Do Private Actors Have Rights Under The Wto? The Motivation For And (Inadequate) Implementation Of Gatt Article X, Adeet Dobhal, Petros C. Mavroidis, Lucas Moreira Jiminez, Sunayana Sasmal, Robert Wolfe Jul 2024

Do Private Actors Have Rights Under The Wto? The Motivation For And (Inadequate) Implementation Of Gatt Article X, Adeet Dobhal, Petros C. Mavroidis, Lucas Moreira Jiminez, Sunayana Sasmal, Robert Wolfe

Faculty Scholarship

General Agreement on Tariffs and Trade (GATT) Article X has been consistently overlooked in literature even though it is a unique provision in the GATT-regime: it acknowledges standing for private actors who can challenge trade-related administrative action by World Trade Organization (WTO) members. This provision is an unusual instantiation of the need to provide transparency for private actors about state policy. It is equally eccentric in seeming to provide a right for private actors to challenge governments, albeit only before domestic fora. How did the GATT end up with this provision? And are these apparent private rights meaningful in practice? …

Fund Kinship Caregivers To Help Keep Families Together, Not Separate Them, Joshua Gupta-Kagan Jul 2024

Fund Kinship Caregivers To Help Keep Families Together, Not Separate Them, Joshua Gupta-Kagan

Faculty Scholarship

Money impacts relationships. And when the money involved is a foster care subsidy to kinship caregivers, it can drive a wedge in relationships between parents and kinship caregivers that should be strengthened, not strained. Unfortunately, foster care funding incentivizes the “relational disruption”1 endemic to foster care, when it should instead support family members coming together to support each other and their children.

In contrast, Medicaid funding has increasingly supported family members taking care of each other and can provide child welfare with a model for funding family caregiving without disrupting relationships and without even requiring a family court or foster …

Navigating Identity: An Examination Of Intersectional Discrimination And Suicidal Ideation Among Lgbq Latinx Individuals, Jaclyn Pachicano Jul 2024

Navigating Identity: An Examination Of Intersectional Discrimination And Suicidal Ideation Among Lgbq Latinx Individuals, Jaclyn Pachicano

Dissertations (1934 -)

Suicide is one of the leading causes of death in the United States, with LGBQ Latinx adults showing higher risk for suicidality and related mental health outcomes. Experiences of discrimination, including heterosexism and ethnic discrimination, are often connected to increased risk for suicidal ideation. In addition to intersectional experiences of discrimination, LGBQ Latinx people often feel an incompatibility between their sexuality and ethnic identity, known as conflicts in allegiances (CIA), possibly increasing risk of suicidal ideation. It remains unclear what mechanisms connect intersectional discrimination and suicidal ideation. The current study expands on intersectional research by utilizing the Interpersonal Theory of …

A Smartphone-Based Cardiac Health Monitoring System For Hypertension, Kazi Shafiul Alam Jul 2024

A Smartphone-Based Cardiac Health Monitoring System For Hypertension, Kazi Shafiul Alam

Dissertations (1934 -)

Hypertension is the primary modifiable risk factor affecting global health across all causes. It is responsible for developing serious health concerns, including Cardiovascular diseases (CVD), the number one cause of death worldwide. More than half of individuals with hypertension do not know about their condition, and a substantial portion of those who are aware do not get the appropriate treatment. However, effectively managing hypertension has the potential to reduce the global burden of disease and mortality. Monitoring hypertension and cardiovascular health at home or in the office often requires specialized equipment or wearable devices, which can be uncomfortable, require specific …

Empowering Informed Decision-Making In Mental Health Care: A Web-Based Recommendation System For Mobile App Selection, Md Romael Haque

Dissertations (1934 -)

In 2022, 23.1% of adults in the United States (77 million individuals) were affected by mental health (MH) concerns. Due to the inaccessibility and high cost of traditional treatment, around 55% of people with severe mental illnesses do not receive treatment. Mental health concerns are prevalent, affecting a significant portion of the population in the United States. Traditional treatment options are often inaccessible and expensive, leaving many people without essential mental healthcare. However, the rise of mobile technologies has given rise to a promising solution: mobile mental health applications (MMHAs). These apps offer greater accessibility and affordability, potentially expanding mental …

Understanding Foster Parents' Experiences Of Secondary Traumatic Stress, Sarah Marie Boeding Jul 2024

Understanding Foster Parents' Experiences Of Secondary Traumatic Stress, Sarah Marie Boeding

Dissertations (1934 -)

Secondary traumatic stress, which has been studied across many helping professions, refers to symptoms similar to posttraumatic stress disorder which an individual may develop as a result of indirect exposure to another individual’s trauma (Sprang et al., 2019). Foster parents may be particularly susceptible to developing secondary traumatic stress due to their exposure to their foster child’s trauma history and trauma symptoms, which has been confirmed in recent studies (Bridger et al., 2020; Whitt-Woosley et al., 2020). Importantly, foster parents’ experiences of secondary traumatic stress may differ from those of other helping professionals given their unique role. The purpose of …

African American Women’S Writing: A Critical Edition Of A Narrative Of The Life And Travels Of Mrs. Nancy Prince (1856), Susan E. Landwer

Dissertations (1934 -)

This dissertation expands on current knowledge of how Black women of the early nineteenth century not only participated in political and social movements within the United States but were instrumental in effecting fundamental social and economic progress both domestically and abroad. They did this while grappling with what their US citizenship meant to them within a gendered and race-based hierarchy. In the process, they had their own labor to sustain their livelihood and apprenticed the future labor of others. Centering on Nancy Gardner Prince (1799-1859), a Black activist born in Newburyport, Massachusetts, I explore how Prince was not an exception …

Novel State Estimation Techniques And Their Applications, Jiayi Su Jul 2024

Novel State Estimation Techniques And Their Applications, Jiayi Su

Dissertations (1934 -)

This dissertation contributes to the field by developing and applying novel state estimation techniques in three distinct areas: the detection of cyber-physical systems (CPS) intrusion, the estimation of State-of-Charge (SOC) and State-of-Health (SOH), and multi-object tracking in video sequences. In the first area, emphasis is placed on the detection of unknown intrusion signals within CPS. A pioneering detection scheme is formulated to discern potential cyber-attacks on industrial control systems. A novel intrusion model is first introduced and subsequently incorporated into the Multi-Model Adaptive Estimation (MMAE) technique for the identification of sensor or actuator attack signals. Simulation results underscore the effectiveness …

Is Telehealth Equivalent To In-Person Intervention? A Replication And Extension Of Peers For Adolescents, Elyse Jeannine Adler

Dissertations (1934 -)

One commonly requested area of support for autistic youth centers around teaching and maintaining social skills, as social communication differences are a core feature of autism spectrum disorder. During the COVID-19 pandemic, many healthcare services transitioned to telehealth, and some caregivers were concerned about if telehealth services were efficacious. There is a growing body of literature supporting the effectiveness of in-person social skills interventions, however research on telehealth administration of social skills intervention is more limited. This study aimed to evaluate if the telehealth version of PEERS for Adolescents has similar effects for autistic youth as the originally developed in-person …

Mechanisms Of Fatigability In Individuals With Prediabetes And The Effect Of Dietary Nitrate Supplementation, Blaine Evan Arney Jul 2024

Mechanisms Of Fatigability In Individuals With Prediabetes And The Effect Of Dietary Nitrate Supplementation, Blaine Evan Arney

Dissertations (1934 -)

Prediabetes is characterized as elevated blood glucose levels below the clinical threshold for type 2 diabetes. Previous research identified an increased fatigability (exercise-induced reduction in limb force or power) of the lower limb muscles in individuals with prediabetes which can impair physical function and lead to reduced physical activity. The mechanisms of fatigability in people with prediabetes are not known but are likely related to suggested vascular dysfunction in prediabetes. An important healthcare goal is to determine effective treatments to offset the increased fatigability in people with prediabetes to improve daily function. The purpose of this dissertation was to determine …

Predicting Critical Risks And Long-Term Impact Of Covid-19 Patients With Substance Use Disorder (Sud) Using Machine Learning, Jiawei Wu Jul 2024

Predicting Critical Risks And Long-Term Impact Of Covid-19 Patients With Substance Use Disorder (Sud) Using Machine Learning, Jiawei Wu

Dissertations (1934 -)

The crisis of substance use disorder (SUD), a problematic pattern of substance use that causes significant impairment or distress, is one of the most devastating threats to the public health system in the United States and it is ongoing. Opioid dependency or opioid overdose is a common drug use disorder and the number of deaths due to opioid overdose is increasing significantly during the COVID-19 pandemic because opioid use impacts mostly human respiratory, increases vulnerability to COVID-19, and further leads to higher morbidity and mortality. Other substance use disorders, including alcohol, cocaine, cannabis, and tobacco, will also exacerbate both physical …

Enhancing Security In Modern Medical Devices: The Medicalharm Methodology And Cyberllama2, Emmanuel Kwarteng Jul 2024

Enhancing Security In Modern Medical Devices: The Medicalharm Methodology And Cyberllama2, Emmanuel Kwarteng

Dissertations (1934 -)

With the rapid growth of Modern Medical Devices (MMDs) and their increasing connectivity to enhance patient care, concerns about security, privacy, and safety are paramount. If compromised, these devices can expose sensitive patient information and harm patients. Therefore, securing MMDs against cyber-attacks is critical. Threat modeling, mandated by the FDA as a premarket submission requirement in the MMD domain, serves as the first defense mechanism. However, our investigation of 119 participants from various MMD manufacturing companies revealed a need for a tailored threat modeling methodology that considers both patient safety and device complexity. To address this, we present MEDICALHARM, a …

Results of an adapted variation of Baxter Magolda and King’s (2001) Self-Authorship Survey (SAS) indicated that overall, when learning to cultivate a positive and supportive classroom environment, junior cohort study participants trusted the academia perspective of …

Intense, Repeated, And Ever-Present: An Initial Investigation Of Traumatic Invalidation Among Sexual Minorities, Zane Browning Ballard Jul 2024

Intense, Repeated, And Ever-Present: An Initial Investigation Of Traumatic Invalidation Among Sexual Minorities, Zane Browning Ballard

Dissertations (1934 -)

Lesbian, gay, bisexual, and queer individuals have been shown to experience significantly more negative health outcomes than do heterosexuals, commonly attributed to sexual minority stress. Research to date has insufficiently explained the processes by which stigma exposure becomes felt, internalized stigma and has not accounted for resemblance between presentation of mental health effects of sexual minority stress and of post-traumatic responses. Researchers have posited traumatic invalidation may partially explain the development and manifestations of reactions to sexual minority stress. The current study proposed and tested a measure of traumatic invalidation, conceptualized as instances of interpersonal, identity-based invalidation among sexual minorities. …

Negotiating Police Reform, Cynthia Alkon Jul 2024

Negotiating Police Reform, Cynthia Alkon

Faculty Scholarship

In the summer of 2020, after the murder of George Floyd, the national conversation around police reform intensified and was part of a conversation with students at Texas A&M University School of Law. Students wanted more discussion and teaching about police, police misconduct, police reform, and defunding the police. Following those discussions, I created a simulation on local level police reform that, as of this writing, I have used twice in my negotiation class. Simulations are helpful teaching tools in a variety of settings, including law schools. Simulations can be particularly useful to help students discuss difficult topics in different …

Whistle-Blowing And The Incentive To Hire, Jef De Mot, Murat C. Mungan Jul 2024

Whistle-Blowing And The Incentive To Hire, Jef De Mot, Murat C. Mungan

Faculty Scholarship

We consider a previously neglected cost of whistle-blower awards: employers may base their hiring decisions, on the margin, not on the productivity of an employee but rather on the probability that the employee will become a whistle-blower. We develop a three-stage model to examine how productivity losses due to distortions at the hiring stage influence optimal whistle-blower rewards. We characterize optimal rewards for whistle-blowing, and show that when rewards can be chosen according to either the benefits of the employer from offending or the productivity of the worker being hired, productivity-based rewards are superior to benefit-based rewards.

High–Strength Porous Tinbzrtafe Alloys Fabricated By Sintering Of Nanocomposite Powder Precursor With Space Holder Technique, Yuhua Li, Yuxin He, Rong Zhao, Libin Niu, Juxin Qu, Lai Chang Zhang

Research outputs 2022 to 2026

Although introducing high porosity in biomedical Ti alloys can reduce their elastic modulus and promote new bone ingrowth, relieving the stress–shielding effect and implant failure, this also causes a decline in the alloys’ mechanical strength. In this work, a new preparation method for the high–strength and high–porosity Ti65Nb23.33Zr5Ta1.67Fe5 (TNZTF, at.%) alloy was suggested by sintering nanocomposite powder precursor in combination with the use of a space holder technique, in which NH4HCO3 is adopted to achieve a porous structure. The highly porous TNZTF alloy possesses a homogeneous fine–grained microstructure consisting of equiaxed α–Ti and a small amount of FeTi2, the latter …

Guided by two research questions, the study first explores the antecedents and mechanisms of trust creation on these platforms and then examines how the global pandemic affected trust in these services. The findings reveal that structural assurance, privacy protection, and social influence (only for Uber) are key antecedents of trust. Trust, in turn, significantly influences perceived usefulness and the intention to use both platforms. The results also show that perceived risk, heightened by …

Legal Support For Local Election Officials, Rebecca Green Jul 2024

Legal Support For Local Election Officials, Rebecca Green

Washington and Lee Law Review

Local election officials (“LEOs”) face enormous pressure. They must administer elections when a wide swath of the American public has grown mistrustful of their work; they increasingly face ominous personal attacks and threats; they cope with chronic underfunding of elections; and they must navigate frequent changes in the law governing elections. Lawyers provide a critical avenue of support for local election officials. They provide guidance on how to implement legislative mandates and judicial orders; they anticipate and prevent disputes from arising; and they represent election officials when they or their offices are sued—a more common occurrence today than ever. Although …
