A Balancing Act: Overcoming Incommensurability In Rights Adjudication, Samantha Knutson Jex

The Supreme Court's current system for rights adjudication is insufficient in cases where both sides feel that a fundamental right has been violated, such as Masterpiece Cakeshop v. Colorado Civil Rights Commission. To overcome this insufficiency, I argue that the Court should implement a new test that is a modified combination of the Supreme Court's strict scrutiny and the test used internationally for rights adjudication--the proportionality test. I call this new test the "Incommensurability Test" and explain how it works and why it is beneficial for rights adjudication in the United States. Historically, the United States has maintained a policy of robust assistance to refugees that enter the country. Refugee relief includes short-term health coverage and employment services. Unfortunately, many international medical graduates who come as refugees face excessive barriers to join the healthcare industry when they arrive. In light of emergency adjustments to the accreditation processes during the COVID-19 pandemic, this article proposes that the accreditation process for foreign-educated healthcare workers poses an undue burden on refugees.

Nontuberculous mycobacteria (NTM) infection is common in patients with structural lung damage. To address how NTM infection is established and causes lung damage, we established an NTM mouse model by intranasal inoculation of clinical isolates of M. intracellulare. During the 39-week course of infection, the bacteria persistently grew in the lung and caused progressive granulomatous and fibrotic lung damage with mortality exceeding 50%. Lung neutrophils were significantly increased at 1 week postinfection, reduced at 2 weeks postinfection and increased again at 39 weeks postinfection. IL-17A was increased in the lungs at 1–2 weeks of infection and reduced at 3 weeks …

Studies have configured immunological responses to Aspergillus fumigatus in mice, leading to advanced understandings. However, the comparisons of the immune responses between juvenile (younger than 6 weeks) male and female C57BL/6J mice after A. fumigatus exposure, remains uninvestigated. In this study, we intranasally inoculated 3 week old male and female mice with Aspergillus fumigatus spores dilution of 2 106spores per 40 l. They were exposed to the allergen once a week for 8 consecutive weeks and euthanized on day 28 post the last inoculation. The offense of “sedition” — often characterized as criminalizing the incitement of rebellion against the government — is an archaic crime that is frequently used to target political speech. Introduced in the sixteenth century in England specifically to suppress dissent, sedition laws spread through the British colonies. These laws still persist in some legal systems, and while there are reforms underway in some of those jurisdictions, in a few outliers, the offense continues to be prosecuted — and in some there has been a resurgence in cases.

On the night of October 6, 2020, at the conclusion of a virtual human rights meeting between the governments of the United States of America and Vietnam, Vietnamese police arrested the journalist and human rights activist Pham Thi Doan Trang at her home in Hanoi. Ms. Trang was arrested and detained for allegedly “conducting propaganda against the Socialist Republic of Vietnam” and “making, storing, spreading information, materials, items for the purpose of opposing the State of Socialist Republic of Vietnam” — two of the most notorious of Vietnam’s fifteen national security offenses.

The purpose of this research was to identify the psycho-emotional needs of family-caregivers of individuals who sustained a traumatic brain injury (TBI), and measure if there was a change in knowledge among occupational therapists, and occupational therapy students following a two-hour seminar covering topics identified in the literature. The topics covered in the seminar included the concept of ambiguous loss, the importance of validating emotions, the caregiver grieving process, and the importance of providing caregiver resources. To measure the change in knowledge, researchers utilized primarily a quantitative research design using pre- and post-test questionnaires with Likert- scale questions. The questionnaire …

The semiconductor industry has mainly exploited two routes for designing microprocessors. The multi-core route aims to speed up the performance of latency-oriented processing. In contrast, the many-thread route concentrates on throughput-oriented improvement of parallel processing. Many-thread microprocessors, such as Graphics Processing Units (GPUs), are leading the computing capability for this past a decade. According to the current hardware market, at the similar price range, the ratio of peak computing power between multi-core CPUs and many-thread GPUs is up to 15X. Background: In 2018 our library migrated to Ex Libris’s Alma and its discovery service Primo. Alma allows content from OAI-PMH compliant archives to be loaded to Primo for discovery. Our library has a Digital Commons institutional repository (IR) system and librarians were eager to explore including IR content in Primo. Post-migration a feed was established between the IR and Primo, but there were issues with adding all IR content and the feed was removed. Consequently, we wanted to explore alternatives that would allow for the integration of more selective IR content.

Oxygen deprivation masks are being advertised towards athletes as a piece of fitness equipment that can simulate the effects of high altitude, as well as a respiratory muscle training device. Studies that investigated the claims as to whether ODMs increased VO2max and improved endurance were looked into. Experimental data did not find that the use of these masks increased VO2max, nor was there any supporting data to prove that it improved endurance. The function of ODMs as a training tool to increase respiratory muscle strength was also examined. There were contradicting results between the three different studies examined. One study …

Throughout American history, sexual violence against Native Americans has been an all-too common phenomenon. This ranges from outright rape to less obvious examples, including the desecration of native bodies and the separation of native children from their parents, such as at the boarding schools. Analyzing "Sexual Violence as a Tool of Genocide" by Andrea Smith, along with a variety of other sources, this article argues that sexual violence against native peoples reinforces the colonial idea that they are subhuman and "rapable." During the Nazi Regime, Adolf Hitler and the Nazis seized an estimated one fifth of all art in Europe and more than 5 million cultural objects before 1945. The Nazis established control over the regime and furthered their racist ambitions through stealing art of any cultural or monetary value to them. They stole “degenerate” art in an attempt to annihilate “racially inferior” races, and “racially pure” art for the glorification of the “Aryan” race. Coral reefs are biodiversity hotspots that provide humans with extractive ecosystem services like fisheries and non-extractive services like tourism. Though no studies have examined these trade-offs among these services at a global scale, there are now large, open datasets that make this possible. Using these datasets, we asked whether spatial protection and the level of protection (World Database on Protected Areas) impacted coral reef tourism value (Atlas of Ocean Wealth). We also examined whether proximity to regions of high fishing effort, defined as the top 25th percentile of the average annual effort from Global Fishing Watch, impacted tourism values. Since …

The Pharaoh Hatshepsut is one of the most well-known rulers of ancient Egypt and she has fascinated historians for decades. She ruled Egypt during the 15th century BCE, coming to power after the death of her husband, Thutmose II. Hatshepsut is particularly interesting to historians due to how she was portrayed in her art. The concept of postmaterialism posits that individuals who are born in an economically and socially secure environment tend to be more open to changes in their societies and accepting of different values among individuals compared to those who are materialists (i.e., individuals who tend to value security, affluence, and strong law and order more in comparison to postmaterialists). Postmaterialism is associated with individuals who are more educated and have access to different educational opportunities, given the existence of economic stability in postmaterialist societies. This paper is a review of recent research on the subject of exercise-associated hyponatremia. Hyponatremia is notoriously difficult to diagnose and to treat due to its general symptoms and required specificity in diagnosis in order to assign appropriate treatment. If left untreated, Hyponatremia can result in the development of complications like cerebral edema, seizures, coma, and sometimes death. The pathogenesis of hyponatremia includes multiple proposed mechanisms, including overconsumption of hypotonic fluids, inappropriate release of antidiuretic hormone, inefficiency of fluid filtration by the kidneys, redirection of fluid into intestinal lumen, and activation of the renin-angiotensin-aldosterone system. Within the human body, there are two types of adipose tissue: white adipose tissue (WAT) and brown adipose tissue (BAT). WAT is beneficial for insulation whereas BAT has thermogenic capacity. BAT activation increases energy consumption via heat generation. Increased energy expenditure is associated with improved glucose and lipid metabolism. Therefore, BAT activation research has primarily been aimed at its potential use in the treatment of obesity, diabetes, and other metabolic disorders. In this literature review, BAT's thermogenic mechanisms, techniques of activation, potential therapeutic targets, and future research topics are explored.

Logging can affect freshwater streams around logging sites, even years after the logging has occurred. In this study, we looked into how sustainable logging in Michaux State Forest (in Adams County, Pennsylvania) has affected two streams within the state park: Mountain Creek and Birch Run. Six sites were selected along each stream, with three upstream and three downstream from the logging area. We hypothesized that the water quality would be lower at the stream sites downstream from the logged areas as compared to the upstream sites. Freshwater tidal marshes are essential stopover points for migratory birds traveling up and down the east coast of North America. Given the importance of these habitats, we examined the effects of sea level rise on vegetation health and vegetation migration at Otter Point Creek Estuarine Reserve. We aimed to test three predictions: 1) vegetation health will decline over time during vegetation growth periods, 2) vegetation migration of less water-tolerant species will occur with movement into higher elevation plots, 3) people will be aware that there are impacts of climate change on species around them and themselves. In this paper, I investigate the validity of the widely held assumption that high rates of youth unemployment will lead a state to experience internal armed conflict. I hypothesize that as youth unemployment rates increase, a state will have a larger number of internal armed conflicts occur annually. Science is increasingly collaborative, but scientists from the Global North (GN) often fail to collaborate with local scientists or to build local scientific capacity when conducting research in the Global South (GS). This practice is known as “parachute science” or “helicopter science”. In addition to ethical concerns, this practice is problematic in the field of ecology because it may reduce the likelihood that the research will inform local resource management and science policy. American public lands provide significant outdoor recreational opportunities that enhance an individual's physical and mental well-being. Hiking is an example of a highly accessible and affordable recreational activity that is popular and easy for people to engage in no matter how experienced they are. While hiking has improved the well-being of many individuals, its impacts on local ecosystems are often disregarded.
