U.S. Department Of The Interior: Sharing Fair Data Fairly, Jason Earl Duke
Theses and Dissertations
Thousands of scientists, researchers, students, and organizations consume government-produced data daily that are often difficult to locate because they are collected and stored in multiples at varying levels of quality, inhibiting their usefulness for data science investigations and analysis. To address these challenges, United States Government agencies and bureaus have been implementing Findable, Accessible, Interoperable, and Reusable (FAIR) Data Principles into their data-sharing strategies since 2016. However, differing interpretations of the FAIR Data Principles lead to data that must be documented uniformly and adequately integrated for reuse. Select datasets have been analyzed with peer-reviewed FAIR assessment tools to establish a …

Establishing A Conditional Driver Permit In Texas, Luz E. Herrera, Taylor Garner, Crystal Hernandez, Lisa Mares

The article presents supporting data to expand access to state-issued driver permits for Texans who cannot provide the required documents to obtain a driver’s license. Part I examines the unlicensed and uninsured population in Texas that these efforts attempt to address. Part II discusses state jurisdiction to issue driver licenses and permits. It discusses existing Texas statutes that authorize the issuance of driver’s licenses and permits. The section also offers examples of other state statutes that have expanded their right to regulate driving privileges beyond Real ID Act requirements. Cryptocurrencies And Climate Change: A Net-Zero Paradox, Jason Maclean
Canadian Journal of Law and Technology
Cryptocurrencies pose a number of complex law and policy problems, the most pressing of which are the industry’s climate and environmental impacts. This article examines the climate and environmental impacts of crypto-assets in the broader law and policy context of the UN Paris Agreement and the global goal of reaching net-zero emissions by 2050 or earlier. This approach not only illuminates the limitations and paradoxical nature of the crypto-industry’s climate commitments, but also the limitations and paradoxical nature of ‘‘net zero” itself as the predominant framing of national, subnational, and nonstate actors’ climate pledges. This essay is a culmination of my personal experience as an Afro-Indigenous person while living in the Twin Cities for the past few years. This essay examines the public health hazard of Flint Michigan that affected tens of thousands of individuals predominately Black and African Americans. This event was not only systematic, but it portrayed a sense of racial bias and environmental injustice. Not only were Flint residents getting sick due to the unhealthy supply of water source but they were silenced. Unfortunately Black and African Americans felt undermined and oppressed. From Extractivism To Adjacency. A Research Manifesto, Margarita Palacios, Anette Baldauf
Emancipations: A Journal of Critical Social Analysis
This essay concerns with the ways in which extractivism continues to be reproduced in academic frameworks despite innumerous initiatives of decolonization. Engaging with artistic research and embracing a materialist approach that emphasizes embeddedness and embodiment, as well as acknowledging the affective-aesthetic flows that accompany research, the authors locate the heart of the problem at the disjuncture between critical epistemology and research practices. This disavowed space of knowledge production, they argue, is where the logics of extractivism and its racialized epistemic dualism are reproduced. Tackling the climate crisis requires transitioning from fossil fuel to clean energy, which will necessarily have a significant impact on jobs and the economy overall. The impact of this shift has sometimes been feared as a development that will be harmful to workers and the economy. Fossil fuel jobs are seen as good jobs--well-paid jobs with good benefits and protections--while the emerging clean energy industry has not yet uniformly embraced a high-road employment model. The recent dual crises of the COVID-19 pandemic and extreme heat in the Pacific Northwest have brought environmental injustices for food system workers into stark view. These events prompt us to reflect on how and why our existing laws, some of which expressly include environmental justice “tools,” failed to fully protect food system workers during times of crisis, and what changes we might implement to ensure that people employed in food system jobs are safe at their places of work. As many elements of a Green New Deal languished in Congress, economic policy took dramatic turns instead to address a different crisis: the Covid-19 pandemic. This Essay explores the way in which legal and policy responses to Covid-19 in the United States—particularly as discourse has focused on the impacts of Covid-19 response on labor markets—may provide insight into the political economy of a Green New Deal. New federal spending toward a just transition is structurally much easier to accomplish than developing new regulatory policy through legislation or executive action and avoids judicial policing of administrative authority.

Through a structured decision-making framework, this study aims to better understand the key factors influencing transportation adaptation planning in practice. Qualitative, semi-structured, in-depth interviews with various stakeholders were conducted to identify the main concerns, challenges, objectives, tradeoffs, and evaluation variables in transportation adaptation planning. Stakeholders were identified through preliminary interviews with transportation planning experts from the metropolitan planning organization using typical case and snowball sampling methods. Key aspects related to the major concerns, objectives, priorities, adaptation plan evaluations, implementation challenges, and potential conflicts and tradeoffs are identified. Major barriers to adaptation plan development and implementation include lack of resources, competing …

In 2019, Democrats won a majority in the House of Delegates and the Senate, and the Commonwealth was led by a Democratic Governor. The Democrats’ majority trifecta, which they had obtained for the first time since 1992, was once again lost on November 2, 2021, when Virginians voted to renew the Republican leadership in the Office of the Governor and in the House of Delegates. Under this once again bifurcated, yet unusually polarized, assembly, legislators on either side of the political aisle faced an uphill battle getting legislation passed, with the majority of bills ending in a stalemate.
