Lessons In Movement Lawyering From The Ferguson Uprising, Maggie Ellinger-Locke
Human Rights Brief
Michael Brown was killed by Officer Darren Wilson on August 9, 2014. That day, I was on vacation in Michigan with my family, hanging on the beach and playing in the water. My father passed away from liver cancer exactly four months before, and I made the decision to close down his law practice in the St. Louis, Missouri area, and move to Washington, DC, where my longterm partner had taken a job. The trip to Michigan was supposed to be a stopover on my way to DC; my car was packed to the brim.
Criminalizing Environmental Degradation And Devastation: New Prospects For The Icc Rome Statute, Kelly Pisimisi
Criminalizing Environmental Degradation And Devastation: New Prospects For The Icc Rome Statute, Kelly Pisimisi
American University International Law Review
Over the last decade, steadily increasing voices are ringing the tocsin to the international community for the impact of human activities on climate and their potential consequences on human life and dignity. The Intergovernmental Panel on Climate Change (IPCC), in its recent (6th) Assessment Report, confirmed this assertion. Greenhouse gas concentrations and emissions (particularly CO2), as well as the retreat of arctic glaciers and the subsequent sea level rise causing—among other issues—the acidification of the oceanic waters, are some of the most evident human-induced implications on climate and the environment.
Evaluation Education In A World In Transformation: The Way Forward, Marcia Paterno Joppert
Evaluation Education In A World In Transformation: The Way Forward, Marcia Paterno Joppert
CGU Theses & Dissertations
The world has experienced rapid changes, leading to pressing issues such as environmental degradation, social inequality, and resource depletion. As a transdisciplinary field, evaluation has emerged as a crucial tool in addressing these challenges and promoting systemic change. However, concerns have been raised regarding the field's capacity to meet these expectations and the existing gaps in evaluation education. This research aims to address these gaps by exploring how formal evaluation education programs (EEPs) respond to the preparation of professionals for systems change evaluations, prompting discussions on the need to redefine the approach to teaching evaluation. The study adopts a sequential …

Strengthening Urban Resilience: Understanding The Interdependencies Of Outer Space And Strategic Planning For Sustainable Smart Environments, Ulpia-Elena Botezatu, Olga Bucovetchi, Adrian V. Gheorghe, Radu D. Stanciu
Engineering Management & Systems Engineering Faculty Publications
The conventional approach to urban planning has predominantly focused on horizontal dimensions, disregarding the potential risks originating from outer space. This paper aims to initiate a discourse on the vertical dimension of cities, which is influenced by outer space, as an essential element of strategic urban planning. Through an examination of a highly disruptive incident in outer space involving a collision between the Iridium 33 and Cosmos 2251 satellites, this article elucidates the intricate interdependencies between urban areas and outer space infrastructure and services. Leveraging the principles of critical infrastructure protection, which bridge the urban and outer space domains, and …

Dobbs, Right-Wing Revisionism, And Public Outrage: Rodrigo's Late-Night Chronicle, Richard Delgado, Jean Stefancic
American University Law Review
When we next see Rodrigo, he has been brought into town by Giannina’s women’s rights group. The Supreme Court had just decided Dobbs and revoked a constitutional right that had existed for fifty years prior. Giannina’s organization is meeting to discuss possible responses to the Dobbs decision. While he is in town, Rodrigo decides to seek out the professor, hoping to reconnect and pick his brain on this seismic shift in the legal landscape.

Faculty Contributions to Books
This paper explores the organizational theory, programs, and concomitant challenges faced by a state-level higher education consortium for sustainability in the United States, the Pennsylvania Environmental Resource Consortium (PERC). We provide insights for other institutions of higher education that may want to form consortia or consider changes to existing consortia. PERC members collaborate to advance sustainability on member campuses, in local communities, and across the Commonwealth. PERC envisions thriving, just communities on a healthy planet, and seeks to inspire higher education communities throughout the Commonwealth to lead transformational sustainability efforts through example, expertise, and collaboration. This chapter provides a brief …
Youth Voices For Human Rights Litigation In The Face Of Climate Change, Mckenzie Gallagher
Youth Voices For Human Rights Litigation In The Face Of Climate Change, Mckenzie Gallagher
Human Rights Brief
In the European Court of Human Rights (ECtHR), six young activists, age eleven to twentyfour, filed a case against thirty-two countries claiming violations of their human rights related to climate change. The Grand Chambers of the ECtHR heard the case, Duarte Agostinho and Others v. Portugal and Others, on September 27, 2023, but the court has yet to issue an opinion on the admissibility and merits of the claim. The case was granted priority status and deferred directly to the Grand Chambers due to the importance of the issue, climate change.

The stated goal of the workshop was to synthesize and coordinate UNH’s efforts on geoscience topics impacting the health and well-being of under-served communities locally and regionally. The workshop welcomed approximately 35 participants primarily from the University of New Hampshire, but with representation from the NH Conservation Law Foundation, US Geological Survey, and NH Department of Environmental Services. A keynote address was provided by Dr. Daniel Faber …
Movement Administrative Procedure, Evan D. Bernick
Movement Administrative Procedure, Evan D. Bernick
College of Law Faculty Publications
On April 4, 1946, The Potters Herald, a Thursday weekly dedicated to labor and union news, published an editorial warning readers of pending legislation “which may seriously affect labor” despite not containing a “single word about labor” in its text. This legislation would empower “anti-labor judges” to overturn decisions by the National Labor Relations Board. Despite its neutral appearance, it was in reality designed to “kick [labor and the NLRB] in the teeth” and would result in “a field day for the corporation lawyers.”
The complained-of legislation was the Administrative Procedure Act of 1946 (APA). From today’s vantage point, the …

The Intentional Community: Toward Inclusion And Climate-Cognizance, Shelby D. Green
Elisabeth Haub School of Law Faculty Publications
In adapting communities to new levels of fairness, we must resist the notion that building equitable and accessible communities is antagonistic to building climate-cognizant communities. This paper will raise some of the core points in this endeavor and will offer suggestions for finding harmony between the two ends through creating communities with intention.
In Part I, I offer some details on what climate change, if unheeded, portends most in our daily lives. In Part II, I tell tales of two cities to frame the larger discussion. In Part III, I highlight some social, political, and economic history that produced a …

Local Leadership Strategies To Mitigate The Effects Of The Public Charge Rule And Covid-19 Among Undocumented Immigrants, Amos Onyango Oketch
Walden Dissertations and Doctoral Studies
AbstractScholars have focused on the effects of implementing the federal-level Public Charge Rule (PCR) and COVID-19 on undocumented immigrants' health and socioeconomic well-being. Researchers have demonstrated that many federal assistance programs that benefit the general population in the wake of the pandemic exclude undocumented immigrants due to PCR restrictions; thus, they are disproportionately affected and suffer social and socioeconomic disparity. Researchers have yet to establish consensus strategies and interventions at the local and state levels to fill the gap and support disadvantaged communities during the pandemic to ensure equitable care and mitigate harm. Thus, this study aimed to identify the …
Faithful Democracy: Synthesising Religious And Political Practice In The Sydney Alliance, Rosemary Hancock
Faithful Democracy: Synthesising Religious And Political Practice In The Sydney Alliance, Rosemary Hancock
IES Papers and Journal Articles
This article examines the role religious institutions, communities, and individuals might play in democratising 21st-century cities. Based on participatory action research with the Sydney Alliance, a broad-based community organisation in Sydney, Australia, I examine how a civil society coalition attempts to draw religious communities into the political life of the city, the way religious culture and space shapes the political culture of the coalition, and the challenges faced by the coalition in working across religious and nonreligious difference. I argue that political coalitions like the Sydney Alliance that work across diverse worldviews are pulled in two different directions: the effort …

Synthesizing Energy Transitions, Nadia Ahmad, Uma Outka, Danielle Stokes, Hannah Jacobs Wiseman
Faculty Scholarship
This Article assesses the growing and cross-disciplinary literature on energy transitions to explore how it can guide law and policy reforms for the energy sector. The modern conception of energy transition centers primarily on clean energy—a shift away from fossil energy dependence. It also, however, incorporates equity as a core principle, as an increasing emphasis on energy justice and just transition seeks to create guiding norms for the energy sector’s current state of change. The concept of energy transition is critical for describing and giving meaning to a fundamental societal shift at the local, regional, national, and global scales, aligned …

Wildfires And Their Impacts On Immigrant Farmworker Women Of Childbearing Age, Rosa Gonzalez Juarez
Public Health Theses
Wildfires have been increasing in recent years due to the climate change that has been affecting the nation and across the globe. The Western part of the United States has been greatly affected, especially California. In 2022 there were 68,988 wildfires reported which consumed 7,577,183 acres nationwide, this was strikingly higher than the 10-year average (National Interagency Coordination Center Wildland Fire Summary and Statistics Annual Report 2022, 2022). The California Wildfires have been detrimental to its residents; however, they have specifically disproportionately affected the Latino population either due to the location of their homes, citizenship status or socioeconomic status (Rosenthal …

Climate Change And The Built Environment For Asian Americans, Sunny Sun
Public Health Theses
Although the relationship between climate change and the built environment is well-established, much less is known about the impact of this relationship on the health of Asian Americans. This study sought to identify available literature that discussed climate change and the built environment for Asian American populations. The majority of the 125 articles screened in (94%) were about Asian Americans and the built environment. Most (49%) articles used national level datasets or included multiple geographic regions, while others primarily represented the East and West Coasts. Nearly all (80%) of articles were published between 2010 and March 2023. Of the screened …
Towards Critical Environmental Justice Approach In Multicultural Divided States: Lessons From The Israeli Regulative System, Manal Totry-Jubran
Towards Critical Environmental Justice Approach In Multicultural Divided States: Lessons From The Israeli Regulative System, Manal Totry-Jubran
Fordham Environmental Law Review
This article draws upon the evolving framework of the Critical Environmental Approach in examining the conceptualization and manifestation of the Environmental Justice approach and its pillars within the regulatory system of multicultural and divided societies. These are states comprised of marginalized ethnic and minority groups that frequently face instances of social and environmental injustice. Employing this perspective through a case study show that gradual and anecdotic but unorganized and incoherent incorporation of Environmental Justice pillars lacks the capacity to effectively address long-standing historical environmental injustices and fails to challenge the prevailing social framework. In fact, it runs the risk of …

Honors Colleges, Transdisciplinary Education, And Global Challenges, Paul Knox, Paul Heilker
Honors Colleges, Transdisciplinary Education, And Global Challenges, Paul Knox, Paul Heilker
National Collegiate Honors Council Monographs: Chapters
The authors contend that the most significant comparative advantage of honors colleges is the combination of gifted and motivated students from every academic discipline and interdisciplinary curricula that train students to integrate diverse perspectives. The authors discuss how to harness this advantage to provide a truly transdisciplinary education through collaborative, project-based learning, both on campus and beyond. They assert that honors colleges are in a unique position to circumvent the siloed structures of academia by convening multidisciplinary groups of students guided by faculty from a wide range of disciplines. Doing so can help reimagine undergraduate education to address urgent and …

Polytech To Polytek: Traditional Ecological Knowledge, Indigenous Science, And The Future Forward Polytechnic University, Cutcha Risling Baldy, Kaitlin P. Reed, Kayla Begay
Humboldt Journal of Social Relations
It is clear from Cal Poly Humboldt’s Polytechnic Prospectus that Traditional Ecological Knowledge (TEK) and Indigenous communities are key parts of what elevates Humboldt’s development of a polytechnic university for the next century. The prospectus demonstrates Humboldt's proposed framework for a different comprehensive polytechnic "will also be informed by Indigenous communities and ways of knowing, as many Native peoples have lived sustainably in their places since time immemorial” (19). There are many considerations when engaging with TEK, especially around sustainable use. It is also important that engagement with TEK and Indigenous science not only center knowledge sharing, but also how …

Fostering Socio-Ecological Resilience To Wildfire By Interconnecting Knowledge Systems At Cal Poly Humboldt, Jeffrey M. Kane, Erin Kelly, Benjamin Graham, David Greene
Humboldt Journal of Social Relations
The wildfire-related challenges of Northern California and many other regions in the western United States are daunting in scope and magnitude. Ecologically and culturally salient solutions that limit the negative impacts of wildfire and promote resilience of human and ecological systems will require newer approaches. Through Cal Poly Humboldt and the Fire Resilience Institute, there is greater emphasis on the interconnection of knowledge systems across education, training, research, and management. Here we highlight several on-going efforts that seek to enhance the fire resilience workforce, promote socio-ecological resilience through interdisciplinary projects, and inform management through monitoring and research projects that intentionally …

In her presidential speech at the 2022 annual conference of the National Collegiate Honors Council, Christina M. McIntryre set the tone for this volume of Honors in Practice. Titled “The NCHC’s Inclusive Mission,” the speech cites an honors alumnus who contributed to the Forum on “The Value of Honors to its Graduates” (JCHC 23.1, spring/summer 2022). McInyre summarizes Quimby Wechter’s essay (145–47) by noting his appreciation of “the value of engaging in course material through meaningful experiential learning; of becoming a part of a community of scholars that is nurturing, not competitive; of classmates focused on challenging each other and …
