Refining Statutory Construction: Contextualism & Deference

This Article urges a novel structure for marrying statutory construction and Chevron deference into a paradigm best described as contextualism. All too often jurists and scholars describe modern statutory construction as dominated by textualism. Textualism is too simplistic and obscures how invariably courts employ a contextualist analysis when construing language. Contextualism, not textualism, is—and always has been—the paradigm for statutory construction. Focusing on contextualism in lieu of textualism promotes an acute focus on what aids in construction a court is willing to entertain, and the Article illustrates that liberal and conservative judges alike employ a contextual analysis while they may …

This article summarizes merger enforcement data for the period between 2001 and 2020, using a database created by the authors. The database lists the identity and outcome of every transaction that received a second request during this 20-year period. The database also lists the identity and outcome of every challenge to an already-consummated merger during the period. To our knowledge, it is the only complete database for the listing and outcomes of all such transactions. The goal of creating the database is to provide further information on merger enforcement, which hopefully can inform policy and spur additional analysis. We describe …

The goal of this research is to determine the structural parameters of the recycled plastic polypropylene when molded into bricks resembling CMU blocks. To accomplish this, three mechanisms had to be assembled: the shredder, the injector, and the 1x1 mold. A tensile and compression test were to be performed on the plastic brick, and the values would be used to compare the tensile and compressive strength of PP plastic bricks, as well as their modulus of elasticity and stress vs. Strain performance. The aim of this study is to provide an overview of various models to study drug diffusion for a sustained period into and within the human body. Emphasized the mathematical compartment models using fractional derivative (Caputo model) approach to investigate the change in sustained drug concentration in different compartments of the human body system through the oral route or the intravenous route. This research aimed to increase the awareness of licensed family childcare programs and use the viewpoints of four stakeholder groups to construct recommended best practices. These best practices are crucial for supporting effective business practices and providing high-quality services to their stakeholders. Online surveys and virtual interviews were used to acquire the stakeholders' perspectives. The collected data revealed three principal thematic codes: family childcare provider, family childcare business, and family childcare environment. The strong negative consequences caused by the outbreak of the COVID-19 pandemic created the need for a scientific investigation of changes that occurred in the organizational culture of the hospitality industry. This research paper, using the Delphi method, served three purposes. It first assesses the changes that the COVID-19 pandemic has brought to selected cultural components (product, external relations, and entrepreneurship strategy) that shape a hotel’s organizational culture, and determines how it interacts with other stakeholders on an inter-organizational level. In this report, we investigate the status of the TPS-charter school funding gap a year after the full implementation of the LCFF. The war in Yemen has remained the world’s worst humanitarian crisis since 2015, and yet it is shockingly invisible. The global legal system fails to offer a clear avenue through which the Yemeni people can hold the state actors responsible for their harm accountable. This Note analyzes international legal mechanisms for vindicating war crimes and human rights abuses perpetrated in Yemen. In 2018, Congress passed the First Step Act ("FSA 2018"), which is considered one of the most applaudable efforts in modern history, aiming to reduce federal prison populations. While the Act has made progress in decreasing incarceration rates over the last few years, the pace of reform to reverse the nearly forty-year-long effect of the "War on Drugs" is slow. Past attempts, such as shortened sentences, provide a temporary solution but ultimately fail to keep the prisoner from reoffending.

During a cesarean section, blood loss greater than 1000 mL is classified as a hemorrhage. Quantified blood loss methods are used to detect hemorrhage, however existing methods are inaccurate and time consuming. Our proposed device is inserted vaginally during a cesarean section to collect and quantify blood lost via the cervix during and after the procedure. The device also applies light suction to the uterus, which can aid in uterus collapse and decrease the risk of postpartum hemorrhage.

The 2020 presidential election unearthed valid questions about how the election was administered and whether various state laws were properly followed. However, President Donald Trump and his closest allies routinely fail to distinguish between questions about whether state officials correctly interpreted and applied the state’ s election code and actual fraud or malfeasance. Meat processing plants are linked to the rapid spread of COVID-19 cases. A related literature review shows a lack of proper ventilation standards for the meat processing plants for workers’ health and safety. Ventilation rates in these plants are considered adequate if the meat products are unadulterated. Thus, the air distribution and ventilation rate experiments were conducted in three meat processing plants. These measured ventilation rates were either compared to ASHRAE Std. 62.1 (2019) for a similar space or the design values provided by the plant’s administration. Fatty liver disease is a common health problem caused by an imbalance in the intake, utilization, and distribution of energy. High-fat and high-carbohydrate diets have been identified as major risk factors for fatty liver disease. Other contributors and modifiers can also influence the development of liver damage. Intriguingly, inappropriate copper (Cu) levels in the diet and organs are associated with fatty liver disease, though the exact way in which Cu deficiency or toxicity contributes to metabolic issues is not yet clear. Introduction: Cover crop (CC) is an essential tool to improve or maintain soil health, potentially improving cash crop productivity. Several recent reports of cash crop yield reduction following cover cropping necessitated this research to guide efficient CC decisions in the season before corn (Zea mays) or soybean (Glycine max) is to be grown.

Abstract
Purpose To compare the diagnostic ability of medical students using smartphone ophthalmoscopy (SO) with conventional direct ophthalmoscopy (DO).
Methods Twenty-eight first- and second-year medical students were trained to use the SO and DO. They also attended educational seminars regarding optic nerve and retinal pathology and were given hands-on practice with each ophthalmoscopy method. Students were randomized 2:1 into one of the groups (DO or SO). Students then examined six patients and recorded their findings, ease of use, and confidence level on a questionnaire. Rice husk, a rice processing byproduct generated in large quantities (∼20% of the grain weight), creates a major disposal problem for the rice industry. However, rice husk contains high-value bioactive compounds that can provide potential health benefits. Naturally occurring reefs are some of the world’s most biologically diverse ecosystems formed by jagged rocks tucked slightly below sea level. In recent years global warming began to pose a major threat to many reef habitats. Most relevant is the increase in surface seawater temperatures that cause coral to bleach, taking away major food sources for larger marine species. Researchers have combated this by deploying artificial reefs in substitution for naturally formed limestone rock formations in order to promote the expansion of coastal habitats.
