Expanding The Ban On Forced Arbitration To Race Claims, Michael Z. Green Mar 2024

Expanding The Ban On Forced Arbitration To Race Claims, Michael Z. Green

Faculty Scholarship

When Congress passed the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act (“EFASASHA”) in March 2022, it signaled a major retreat from the Supreme Court’s broad enforcement of agreements to force employees and consumers to arbitrate discrimination claims. But the failure to cover protected discriminatory classes other than sex, especially race, tempers any exuberance attributable to the passage of EFASASHA. This Article prescribes an approach for employees and consumers to rely upon EFASASHA as a tool to prevent both race and sex discrimination claims from being forced into arbitration by employers and companies. This approach relies upon procedural …

Outcome Reasons And Process Reasons In Normative Constitutional Theory, Lawrence B. Solum Mar 2024

Outcome Reasons And Process Reasons In Normative Constitutional Theory, Lawrence B. Solum

Faculty Scholarship

Constitutional theory is a mess. Disagreements about originalism and living constitutionalism have become intractable. Constitutional theorists make some arguments that seem clearly fallacious and advance proposals that are pie in the sky. One of the reasons for the mess is an overreliance by constitutional theorists on “outcome reasons,” justifications that rely on the theorist’s beliefs about what outcomes are good and what outcomes are bad. This outcome-drive approach is exemplified by the so-called “canonical cases” argument, which evaluates positions in normative constitutional theory on the basis of its counterfactual implications for a handful of prior decisions of the Supreme Court. …

Background: Pulmonary artery embolus is a rare complication following gunshot wounds that creates a unique and serious challenge for trauma surgeons. While the majority of bullets that embolize through the vascular system end in the peripheral circulation, approximately one-third enter the central venous circulation. Case Report: We present the case of a bullet embolus to the left pulmonary artery following gunshot wounds to the right chest and the abdomen, with the abdominal ballistic traversing the liver before entering the vena cava and embolizing. The patient’s course was complicated by the development of severe acute respiratory distress syndrome that was successfully …

Community Similarity Based On User Profile Joins, Konstantinos Theocharidis, Hady Wirawan Lauw Mar 2024

Community Similarity Based On User Profile Joins, Konstantinos Theocharidis, Hady Wirawan Lauw

Research Collection School Of Computing and Information Systems

Similarity joins on multidimensional data are crucial operators for recommendation purposes. The classic -join problem finds all pairs of points within distance to each other among two -dimensional datasets. In this paper, we consider a novel and alternative version of -join named community similarity based on user profile joins (CSJ). The aim of CSJ problem is, given two communities having a set of -dimensional users, to find how similar are the communities by matching every single pair of users (a user can be matched with at most one other user) having an absolute difference of at most per …

Ur2m: Uncertainty And Resource-Aware Event Detection On Microcontrollers, Hong Jia, Young D. Kwon, Dong Ma, Nhat Pham, Lorena Qendro, Tam Vu, Cecilia Mascolo Mar 2024

Ur2m: Uncertainty And Resource-Aware Event Detection On Microcontrollers, Hong Jia, Young D. Kwon, Dong Ma, Nhat Pham, Lorena Qendro, Tam Vu, Cecilia Mascolo

Research Collection School Of Computing and Information Systems

Traditional machine learning techniques are prone to generating inaccurate predictions when confronted with shifts in the distribution of data between the training and testing phases. This vulnerability can lead to severe consequences, especially in applications such as mobile healthcare. Uncertainty estimation has the potential to mitigate this issue by assessing the reliability of a model's output. However, existing uncertainty estimation techniques often require substantial computational resources and memory, making them impractical for implementation on microcontrollers (MCUs). This limitation hinders the feasibility of many important on-device wearable event detection (WED) applications, such as heart attack detection. In this paper, we present …

Mining Engineering Faculty Research & Creative Works

Numerical Modeling Of Complex Underground Engineering Projects Such As Caverns, Tunnels, And Bulk Mining Zones Is An Essential Part Of The Design Phase. Large-Scale Models Require Significant Reductions In Complexity From The Real-World Scenario, Which Often Leads To Low Confidence In The Model Output. In This Work, A Mine-Scale Numerical Model Is Developed To Simulate A Room And Pillar Extraction Mining Operation. The Model Inputs Are Calibrated Through The Comparison Of The Model Response To Pillar Extraction In An Analogous Mine Geometry With Measured Strain Values Collected Using A Novel Distributed Optical Fiber Strain Sensing Technique After Pillar Extraction. Calibration …

Wnt5b As A Therapeutic Target For Osteosarcoma Stemness, Metastasis, And Chemoresistance, Rachel S. Perkins

Alternative Theses and Dissertations (AETDs)

Osteosarcoma is a pediatric bone cancer that has no targeted therapy and has had no treatment advances for the last three decades. Osteosarcoma frequently metastasizes to the lungs and is highly chemotherapy resistant, reducing patient survival with metastatic disease to 20% after 5 years. New therapies targeted to metastasis and drug resistance in osteosarcoma are essential to improving patient outcomes.

A Pathway To World Law? International Solidarity As Key To Overcoming Our Current Global Crises, Obiora C. Okafor Mar 2024

A Pathway To World Law? International Solidarity As Key To Overcoming Our Current Global Crises, Obiora C. Okafor

Articles & Book Chapters

This article analyzes the extent to which international solidarity is key to overcoming our current global crises; a goal that must be achieved in robust measure if humanity is to have a chance at successfully constructing the kind of deeply integrated world society that is a pre-condition for the emergence and global acceptance of world law properly so-called. In developing its argument, it devotes the first three sections to relatively in-depth explanations of three concepts that are key to an understanding of the issues at hand, namely: the identity and nature of our current global crises; the idea of world …

Psychological Science Faculty Publications and Presentations

This study describes the development of a 12-item inventory of school supports for military-connected (MC) children. Participants were 444 students (grades 3 or 5) with an active-duty military parent (48% female; 57.3% White, 10.7% Black, 6.2% Native American, 5% Asian, 3.3% Pacific Islander, 17.5% bi/multiracial; 19% Latinx). Youth completed the Inventory of School Supports-Youth Report (ISS-YR) and measures of academic efficacy, parental involvement in school, school connectedness, and whether they had a non-parental supportive adult in their life. Parents reported on parent–teacher relationship quality. Confirmatory factor analyses supported a two-factor model (functional and relational support). Results psychometrically supported the ISS-YR. …

Circular Economy Policies For Decarbonization Of Us Commercial Building Stocks: Data Integration And System Dynamics Coflow Modeling Approach, Radwa Eissa, Islam H. El-Adaway Mar 2024

Circular Economy Policies For Decarbonization Of Us Commercial Building Stocks: Data Integration And System Dynamics Coflow Modeling Approach, Radwa Eissa, Islam H. El-Adaway

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

Despite the recognition of the built environment as a sector with high potential for reducing embodied emissions, there is a lack of national-level data on embodied carbon emissions attributed to the US commercial building stocks. Hence, there is a need to benchmark the current state of embodied emissions attributed to the commercial built environment and the impact of circular economy (CE) policies for their decarbonization to facilitate well-informed decision-making. This paper fills this knowledge gap through providing policy makers with a framework that estimates the current and future projections of embodied carbon emissions attributable to the US commercial building stocks …

Black Girls Youth Participatory Action Research & Pedagogies, Kimberlé W. Crenshaw, Venus E. Evans-Winters

Faculty Scholarship

More than a decade ago, as a group of anti-racist and feminist researchers, including one of the authors, set out to survey the landscape of the schooling experiences of Black girls, we encountered a pronounced knowledge desert that threatened research-informed policy interventions that served to protect Black girls. Most research at the time focused on the educational experiences of male, female, or Black students. There was hardly any readily available data on the school-based outcomes of Black girls as a specific group of students with a unique set of experiences. In Black Girls Matter: Pushed Out, Overpoliced, & Underprotected (Crenshaw, …
