The identification of novel SARS-CoV-2 variants can predict new patterns of COVID-19 community transmission and lead to the deployment of public health resources. However, increased access to at-home antigen tests and reduced free PCR tests have recently led to data gaps for the surveillance of evolving SARS-CoV-2 variants. To overcome such limitations, we asked whether wastewater surveillance could be leveraged to detect rare variants circulating in a community before local detection in human cases. Here, we performed whole genome sequencing (WGS) of SARS-CoV-2 from a wastewater treatment plant serving Las Vegas, Nevada in April 2022. Using metrics that exceeded 100× …

Human Movement Studies & Special Education Faculty Publications
Introduction: Breastfeeding women have elevated resting metabolic rate (RMR); however, whether a single bout of lactation increases RMR is unknown. This study aimed to determine if a single bout of lactation acutely increased RMR.
Methods: Twenty-two lactating women (age: 31 ± 0.9 year, body mass index: 27.3 ± 1.2 kg/m2) were recruited. RMR was assessed at baseline and at 1- and 2-h following breast milk expression.
Results: RMR was unchanged in lactating women following a single bout of lactation (baseline: 1437 ± 39; 1 h: 1425 ± 37 2 h: 1440 ± 31 kcal/day) (p > .05). RMR was …

Recent evidence points to autophagy as an essential cellular requirement for achieving the mature structure, homeostasis, and transparency of the lens. Collective evidence from multiple laboratories using chick, mouse, primate, and human model systems provides evidence that classic autophagy structures, ranging from double-membrane autophagosomes to single-membrane autolysosomes, are found throughout the lens in both undifferentiated lens epithelial cells and maturing lens fiber cells. Recently, key autophagy signaling pathways have been identified to initiate critical steps in the lens differentiation program, including the elimination of organelles to form the core lens organelle-free zone. Other recent studies using ex vivo lens culture …

Journal of Dispute Resolution
The Legislative Update exists to inform the reader of various state and federal laws passed during the 2021-2022 legislative sessions. More specifically, the statutes discussed below relate to alternative dispute resolution (“ADR”) in its many forms. This is an annual update compiled and written by the Journal of Dispute Resolution’s Associate Members and edited by the Associate Editor-in-Chief. This year represented a wide mix of laws passed—some related to health and safety in a post-pandemic world; others posed solutions to problems relevant before the COVID-19 pandemic. Usually, the Legislative Update is limited exclusively to state legislation. We decided to include …
Considering Vaccination Status, Govind Persad
Considering Vaccination Status, Govind Persad
UC Law Journal
This Article examines whether policies—sometimes termed “vaccine mandates” or “vaccine requirements”— that consider vaccination status as a condition of employment, receipt of goods and services, or educational or other activity for participation are legally permitted, and whether such policies may even sometimes be legally required. It does so with particular reference to COVID-19 vaccines.
Part I explains the legality of private actors, such as employers or private universities, considering vaccination status, and concludes that such consideration is almost always legally permissible unless foreclosed by specific state legislation. Part II examines the consideration of vaccination status by state or federal policy. …
Mitigating Catastrophe Risk For Landowners, Stewart E. Sterk
Mitigating Catastrophe Risk For Landowners, Stewart E. Sterk
UC Law Journal
Local, national, and global catastrophes entail significant risk for landowners. The governmentsponsored National Flood Insurance Program illustrates how subsidizing insurance against catastrophe risk can result in overinvestment in risk-prone properties. Government intervention, however, has largely been a response to the historical failure of the private insurance industry to provide adequate protection against correlated risks, a failure with the potential to generate underinvestment in land and devastate existing owners.
When data is available about the incidence and severity of potential disasters, improvements in technology have made it more feasible for insurers to calibrate premiums and discounts with greater accuracy, and sophisticated …
Foreign Investment And National Security Challenges In The Data Age: An Assessment Of The Current Regime And Recommendations, Irene Yu
UC Law Journal
This Note contributes to the growing literature that attempts to grasp the current landscape of international trade and investment norms and policies in the data age. Focusing on the disputes between the United States and China surrounding Chinese investment in American businesses that gather private user data, this Note adds to the argument that new challenges posed by the internet age and the use of private data have transformed current international trade policy and the national security exception regime. The U.S. government in the recent years has demonstrated little self-restraint in employing national security grounds to justify its interference with …

School districts have called upon principals to build capacity for inclusive learning environments and prioritize the needs of an increasingly diverse group of students. A principal's work to effectively include students so they are part of the school community and have opportunities to achieve academically has been challenging. As the instructional leader of the school, principals have played an essential role by collaborating with teachers and specialists, removing obstacles to learning, and ensuring that teachers meet the needs of all learners in their classrooms. They have also been held accountable for knowing the laws, policies, and best practices to support …

According to studies, money is a major source of anxiety for most Americans. In looking for ways to remedy the source of such anxiety, some believe that increasing children’s financial orientation could help lower their money-related anxiety levels as adults. Identifying this market as a business opportunity—and reassured by research that shows that by age six, children are already veteran consumers of mobile apps—financial technology (fintech), decentralized finance (DeFi), and even traditional financial entities have started offering services and products to children. These services and products include a broad array of financial-related products and services, from enabling children to earn …

The Department of Homeland Security (DHS) announced that beginning on May 26, 2015, certain H-4 dependents of H-1B nonimmigrants would be eligible to apply for an Employment Authorization Document (EAD). The H-4 EAD program was the target of several threats and changes under the Trump Administration, which made it increasingly difficult for H-4 EAD holders to maintain uninterrupted employment authorization. These difficulties prompted several lawsuits against the U.S. Citizenship and Immigration Services (USCIS), under DHS. USCIS favorably settled one such class-action lawsuit. Still, the H-4 EAD program remains only precariously in place because it was never officially codified and exists …

JOHNSON CITY – Dr. David Harker’s research, like the philosophy and purpose of science, was always important in academic circles. But in recent years, it has reached a deep level of relevancy – both in the United States and throughout the world.
“Vaccine skepticism and vaccine hesitancy are big problems, and they are also really complicated,” said Harker, a professor and chair of Philosophy and Humanities at East Tennessee State University.
Harker has considered some of the reasons why such indecision exists.
“There is nothing very intuitive about the idea of injecting something into your arm helping protect you …

BACKGROUND: Potential care gaps in the cervical cancer screening process among women diagnosed with cervical cancer in an era with increased human papillomavirus (HPV) testing have not been extensively evaluated.
METHODS: Women diagnosed with cervical cancer between ages 21 and 65 at four study sites between 2010 and 2014 were included. Screening histories were ascertained from 0.5 to 4 years prior to cervical cancer diagnosis. We identified potential care gaps in the screening history for each woman and classified them into one of three mutually exclusive types: lack of a screening test, screening test failure, and diagnostic/treatment care gap. Distributions …

Pregnancy determination is necessary for sound wildlife management and understanding population dynamics. Pregnancy rates are sensitive to environmental and physiological factors and may indicate the overall trajectory of a population. Pregnancy can be assessed through direct methods (rectal palpation, sonography) or indicated using hormonal assays (serum progesterone or pregnancy-specific protein B, fecal progestogen metabolites). A commonly used threshold of 2 ng/ml of progesterone in serum has been used by moose biologists to indicate pregnancy but has not been rigorously investigated. To refine this threshold, we examined the relationship between progesterone concentrations in serum samples and pregnancy in 87 moose ( …

State V. Gutierrez Abolishing The Spousal Communications Privilege: An Opinion Raising Profound Questions About The Future Of Evidentiary Privileges In The United States, Edward J. Imwinkelried
New Mexico Law Review
Part I of this article is a detailed description of the original Gutierrez decision, the dissents as well as the majority opinion. Part II then critically evaluates the majority’s analysis of the application of the instrumental theory to the spousal communications privilege. Part II argues that the majority correctly concluded that the instrumental case for the spousal privilege is weak. The majority rigorously applied the instrumental criteria to the privilege and came to the honest, realistic conclusion that, in most cases, spouses would consult and confide even if there were no spousal privilege. However, Part II points out that the …

The Effect Of An American Heart Association–Approved Exercise Regimen On Burnout In Nurse Practitioners And Physician Assistants Working In Emergency Departments, Michelle Lee Johnson
Electronic Theses and Dissertations
Burnout is a widely known state of physical and emotional fatigue previously noted to affect as many as 60% of healthcare providers, but one that is understudied in nurse practitioners and physician assistants working in emergency departments. It is imperative that the providers of healthcare recognize in themselves signs of burnout and have resources available to mitigate the condition. A pretest–posttest, quasi-experimental, nonequivalent control group, descriptive research design with descriptive statistics analysis was used to analyze answers to an email-based survey sent to nurse practitioners and physician assistants working for one large emergency medicine staffing company. The intent of this …

Race-Ing Antitrust, Bennett Capers, Gregory Day
Race-Ing Antitrust, Bennett Capers, Gregory Day
Michigan Law Review
Antitrust law has a race problem. To spot an antitrust violation, courts inquire into whether an act has degraded consumer welfare. Since anticompetitive practices are often assumed to enhance consumer welfare, antitrust offenses are rarely found. Key to this framework is that antitrust treats all consumers monolithically; that consumers are differently situated, especially along lines of race, simply is ignored.
We argue that antitrust law must disaggregate the term “consumer” to include those who disproportionately suffer from anticompetitive practices via a community welfare standard. As a starting point, we demonstrate that anticompetitive conduct has specifically been used as a tool …
Repugnant Precedents And The Court Of History, Daniel B. Rice
Repugnant Precedents And The Court Of History, Daniel B. Rice
Michigan Law Review
Aged Supreme Court precedents continue to tolerate many practices that would shock modern sensibilities. Yet the Court lacks standard tools for phasing out decisions that offend our national character. The very cultural shifts that have reoriented our normative universe have also insulated most repugnant precedents from direct attack. And the familiar stare decisis factors cannot genuinely explain what ails societally outmoded decisions. Even for justices inclined to condemn these embarrassments in less clinical terms, it is unclear what qualifies courts to make universalist claims about contemporary American values.
The Court recently sidestepped these difficulties by insisting that one of its …
