Investigating Disparities And Safety Equity In Pedestrian Nighttime Crashes In Michigan, Sia Isaria Mwende

For the past eleven years (2011 - 2021) in Michigan, 76 percent of all fatal pedestrian crashes occurred at night. Over the same period, about 36 percent of pedestrian nighttime crashes were fatal or incapacitating (KA), while only 25 percent of daytime pedestrian crashes were fatal or incapacitating (KA). Previous studies suggest that, overall, poor neighborhoods and racial minorities are associated with more pedestrian crashes. With more fatal and incapacitating pedestrian crashes occurring at night, it is imperative to examine how these crashes are distributed by economic status and racial makeup. Municipal Perspectives On Managed Retreat, Kristin Uiterwyk, Kimberly Starbuck

As coastal municipalities work to address the impacts of climate change, they need access to a variety of strategies. One under-utilized option is managed retreat. To better understand benefits and barriers to retreat, UHI conducted a survey of staff in coastal municipalities throughout Massachusetts. Responses from 47 municipalities showed that while some have considered retreat as a way to mitigate flooding and sea level rise impacts, few are implementing the strategy. The findings of this research, including open-ended responses in the appendix, can guide development of tools and resources to advance managed retreat.

Long-distance train travel in the United States is slow, inefficient and woefully underfunded. Trains are routinely delayed for freight traffic. Many major cities are served in the middle of the night, or not at all. And the cost of a sleeping compartment is far out of reach for most Americans. This is all in stark contrast to the reliable services offered across Europe and parts of Asia. But for the 3.5 million people who ride Amtrak’s long-distance trains every year, the experience can be a fulfilling one. Regulatory trading systems, such as the SO2 cap-and-trade system, are ubiquitous in environmental and natural resources law. In addition to cap-and-trade systems for pollutants such as SO2, NOx, and CO2, environmental and natural resources law uses trading in areas such as endangered species, water quality, wetlands, vehicle mileage, and forestry and farming practices. Trading, however, is rarely used as a regulatory approach in other areas of law. This Article seeks to identify the reasons for this dichotomy. Do societal power structures shape the organization of legal information? Do they embed biases in legal research tools? If so, how can the insights of critical legal theory assist us in contending with this phenome-non? An entire body of scholarly literature using the lenses of critical legal studies, feminist legal theory, and Critical Race Theory to examine legal information and the legal research process has grown up around answering these questions. However, the theories, methods, and strategies proffered by the scholars writing in this area are rarely taught in the legal research classroom.

BACKGROUND: Exposures to environmental contaminants can be influenced by social determinants of health. As a result, persons living in socially disadvantaged communities may experience disproportionate health risks from environmental exposures. Mixed methods research can be used to understand community-level and individual-level exposures to chemical and nonchemical stressors contributing to environmental health disparities. Furthermore, community-based participatory research (CBPR) approaches can lead to more effective interventions.

Ticketing Poverty: An Analysis Of The Discriminatory Impacts Of Public Intoxication By-Laws On People Experiencing Homelessness In Montreal, Emily Knox, Jeanne Mayrand-Thibert, Michelle Pucci

Municipalities like Montreal penalize what they consider public disturbances through by-law infraction citations, or “tickets,” that are issued to people experiencing visible homelessness at a disproportionate rate. This is a pattern we observed over the course of two years during our time at a legal clinic providing legal information to people in precarious housing situations. In this article, we propose that Montreal’s by-laws prohibiting public drinking and public intoxication adversely impact unhoused people and are discriminatory under the Quebec Charter of Human Rights and Freedoms, a quasi-constitutional human rights instrument unique to Quebec. Background and Objectives
As climate change drives more frequent and intense weather events, older adults face disproportionate impacts, including having the highest mortality rates from storms, wildfires, flooding, and heat waves. State governments are critical in deploying local resources to help address climate change impacts. This policy study analyzes states’ climate adaptation plans to assess the methods through which they address the impact of climate change on older adults.

This study described the roles of the Armed Forces of the Philippines (AFP) in Disaster Risk Reduction Management (DRRM) in Metro Manila and how climate-induced hazards impact the role of the military. It used a qualitative approach, which involved semi- structured interviews among AFP officers and barangay leaders with expertise and experience in DRRM and an analysis of selected policy documents and military doctrine. These methods revealed that: (1) the military acts as a political first-aid, since they are the first responders – thus, the face of the local government – in climactic disasters during peacetime; (2) the military is …

Indigenous people are particularly at risk of water scarcity in the U.S. and abroad, and face high rates of nonexistent or failing water infrastructure, water pollution, pipeline proposals that threaten water resources, and water-related climate change impacts. They also are often unequipped, politically and economically, to react and adapt to these impacts, resulting in devastating health impacts. Due to this widespread insecurity, many scholars are calling for the application of a theory and set of principles known as water justice. The Fremont Bridgehead Reclamation Project aims to promote the redesign of Kerby Avenue I-405 Freeway ramps and the return of ODOT land to community-oriented uses with the hopes of providing economic restitution to displaced community members. It intends to offer an action roadmap to advance the case for ramp redesign and potential alternatives for reclaimed land uses. Collaborating with the Eliot Neighborhood Association, the student team formulated recommendations, actionable steps, and future visions for the site based on stakeholder interviews and engagement feedback. This article disrupts the false narrative of white supremacism that has, for more than a century, cast American land use law as race neutral. In doing so, this article builds on an important but underdeveloped body of legal scholarship elucidating zoning law’s role in creating and perpetuating a separate and unequal dual housing system. It provides primary historical evidence and a clear narrative demonstrating that the defining feature of American zoning law—a strict residential use taxonomy that privileges neighborhoods of restrictively regulated single-family homes and burdens less restrictively regulated residential areas—emerged directly from the facially race-based and facially neutral, but …

The community reclaimed an abandoned plot of land over 25 years that was being used for drug deals and prostitution. The community changed it into a community garden celebrating the various cultures from South America. This study investigated the implementation of culturally humble art therapy directives centered around identity development and social justice with adolescents. Intersectionality theory was applied to examine the ways operating from a culturally humble lens benefits clients and art therapists. Existing research supports the application of cultural humility with various populations as a method of validating client’s experiences and strengthening the therapeutic alliance. A series of art therapy interventions were implemented at a private non-profit children's psychiatric hospital with the adolescent inpatient units. Florida has been designated as a hotspot for sea level rise by NASA (Hamlington et al., 2022) and is likely to experience more frequent and severe storm events (EPA, 2020), increasing pollutant mobility in contaminated developed land, such as Brownfield sites (Crawford et al., 2022). Disadvantaged communities and minorities are more vulnerable to the effects of sea level rise and storms surges, and they are more likely to live in proximity to Brownfields (Marcantonio et al., 2020; U.S. EPA, Office of Land and Emergency Management, 2021). Toward Mutual Recognition: An Investigation Of Oral Tradition Evidence In The United States And Canada, Kalae Trask

United States (“U.S.”) courts have long failed to recognize the value of oral traditional evidence (“OTE”) in the law. Yet, for Indigenous peoples, OTE forms the basis of many of their claims to place, property, and political power. In Canada, courts must examine Indigenous OTE on “equal footing” with other forms of admissible evidence. While legal scholars have suggested applying Canadian precedent to U.S. law regarding OTE, scholarship has generally failed to critically examine the underlying ethos of settler courts as a barrier to OTE admission and usefulness.
