The Minnesota Vulnerable Adult Act Policy Analysis Of 1995 Reforms, Therese L. Buckley

Maltreatment of vulnerable adults is increasing at an alarming rate in the decade since the Minnesota Vulnerable Adult Act was passed in 1980. National estimates of elder maltreatment have risen by 50% in the last decade. Educated estimates of maltreatment are as high as 1.5 million incidents in the United States per year. The Minnesota legislature mandated in 1994 that the Minnesota Departments of Health and Human Services convene an advisory committee to make recommendations to the legislature on the means of preventing maltreatment of vulnerable adults. Malaysia is in the process of developing the Multimedia Super Corridor ("MSC"), a high-tech zone sometimes called "the Silicon Valley of the East." As a way of attracting investors to the MSC, Malaysia is adopting business-friendly policies and comprehensive "cyberlaws" designed to assure MSC participants that they and their technology will be protected. One of Malaysia's many goals is to be a leader in the development of cyberlaws. However, the Computer Crimes Act 1997 is too flawed to place Malaysia in that role. Forensic accounting is the integration of accounting, auditing, and investigative skills. This discipline has gained immense popularity in recent years. In fact, this field is expanding so rapidly that the number of qualified individuals in this area is not meeting its demand for job opportunities. On my plane flight to attend the American Association of Law Schools meeting at which Professor David Wilkins presented his paper, Do Clients Have Ethical Obligations to Lawyers? Some Lessons From the Diversity Wars, the pilot requested passengers to "assist the flight attendants in their principal duty of providing safety to all passengers," following a recent incident with mid-flight turbulence in which one person died and several were injured. The pilot reminded us that "service" was only a secondary function of the flight attendants, with their principal duty being to ensure that all of us traveled and arrived safely, …

This Article discusses how privacy may be invaded electronically on the Internet, tools available to protect oneself, and the state of the law regarding the rights of individuals to control the disclosure of their personal information. The author proposes "fair information practices guidelines" in the context of a comprehensive federal policy guaranteeing individual rights to the control of one's personal information.

Concern over the ethical behavior of accountants in public practice is legitimate. Willful misrepresentation of accounting information undermines the effective operation of economic institutions and social systems that rely on financial information. Such concern, fueled by salient instances of accounting failures, has prompted investigation by the federal government and research by both accounting institutions and researchers in academe.

One of the most critical claims coming out of these inquiries is that the accounting profession is controlled by a self perpetuating culture that too readily identifies with the interests of clients, as opposed to the needs of financial information users. Anecdotal …

United States V. Mcdougald: The Anathema To 18 U.S.C § 1956 And National Efforts Against Money Laundering, Mathew Paulose Jr.

This Comment argues that the Sixth Circuit should overrule McDougald. Part I discusses the purpose, process, and problems of the crime generally known as money laundering. Part I also discusses national efforts against money laundering, and in particular, the United States' efforts through Section 1956 of the Money Laundering Control Act. Part I concludes by discussing the Salinas-Citibank Affair and the probable prosecution of Citibank for money laundering violations. Part II reviews the Sixth Circuit's line of cases leading up to and including the McDougald decision. Part II also contrasts McDougald by reviewing the decisions of the United States …
