Landscapes Of Play: An Exploration And Illumination Of Children’S Unsupervised Play Close To Home And A Researcher’S Journey To Becoming Posthuman., Mandy Andrews

School of Law, Humanities and Social Sciences Theses

Title: Landscapes of Play: An exploration and illumination of children’s unsupervised play close to home and a researcher’s journey to becoming posthuman. Author: Mandy Jo Andrews This thesis explores children’s play experiences and engagements out of doors close to home. Adopting a Deleuzian informed posthumanism the researcher’s journey towards immanence prompts re-thinking about play, childhood-nature entanglements, and play-space-place-player generation. Children’s unsupervised play outside of organised settings such as school or adventure playgrounds is less researched than that of organised settings. This thesis puts to work Deleuze’s process philosophy and Barad’s agential realism, together with Haraway’s biology informed multispecies manifesto, Bennett’s …

A sample of 331 students and 12 teachers were conveniently selected from three schools from three parishes in Jamaica for the intervention group. The comparison group consisted of 180 students and seven teachers conveniently selected from two schools in central Jamaica. …

A Delicate Matter: The Madhouses Of The South West Of England, 1770 – 1851, Emma Barrett Jan 2024

A Delicate Matter: The Madhouses Of The South West Of England, 1770 – 1851, Emma Barrett

School of Law, Humanities and Social Sciences Theses

This thesis examines the private madhouses of Somerset, Dorset, Devon, and Wiltshire during a period of great transition within the existing lunacy care landscape. Many madhouses pre-dated county asylums in provision for the pauper mentally ill, including in the south west. Madhouses operated as an enterprise, unlike the parish overseen county asylums. This led to a lack of regulations in care. The Lunacy Commission was formed as part of the 1828 Madhouse Act. This led to a series of inspections of all asylums throughout England for the first time. At this time, Devon and Somerset had disproportionally high rates of …

Teaching An English Geography Curriculum Abroad: Who Is The Other?, Kay Chapman

School of Law, Humanities and Social Sciences Theses

In former British colonies, such as Sri Lanka, affluent families from that country may choose to send their children to international schools because they want their children to have a British education and qualifications and be taught by British teachers. This research investigates how some of the actors involved negotiate a geography curriculum constructed for sixteen year olds in England with pupils from Sri Lanka. This small scale, multi-method, qualitative study focuses on one geography department at one international school in Sri Lanka. Data collected includes in-depth interviews with a Sri Lankan teacher, British teachers at the school and an …

Democratic Accountability And Tax Enforcement, Joshua D. Blank, Leigh Osofsky Jan 2024

Democratic Accountability And Tax Enforcement, Joshua D. Blank, Leigh Osofsky

Faculty Publications

One of the most powerful charges that can be leveled against the IRS is that it is targeting taxpayers. Charges of political targeting have dogged the IRS for over a century, including in major controversies such as the alleged Tea Party auditing scandal in 2013. Commentators and scholars have long critiqued the IRS for focusing audit resources on some of the lowest-income Americans. And, most recently, a group of researchers estimated that the IRS audits Black taxpayers at a 2.9 to 4.7 times greater rate, as compared to non-Black taxpayers. In response, legislators demanded action, there was widespread public consternation, …

Debt, Race, And Physical Mobility, Kate Sablosky Elengold Jan 2024

Debt, Race, And Physical Mobility, Kate Sablosky Elengold

Faculty Publications

Residents in every state in the United States can lose their driver’s license or car registration because they owe debt to the state. At least eleven million people across the United States suffer these debt-based driving restrictions at any given time. Because Americans overwhelmingly rely on personal automobiles for transportation, states, by controlling access to driver’s licenses and vehicle registrations, use debt policy to control where and how people travel. And because these laws disproportionately affect people of color, primarily Black people, this kind of regulation props up racial segregation in both location and opportunity. This Article’s first contribution is …

Answering The Call Through An Inquiry Circle : English Educators Embark On A Journey To Become Antiracist, Lisa V. Kenny

Theses, Dissertations and Culminating Projects

This study examines a group of four English educators, two women of color and two white women, who self-identified as teachers for social justice as they formed a teacher inquiry group, called a teacher inquiry circle, as they attempt to become antiracist. The purpose of the inquiry circle was to answer the call to action for more equitable racially just schools that permeated the nation during the Covid-19 pandemic and after the murder of George Floyd in the summer of 2020. To conduct the study a feminist practitioner action research methodology was used, and a racial literacy framework was applied …

Originalism And Historical Fact-Finding, Joseph Blocher, Brandon L. Garrett Jan 2024

Originalism And Historical Fact-Finding, Joseph Blocher, Brandon L. Garrett

Faculty Scholarship

Historical facts are more central to constitutional litigation than ever before, given the Supreme Court’s increasing reliance on originalism and other modes of interpretation that invoke historical practice and tradition. This raises a central tension. The case for originalism has rested largely on the idea that it is simultaneously fact-bound and a theory of adjudication capable of resolving questions of constitutional law. In practice, however, the historical facts central to originalism typically are not litigated in accordance with standard practices for fact-finding: introduction at trial, expert testimony, adversarial testing, deference on appeal, and so on.

In the absence of the …

Bruen's Enforcement Puzzle: Unearthing And Adjudicating The Historical Enforcement Record In Second Amendment Cases, Andrew Willinger Jan 2024

Bruen's Enforcement Puzzle: Unearthing And Adjudicating The Historical Enforcement Record In Second Amendment Cases, Andrew Willinger

Faculty Scholarship

The Supreme Court’s 2022 decision in New York State Rifle & Pistol Ass’n v. Bruen brings historical complexity to the fore by instituting a history-focused test for the Second Amendment that demands analogues from the Founding or Reconstruction eras to support modern gun regulations. The majority opinion in Bruen considers, in multiple places, how certain historical gun regulations may have been enforced. In each instance, the Court suggests that evidence of racially disparate enforcement of a historical law is relevant to whether that law is part of the American historical tradition and an appropriate analogue. Historical enforcement data appear to …

As we approach an era of potentially widespread consumer neurotechnology, scholars and organizations worldwide have started to raise concerns about the data privacy issues these devices will present. Notably absent in these discussions is empirical evidence about how the public perceives that same information. This article presents the results of a nationwide survey on public perceptions of brain data, to inform discussions of law and policy regarding brain data governance. The survey reveals that the public may perceive certain brain data as less sensitive than other ‘private’ information, like social security numbers, but more sensitive than some ‘public’ information, like …

Growing Critical Information Literacy In Our General Education Program By Grounding Ourselves In An Ethics Of Care, Drew Wallace, Perri Moreno, Catherine Baird

University Libraries Scholarship and Creative Works

Montclair State University will begin implementing its new general education curriculum, known as Montclair Core, in the Fall 2024 academic term. Following years of collaborative conversations among university stakeholders, including the library, critical information literacy (CIL) was adopted as a foundational value in the new curriculum. Embedding CIL into the Montclair Core represents an incredible opportunity for the library to cultivate new partnerships and share our expertise more broadly with students and faculty. However, this opportunity also poses a number of challenges to an already under-resourced Research and Reference Services (RRS) department at the Harry A. Sprague Library. After years …

Peoples Of India: The Use Of Craniometric Data To Distinguish A Separate Ancestral Group, Stephanie A. Craig Jan 2024

Peoples Of India: The Use Of Craniometric Data To Distinguish A Separate Ancestral Group, Stephanie A. Craig

Graduate Student Theses, Dissertations, & Professional Papers

The Peoples of India come from an area with a long history of migrations into and out of the area. This area is considered the second most diverse genetically outside of Africa. Many would group these people as Asian due to the country’s location. However, when studies are done on the skeletal remains from this area, the remains tend to give results of mixed or indeterminate ancestry unless the analyst is familiar with identifying Peoples of India. This study aims to determine the Peoples of India as a separate ancestral group separated from Asians, Europeans, and Africans. To do this, …

Ambient Air Pollution, Hypertensive Disorders Of Pregnancy, And Geomasking In Montana, Elizabeth Rae Susanne Williams Jan 2024

Ambient Air Pollution, Hypertensive Disorders Of Pregnancy, And Geomasking In Montana, Elizabeth Rae Susanne Williams

Graduate Student Theses, Dissertations, & Professional Papers

Background: Air pollution is the world’s largest single environmental health risk. Particulate matter air pollution with aerodynamic diameter ≤ 2.5 μm (PM2.5) poses significant health hazards and has been increasing in some parts of the United States in recent decades due to increased wildfire activity. Prenatal exposure to PM2.5 may increase risk of hypertensive disorders of pregnancy (HDPs), though this has not been evaluated in a rural, wildfire-prone context. To develop recommendations to mitigate harmful health effects of PM2.5, more research is needed to understand the precise timing and dose of PM2.5 that is harmful to human health. Such research …

From Creek To Ditch And Back Again: The History And Future Of Pattee Creek, Missoula, Montana, Carver Edward Butterfield

Graduate Student Theses, Dissertations, & Professional Papers

Pattee Creek was once a free-flowing stream that meandered across the Missoula Valley, but has been channelized, piped, and degraded by logging, mining, agriculture, and urbanization. This thesis used a mixed-method approach to examine the impact of human activities on the Pattee Creek watershed. Beginning with a historical overview, the story of how the creek has been utilized and why it was buried was told. An analysis of historical photos from 1937 to 2019 revealed drastic changes in the land cover of the watershed and the channel of lower Pattee Creek. Developed land increased dramatically, while open land decreased and …

Dynamics Of Rural Water Quality And Wastewater Infrastructure: A Case Study Of Seeley Lake, Montana, Marie Watson Jan 2024

Dynamics Of Rural Water Quality And Wastewater Infrastructure: A Case Study Of Seeley Lake, Montana, Marie Watson

Graduate Student Theses, Dissertations, & Professional Papers

Wastewater infrastructure is a necessary component for societies to manage human waste and to maintain public health. At the same time, wastewater infrastructure is intricately tied to land use and development. Two primary types of wastewater infrastructure – septic systems and sewer systems – reflect and influence land use and development through density, mirroring the spectrum of rural and urban land use. In Seeley Lake, Montana, groundwater pollution in the form of nitrates is stemming from aging septic systems in the heart of the town. Stakeholders involved in water management aimed to address the issue by constructing a centralized wastewater …

Complexities Of Companionship: Exploring The Human-Dog Relationship Through Mtdna Analysis Of Bridge River Canine Remains, Seth Warnick

Graduate Student Theses, Dissertations, & Professional Papers

Dogs (Canis lupus familiaris) hold an unquantifiable level of cultural influence and companionship across swathes of societies all over the globe. While dogs are genetically very distinct from Homo sapiens, throughout human history the two organisms have spread across the world together and have biologically gone through similar selective, social, and environmental constraints. Today the biological makeup of dog breeds is incredibly diverse, however, the archaeological record and genetic research has provided insight into the humble beginnings of a relationship between humans and dogs that has transcended the fabric of emerging civilization itself. Located on the Northwest interior plateau, Bridge …

Shaping Outdoor Recreation In Protected Areas: Insights From Factors Influencing Brazilian Protected Area Professionals, Renata Burlamaqui Bradford

Graduate Student Theses, Dissertations, & Professional Papers

The growing demand for outdoor recreation (OR) in protected areas has led to positive and negative impacts on natural and social environments. As stewards of these areas, protected area professionals (PAPs) are responsible for planning and managing this complexity, and yet we know little about the factors influencing their decisions and actions. This study fills this gap by examining how psychological and organizational aspects influence PAPs’ decisions and behavioral intentions toward OR in protected areas. Insights come from the PAPs working at the Chico Mendes Institute for Biodiversity Conservation (ICMBio), the Brazilian federal agency. ICMBio’s evolving approach toward OR provides …

Local Visions For Patagonia: Drivers And Dynamics Of Collaborative Environmental Governance In Aysén, Chile, Zachary J. Hummel

Graduate Student Theses, Dissertations, & Professional Papers

Collaborative governance (CG) has emerged as a tool for addressing increasingly complex societal problems by engaging a diverse of set of cross-sector actors in a deliberative process with the aim of realizing consensus-driven outcomes. Emerson et al.’s (2011) Integrated Framework for Collaborative Governance (IFCG) attempts to improve understanding of these arrangements by articulating causal connections between collaborative drivers and dynamics across different contexts. Answering researchers’ call for more empirical support for the IFCG in non-US/European contexts, I used the framework to guide 10 interviews with collaborative governance practitioners in the comanaged marine protected area, AMCP-MU Pitipalena Añihue, located in Aysén, …

Ending The Doom Cycle: Redefining Historic Preservation And Reclaiming Total Heritage Through Community And Social Justice Advocacy, Nikki Marie Manning Jan 2024

Ending The Doom Cycle: Redefining Historic Preservation And Reclaiming Total Heritage Through Community And Social Justice Advocacy, Nikki Marie Manning

Graduate Student Theses, Dissertations, & Professional Papers

In the wake of a global pandemic and escalating societal challenges, yet another attempt to examine familiar debates about what we preserve and why and the typical arguments for and against historic preservation, seem inconsequential and disconnected from addressing more urgent societal needs such as systemic racism, inequality, police brutality, LGBTQ+ rights, economic and healthy disparities, and environmental justice. The field of historic preservation has the potential, and even obligation, to emphasize and create meaningful impact on larger issues. It should be highlighting and celebrating the diverse stories of people and places that define our community, and the history embodied …

Flyway Bottlenecks: Migratory Waterbirds Confront Diminishing Wetland Networks In Western North America, J. Patrick Donnelly

Graduate Student Theses, Dissertations, & Professional Papers

In the arid and semi-arid western U.S., migratory waterbirds (e.g., shorebirds, wading birds, and waterfowl) rely on wetland landscapes that function as nodes in broader continental habitat networks (e.g., flyways). Here, I integrate citizen science and GPS animal tracking technologies with satellite imagery and cloud computing to quantify the effects of climate and land use change on wetland ecosystems that sustain migratory waterbirds in the western U.S. Four decades of wetland surface water hydrology were first reconstructed from over 150,000 individual satellite images covering 3.1 million ha to track monthly changes in the extent and duration of wetland inundation. Results …
