A Porpoise-Driven Approach: Using Agent-Based Models To Predict Population Consequences Of Offshore Wind Noises On Gulf Of Maine Harbor Porpoises, Ben Greenberg Pridonoff Jan 2025

A Porpoise-Driven Approach: Using Agent-Based Models To Predict Population Consequences Of Offshore Wind Noises On Gulf Of Maine Harbor Porpoises, Ben Greenberg Pridonoff

Cal Poly Humboldt theses and projects

Marine mammals are increasingly exposed to anthropogenic noises, including from offshore wind activities, necessitating the development and refinement of tools to predict the effects of noise on their populations. Agent-based models (ABMs) are an effective tool that can simulate realistic movements and behaviors of animals to quantify population consequences of disturbance. In this study, I used the Europe-based ABM ‘DEPONS’ to (1) evaluate its effectiveness in a new environment, the Gulf of Maine, USA/Bay of Fundy, Canada, and (2) develop estimates of the population dynamics of local harbor porpoises (Phocoena phocoena) interacting with expected noises from proposed floating …

Addressing Witness Coaching By Cross-Examination, Gregory C. Sisk Jan 2025

Addressing Witness Coaching By Cross-Examination, Gregory C. Sisk

St. Mary's Journal on Legal Malpractice & Ethics

In preparing a witness, may a lawyer script the testimony by taking the witness through repeated rehearsals to fabricate a narrative in the form directed by the lawyer and to use words that the lawyer suggests are more favorable for the represented party? Suppose the lawyer believes a suggestion to the witness regarding the specific substance or word choice of testimony does not introduce a falsehood but rather produces a more favorable spin on the witness narrative. May the lawyer justify that shaping of testimonial content as legitimate zealous representation of a client?

Given that any such suggestion by the …

Trading Places: An Education For Legal Employers: A View From The Perspective Of A New Generation Of Legal Talent, Michele N. Struffolino

St. Mary's Journal on Legal Malpractice & Ethics

Most lawyers remember the stress associated with walking into their first job interview. The goal being to get the interviewer to “pick me.” Today, legal employers need to be prepared to be more of the interviewee than the interviewer in the hiring process. Over the past few decades, much focus has been on identifying the skills essential to success in the legal profession—mainly those skills and traits legal employers view as important when hiring new associates. These findings led to changes in legal education in order to prepare law students for entering the employment market and successfully securing a position. …

I Am A Person Too: The State's Failure To Secure Transgender Rights And Personhood, Trevor L.M. Reynolds Jan 2025

I Am A Person Too: The State's Failure To Secure Transgender Rights And Personhood, Trevor L.M. Reynolds

Law Student Publications

The winds of change appeared to blow on June 15, 2020, when the Supreme Court decided Bostock v. Clayton County. The Bostock decision - in which the Court held that discrimination based upon an employee's gender identity violated Title VII of the Civil Rights Act - has been heralded as a revolutionary triumph for the LGBTQ+ community. And yet, while the Bostock decision dictated that employers cannot terminate people based on their gender identity, it failed in the most important regard: establishing gender identity as a protected constitutional class. The Court, however, is not unique in its failure to …

Roosting Habits Of Male Silver-Haired Bats In The Willard Creek Drainage Of Northeastern California, Alexander Christopher Lewis Jan 2025

Roosting Habits Of Male Silver-Haired Bats In The Willard Creek Drainage Of Northeastern California, Alexander Christopher Lewis

Cal Poly Humboldt theses and projects

Silver-haired bats (Lasionycteris noctivagans) are one of the most widely distributed forest bats in North America. Although wildfires have been increasing across their range, how they respond to wildfire is understudied. Previous studies on silver-haired bats and fire focused on roosting behavior in low-severity controlled burns or used acoustics to understand activity levels post-wildfire. Quantifying how silver-haired bats use the physical structures created by high-severity wildfires and the landscape features in which they occur is critical in the face of rapidly shifting fire regimes. During the summer of 2023 and 2024 I radio-tracked male silver-haired bats to 37 roosts …

Ethical Issues In Pandemic Prevention, Preparedness, And Response, Govind Persad Jan 2025

Ethical Issues In Pandemic Prevention, Preparedness, And Response, Govind Persad

Publications

Pandemic policies raise complex ethical challenges, as well as scientific and technical ones. This chapter examines four critical areas where ethical analysis is essential for effective pandemic prevention, preparedness, and response: spending decisions, clinical research, restrictions on rights and freedoms, and fair allocation of scarce medical resources.

Spending on pandemic prevention, preparedness, and response often involves trade-offs with other societal priorities, such as education, infrastructure, and environment. Navigating these trade-offs requires careful consideration of opportunity costs and distributional impacts.

Rights and freedoms can likewise present difficult trade-offs when pandemic policies restrict individual liberties, requiring clear goals and proportionate responses that …

Transforming Tax Expenditures, Sloan G. Speck Jan 2025

Transforming Tax Expenditures, Sloan G. Speck

Publications

For decades, reformers have advocated the repeal of tax expenditures--disguised government spending through special preferences in the Internal Revenue Code. And yet, tax expenditures persist, impairing federal tax receipts by more than $1.8 trillion in 2024. This Article introduces a novel mechanism for tax expenditure reform. To the extent that direct statutory repeal proves impossible or impractical, lawmakers can achieve an equivalent result through a strategy of legislative anti-repeal. By radically expanding a tax expenditure's legal scope, then adjusting progressive income tax rates to account for revenue loss and distributional considerations, lawmakers can effectively eliminate tax expenditures from the tax …

The Effect Of Fatigue On Climbing Fluidity And Hand Movements, Andrew Walsh, L. Seifert, C. Button, S. Vial, J. Croft

Research outputs 2022 to 2026

In rock climbing, climbers use their arms to regulate their posture on the wall, which can lead to localised muscle fatigue. Evidence shows fatigue is the primary cause of falls, but little is known about how fatigue specifically affects climbing rhythm and hand movements. The present study examined climbing fluidity and hand movements on an indoor climbing wall before and after a specific fatiguing protocol. Seventeen climbers completed three repetitions of a challenging climbing route (21 on Ewbank scale) with different levels of localised arm fatigue. Climbers’ movements were tracked using 3D motion capture, and their hand actions assessed using …

To effectively identify, respond to, and analyse these threats, it is essential to understand the cyber securityvulnerabilities in maritime systems and system-of-systems.Currently, there are no standardised methods or automated tools for conducting cyber security testing of maritime systems. This thesis presents an automated vulnerability scanning and security audit …

Bayesian Multilevel Models For Survival Data From Multiple Centres, Lingling Zhang Jan 2025

Bayesian Multilevel Models For Survival Data From Multiple Centres, Lingling Zhang

School of Engineering, Computing and Mathematics Theses

Recently, there has been an increasing use of flexible parametric survival models to analyse survival outcomes. Much of our work is based on a survival analysis model in which the baseline hazard function is modelled flexibly using an M-spline. Motivated by the analysis of a large kidney transplant data set supplied by NHSBT (NHS Blood and Transplant), we extend this baseline hazard function flexibility in various ways to allow a random effect for each transplant centre. After providing an introduction to survival analysis, we present an exploratory analysis of the NHSBT kidney transplant data. Next, we analyse the data using Bayesian …

A Testing Load: A Review Of Cognitive Load In Computer And Paper-Based Learning And Assessment, James Pengelley, Peter R. Whipp, Anabela Malpique

Research outputs 2022 to 2026

The rising use of technology in classrooms has also brought with it a concomitant wave of computer-based assessments. The argument for computer-based testing is often framed in terms of efficiency and data management: computer-based tests facilitate more efficient processing of test data and the rate at which feedback can be leveraged for student learning rather than being framed in terms of the direct effects that students experience from engaging with novel learning tools. Whilst potentially beneficial, for some students the outcomes of computer-based tests may be counter-productive. This review considers the cognitive, and often implicit, consequences of testing mode upon …

Steering Towards A Permanent Schism? The Establishment Of The Russian Orthodox Exarchate In Africa, Pål Kolstø Jan 2025

Steering Towards A Permanent Schism? The Establishment Of The Russian Orthodox Exarchate In Africa, Pål Kolstø

Occasional Papers on Religion in Eastern Europe

When the Ecumenical Patriarch granted the Orthodox Church of Ukraine autocephalous status in 2019, in what was hitherto recognized as the the canonical territory the Moscow patriarchate (MP), the Russian Orthodox Church (ROC) retaliated two years later by establishing an Exarchate in the territory of the Patriarchate of Alexandria, one of the churches which sided with the Ecumenical Patriarch. In a few years’ time ROC had recruited more than 200 clerics in Africa who formerly served in the Patriarchate of Alexandria.

By moving from verbal protests to confrontational action, Moscow has drastically reduced the possibility of finding a compromise solution. …

Metaphors And Myths: Using The Board Game Dixit To Understand The Autistic Lived Experience, Gray Atherton, Emily Dawson, Liam Cross

School of Psychology

Autism is a condition that takes on many meanings, particularly to those with lived experience. Exploring these meanings is paramount to being able to improve the way that autistic people are treated in the wider world. To further examine autistic lived experience, a new form of qualitative analysis was developed in line with the growing trend of gamification, or creating a game-like condition for exploring different domains. In this paper, we present Dixit-elicitation, a form of qualitative inquiry that uses the popular board game Dixit to interview autistic people about their experiences living with the condition. Themes and subthemes relating …
