A Perspective On Imbalance: A Memoir Through The Lens Of Eating Disorders Anonymous, Samantha C. Lasky Jan 2025

A Perspective On Imbalance: A Memoir Through The Lens Of Eating Disorders Anonymous, Samantha C. Lasky

Scripps Senior Theses

A Perspective on Imbalance uses a crab shell essay format within the adjusted framework of Eating Disorder Anonymous’ “Perspective on Balance” letter. This original letter speaks to how physical, social/emotional, and spiritual balance came to exist in the founder’s life after working the 12 steps of the program, but the author of this thesis felt more inclined to examine what life looks like in each of those categories before the 12 steps, as well as what happens when you choose not to work them (as this has been her experience thus far). The resulting linear prose essay includes themes of …

Introduction: This study uses the Exploration, Preparation, Implementation , and Sustainment (EPIS) model to retrospectively describe the mail-based overdose education and naloxone distribution (OEND) program developed in collaboration with the Kentucky Department of Corrections (DOC) for use in the HEALing Communities Study in Kentucky (HCS-KY) and details the reach of this innovative delivery model.

Methods: HCS-KY is a community-engaged cluster-randomized trial assessing the effects of implementing evidence-based practices, including OEND, on overdose death reduction across 16 communities highly impacted by the opioid epidemic in Kentucky. 6 The study launch coincided with the COVID-19 pandemic. All coalitions in the 16 HCS-KY …

Multi-Scale Computational Mechanical Modeling Of Complex Multi-Phase Materials Systems, Naji Al-Mashrafi Jan 2025

Multi-Scale Computational Mechanical Modeling Of Complex Multi-Phase Materials Systems, Naji Al-Mashrafi

Theses and Dissertations--Chemical and Materials Engineering

This thesis employs finite-element–based computational methods to investigate how microstructural features and material heterogeneity govern mechanical behavior across three distinct complex systems. First, the elastic response of open-cell metallic foams is analyzed using large ensembles of model RVEs generated with the Kentucky Random Structures Toolkit (KRaSTk); finite-element homogenization reveals that effective stiffness is not dictated by relative density alone, as the skewness of ligament-length distributions—captured by the second Pearson’s coefficient—exerts a strong and previously unrecognized influence, with structures enriched in short load-bearing ligaments exhibiting consistently higher stiffness even at fixed density and connectivity. The second study examines heterogeneous polycrystalline solids …

Insects, Ai Systems, And The Future Of Legal Personhood, Jeff Sebo Jan 2025

Insects, Ai Systems, And The Future Of Legal Personhood, Jeff Sebo

Animal Law Review

This Article makes a case for insect and AI legal personhood. Humans share the world not only with large animals like chimpanzees and elephants but also with small animals like ants and bees. In the future, we might also share the world with sentient or otherwise morally significant AI systems. These realities raise questions about what kind of legal status insects, AI systems, and other nonhumans should have in the future. At present, debates about legal personhood mostly exclude these kinds of individuals. However, I argue that our current framework for assessing legal personhood, coupled with our current framework for …

Is One Cow’S Waste Another (Hu)Man’S Treasure? Exploring The Environmental And Energy Impacts Of Manure Biogas, Katie Thompson Jan 2025

Is One Cow’S Waste Another (Hu)Man’S Treasure? Exploring The Environmental And Energy Impacts Of Manure Biogas, Katie Thompson

Animal Law Review

There is no question that manure biogas, a form of natural gas derived from animal waste, is quickly becoming the most valuable product supplied by factory farms, known also as concentrated animal feeding operations (CAFOs). Manure biogas can be used to produce heat, electricity, or transportation fuel, but its greatest profit stream rests in the myriad government credits and subsidies it can garner. Although turning trash into treasure by giving waste a new life may appear laudable and worthy of such investment, this Article argues that manure biogas is far from a sustainable solution to the United States’ environmental and …

The opaqueness of author naming and ordering, when coupled with power dynamics, can lead to a number of disadvantages in academic careers. In this commentary, we investigate gender differences in authorship experiences in a large prospective meta-analytic study (k = 46; n = 3,565; 12 countries). We find that women’s and men’s authorship experiences differ significantly with women reporting greater prevalence of problematic behaviors. We present seven actionable recommendations for improving the receipt and reporting of intellectual credit. Such actions are needed to ensure fairness in authorship, which is one of the most powerful factors in academics’ career outcomes.

Factory Farms And Labor Law: Can Unionization Get The Job Done?, Miranda Herreid Jan 2025

Factory Farms And Labor Law: Can Unionization Get The Job Done?, Miranda Herreid

Animal Law Review

At different moments in U.S. history, workers have joined together to fight for a better future. Now more than ever, as industries become increas-ingly consolidated and powerful, workers’ ability to band together and ad-vocate for their rights is integral. Recent victories in labor rights have not yet made their way to the industrial animal agricultural sphere. This is unfortunate, as the conditions at slaughterhouses and concentrated animal feeding operations are extractive and abusive towards workers and animals alike. In the past, strong union presence in slaughterhouses aided workers in achieving wage increases and job stability. However, this resulted in extreme …

Metallic Nanoparticles And Cosmetics: The Role Of Mitochondria And Premature Aging, Veronica Montesinos-Cruz, Justin Olmanson Jan 2025

Metallic Nanoparticles And Cosmetics: The Role Of Mitochondria And Premature Aging, Veronica Montesinos-Cruz, Justin Olmanson

Department of Teaching, Learning, and Teacher Education: Faculty Publications

The cosmetic industry has developed and commercialized numerous products using new technologies, making them increasingly appealing to the public. The use of metallic nanoparticles (MtNPs) as key ingredients in cosmetics has become more widespread due to their demonstrated benefits. However, the use of these products remains controversial, as some studies have shown that MtNPs can penetrate the deeper layers of the skin and disrupt homeostatic balance. It has also been demonstrated that the interaction between MtNPs and keratinocytes increases the generation of reactive oxygen species (ROS), which can lead to oxidative stress, a condition associated with premature aging. Mitochondria, as …

Convinced Or Pressured: Investigating The Effect Of Self-Esteem Levels And Majority Opinion Size On Jurors Conformity In Deliberations, Mia Draisin Jan 2025

Convinced Or Pressured: Investigating The Effect Of Self-Esteem Levels And Majority Opinion Size On Jurors Conformity In Deliberations, Mia Draisin

Scripps Senior Theses

Conformity has been shown to influence decision-making due to informational (knowledge seeking) and normative (social pressure) influence. Majority size is also related to conforming tendencies. In addition, self-esteem has been found to have a relationship with conformity. Individuals with low self-esteem have a fear of social rejection and partake in conforming behaviors. This study will illuminate the juror decision-making process and how external factors impair jurors' impartiality. This study will investigate how a juror's self-esteem level and the size of the majority opinion influence their likelihood of conforming during deliberations. It is hypothesized that individuals will be more likely to …

Cities In Transition: Insights From Three Latin American Cities On Urban Growth, Governance, And Sustainable Development, Abby Barahona Jan 2025

Cities In Transition: Insights From Three Latin American Cities On Urban Growth, Governance, And Sustainable Development, Abby Barahona

Scripps Senior Theses

In 2015, the Inter-American Development Bank reported that nearly 80 percent of the Latin American population lived in cities, a figure projected to reach 90 percent by 2040. In addition to being the most urbanized region in the world, Latin America is also the most unequal. This research explores the challenges and possibilities of equitable urban development in Latin America by evaluating how cities perform across four key dimensions: functionality, inclusivity, environmental sustainability, and aesthetic value. Drawing from historical context and case studies of El Alto (Bolivia), Brasília (Brazil), and Medellín (Colombia), this thesis examines patterns of urban growth shaped …

Methods: After completing the extensive in-house quality assurance checks including Winston–Lutz test and independent dose verification via MD Anderson IROC SRS head phantom irradiation on Halcyon, fifteen brain SRS patients previously treated with a single dose of 20 Gy on TrueBeam (6MV-FFF) with HyperArc geometry were retrospectively replanned on Halcyon (6MV-FFF). Plan quality metrics including conformity index (CI), gradient index (GI), gradient distance (GD), PTV coverage, gross tumor volume (GTV) dose, heterogeneity …

A Predictive Quality Assurance Model For Patient-Specific Gamma Passing Rate Of Hyperarc-Based Stereotactic Radiotherapy And Radiosurgery Of Brain Metastases, Shane Mccarthy, Brent Harrison, Damodar Pokhrel Jan 2025

A Predictive Quality Assurance Model For Patient-Specific Gamma Passing Rate Of Hyperarc-Based Stereotactic Radiotherapy And Radiosurgery Of Brain Metastases, Shane Mccarthy, Brent Harrison, Damodar Pokhrel

Radiation Medicine Faculty Publications

Objective: Measurement-based patient specific quality assurance (PSQA) is an increasingly debated topic among medical physicists. Developments like online adaptive radiotherapy and same-day stereotactic treatments limit the time to do measurement-based PSQA. Herein, we develop a predictive machine learning model to supplement PSQA by predicting the gamma passing rate (GPR) per stereotactic arc. This streamlines PSQA, providing planners the insight to replan potentially sub-optimal plans, to mitigate machine time inefficiencies.

Methods: 122 patients that had previously received HyperArc stereotactic radiosurgery/radiotherapy on a TrueBeam LINAC (Millenium 120 MLCs, 6MV-FFF) were used to generate a long short-term memory (LSTM) recurrent neural network to …

Feasibility Of Treatment Planning With Hyperarc Stereotactic Radiosurgery Methods For Ocular Tumors, Chase Cochran, Shane Mccarthy, William St. Clair, Damodar Pokhrel

Radiation Medicine Faculty Publications

Purpose/objectives

Currently, ocular disease is primarily managed with COMS plaque brachytherapy. Various stereotactic radiosurgery (SRS) platforms have also been employed, yet widespread access remains a challenge. Herein, we demonstrate the feasibility of using the HyperArc SRS system to provide an additional platform for the treatment of ocular malignancies.

Materials/methods

Twenty previously treated COMS patients with ocular melanoma were selected for a retrospective HyperArc SRS planning study. The average gross tumor volume (GTV) derived from MRI was 1.19 ± 0.60 cc. Planning target volumes (PTV) were generated from a 2 mm expansion of the GTVs. HyperArc plans were created for a …

Don’T Trust The Process: The Viability Of Eighth Amendment Claims For Ultra-Processed Food Overconsumption In Prisons, Markus C. Johnson, Rita L. Rahoi-Gilchrest

Marquette Law Review

With the largest prison population worldwide, American prisons serve more food than anywhere else. To cut costs, American prisons overwhelmingly (or even entirely) serve prisoners ultra-processed foods, which, if overconsumed, have detrimental and long-lasting health effects. Prisoners taking issue with the food being served to them rely on the courts to counteract any inappropriate prison dietary practices, wielding the Eighth Amendment as a constitutional guarantee to be free from cruel and unusual punishment. But courts are failing to protect this constitutional guarantee by relying on precedent that is at odds with modern Eighth Amendment principles. Indeed, when it comes to …

A City’S Day In Court: Using Class Action Principles To Protect Cities’ Due Process Rights, David Stage Jan 2025

A City’S Day In Court: Using Class Action Principles To Protect Cities’ Due Process Rights, David Stage

Marquette Law Review

In a recent trend in public law, municipalities are increasingly bringing “affirmative litigation,” suing large corporations to protect municipal residents and increase revenue. As affirmative litigation becomes popular among municipalities, more and more municipalities have found that their respective states (e.g., the State of Illinois for the City of Chicago) have already sued the would-be defendant for the same action. Because of the state’s prior action, the defendant can raise the common law defense of res judicata against the municipality to preclude the municipality’s lawsuit. If a defendant wants to raise the defense and preclude a subsequent lawsuit, then the …

Boden Lecture: Taxation Of Autonomous Artificial Intelligence, Reuven Avi-Yonah, Lucas Brasil Salama, Herbert Snitz, W. Robert Thomas

Marquette Law Review

This Article proposes that tax can be a useful supplement to other measures to regulate Autonomous Artificial Intelligence (AAI) and limit its potential harmful effects. This proposal differs from command-and-control regulation of AAI along the lines of European Union legislation that may unduly limit the development of AAI. It also differs from existing proposals to tax AAI to generate revenue to help workers displaced by AAI programs, or to tax the data used by AAI. The proposal is based on granting AAI programs like ChatGPT separate legal personhood, like corporate personhood, while incentivizing or requiring their corporate owner to place …

Substituting One Judge For Another: The Lax Standard Of Review In Involuntary Commitment, Caitlin Riordan Jan 2025

Substituting One Judge For Another: The Lax Standard Of Review In Involuntary Commitment, Caitlin Riordan

Marquette Law Review

Wisconsin involuntarily commits individuals at a rate nearly five times the national average, stripping them of core constitutional rights—including liberty, the ability to refuse treatment, and firearm possession. Yet, when these life-altering orders are appealed, they are almost always reviewed by a single appellate judge. This Comment argues that such a limited review undermines the constitutional weight of involuntary commitments, which closely mirror criminal convictions in the scope of rights deprived. Tracing the historical development of Wisconsin’s civil commitment statutes, this Comment demonstrates how commitments implicate both substantive and procedural due process concerns. It then compares Wisconsin’s one-judge review framework …

Straight From The Students: The Impact Of Law School Experiences On Professional Identity Formation, Megan Bess Jan 2025

Straight From The Students: The Impact Of Law School Experiences On Professional Identity Formation, Megan Bess

Marquette Law Review

Unlike other professions, there exists little research about the professional identity formation of law students. This process is key to professional socialization as they transition from student to lawyer. Research from other fields (notably medicine) and limited research on first-year law students suggest that authentic, real-world experiences have a significant impact on professional identity formation. With this hypothesis in mind, this Article presents data gathered from graduating law students about the impact of law school experiences on their ability to think and act like a lawyer. This research was conducted with a goal to aid law schools in directing professional …

Church Autonomy, Textualism, And Originalism: Scotus’’S Use Of History To Give Definition To Church Autonomy Doctrine, Carl H. Esbeck Jan 2025

Church Autonomy, Textualism, And Originalism: Scotus’’S Use Of History To Give Definition To Church Autonomy Doctrine, Carl H. Esbeck

Marquette Law Review

Church autonomy is a First Amendment doctrine altogether distinct from the more familiar causes of action brought under the Establishment Clause and the Free Exercise Clause. The principle of church autonomy was first recognized by the Supreme Court of the United States in the post-Civil War case Watson v. Jones, holding that civil courts must not be drawn into resolving religious questions or settling disputes over church polity. And early this century, in the unanimous decision Hosanna-Tabor Evangelical Lutheran Church & School v. EEOC, the theory of church autonomy took on its most fully developed form as a constitutional immunity …

Tik Tok! Tiktok: Escalating Tension Between U.S. Privacy Rights And National Security Vulnerabilities, Lawrence J. Trautman

Marquette Law Review

Vastly popular short-form video provider TikTok employs personalized content algorithms for each consumer. Because TikTok is controlled by the Chinese Communist Party (CCP) of the People’s Republic of China, a legitimate question exists whether TikTok constitutes a national security risk to the West like a number of influential and successful high growth social media platforms that have been used by nation-states during recent years for propaganda and disinformation purposes. Cyberattacks upon American interests have been attributed to China, Iran, North Korea, Russia, and others. Well-documented examples of foreign activity and exploitation resulting from disruption of the U.S. elections since 2016 …

Public Private Property, Xiaoqian Hu Jan 2025

Public Private Property, Xiaoqian Hu

Marquette Law Review

Many struggles are being fought in America today around regulation and redistribution of private property rights: between owners’ right to develop land and society’s need for environmental conservation; between landlords’ privilege to charge higher rents and society’s need for affordable housing, between property owners’ desire for protection from negative effects and unhoused persons’ need to live in the only space accessible to them, etc. These struggles, however, are doomed by a widely shared notion that public and private are inherent qualities in a zero-sum game. This Article refutes this notion. Building upon Legal Realist, post-Realist, and poststructuralist insights, it argues …

The Salvation Of The Unevangelized: A Comparative Analysis Of The Views Of Clark H. Pinnock And Millard J. Erickson, Christopher R. Mwashinga

Dissertations

Problem and Purpose

This dissertation addresses the problem of the ongoing disagreement among evangelical theologians, as represented by Clark H. Pinnock and Millard J. Erickson, concerning the issue of the salvation of the unevangelized. This disagreement continued even though both scholars focused on special revelation and general revelation as sources for information leading people to receive salvation. This approach failed to resolve the disagreement even after decades of heated theological debates indicating a need for a different approach to this soteriological problem. While other researchers have documented Pinnock’s and Erickson’s views on the salvation of the unevangelized, their motivations and …

A traditional engineering role is to design a safe product. Safety engineering is an exercise in harm avoidance ex ante. In contrast, liability attribution is an exercise to compensate for loss post hoc — traditionally viewed as a legal matter. We observe that, when a natural person incurs liability for a loss that exceeds insurance coverage, economic ruin can follow. Neither engineering nor law focus on the loss suffered by defendants considering law as a "safety risk." The highly automated vehicle (HAV) design space, however, provides an opportunity to prevent this kind of economic harm from occurring ex ante just …
