Fraud in public procurement is a big problem in public sector all over the world, and is very difficult to detect in empirical studies. Common fraud schemes include corruption, collusive bidding, failure to provide the required quality, and false statements, etc. In this paper, I employed game theory, machine learning, and statistical methods to detect fraud risk in Federal Procurement Contract Data, and studied the relationship of fraud, competition and contract types. Stream processing frameworks are designed to process the streaming data that arrives in time. An example of such data is stream of emails that a user receives every day. Most of the real world data streams are also imbalanced as is in the stream of emails, which contains few spam emails compared to a lot of legitimate emails. Fair Or Foul?: Sec Administrative Proceedings And Prospects For Reform Through Removal Legislation, Joseph A. Grundfest
Fordham Law Review
This Article catalogues the long list of criticisms of the Commission’s administrative proceedings. It also evaluates data describing the outcome of litigated matters and finds that, with the exception of insider trading cases, the Commission has an exceptionally high and statistically indistinguishable record of success in administrative and federal court proceedings alike. The data thus seem not to support the view that the Commission has a generalized home-court advantage in administrative proceedings. Nonetheless, the Commission’s virtually unfettered discretion in forum selection decisions, when it can assign cases to a forum that it controls, raises a plethora of institutional design concerns.

The study sets two objectives. The first is to investigate how an array of tourist misbehaviors was perceived by the young generations of the United States and China. The second is to examine factors that could explain any perceptual differences between young Americans and Chinese. Five research questions were developed and addressed for the first objective through online surveys by comparing the perceptions of American respondents and Chinese respondents on a list of tourist misbehaviors. The article explores the Roberts Court's approach to statutory interpretation, focusing on its adherence to the "new textualism," a methodology emphasizing the plain meaning of statutory text. While recent cases like King v. Burwell, Bond v. United States, and Yates v. United States appear to prioritize statutory purpose over textual meaning, the Court's reasoning reinforces its commitment to textualism by framing decisions within textualist methodology, even when outcomes seem to depart from strict textual interpretation.

Audit Committees And Financial Reporting Quality In Singapore, Yuanto Kusnadi, Kwong Sin Leong, Themin Suwardy, Jiwei Wang
Research Collection School Of Accountancy
We examine three characteristics (independence, expertise, and overlapping membership) of audit committees and their impact on the financial reporting quality for Singapore-listed companies. The main finding is that financial reporting quality will be higher if audit committees have mixed expertise in accounting, finance, and/or supervisory. In addition, we do not find evidence that incremental independence of audit committees enhances financial reporting quality because audit committees already consist of a majority of independent directors. Finally, we fail to find any impact of overlapping membership on audit and remuneration committees on financial reporting quality. Overall, the results have policy implications on improving …

Cyber-attacks on Internet users, and in particular senior citizens, who have limited awareness of cybersecurity, have caused billions of dollars in losses annually. To mitigate the effects of cyber-attacks, several researchers have recommended that the cybersecurity awareness levels of Internet users be increased. Cybersecurity awareness training programs are most effective when they involve training that focus on making users more aware so that they can identify cyber-attacks as well as mitigate the effects of the cyber-attacks when they use the Internet. There are plenty of noneconomic reasons to care whether victims are compensated in class actions. The traditional law-and-economics view, however, is that when individual claim values are small, there is no reason to care whether victims are compensated. Rather than compensation deterring wrongdoing is tort law’s primary economic objective. And on this score, law-and-economics scholars contend that only the aggregate amount of money that a defendant expects to pay affects deterrence. Sequences of individual words make up media reports. And sequences of media reports constitute the power of the news media to influence corporate practices. In this paper, we focus on the micro-foundations of news reports to elaborate how an atmosphere of negative news reports following an initial exposure of corporate pollution activity can help stop such activity through their impact on corporate managers. The Price Contagion Effects Of Financial Reporting Fraud And Reputational Losses: Evidence From The Individual Audit Partner Level, Ferdinand A. Gul, Chee Yeow Lim, Kun Wang, Yanping Xu

This study investigates the existence of price contagion effects for the low-quality audits of individual audit partners and the associated reputational losses in China. Low-quality partners are identified as those whose clients have been sanctioned by regulators for financial reporting fraud. Our evidence shows that sanctions induce a significant stock price decline among the contagion firms that share common low-quality partners and common low-quality audit firms; however, the decline is greater for the former. We also find that the price contagion effects of low-quality partners are more pronounced for firms located in regions with weak institutional development and less pronounced …

Retailers can profit from consumers’ social media presence in two ways: (1) through inadequate privacy laws; and (2) through retailers’ reposting of consumers intellectual property uploaded to social media sites. The California Legislature passed the Online Privacy Protection Act (CalOPPA), which moved towards protecting the privacy rights of consumers. However, the Legislature’s inability to hold retailers accountable under CalOPPA leaves consumers susceptible to the invasive technologies retailers use to collect social media users’ information, which they in turn sell and profit from. The Financial Crisis, which began in the United States on Wall Street in the fall of 2008, cost the global economy trillions of dollars, caused millions of people to lose their jobs, homes, life and retirement savings, and resulted in the collapse or taxpayer-funded government bailout of several century-old, storied financial institutions. The purpose of this study is to determine if Facebook® utilization impacts online victimization experience, and if prevention measures moderate such impact. This study primarily focuses on Facebook® users due to this social media outlet being considered the most prominent online networking site today (Milanovic, 2015). Reassessing Board Member Allegiance: Ceo Replacement Following Financial Misconduct, David M. Gomulya, Warren Boeker

Research summary: We examine how board members' reactions following financial misconduct differ from those following other adverse organizational events, such as poor performance. We hypothesize that inside directors and directors appointed by the CEO may be particularly concerned about their reputation following deceptive financial practices. We demonstrate that directors more closely affiliated with the CEO are more likely to reduce their support for the CEO following financial misconduct, increasing the likelihood of CEO replacement. Enactment of the Sarbanes-Oxley Act similarly alters governance dynamics by creating a greater expectation for sound corporate governance. We demonstrate our findings in U.S. public firms …

Market Failure And Reemergence: A Study Of Chinese Firms Listed In The Us., Hai Lu, Hai Lu, Wei Luo

Our study documents a “Lemons” market failure of Chinese firms listed in the US in 2011 and a subsequent rebound by 2013. Our tests reveal that there was little difference in ex ante observable characteristics of fraudulent and non-fraudulent Chinese firms listed in the US prior to 2011 while entrepreneurs appear to have known their type. We document substantial costs of dishonesty and the failure of traditional market signaling mechanisms such as auditor or underwriter quality. We also show a return of Chinese firms after US and Chinese regulatory intervention in 2013 although this intervention was insufficient to fundamentally change …

Does the punishment of one defendant change because of how she fares in comparison to the other defendants on the judge’s docket? This article demonstrates that the troubling answer is yes. Judges sentence the same case more harshly when their caseloads contain relatively milder offenses, and more leniently when their caseloads contain more serious crimes. I call this problem “punishing on a curve.”
Consequently, the article shows how such relative sentencing patterns put into question the prevailing practice of establishing specialized courts or courts of limited jurisdiction. Because judges are punishing on a curve, the court’s jurisdiction systematically shapes sentencing …

A focus on corporate culture, especially at financial institutions, has emerged as a regulatory, public, and media priority in the aftermath of the 2008 financial crisis. With Dodd-Frank, Congress embraced whistleblower statutes as a key instrument to improve corporate culture and governance, and to extirpate undesired and unethical business practices. Despite the clear policy goals, Dodd- Frank’s unclear statutory text has created interpretative controversies. Although Dodd-Frank adds anti-arbitration provisions to preexisting whistleblower statutes, it does not include a dedicated, standalone anti-arbitration provision for Dodd-Frank’s new whistleblower cause of action. Over the past decade, several different models of peer-to-peer lending have emerged in the US and U.K. Each of these models has developed in response to the different regulatory system it faces, which has led to the models’ different risk and reward profiles.
