Scale, a tool designed to measure self-efficacy beliefs among academic librarians engaged in information literacy instruction. By adapting established self-efficacy scales to the library instruction context, this study examines key factors influencing librarian teaching self-efficacy, including instructional strategies, lesson planning, and collaboration with faculty. Reflective practice provides library workers with a critical opportunity to examine professional experiences, question assumptions and approaches, explore new perspectives, and develop innovative solutions to existing problems. When applied to instruction as reflective teaching, this practice better situates library instructors to meet the evolving needs of twenty-first-century library users. This research study explores how library workers engage with reflective teaching in academic libraries across the United States. A survey was distributed to academic library communities, and a total of 153 responses were collected. Background Previous research on upper extremity range of motion has compared in-person to virtual measures for sagittal plane motions (flexion/extension) showing good-excellent reliability. This paper presents the results of an indirect personality assessment of U.S. vice president JD Vance, from the conceptual perspective of personologist Theodore Millon.
Psychodiagnostically relevant data relating to Vance were collected from biographical sources and media reports and synthesized into a personality profile using the Millon Inventory of Diagnostic Criteria (MIDC), which yields 34 normal and maladaptive personality classifications congruent with DSM-III-R, DSM-IV, and DSM-5-TR.
The personality profile yielded by the MIDC was analyzed in accordance with interpretive guidelines provided in the MIDC and Millon Index of Personality Styles manuals. Vance’s primary personality patterns were found …

Background: Plasma phospho-tau biomarkers, such as p217+tau, excel at identifying Alzheimer’s disease (AD) neuropathology. However, their ability to substitute for tau PET to identify AD biological stage is unclear. Methods: Participants included 248 cognitively unimpaired (CU) and 227 cognitively impaired (CI) individuals, with Janssen plasma p217+tau Simoa® assay, 18F-NAV4694 Aβ-PET (A) and 18F-MK6240 tau-PET (T) data. Purpose of Review: Rehabilitation following stroke is a complex series of assistive and catalytic interventions enabling a survivor to recover and adapt to their stroke. To achieve adaptation, rehabilitation should supplement healthcare across the continuum, however comprehensive evidence on the provision of stroke rehabilitation in Australia is lacking. The aim of this paper was to describe stroke rehabilitation provision, collecting data using the World Health Organisation (WHO) template for rehabilitation information collection (TRIC). Biomass gasification is an established and widely utilized renewable energy system. The research work aims to develop and construct a downdraft gasifier to investigate gasifier performance. The gasifier’s performance and cold gas efficiency were calculated for three volumetric airflow rates: 7.16 m3/h, 5.97 m3/h, and 4.78 m3/h. The efficiency was found maximum of 69.6% for an airflow rate of 7.16 m3/h. The oxidation zone and neck region of the gasifier reactor had the maximum recorded temperatures of 845 °C and 823 °C for Swietenia macrophylla (SM) and Mangifera indica (MI), respectively. Background: Evidence suggests First Nations people in Australia may experience a higher burden of eating disorders (EDs) than the broader Australian population. EDs are among the most debilitating and lethal mental health conditions; however, little is known about the unique considerations for First Nations people experiencing EDs, especially around best practices. Purpose of Review: This review summarises the latest evidence on effects of exercise on falls prevention, bone mineral density (BMD) and fragility fracture risk in postmenopausal women, explores hypotheses underpinning exercise-mediated effects on BMD and sheds light on innovative concepts to better understand and harness the skeletal benefits of exercise. Recent Findings: Multimodal exercise programs incorporating challenging balance exercises can prevent falls. Emerging clinical trial evidence indicates supervised progressive high-intensity resistance and impact training (HiRIT) is efficacious in increasing lumbar spine BMD and is safe and well-tolerated in postmenopausal women with osteoporosis/osteopenia. Markerless motion capture has the potential to enable biomechanical analyses without specialised, high-cost equipment. Thalassemia is an inherited blood disorder. Current diagnostic methods mainly rely on sophisticated equipment and specifically trained technicians. This study aims to identify and genotype thalassemia by applying machine learning (ML) algorithms to routine blood parameters. This study recruited a derivation cohort of 31,311 individuals from four independent hospitals and developed eight machine learning (ML) models for the purpose. The performance of these models was compared using a set of evaluation metrics. An additional cohort of 2000 patients was recruited for external validation to assess the generalization of the models. Hyperuricemia (HUA) and gout result from imbalances in uric acid metabolism and are closely associated with the gut microbiota. Advanced analytical methods facilitate the exploration of microbiota complexity. In this study, 16S rRNA sequencing data from stool samples of 233 patients were thoroughly collected. Machine learning (ML) and Shapley Additive exPlanations (SHAP) interpretability algorithms were applied to identify core taxa and predict the metabolic functions. The results revealed that the high-contribution core taxa identified by SHAP in each group, such as Oscillospiraceae_UCG-005 and Rhodococcus provided the basis for ML prediction. Background: Stretching has wide appeal, but there seems to exist some mismatch between its purported applications and what the evidence shows. There is compelling evidence for some stretching applications, but for others, the evidence seems heterogeneous or unsupportive. The discrepancies even affect some systematic reviews, possibly due to heterogeneous eligibility criteria and search strategies. Human cytomegalovirus (CMV) is endemic worldwide. It is often acquired in childhood and persists throughout adult life. CMV is linked with several diseases of aging, but associations with cognitive performance are not consistent. Here we address whether this may reflect a dependence on putative genetic determinants, Apolipoprotein E (APOE) ε4 and Tumour Necrosis Factor (TNF), and/or the age of the subjects tested. Burial disturbances affect foundation plant species in marine ecosystems. Deposition of dredge spoil can bury seagrass meadows yet we have limited threshold information to predict the trajectory of impact from burial or possible recovery. To investigate the response to burial by dredge spoil, established seagrass ramets of Posidonia sinuosa were collected from a population in Western Australia and exposed to cutter suction dredge spoil sediment. Background: Modified constraint-induced movement therapy (mCIMT) improves upper limb (UL) function after stroke. Despite extensive evidence supporting its efficacy and multiple clinical practice guidelines recommending its provision, very few eligible stroke survivors receive mCIMT internationally. A multi-modal behaviour change intervention, guided by the Theoretical Domains Framework (TDF) and Behaviour Change Wheel, was implemented across a large early-supported discharge (ESD) rehabilitation service in Perth, Australia, to increase delivery of mCIMT within existing resources. Over the past 2 decades, per- and polyfluoroalkyl substances (PFAS) have attracted considerable attention due to their widespread occurrence and adverse effects on both the environment and human health. PFAS possess strong carbon‑fluorine bonds that confer exceptional chemical stability and resistance to natural degradation; their fluorinated chains are highly hydrophobic and oleophobic, while their polar functional groups contribute to amphiphilic behavior and water solubility. Certain PFAS thus pose serious risks to living organisms, especially mammals.
