Auditor Reputation And Earnings Management: International Evidence From The Banking Industry, Kanagaretnam Kiridaran, Chee Yeow Lim, Gerald J. Lobo Oct 2010

Auditor Reputation And Earnings Management: International Evidence From The Banking Industry, Kanagaretnam Kiridaran, Chee Yeow Lim, Gerald J. Lobo

Research Collection School Of Accountancy

We examine the relation between auditor reputation and earnings management in banks using a sample of banks from 29 countries. In particular, we examine the implications of two aspects of auditor reputation, auditor type and auditor industry specialization, for earnings management in banks. We find that both auditor type and auditor industry specialization moderate benchmark-beating (loss-avoidance and just-meeting-or-beating prior year’s earnings) behavior in banks. In addition, we find that once auditor type and auditor industry specialization are included in the same tests, only auditor industry specialization has a significant impact on constraining benchmark-beating behavior. In separate tests related to income-increasing …

The Lion Awakens: The Foreign Corrupt Practices Act - 1977 To 2010, Michael B. Bixby

San Diego International Law Journal

This Article discusses the history, purposes and provisions of the Foreign Corrupt Practices Act, and traces its use and enforcement activity from 1977 to the present. This once little-used law has in recent years become the focus of aggressive activity by both the U.S. Department of Justice and the Securities and Exchange Commission. The manuscript also includes numerous charts reporting on key cases and enforcement activities over the last thirty-three years by the DOJ and SEC, as well as other information and statistics regarding the Foreign Corrupt Practices Act.

What Does Speed Have To Do With It?: An Analysis Of The Seventh Circuit's Application Of The Speedy Trial Act, Meagan S. Winings Sep 2010

What Does Speed Have To Do With It?: An Analysis Of The Seventh Circuit's Application Of The Speedy Trial Act, Meagan S. Winings

Seventh Circuit Review

A defendant's right to a speedy trial is ensured by the Sixth Amendment to the Constitution, as well as the Speedy Trial Act. The right was created to prevent oppressive pretrial incarceration, to minimize anxiety and concern of the accused, and to limit the possibility that the defense will be impaired. The Speedy Trial Act is to be interpreted in light of this purpose; however, the Seventh Circuit, along with the other circuits and the Supreme Court, has deviated from this principle.

The Seventh Circuit has applied the excludable days exception within the Speedy Trial Act so liberally as to …

Looking at Warfare through New Lenses

Interpreting the accretion of private and public violence in the midst of the American Civil War has long vexed historians, nearly as much as the civilians and soldiers who lived through it. For those who seek to explain the proliferation of intern....

The Rise In Elder Bankruptcy Filings And Failure Of U.S. Bankruptcy Law, John A. E. Pottow Aug 2010

The Rise In Elder Bankruptcy Filings And Failure Of U.S. Bankruptcy Law, John A. E. Pottow

Law & Economics Working Papers

Recent empirical legal scholarship on the consumer bankruptcy system has uncovered a marked rise in the proportion of elder Americans filing for relief under the Bankruptcy Code. But these studies have not probed the reasons behind that rise, an omission this Article seeks to address. Professor John Pottow and colleagues recently assembled the new dataset of the Consumer Bankruptcy Project (CBP), the largest national sample of consumer debtors in this country, which he uses to explore the sources of elder bankruptcy. The findings are both striking and ominous. While multiple factors, such as health problems and medical debts, contribute to …

Detecting Money Laundering And Terrorism Financing Activity In Second Life And World Of Warcraft, Angela S M Irwin, Jill Slay Aug 2010

Detecting Money Laundering And Terrorism Financing Activity In Second Life And World Of Warcraft, Angela S M Irwin, Jill Slay

International Cyber Resilience conference

In recent years there has been much debate about the risks posed by virtual environments. Concern is growing about the ease in which virtual worlds and virtual reality role-playing games such as Second Life and World of Warcraft can be used for economic crimes such as financially motivated cybercrime, money laundering and terrorism financing. Currently, virtual environments are not subject to the strict financial controls and reporting requirements of the real world, therefore, they offer an excellent opportunity for criminals and terrorism financers to carry out their illegal activities unhindered and with impunity. This paper demonstrates the need for suitable …

Illicit Associations In The Global Political Economy: Courtesan Politics, Arms Trafficking And International Security, Khatchik Derghoukassian Aug 2010

Illicit Associations In The Global Political Economy: Courtesan Politics, Arms Trafficking And International Security, Khatchik Derghoukassian

Open Access Dissertations

The accelerated trend of globalization has transformed the traditional role of the state. According to James Mittelman and Robert Johnston, the state is engaged in a courtesan role, which consists in shifting from serving citizens to acting as tacit partners in market relations, including with globally organized criminal groups. Building on the concept of the courtesan role of the state, this study addresses: (a) the general question of direct and indirect connections of states with illicit transactions in the post-Cold War, with a special attention to arms trafficking; (b) the reaction of the United States, as the remaining unique superpower, …

Internet Governance: A Developing Nation’S Call For Administrative Legal Reform, Surya Mani Tripathi, Anshu Pratap Singh, Dipa Dube

International Journal of Legal Information

The internet has emerged as a reservoir of information and has pushed the world to evolve into a global village. Increased communication across political, social and economic barriers has created a virtual society of its own. This networked society poses considerable challenges for Internet Governance. The Internet Corporation for Assigned Names and Numbers (ICANN) is the institution responsible for the internet management. ICANN has been at the center of the debates over global governance of the internet. Key concerns raised in these debates involve the legitimacy of institutions as well as the participation of developed and developing nations in Internet …

Dream Cities And Cardboard Worlds: Sayers' Moral Vision In Murder Must Advertise, Frances Fowler-Collins Jun 2010

Dream Cities And Cardboard Worlds: Sayers' Moral Vision In Murder Must Advertise, Frances Fowler-Collins

Inklings Forever: Published Colloquium Proceedings 1997-2016

Murder Must Advertise represents a turning point in Dorothy L. Sayers’s development as a writer and Christian thinker. Previously, she had depicted sinful individuals, but here she expands her moral vision to encompass social sin on a grand scale, focusing on advertising. The novel’s major structural device is the comparison of two groups: an advertising agency and a drug trafficking ring. Although these groups differ superficially, Sayers suggests they are fundamentally similar, as each is a “dream city” based on an illusion. They resemble each other in three ways. In both, a small group of people operates behind the scenes …

Lying And Getting Caught: An Empirical Study Of The Effect Of Securities Class Action Settlements On Targeted Firms, Lin (Lynn) Bai, James D. Cox, Randall S. Thomas Jun 2010

Lying And Getting Caught: An Empirical Study Of The Effect Of Securities Class Action Settlements On Targeted Firms, Lin (Lynn) Bai, James D. Cox, Randall S. Thomas

Faculty Articles and Other Publications

Private suits have long been championed as a necessary mechanism not only to compensate investors for harms they suffer from financial frauds but also to enhance the deterrence of wrongdoing. But many critics have claimed that there is a hidden dark side to the successful prosecution of a securities class action. In this paper, we shed light on these issues by examining whether the revelation of earlier misstatements, the initiation of private suit, and the payment of a substantial settlement, weaken the defendant firm so that the firm is permanently worse off as a consequence of the settlement.

We find …

Lying And Getting Caught: An Empirical Study Of The Effect Of Securities Class Action Settlements On Targeted Firms, Randall Thomas, Lynn Bai, James Cox

Vanderbilt Law School Faculty Publications

The ongoing Great Recession has triggered numerous proposals to improve the regulation of financial markets and, most importantly, the regulation of organizations such as credit rating agencies, underwriters, hedge funds, and banks, whose behavior is believed to have caused the credit crisis that spawned the economic collapse. Not surprisingly, some of the reform efforts seek to strengthen the use of private litigation . Private suits have long been championed as a necessary mechanism not only to ompensate investors for harms they suffer from financial frauds but also to enhance deterrence of wrongdoing. However, in recent years there has been a …

The Multienforcer Approach To Securities Fraud Deterrence: A Critical Analysis, Amanda M. Rose Jun 2010

The Multienforcer Approach To Securities Fraud Deterrence: A Critical Analysis, Amanda M. Rose

Vanderbilt Law School Faculty Publications

Participants in the U.S. capital markets can be sued for securities fraud by a mishmash of enforcers, including the SEC, class action plaintiffs, and state regulators. Does this multi-enforcer approach make sense from a deterrence perspective? This Article suggests that the answer is probably no. Although in theory there are conditions under which a multi-enforcer approach would promote optimal deterrence, it is unclear at best that those conditions exist in the United States. And further empirical research, while warranted, is unlikely to resolve the issue definitively. The status quo tends to persevere in the face of this sort of irreducible …

Advocatus, Et Non Latro? Testing The Supplier-Induced-Demand Hypothesis For Italian, Paolo Buonanno, Matteo M. Galizzi May 2010

Advocatus, Et Non Latro? Testing The Supplier-Induced-Demand Hypothesis For Italian, Paolo Buonanno, Matteo M. Galizzi

Fondazione Eni Enrico Mattei Working Papers

We explore the relationship between litigation rates and the number of lawyers, in a typical supplier-induced demand (SID) frame. Drawing on an original panel dataset for the 169 Italian courts of justice between 2000 and 2007, we first document that the number of lawyers is positively correlated with different measures of litigation rate. Then, using an instrumental variables strategy we find that a 10 percent increase of lawyers over population is associated with an increase between 1.6 to 6 percent in civil litigation rates. Thus, our empirical analysis supports the SID hypothesis for the Italian lawyers: following an increase in …

Racial Coding And The Financial Market Crisis, André Douglas Pond Cummings May 2010

Racial Coding And The Financial Market Crisis, André Douglas Pond Cummings

Law Faculty Scholarship

The financial market crisis of 2008 continues to plague the United States and countries around the world. The underlying causes of the 2008 collapse are numerous, intricate and complex. Academic scholars, investigative reporters and leading economists are now deconstructing the multiplicity of failures that enabled the breathtaking meltdown that nearly collapsed the global economy. As this thoughtful deconstruction emerges, a disturbing trend has forcefully surfaced, wherein dozens of writers, scholars and thinkers, motivated by politics, limelight and self indulgence, attempt to fix a singular or foundational cause as “the” reason for the market crisis of 2008. In a current political …

Battery And Abuse In The Elderly: A Forensic Analysis, Amy Y. Carney Phd, Mfs, Np May 2010

Battery And Abuse In The Elderly: A Forensic Analysis, Amy Y. Carney Phd, Mfs, Np

Dissertations

Elder abuse is a recognized social problem in the United States. First labeled as "granny battering" and originally studied under the umbrella of family violence, maltreatment of the elderly has received more funding and research in recent years. Multiple aspects of elder abuse have been examined in the literature including measures for detection, assessment, and documentation. Although studies have examined the circumstances surrounding abuse as well as theories of causation and characteristics of the abuser and the abused, studies of the relationship between the abuser and the abused are less well documented. The purpose of this research was to examine …

Race And Crime: Social Perceptions, Diana Teverovskaya May 2010

Race And Crime: Social Perceptions, Diana Teverovskaya

Honors College Theses

This study looked at whether White offenders are more likely to be socially accepted back into society as compared to their counterpart Black offenders, when both offenders commit the same crime. A sample of 120 Pace University undergraduate students were recruited. Acceptance of offenders was determined by using the Bogardus Social Distance Scale, which measures how much an individual would allow a criminal into their social circle. Participants received one of four fictional vignettes of either a White male or Black male committing one of two crimes: a white collar crime or a drug-related crime. It was found that, regardless …
