The statutory framework which prohibits individuals at financial institutions from engaging in money laundering attributes criminal or civil liability on the basis of an individual’s culpability with respect to the prohibited conduct. A recent Department of Justice policy shift has begun to place a greater focus on the prosecution of individuals within corporations. This shift has led to increased prosecutions of compliance personnel and bank officials in recent years.

Protecting Crime Victims In State Constitutions: The Example Of The New Marsy's Law For Florida, Paul G. Cassell, Margaret Garvin

Journal of Criminal Law and Criminology

A majority of states have adopted state constitutional amendments protecting crime victims’ rights. Most of those amendments were adopted long ago and many fail to comprehensively address crime victims’ interests. In response to these shortcomings, the nation is seeing a new wave of state constitutional amendments protecting crime victims’ rights. Among these states is Florida, where in November 2018 Florida voters approved significantly expanded protections for crime victims in Florida’s Constitution—“Marsy’s Law for Florida.”

This Article explains in detail how Marsy’s Law for Florida provides important new protections for crime victims in the Florida criminal justice process. …

The New York Attorney General filed a lawsuit against Exxon Mobil on October 24, 2018, claiming the company committed securities fraud in order to prop up the value of the company by publicly disclosing a higher proxy cost—or projected future cost—of climate change regulation than the internal cost used. Following this lawsuit, a federal class action was filed utilizing the same legal theory on the same facts. These lawsuits should be viewed as part of the larger history of lawsuits against large fossil fuel companies for climate change-related harms. Leaders in the U.S. hospitality industry experience significant losses in profitability, increased mitigation cost, and reduced revenues because of business and consumer identity theft. Grounded in the fraud triangle theory and the fraud diamond theory, the purpose of this qualitative multiple-case study was to explore strategies leaders in the hospitality industry use to mitigate identity theft. A purposeful sample of 5 leaders of 5 different hospitality businesses in Montana participated in the study. Lie To Me: Examining Specific Intent Under 18 U.S.C. §§ 1001, 1035

One court notes that the Supreme Court of the United States (“SCOTUS”) has previously not found specific intent to be required under similar language within Section 1001.9 While there are many similarities between Sections 1001 and 1035, there are salient differences. Notwithstanding the differences, this Article argues that Sections 1001 and 1035 should be interpreted without “intent to deceive” and rather be interpreted as a strict liability offense. This argument began with Part I, which provided a brief introduction regarding specific intent under Sections 1001 and 1035. Auditors play a major role in corporate governance and capital markets. Ex ante, auditors facilitate firms’ access to finance by fostering trust among public investors. Ex post, auditors can prevent misbehavior and prevent financial fraud by corporate insiders. In order to fulfill these goals, however, in addition to having the adequate knowledge and expertise, auditors must perform their functions in an independent manner. Our activities, both online and offline, are increasingly monitored, converted into data, and tracked. These troves of data—collected by entities invisible to us, stored in disparate databases—are then aggregated, disseminated, and analyzed. Against Regulatory Stimulus, Erik F. Gerding

With political constraints on fiscal responses and monetary policy confronting the zero lower bound, policymakers may be tempted to turn to financial deregulation as a tool to stimulate economic growth in a recession, a strategy I label “regulatory stimulus.” This article creates a framework for answer two questions: first, whether and when regulatory stimulus is effective in promoting macroeconomic growth, particularly in a severe recession or liquidity trap; and second, if regulatory stimulus is effective, whether it is worth the potential trade-offs in terms of longer-term macroeconomic policy objectives.

การวิจัยเรื่อง แบบจำลองการคาดคะเนปัจจัยที่เป็นข้อบ่งชี้ลักษณะอาชญากรรมลูกผสมในสังคมไทย มีวัตถุประสงค์ในการวิจัยเพื่อ (1) ศึกษาปัญหาอาชญากรรมลูกผสมที่เป็นปัญหาสำคัญในสังคมไทย (2) สร้างแบบจำลองการคาดคะเนปัจจัยที่เป็นข้อบ่งชี้ลักษณะอาชญากรรมลูกผสมที่ใช้ในการจำแนก และอธิบายความสัมพันธ์และ/หรือหลักฐานในการยอมรับว่าเป็นอาชญากรรมลูกผสมในสังคมไทย และ (3) ศึกษาแนวทางในการป้องกันและแก้ไขปัญหาอาชญากรรมลูกผสมในสังคมไทย ผู้วิจัยใช้ระเบียบวิธีวิจัยแบบผสมผสานของการวิจัยเชิงปริมาณและเชิงคุณภาพ โดยเน้นการวิจัยเชิงปริมาณเป็นหลักสำคัญจากเจ้าหน้าที่ผู้ปฏิบัติงาน สำนักงานตำรวจแห่งชาติ และเจ้าหน้าที่ผู้ปฏิบัติงาน กรมสอบสวนคดีพิเศษ จำนวน 400 คน ซึ่งใช้วิธีการเลือกกลุ่มตัวอย่างจากการสุ่มกลุ่มตัวอย่างแบบง่าย เครื่องมือที่ใช้ในการวิจัยเป็นแบบสอบถามที่ผู้วิจัยสร้างขึ้น (IOC = 0.868, Reliability = 0.981) วิเคราะห์ข้อมูลโดยการหาค่า ความถี่ ร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน และวิเคราะห์ปัจจัยบ่งชี้ลักษณะอาชญากรรมลูกผสมในสังคมไทยโดยใช้ตัวแบบสมการเชิงโครงสร้าง ในส่วนของการวิจัยเชิงคุณภาพ ใช้เทคนิคการสัมภาษณ์เชิงลึกผู้ปฏิบัติงานระดับผู้บริหารหน่วยงานภาครัฐที่เกี่ยวข้องกับปัญหาอาชญากรรมลูกผสมในสังคมไทย จำนวน 15 คน ซึ่งใช้วิธีการเลือกกลุ่มตัวอย่างแบบเจาะจง เครื่องมือที่ใช้ในการวิจัยเป็นแบบสัมภาษณ์แบบกึ่งโครงสร้าง วิเคราะห์ข้อมูลโดยวิธีการวิเคราะห์เนื้อหา เพื่ออธิบายและยืนยันความถูกต้องของข้อมูลที่ได้จากการวิจัยเชิงปริมาณ รวมทั้งเป็นส่วนเสริมหรือส่วนเติมเต็มความสมบูรณ์ถูกต้องของงานวิจัย ผลการวิจัย พบว่า ปัญหาอาชญากรรมในสังคมไทยมีการปรับเปลี่ยนรูปแบบด้านปัญหาอาชญากรรมลูกผสมอยู่ในระดับมาก (ค่าเฉลี่ย = 4.18) ซึ่งเป็นอาชญากรรมมากกว่ารูปแบบเดียว ที่เกิดจากการผสมผสานกันระหว่างอาชญากรรมรูปแบบเดิมและอาชญากรรมรูปแบบใหม่ เป็นอาชญากรรมลูกผสมพื้นฐาน อาชญากรรมลูกผสมขั้นสูง อาชญากรรมลูกผสมอื่น ๆ และในอนาคต โดยปรากฏลักษณะสำคัญของปัญหาอาชญากรรมลูกผสมในมิติด้านต่าง ๆ ได้แก่ ผู้กระทำผิดหรืออาชญากรมีการรวมตัวกันเป็นเครือข่าย/องค์กรมากขึ้น ข้ามรัฐ/ไร้พรมแดน พึ่งพาเทคโนโลยี วิธีการที่หลากหลาย/ซับซ้อน ส่งผลกระทบในวงกว้าง ไม่จำกัดช่วงเวลาและสถานที่ สร้างการเลียนแบบ เข้าถึงเป้าหมายได้ง่าย ไม่จำเป็นต้องเผชิญหน้ากับเป้าหมาย คุ้มค่ามากที่สุดในการก่อเหตุต่อครั้ง เกี่ยวข้องกับการใช้ชีวิตประจำวัน ติดตามตัวผู้กระทำผิดมาลงโทษได้ยาก ทำให้สูญเสียบุคลากรและงบประมาณจำนวนมากในการปราบปราม ป้องกันและแก้ไข ซึ่งการสร้างแบบจำลองการคาดคะเนปัจจัยบ่งชี้ลักษณะอาชญากรรมลูกผสมในสังคมไทยตามสมมติฐาน มีความสัมพันธ์กับข้อมูลเชิงประจักษ์ (p-value = 0.881, Chi-square / df = 0.920, CFI = 0.95, GFI = 0.96, AGFI = 0.95, RMSEA = 0.000, SRMR = 0.040) สรุปได้ว่า ปัญหาอาชญากรรมลูกผสมในสังคมไทยได้รับอิทธิพลรวม …

This Article addresses a topic at the intersection of finance, agency, contract, and trust law: the pre-default duties of an indenture trustee for bondholders. The existing scholarship on indenture trustee duties focuses on the post-default scenario, when the indenture trustee is required to act as a prudent person in like circumstances on behalf of the bondholders. No prior scholarship addresses an indenture trustee’s predefault duties. It is critical to try to define those duties because activist investors in the $42-trillion-plus bond market increasingly are making pre-default demands on indenture trustees, requiring them to know how to respond.

evident that whistleblowers provide immense value to society.
Yet, for years, whistleblowers have been victims of retaliation,

As the Supreme Court continues to restrict the reach of private class actions, numerous commentators have championed public enforcement actions by state attorneys general (AGs) as a superior alternative to hold corporations accountable for misconduct. While AG actions fill some of the void left by the forced retreat of the private class action, few scholars have seriously considered whether the agency problems that exist in private class actions also occur in AG actions. And, until now, no scholar has recognized the unique agency problems that arise when AGs act together in multistate actions.
