A Case For Judge-Made Law For The American Jurists From An English Perspective—Drawing Example From The Human Rights Act 1998, Samuel Kuo Jan 2026

A Case For Judge-Made Law For The American Jurists From An English Perspective—Drawing Example From The Human Rights Act 1998, Samuel Kuo

Georgia Journal of International & Comparative Law

Many authors frown upon judge-made law as an inappropriate and ghastly exercise of judicial activism in American jurisprudence. This, nevertheless, is not the view of English jurisprudence. This Comment proposes instead that the American legal audience should embrace the benefits of judge-made law as a means of correcting the rigidity and inadequacies of the legislature. It does so by drawing an example from the recent debates over whether the Human Rights Act 1998 should be amended or repealed by the legislature, which is comprised of the members of parliament sitting in the House of Commons. By drawing the example of …

No Man’s Land Another crude mission into the darkness we’ve dreamed, our intuition scream, and with no one there to hear it the truth of our condition only ever harkens to the meanings and the means we rectify with words and spirits. Yes, the human mind cannot help but defy conventions, intentional or otherwise, necessity always inspiring invention. —Stan Vilensky

Changing Climate, Changing Rights: How The Unitedstates Can Learn From The Emergence Of The Right To A Healthy Environment In Colombia And India, Jasmine Furin

Georgia Journal of International & Comparative Law

The right to a healthy environment embodies the idea that environmental protection and the enjoyment of human rights are connected. As this concept has developed, authorities around the world have described the contours of this right in various ways. The right to a healthy environment generally includes a safe climate, clean air, healthy ecosystems, biodiversity, access to safe water, healthy and sustainable food, non-toxic environments, access to information, public participation in decision-making, and access to justice. Thus, the right to a healthy environment is unique because it provides individuals with a more complete set of protections against environmental harms compared …

Exploring Chinese Elements In J.D. Salinger’S Works: A Response To Mccarthyism In The Early Cold War Era, Yixin Lu Jan 2026

Exploring Chinese Elements In J.D. Salinger’S Works: A Response To Mccarthyism In The Early Cold War Era, Yixin Lu

CLCWeb: Comparative Literature and Culture

Since the publication of “The Laughing Man” in 1949, various ideas about “China” have emerged in J. D. Salinger’s famously obscure works. This article aims to argue that Salinger’s incorporation of elements related to China and ancient Chinese philosophy in his works illustrates an artistic response to American anxieties during the McCarthy Era. The article uses “The Laughing Man” and “De Daumier-Smith’s Blue Period” as case studies to demonstrate how Salinger’s engagement with “China,” including the concept of indiscrimination from Zen Buddhist ideas, as well as notions of naturalness and non-action from Taoist ideas, develops not only a mystical writing …

Cyborg Feminism And Toxic Colonialism In Chen Qiufan’S Waste Tide, Yuan Yuan Jan 2026

Cyborg Feminism And Toxic Colonialism In Chen Qiufan’S Waste Tide, Yuan Yuan

CLCWeb: Comparative Literature and Culture

The article probes into the interrelationships among cyborg technology, sexual violence, and toxic colonialism represented in the Chinese SF novel Waste Tide by Chen Qiufan. It applies methodologies in posthumanism and ecofeminism and situates the text in the Chinese as well as a global context. It intends to provide a non-Western perspective to understand cyborg feminism by associating the Chinese historical reality with trans-species thinking. It argues that the SF author Chen Qiufan is critical about the anthropogenic body modifications which may challenge the process of female resistance and resilience in the face of gender and colonial oppression. By doing …

Finite Element Analysis Of Conical Steel Crash Boxes With Uniform And Graded Aluminum Honeycomb Cores, Sura T. Bader, Mohsin N. Hamzah, Qasim A. Atiyah Jan 2026

Finite Element Analysis Of Conical Steel Crash Boxes With Uniform And Graded Aluminum Honeycomb Cores, Sura T. Bader, Mohsin N. Hamzah, Qasim A. Atiyah

Engineering and Technology Journal

Crash boxes play a vital role in vehicle crashworthiness by dissipating kinetic energy during frontal impacts. Positioned between the bumper and side rails, they limit vehicle damage, reduce repair costs, and improve passenger safety. Enhancing their energy absorption capacity is therefore critical. Graded fillers have emerged as an effective approach, providing controlled crushing behavior, reduced initial peak forces, and improved performance. While most prior studies have focused on rectangular and cylindrical crash boxes, limited work has explored conical designs, particularly with graded honeycomb reinforcement. This study examines the crashworthiness of conical steel crash boxes using finite element analysis in ABAQUS …

“She Was My Egg Donor, Not My Mom”: Using Attribution Theory To Understand How Adult Daughters Manage Their Low-Quality Daughter-Mother Relationship, Denise Alonso-Pecora, Crystal Nguyen, Jennifer L. Bevan, Michelle Miller-Day, Allison Alford

Communication Faculty Articles and Research

This study employs attribution theory to examine how adult daughters from low-income backgrounds perceive and manage low-quality daughter-mother relationships. Using in-depth interviews and flexible coding, we analyzed how daughters (n = 42) attribute locus, responsibility, specificity, and stability. Daughters often located control internally within their mothers, citing enduring traits as sources of conflict while noting external influences such as trauma or substance abuse. Responsibility was frequently self-assumed despite blaming mothers, positioning attribution as a means of asserting agency. Many saw their relationships as uniquely difficult and consistent, reinforcing perceptions of stability and specificity. Our study extends attribution theory to …

Impact Of Dialysis On Medication Pharmacokinetics, Rachel Marie Bounds Jan 2026

Impact Of Dialysis On Medication Pharmacokinetics, Rachel Marie Bounds

Walden Dissertations and Doctoral Studies

This doctoral project was a staff education initiative to improve nurses’ knowledge and comfort with dialysis-specific medication management. The project addressed a practice gap in which nurses at the clinical site had limited knowledge of medication administration for patients with end-stage renal disease. These patients have altered pharmacokinetics and high medication burden, which increases the risk of adverse drug events. Inappropriate management of medications during dialysis can lead to hypotension, ineffective treatment, and glucose instability, making this a critical nursing practice issue. The project answered the practice-focused question of whether a structured educational intervention would improve nurses’ knowledge and comfort …

Insight Into The Decalcification Mechanism Of Calcium Silicate Hydrate Under A Water–Heat–Salt Environment, Wei Zhang, Boya Zhang, Jia Sun, Juntao Dang, Xiangke Guo, Keliang Li, Bo Tao Huang, Biqin Dong, Hongyan Ma, Dongshuai Hou

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

Understanding the decalcification mechanism of calcium silicate hydrate (C–S–H) under marine environments is crucial for concrete durability. In this study, the decalcification behavior of C–S–H under a water–heat–salt environment was systematically investigated through immersion experiments and reactive molecular dynamics simulations. Experimental results showed that elevated temperature and NaCl solution significantly accelerated Ca leaching and reduced the Ca/Si ratio of C–S–H. Simulation results further revealed that both high temperature and NaCl reduce the dissolution free energy of Ca, making its release more thermodynamically and kinetically favorable. Local structure analysis indicated that Cl– disrupts Ca–Os (O atoms in silicate tetrahedra) connection …

Stealth Consolidation: Healthcare’S Process Of Quietly Dodging Antitrust Enforcement, Nathan Rush Jan 2026

Stealth Consolidation: Healthcare’S Process Of Quietly Dodging Antitrust Enforcement, Nathan Rush

Washington and Lee Law Review Online

The healthcare industry has become highly concentrated due to increased rates of consolidation. Mergers and acquisitions among healthcare providers have become extremely common, making dominant hospital systems the norm. When healthcare provider markets are highly concentrated, competition deteriorates, leaving patients to suffer the consequences: higher prices for lower quality care.

The federal antitrust agencies tasked with preserving competition have failed to combat the consolidation trends that are plaguing the healthcare industry. Vertical consolidation between hospitals and physician groups has especially gone unchecked. The Hart-Scott-Rodino Act, a federal antitrust law, requires merging parties to give the agencies pre-merger notice. This law, …

Rules Of The Game: Lessons From Sports To Understand Antitrust Law’S Fairness Foundations, Tara Pincock, Daniel A. Hanley

Washington and Lee Law Review Online

Traditionally, courts and practitioners assert that the antitrust laws are simply about protecting competition, not competitors. In essence, these parties perceive competition to be inherently desirable, rather than recognizing that it can be beneficial or harmful depending on its intensity and scope. As a result of this mistaken belief, courts hold that certain conduct is legal under the antitrust laws simply because they determine it to be procompetitive, while conduct deemed anticompetitive is condemned. Courts seldom provide definitive boundaries to this pro-competition trope and instead assert it as if it were a well-established truism and universal societal good.

Wedded To Power: Dynastic Marriages And The Hidden Diplomacy Of Women In Early Modern Europe, Amelia H. Earl Jan 2026

Wedded To Power: Dynastic Marriages And The Hidden Diplomacy Of Women In Early Modern Europe, Amelia H. Earl

Departmental Honors & Graduate Capstone Projects

The diplomatic power of women in the ‘Great Power’ dynasties of Europe has been passed over in historiography because very often their power rested in their relationships to their male counterparts. Dismissing these women’s diplomatic and political power as “soft power” of the domestic sphere overlooks the fact that the political structure of Europe relied heavily on familial ties. In early modern Europe, the whole continent was a kinship; thus, familial relationships between two dynasties were inherently political. The daughters and mothers of these dynasties discovered that there was permeable access to the European political arena through marriage and motherhood. …
