The Impact Of Board Heterogeneity On Corporate Internationalization Strategy, Yi Qiang Nov 2022

The Impact Of Board Heterogeneity On Corporate Internationalization Strategy, Yi Qiang

Dissertations and Theses Collection (Open Access)

This study analyzes the relationship between board heterogeneity and the company’s internationalization strategy to determine the internal mechanism through which board heterogeneity affects the company’s internationalization strategy. Based on the analysis of the primary effect, the moderating effects of contextual factors at various levels, such as individual, organization, and environment, are introduced. Subsequently, this study empirically tests the proposed research hypothesis using the data of Chinese listed companies from 2011 to 2020.

The empirical results indicate that board heterogeneity has a positive impact on the company’s internationalization strategy. When the board chairman is female or has a longer tenure, board …

“Elder Scam” Risk Profiles: Individual And Situational Factors Of Younger And Older Age Groups’ Fraud Victimization, Katalin Parti Nov 2022

“Elder Scam” Risk Profiles: Individual And Situational Factors Of Younger And Older Age Groups’ Fraud Victimization, Katalin Parti

International Journal of Cybersecurity Intelligence & Cybercrime

In an attempt to understand how differently fraud works depending on a victim’s age, we have examined the effects of situational (lifestyle-routine activities), self-control, and sociodemographic variables on scam victimization across age groups. The analysis was carried out on a national sample of 2,558 Americans, representative by age, sex, and race, and includes additional factors such as their education, living arrangement, employment, and propensity for reporting a crime or asking for help. The results substantiate research findings of the contribution of self-control and LRAT in predicting victimization in general but could not identify major situational and individual differences between older …

Privacy Qui Tam, Peter Ormerod Nov 2022

Privacy Qui Tam, Peter Ormerod

Faculty Publications

Privacy law keeps getting stronger, but surveillance-based businesses have proven immune to these new legal regimes. The disconnect between privacy law in theory and in practice is a multifaceted problem, and one critical component is enforcement.

Today, most privacy laws are enforced by governmental regulators—the Federal Trade Commission, the nascent California Privacy Protection Agency, and state attorneys general. An enduring impasse for proposed privacy laws is whether to supplement public enforcement by using a private right of action to authorize individuals to enforce the law.

Both of these conventional enforcement schemes have significant shortcomings. Public enforcement has proven inadequate because …

Deceptive Appeals And Cognitive Influences Used In Fraudulent Scheme Sales Pitches, Rafael J. Toledo Oct 2022

Deceptive Appeals And Cognitive Influences Used In Fraudulent Scheme Sales Pitches, Rafael J. Toledo

USF Tampa Graduate Theses and Dissertations

Fraud schemes exploit the complex interplay that results from utilizing deceptive appeals to activate underlying cognitive influences. This study was designed, first, to identify the deceptive appeals present in the messaging of fraudulent schemes and, second, to identify the underlying cognitive influences being exploited by the deceptive appeals utilized. Findings reveal that effectively used deceptive appeals work to keep viewers’ mental processes in a state of cognitive ease. This state allows cognitive influences--such as heuristics, cognitive biases, and the System 1 mind--to remain in control of mental processing; however, System 1 is prone to accept deceptive beliefs. The results of …

P-01 Financial Reporting Fraud: How Merger And Acquisition Complexity Provide Greater Opportunities For Ceos To Engage In Wrongdoing, Carmelita J. Troy, Jong Chool Park, Madeline Domino Oct 2022

P-01 Financial Reporting Fraud: How Merger And Acquisition Complexity Provide Greater Opportunities For Ceos To Engage In Wrongdoing, Carmelita J. Troy, Jong Chool Park, Madeline Domino

Celebration of Research and Creative Scholarship

Using mergers and acquisitions (M&As) as a proxy to increase organizational complexity, we build upon Schnatterly et al.’s (2018) framework to addresses the gap in the management literature relating to how major firm disruptions, such as M&As, provide greater opportunities to entrenched CEOs for financial statement fraud due to higher levels of complexity. We extend the research on complexity-based information asymmetries (Ndofor et al. 2015) by empirically investigating whether accounting fraud is linked to M&As using a diverse set of variables. We propose the complex nature of M&A transactions result in higher information asymmetry, which provides a “veil” for self-interested …

Carrie Menkel-Meadow: Dispute Resolution In A Feminist Voice, Andrea Kupfer Schneider Oct 2022

Carrie Menkel-Meadow: Dispute Resolution In A Feminist Voice, Andrea Kupfer Schneider

Texas A&M Law Review

The presence of women in the law has changed the law’s substance, practice, and process. Carrie Menkel-Meadow, whose scholarship centers on this theme, is one such revolutionary woman.

Professor Menkel-Meadow, who I am proud to call my colleague, co-author, and friend (hereinafter referred to as Carrie), began her career in 1977 with a series of simple questions that sparked a breathtaking body of work. Carrie probed the depth of male domination in the realm of law and wondered what changes female representation might engender. In particular, she focused her inquiry on the value orientation each respective gender might bring to …

The Implications Of Fraud On Non-Shareholder Stakeholders, Chasen P. Spicer Oct 2022

The Implications Of Fraud On Non-Shareholder Stakeholders, Chasen P. Spicer

Senior Theses

Popular news outlets such as The New York Times or The Wall Street Journal frequently release articles detailing the financial losses incurred by shareholders of a company that have recently been publicly exposed for their fraudulent activities (Shumsky, 2018; Whitmire, 2005). Given that shareholders are visibly impacted by fraud, it is also reasonable to believe that other stakeholders experience repercussions from the fraudulent activities carried out by the company (Velikonja, 2013). To provide more insight into the implications of fraud incurred by non-shareholder stakeholders, I conduct a case study analysis of HealthSouth’s various fraudulent activities between the years of 1997 …

Fraud Detection In Financial Services Using Machine Learning, Khalifa Alsenaani Oct 2022

Fraud Detection In Financial Services Using Machine Learning, Khalifa Alsenaani

Theses

The banking industry is an important part of modern actions as it manages the movement of funds between different parties. However, this area is synonymous with some cases of fraud where people are being swindled their money, illegal transactions are being made and others.

The complexity of ensuring that transactions stay legitimate has since made it almost impossible to regulate fraud in this industry correctly. This report presents an approach that utilizes Machine Learning techniques to build a model that detects fraudulent transactions and flags them. The approach utilizes a dataset that contains a collection of observation points on transactions …

Semi-Parametric Bayes Regression With Network-Valued Covariates, Xin Ma, Suprateek Kundu, Jennifer Stevens Oct 2022

Semi-Parametric Bayes Regression With Network-Valued Covariates, Xin Ma, Suprateek Kundu, Jennifer Stevens

Faculty, Staff and Student Publications

Although there has been an explosive rise in network data in a variety of disciplines, there is very limited development of regression modeling approaches based on high-dimensional networks. The scarce literature in this area typically assume linear relationships between the outcome and the high-dimensional network edges that results in an inflated model plagued by the curse of dimensionality and these models are unable to accommodate non-linear relationships or higher order interactions. In order to overcome these limitations, we develop a novel two-stage Bayesian non-parametric regression modeling framework using high-dimensional networks as covariates, which first finds a lower dimensional node-specific representation …

Ip Addresses And Expeditious Disclosure Of Identity In India, Prashant Iyengar Sep 2022

Ip Addresses And Expeditious Disclosure Of Identity In India, Prashant Iyengar

Indian Journal of Law and Technology

Concomitant with the proliferation of cybercrime in India has been the use of Internet Protocol (IP) addresses by law enforcement agencies to track down criminals. While useful in many situations, the potential for misuse of this information raises important concerns for the privacy of individuals online. This note reviews the statutory mechanisms regulating the retention and disclosure of IP addresses by internet companies in India. It identifies and analyses the four broad sources to which the regime of IP Address disclosure by Internet Service Providers (ISP) may be traced: under the (i) operating licenses issued under the Telegrah Act, 1885, …

What’S The Use?: Interpreting The Term “Uses” In The Aggravated Identity Theft Provision, Shang-Chi Andrew Liu Sep 2022

What’S The Use?: Interpreting The Term “Uses” In The Aggravated Identity Theft Provision, Shang-Chi Andrew Liu

University of Chicago Law Review

The Identity Theft Penalty Enhancement Act (ITPEA) increases penalties for crimes that involve the unlawful use of another person’s identifying information. A subsection of the ITPEA—the aggravated identity theft provision—imposes a mandatory two-year sentencing enhancement on a defendant who “uses” a means of identification of another person during and in relation to a predicate felony. Currently, federal circuit courts disagree about whether the term “uses” in the statute is ambiguous and whether the rule of lenity should consequently apply to narrow its reach. On the one hand, courts that have held the statute to be ambiguous apply the rule of …

Six Ways To Misunderstand Precarity: Reflections On Social Angst And Its Political Offspring, Albena Azmanova Aug 2022

Six Ways To Misunderstand Precarity: Reflections On Social Angst And Its Political Offspring, Albena Azmanova

Emancipations: A Journal of Critical Social Analysis

These reflections develop a comprehensive conceptualization of precarity as a condition of politically and systemically generated economic and social vulnerability caused by insecurity of livelihoods – a form of disempowerment, experienced as incapacity to cope, itself rooted in a misalignment between responsibility and power. Precarity, thus understood, is a transversal social injustice cutting across differences in social class, education, employment, and income. It harms people’s material and psychological welfare and hampers society’s capacity to manage adversity and govern itself.

The article elaborates on the above conceptualization by addressing six fallacies in debates on precarity:

1: “There is nothing particularly new …

Prosecuting White-Collar Financial Crime: The Contrasting Cases Of The Us, Spain, And Ireland In The Aftermath Of The 2008 Global Financial Crisis, Justin Rex, Adam Panas

Indiana Journal of Global Legal Studies

Why have no Wall Street executives been prosecuted or convicted for actions that contributed to the global financial crisis? Scholars have documented a variety of legal, bureaucratic, economic, and political reasons for a lack of prosecutions, but one missing piece from this scholarship is a comparative perspective; other countries similar also experienced the effects of the crisis but convicted more financial executives than did the US. This article examines the financial crises and post-crisis responses in Ireland and Spain to see why they put more bankers in jail. The comparative analysis highlights several legal, economic, and political variables that partially …

Does The Financial Experience Of Sec Regional Directors Impact Sec Investigations Into Reporting Entities?, James Justin Blann Aug 2022

Does The Financial Experience Of Sec Regional Directors Impact Sec Investigations Into Reporting Entities?, James Justin Blann

Graduate Theses and Dissertations

The SEC’s Division of Enforcement is frequently criticized for its lack of oversight effectiveness, and certain vocal critics attribute this to a lack of financial experience within the SEC. Using hand-collected data on SEC regional directors, I find that the majority of these SEC officials lack financial experience. I then examine whether the financial experience of SEC regional directors impacts SEC investigations into reporting entities. Consistent with financial experience equipping directors to better process complex financial transactions and reports, I find that directors with financial experience open public company investigations 29 percent more often and conduct these investigations 34 percent …
