The Transnationalisation Of Civil Society In East Asia’S War Redress Movement, Timothy Webster Jan 2025

The Transnationalisation Of Civil Society In East Asia’S War Redress Movement, Timothy Webster

Faculty Scholarship

Transnational human rights litigation is commonly associated with developments in Europe and the Americas during the 1990s. But Asian actors have used legal mobilisation to hold corporate actors to account since at least the 1970s. This chapter charts the first usages of transnational litigation in East Asia’s Word War II redress movement, akin to the Holocaust Restitution movement of the West. Korean and Chinese forced labourers liaised with Japanese attorneys, activists and academics to press compensation claims against Japanese corporations for wartime human rights abuses in Tokyo. Legal mobilisation did not succeed in the traditional sense. Yet, the formation of …

Title Ix And Athlete Compensation In The Postamateurism Era, Erin E. Buzuvis Jan 2025

Title Ix And Athlete Compensation In The Postamateurism Era, Erin E. Buzuvis

Faculty Scholarship

This Essay argues that Title IX applies to all manners of compensation that universities provide and facilitate to their athletes because of their athletic participation. This includes paying wages (when and if that becomes permissible), paying for NIL (when that permission takes effect), and facilitating payments from booster collectives that are working on those universities’ behalf (as happens now). The statute and its implementing regulations create a structure of substantive equality that is flexible enough to address even the changing landscape of college athletics as it applies to matters of compensation that were not contemplated by the drafters of the …

An Analysis Of Covid-19 Vaccine Hesitancy In The U.S., Hieu Trung Bui, Sandra Eksioglu, Ruben Proano, Sarah Nurre Pinkley

Industrial Engineering Faculty Publications and Presentations

Reluctance or refusal to get vaccinated, commonly known as Vaccine Hesitancy (VH), poses a significant challenge to COVID-19 vaccination campaigns. Understanding the factors contributing to VH is essential for shaping effective public health strategies. This study proposes a novel framework for combining machine learning with publicly available data to generate a proxy metric that evaluates the dynamics of VH faster than the currently used survey methods. The metric is input to descriptive classification models that analyze a wide array of data, aiming to identify key factors associated with VH at the county level in the U.S. during the COVID-19 pandemic …

How Theories Of Art Can Inform Debates About Ai, Jessica Silbey Jan 2025

How Theories Of Art Can Inform Debates About Ai, Jessica Silbey

Faculty Scholarship

Debates about artificial intelligence (AI) tend to swing between the optimistic and the apocalyptic. I propose a less binary approach that frames conversations about AI from the perspectives of theories of art and creativity. Whether we agree that AI is artificial or intelligent, whether it should be constrained or liberated, we cannot deny its influence on literary, artistic, and innovative production. AI may be described as simply a new tool to produce art and science, like the camera or the microscope, or it may transform art and science, the way the internet transformed global communication. Either way, these debates about …

Guided Autonomy: A Research-Based Approach To Improving Students' Wellbeing And Decision-Making In The Development Of Problem-Solving Skills, Jonathan E. Moore Jan 2025

Guided Autonomy: A Research-Based Approach To Improving Students' Wellbeing And Decision-Making In The Development Of Problem-Solving Skills, Jonathan E. Moore

Akron Law Faculty Publications

Law schools and the legal profession face a wellbeing crisis. Law students and lawyers suffer from high rates of depression, substance abuse, and job dissatisfaction. Research shows that cultivating autonomy—the sense of control over one’s own decisions and actions—is key to wellbeing and success in legal education and practice. Yet, fostering autonomy in new law students is challenging, as too much independence too soon can overwhelm learners and increase stress. This article introduces a “guided autonomy” approach for law students, with a focus specifically on legal writing courses. The article combines insights from Self-Determination Theory and Cognitive Load Theory to …

Approaches To The Synthesis Of Highly Substituted Arenes, Kh Tanvir Ahmed Jan 2025

Approaches To The Synthesis Of Highly Substituted Arenes, Kh Tanvir Ahmed

Graduate Theses, Dissertations, and Problem Reports (ETD)

While benzene rings and their derivatives are among the most frequently encountered ring systems in natural products, pharmaceuticals, agrochemicals, dyes, and functional materials, polysubstituted arenes are relatively scarce. The analysis of FDA-approved small molecules provides valuable insights into the characteristics of successful drugs while also highlighting gaps in the availability of synthetic methods capable of efficiently accessing diverse substitution patterns on aromatic rings. Highly substituted arenes are typically synthesized through sequential modification of a pre-existing benzene core; however, this stepwise approach becomes increasingly challenging with each additional substitution. An alternative strategy involves the direct construction of benzene rings via annulation …

Reprogramming Of Immunometabolic Functions In Brain Microvascular Endothelial Cells During Neuroinflammation: Insights From Ischemic Stroke And Sepsis, Shokofeh Rahimpourkaldeh Jan 2025

Reprogramming Of Immunometabolic Functions In Brain Microvascular Endothelial Cells During Neuroinflammation: Insights From Ischemic Stroke And Sepsis, Shokofeh Rahimpourkaldeh

Graduate Theses, Dissertations, and Problem Reports (ETD)

Ischemic stroke and sepsis-associated encephalopathy (SAE) are two distinct conditions that share common pathophysiological mechanisms affecting brain microvascular endothelial cells (BMECs). Ischemic stroke results from an acute reduction in cerebral blood flow due to thrombosis or embolism, leading to energy failure, oxidative stress, and blood-brain barrier (BBB) dysfunction. SAE, a neurological complication of sepsis, arises from systemic inflammation, endothelial activation, and BBB disruption, leading to cognitive impairment and neuroinflammation. Despite their different etiologies, both conditions involve BMEC dysfunction as a central mediator of neurovascular injury. This dissertation aims to investigate the immunometabolic dysfunction of BMECs in ischemic stroke and sepsis, …

Prioritizing Amd Impaired Watersheds For Watershed-Scale Restoration Using Multi-Criteria Decision Analysis, James Nicholas Marino

Graduate Theses, Dissertations, and Problem Reports (ETD)

Acid Mine Drainage (AMD) remains a significant environmental challenge in coal-mining and hard rock regions like West Virginia, degrading water quality and ecosystem health. Traditional site-specific remediation efforts often prove inefficient in addressing AMD at large scale. This study explores watershed-scale restoration as a more effective solution, leveraging centralized treatment facilities and multi-source pollution management. This study will follow Multi-criteria Decision Analysis (MCDA), specifically the Analytical Hierarchy Process (AHP), to develop a structured rubric for grading watersheds. The process involves identifying critical criteria, organizing them into a hierarchy, and generating weights for clusters of criteria through collaboration with decision makers. …

Creative Energies: Unearthing The Role Of Romantic Ecocriticism, Nicole Marie Chambers-Stahl Jan 2025

Creative Energies: Unearthing The Role Of Romantic Ecocriticism, Nicole Marie Chambers-Stahl

Graduate Theses, Dissertations, and Problem Reports (ETD)

The literary field of ecocriticism has transcended the boundaries of Academia: excited to connect to their physical environments, many of these scholars are focusing on genres like place-based writing, rhetoric of energy policy, and representations of the Earth in film and media. Interdisciplinary by nature, ecocriticism has demonstrated clear potential in its ability to intersect with concentrations like the history of science, animal studies, and environmental justice.

However, as the language around global crises is heating up —“Today it is scientists, not prophets,” writes Tobias Menely in “‘The Present Obfuscation,’” “who speak the language of apocalypse” (478)—ecocritical scholarship is at …

Using Visual Prompts To Analyze Ejection Fraction In Echocardiograms, Kevin Reisch

Graduate Theses, Dissertations, and Problem Reports (ETD)

Left ventricular ejection fraction (LVEF) is a critical biomarker for heart failure, but manual estimation from echocardiograms is time-consuming. Artificial intelligence can be used to accelerate this process, allowing clinicians to focus on other critical tasks. Current methods typically train models from scratch on echocardiogram datasets; however, this approach is limited by the scarcity of large medical imaging datasets, which are expensive and difficult to acquire. We present a transfer learning approach that leverages pretrained models from massive datasets, enabling continuous improvement as foundation models advance. Our method employs visual prompting to generate trainable masks for echocardiogram videos, transforming the …

Selective Recovery Of Critical Minerals (Ni, Zn, Co, And Mn) From Acid Mine Drainage Utilizing Ion Exchange And Selective Precipitation Processes, Esteban Albeiro Cardenas Restrepo

Graduate Theses, Dissertations, and Problem Reports (ETD)

Critical minerals (CMs) are essential for U.S. national security and technological development. The U.S. heavily depends on imports of these minerals from other countries, making supply chain disruptions a likely scenario. In consequence, finding alternative sources to conventional mining for these elements has become a topic of interest in recent years. Acid Mine Drainage (AMD), once solely viewed as an environmental problem, has emerged as a potential alternative source for CMs. AMD is a naturally occurring process where surface and underground water interact with sulfur-bearing minerals in the presence of oxygen and microorganisms. This interaction causes the water to become …

Improving Neuromuscular Blockade Surveillance In Anesthesia Care With Quantitative Train Of Four Monitoring, Carley S. Blair

Graduate Theses, Dissertations, and Problem Reports (ETD)

Problem Statement: Despite the availability of quantitative train of four (TOF) monitoring, anesthesia providers more frequently rely on tactile (qualitative) TOF monitoring, which is associated with underestimation of recovery from muscle relaxation. Inadequate recovery from muscle relaxants results in residual weakness and its associated complications in the postoperative period, including compromised respiratory function (Thilen et al., 2023).

Background: Neuromuscular blockade (NMB) drugs are required to facilitate endotracheal intubation and allow for surgical manipulation. When these drugs are used, train of four (TOF) stimulations are used to monitor and assess the depth and recovery from NMB. TwitchView monitors (quantitative monitoring) is …

The People Of The North: Influencer Histories And Miniaturization In Eleventh-Century Italy, Evan Anthony Simonetti

Graduate Theses, Dissertations, and Problem Reports (ETD)

The Norman invasion of Italy in the eleventh century was a process that required political support and legitimacy for its leaders, the Hauteville dynasty. The members of this dynasty either commissioned or financed three individuals as they wrote three respective histories of the Norman conquest in order to accomplish this legitimation. In these sources, each author took inspiration from the classic works of history and poetry of the Greek and Roman world and applied symbolism and direction from their understanding of medieval Christian theology. In addition, these works catalogued examples of events, people, places, animals, and behavior as exotic objects …

Parental Behavioral Control Across Domains In Indian And Indian American Families, Avneet Batra Jan 2025

Parental Behavioral Control Across Domains In Indian And Indian American Families, Avneet Batra

Graduate Theses, Dissertations, and Problem Reports (ETD)

Prior research literature has often found parental behavioral control to have mixed associations with varied adolescent outcomes (Bean et al., 2006; Finkenauer et al., 2005). However, a relatively lesser explored topic of research focusses on the domain specificity of this kind of control and its association with internalizing and externalizing behaviors in sample of Indian and Indian American parents (Arim et al., 2010). The current study adds to the limited literature by emphasizing the five domains of control (e.g., moral, conventional, prudential, personal and overlapping) based on the social cognitive domain theory and explores their association with adolescent adjustment outcomes …

The Article briefly also considers the topic of gravity and cyber-operations. (Abstract from author.)

Human Rights In Technology -- A Need For A New Norm, Els De Busser Jan 2025

Human Rights In Technology -- A Need For A New Norm, Els De Busser

Case Western Reserve Journal of International Law

The field of cyber security has relied on norms quite heavily to govern the behavior of states and non-state actors in cyberspace. However, existing norms do not offer guidance on integrating attention to human rights into the design and development of digital consumer products. This Paper introduces a way to foresee the human rights impact of new technology combined with a form of governance that regulates problems we do not know exist yet. (Abstract from author.)

"Old" Law For A "New" Frontier: The Sufficiency Of International Humanitarian Law In Outer Space, Christian Jorgensen Jan 2025

"Old" Law For A "New" Frontier: The Sufficiency Of International Humanitarian Law In Outer Space, Christian Jorgensen

Case Western Reserve Journal of International Law

As military capabilities and activities continue to expand into outer space, questions arise as to whether new legal frameworks are necessary to govern armed conflict beyond Earth. This Article argues that existing international humanitarian law (IHL) principles, including distinction, proportionality, necessity, and humanity, remain sufficient to regulate military operations in space. Rather than drafting new black-letter rules, states should focus on interpreting and applying current law in light of the unique characteristics of space warfare, including the enduring dangers of space debris and the widespread civilian reliance on satellite infrastructure. This Article examines the applicability of IHL in outer space, …

Sacrifice Zone: Conciliating Racial Discrimination In Louisiana's "Cancer Alley" Under The International Convention On The Elimination Of All Forms Of Racial Discrimination, Ellen Buerk

Case Western Reserve Journal of International Law

In June 2023, the Environmental Protection Agency (EPA) abandoned its civil rights investigation into racially discriminatory practices by Louisiana state agencies in Cancer Alley. It did so after issuing initial findings which indicated those agencies had operated in a racially discriminatory manner, subjecting predominately Black communities to adverse health outcomes resulting from air pollution. This action is one in a long line of violations by the United States of its obligations under the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) in Cancer Alley. In light of U.S. inaction in Cancer Alley, other parties to ICERD …

A Taking Or Public Interest Intent: Launching A Universal Standard For Indirect Expropriation, Naomi Matthusen Jan 2025

A Taking Or Public Interest Intent: Launching A Universal Standard For Indirect Expropriation, Naomi Matthusen

Case Western Reserve Journal of International Law

Outstanding note of the year 2025

In 2023, the Russian government announced drastic measures to take control over the management of specific foreign investments located in Russia in response to sanctions imposed on Russian assets abroad. These measures affected nearly onefourth of the largest 200 companies in the world. Expropriation clauses in bilateral investment treaties between nations exist to prevent the usurpation of foreign investments by host state governments, yet the standards for what constitutes indirect expropriation remain unclear and unpredictable and fail to adequately balance government and investor interests. This Note proposes and rationalizes a new definition for indirect …

New Treaty Law On Autonomous Weapons? An Opportunity To Reframe The Discourse, Laurie R. Blank Jan 2025

New Treaty Law On Autonomous Weapons? An Opportunity To Reframe The Discourse, Laurie R. Blank

Case Western Reserve Journal of International Law

Calls for a new treaty for autonomous weapons—or for any other new technology—stem from a concern at the most basic level: the concern that LOAC’s existing treaties are not sufficient to fulfill their core purposes of protecting civilians and other vulnerable persons and regulating the conduct of hostilities. Could treaties drafted in 1949—when air power was new and space a distant dream, when the first operational computer ran its first program and navigation relied on the compass and sextant—be sufficient for the complexities and challenges of the electromagnetic spectrum, artificial intelligence, quantum mechanics, machine learning, cyber, anti-satellite weapons, and other …
