Gender Violence As A Penalty Of Poverty, Deborah M. Weissman
Gender Violence As A Penalty Of Poverty, Deborah M. Weissman
University of Miami Inter-American Law Review
The matter of gender violence, including intimate partner violence (IPV), has long been categorized as a particularly egregious crime. The consequences of IPV are profound and affect all members of the household, family members near and far, and the communities where they live. Gender violence impacts the national economy. Costs accrue to workplaces, health care institutions, and encumber local and state coffers. Survivors are deprived of income, property, and economic stability: conditions that often endure beyond periods of physical injuries. Offenders also experience economic hardship as a result of involvement with the legal system. They often face significant obstacles when …
Is There Force In Force Majeure After Covid-19 Or In The Freedom To Negotiate Risk?, Sara Lazarevic
Is There Force In Force Majeure After Covid-19 Or In The Freedom To Negotiate Risk?, Sara Lazarevic
University of Miami Inter-American Law Review
This note explores the impact COVID–19 has had on contracting parties who have attempted to implicate force majeure provisions. An inquiry of recent cases reveals varying degrees of success and tension when parties turn towards force majeure text. This Note analyzes common law alternatives, discusses the implication of force majeure clauses as applied under Mexican and American law, highlights the implications that have played out in recent court decisions, and discusses post–pandemic implications that could affect how parties conduct cross–border transactions in the future.

Mitigating Zoonotic Disease Threats To Prevent Future Pandemics: A Critical Analysis Of Policy Favoring The Closures Of Wildlife Markets In Latin America, Melany J. Danielson
University of Miami Inter-American Law Review
The Preventing Future Pandemics Act was introduced to mitigate zoonotic disease threats around the world by focusing policy efforts on the closure of wildlife markets that gave rise to COVID–19. This Note challenges the efficacy of wildlife market closure policy by considering cultural, socioeconomic, and legal factors for the existence of wildlife market within megadiverse countries in Latin America. Based on scientific research on the animal-to-human interface and zoonotic disease transmission, this Note suggests effective policy should incorporate a targeted species ban for reservoir species, improved sanitary measures and disease surveillance, and wildlife trafficking prevention. Ultimately, this Note calls for …
Chevron: Fueling The Right Against Title 42 And The Denial Of U.S. Asylum Rights, Nicholas Pierre-Paul
Chevron: Fueling The Right Against Title 42 And The Denial Of U.S. Asylum Rights, Nicholas Pierre-Paul
University of Miami Inter-American Law Review
This Note was inspired by the questionable treatment of Haitian asylum seekers in Del Rio, Texas, where horseback U.S. officials charged at them using reins as whips, before immediately deporting them back to Haiti. The U.S. government justified its actions by claiming that Title 42 permits U.S. officials to prohibit the entry of individuals when there is a danger of introducing certain diseases, such as COVID-19. However, Title 42 conflicts with the United States’ codified commitment to the principle of non-refoulment, prohibiting it from returning certain refugees to a country where their life or freedom would be threatened. Accordingly, the …

Anthropogenic activities are negatively affecting the flora and fauna of Madagascar, including its Endangered flagship lemur species, the ring-tailed lemur Lemur catta. Population numbers at some sites are rapidly declining, yet much of the species’ habitat is insufficiently surveyed. Because widespread population assessments are critical to guiding conservation management strategies, additional data are needed to monitor L. catta population trends and to identify the limits of their geographical range. Here we report survey results confirming the presence of this species at 65 of 83 sites in southern and south-western Madagascar, including three subpopulations that were previously considered likely to …

Positive Impacts Of Tilt: Two Professors’ Journeys In Creating More Student-Centered Teacher Education Courses, Michael Crosby, Rebecca Short
Perspectives In Learning
As the K-12 classroom changes to support the needs of our every-changing society, so should the teacher education courses change on the university level. Additionally, the focus on higher education has become more student-centered with an emphasis on transparency in teaching and learning (TILT). The purpose of this article is to highlight the positive experiences two teacher education professors had using TILT to examine assignments and course syllabi. The journey of developing transparent assignments and student-centered syllabi is time-consuming, challenging, and on-going, but the benefits of a student-centered classroom are invaluable.

Institutionalizing Tilt Across A University, Judy O. Grissett
Perspectives In Learning
Transparency of learning and teaching (TILT) is key to student success, as it allows students to understand directions and make concrete steps toward completing a set of tasks. The present paper outlines the early stages of a campus-wide program at one institution that infuses TILT practices across campus in the classroom as well as non-academic units. TILT practices make the purpose, required tasks, and criteria for success clear to students in everyday campus interactions with faculty and staff. TILT programming for faculty and staff is described, including strengths, challenges, and future directions.

Differential Impacts Of Cereal And Protein Sources Fed To Pigs After Weaning On Diarrhoea And Faecal Shedding Of Escherichia Coli, Production, And Total Tract Apparent Digestibility, John R. Pluske, Bruce P. Mullan, Jae Cheol Kim, David J. Hampson
Animal production and livestock research articles
Different cereal types, in combination with different protein sources, are fed to pigs after weaning, but their interactions and possible implications are not well researched. In this study, 84 male weaned piglets were used in a 21-day feeding trial to investigate the effects of feeding either medium-grain or long-grain extruded rice or wheat, in a factorial combination with protein sources of either vegetable or animal origin, on postweaning performance, shedding of β–haemolytic Escherichia coli, and the coefficient of total tract apparent digestibility (CTTAD). Pigs fed either rice type performed the same (p > 0.05) as wheat-fed pigs after weaning. The use …

Microbiomes play critical roles in host functioning and therefore there is increasing interest in the microbiome assembly of plants. However, sampling strategies for long-lived perennial trees need to be standardised to produce robust data that accurately represents the microbiome over time. This issue is currently unresolved because there is little evidence indicating which portion of perennial tree species (e.g., root region or surrounding soil) is the best to sample to produce the most accurate measure of microbiome communities. Our aim was to sample different compartments of a plant’s belowground microbiome to identify the optimal sampling strategy to account for the …

Gender Mainstreaming At The European Court Of Human Rights: The Need For A Coherent Strategy In Approaching Cases Of Violence Against Women And Domestic Violence, Joanna Evans
University of Miami Inter-American Law Review
Any assessment of the jurisprudence of the European Court of Human Right’s (ECtHR) in the field of violence against women and domestic violence must start with an acknowledgement of the ECtHR’s landmark judgments in this area and the positive practical impact those judgments have had upon the protection of women.
However, much progress is still to be made. This article analyses three ECtHR cases from Russia and Georgia, and in so doing, highlights the need for greater transparency, proactivity, and coherency on the part of the Court. It considers in turn: a) the seemingly discriminatory impact of the ECtHR’s approach …

Ice-Crystal-Templated “Accordion-Like” Cellulose Nanofiber/Mxene Composite Aerogels For Sensitive Wearable Pressure Sensors, Wangwang Xu, Qinglin Wu, Jaegyoung Gwon, Jin Woo Choi
Faculty Publications
Exfoliated MXene nanosheets are integrated with cellulose nanofibers (CNFs) to form composite aerogels with high electric conductivity. The combination of CNFs and MXene nanosheets forms a unique “accordion-like” hierarchical architecture with MXene-CNF pillared layers through ice-crystal templating. Benefiting from the special “layer-strut” structure, the MXene/CNF composite aerogels have low density (50 mg/cm3), excellent compressibility and recoverability, as well as superior fatigue resistance (up to 1000 cycles). When being used as a piezoresistive sensor, the composite aerogel exhibits high sensitivity upon different strains, stable sensing performance with various compressive frequencies, broad detection range, and quick responsiveness (0.48 s). Moreover, the piezoresistive …

Split And Join: An Efficient Approach For Simulating Stapled Intestinal Anastomosis In Virtual Reality, Di Qi, Suvranu De
Engineering Faculty Articles and Research
Colorectal cancer is a life-threatening disease. It is the second leading cause of cancer-related deaths in the United States. Stapled anastomosis is a rapid treatment for colorectal cancer and other intestinal diseases and has become an integral part of routine surgical practice. However, to the best of our knowledge, there is no existing work simulating intestinal anastomosis that often involves sophisticated soft tissue manipulations such as cutting and stitching. In this paper, for the first time, we propose a novel split and join approach to simulate a side-to-side stapled intestinal anastomosis in virtual reality. We mimic the intestine model using …

Damage to bridges can result in partial or complete structural failures, with fatal consequences. Cracks develop in concrete infrastructure from fatigue loading, vibrations, corrosion, or unforeseen structural displacement. Effective long-term monitoring of civil infrastructure can reduce the risk of structural failures and potentially reduce the cost and frequency of inspections. However, deploying structural health monitoring technologies for crack detection on bridges is expensive, especially long-term, due to the density of sensors required to detect, localize, and quantify cracks. Previous research on soft elastomeric capacitors (SECs) has shown their viability for low-cost monitoring of cracks in transportation infrastructure. However, when deployed …

The northeast of Madagascar is as diverse as it is threatened. The area bordering the Analanjirofo and SAVA regions contains six protected areas and at least 22 lemur species. Many applied research and conservation programs have been established in the region with the aim of ensuring both wildlife and people thrive in the long term. While most of the remaining humid evergreen forest of northeast Madagascar is formally protected, the local human population depends heavily on the land, and unsustainable natural resource use threatens this biodiversity hotspot. Drawing from our collective experiences managing conservation activities and research programs in northeast …

Irrespective of the reason for hypoperfusion, hypocoagulable and/or hyperfibrinolytic hemostatic aberrancies afflict up to one-quarter of critically ill patients in shock. Intensivists and traumatologists have embraced the concept of SHock-INduced Endotheliopathy (SHINE) as a foundational derangement in progressive shock wherein sympatho-adrenal activation may cause systemic endothelial injury. The pro-thrombotic endothelium lends to micro-thrombosis, enacting a cycle of worsening perfusion and increasing catecholamines, endothelial injury, de-endothelialization, and multiple organ failure. The hypocoagulable/hyperfibrinolytic hemostatic phenotype is thought to be driven by endothelial release of anti-thrombogenic mediators to the bloodstream and perivascular sympathetic nerve release of tissue plasminogen activator directly into the microvasculature. …

University Administrators, Leadership, And Faculty Views On The Internationalization Of Curriculum, Alina Pap
Seton Hall University Dissertations and Theses (ETDs)
International curriculum is a scholastic model to implement international and intercultural dimensions within teaching and learning strategies across disciplines. However, theorists emphasized that IoC is not an independent institutional strategy rather it is tied to internationalization of higher education as a complex and institutionally customized policy. Studies conducted in various national contexts underscore two main critiques brought to implementation of IoC. First, institutions of higher education have different possibilities to implement IoC and colleges and universities in Northern, European and Western countries manipulate the process of internationalization. Second, the role of administrators, leadership and faculty is essential in the implementation …
