The Hidden Power Of Struggling; When Women At The Crossroads Between Nature And Culture, Dina Amalia Susamto, Erlis Nur Mujiningsih, Purwaningsih Purwaningsih, Dian Susilastri
Wacana, Journal of the Humanities of Indonesia
Women and nature have a bonding which reflect the connectedness between humans and non-humans. The exploitation of women affects nature and vice-versa. The novels Entrok, written by Okky Madasari, Tarian Bumi by Oka Rusmini, and Trilogi Ronggeng Dukuh Paruk by Ahmad Tohari narrate the experiences of women struggling to survive in cultures dominated by the patriarchal system. This article uses qualitative research methods to describe data about the women’s experiences of their encounters with exploitation in these three novels. All data were decoded using the ecofeminism theory. The results show that their nurturing character is a power in …

The End Externalities Manifesto: Restatement, Loose Ends, And Unfinished Business, J.B. Ruhl

Professor J.B. Ruhl observes in his article, “The End Externalities Manifesto: Restatement, Loose Ends, and Unfinished Business,” that Elliott and Esty’s proposal for a rights-centric system of environmental law focuses narrowly on a right to recover compensation for harms to human health caused by pollution. He offers suggestions for implementing that proposal, such as using the concept of ecosystem services to trace how harm to ecosystems can cause harm to human health, and he proposes how Elliott and Esty could extend their rights-centric system to a broader conception of human rights and the environment.

Professor Monika Ehrman provides a pragmatic response to Elliott and Esty’s proposal to end all environmental externalities, which she refers to as an “environmental law moonshot.” She examines the value of transforming environmental law and dreaming big as Elliott and Esty recommend, while discussing the practical considerations of doing so. Her considerations include incentivizing technological advancement, compensating environmentally harmed communities to address systemic issues, and breaking down silos in environmental law.

A Balanced Prescription For More Effective Environmental Regulations, W. Kip Viscusi

Government agencies increasingly base the structure and approval of environmental regulations on a benefit-cost test. For regulations that pass this test, total benefits exceed total costs. Under a benefit-cost framework, the degree of regulatory stringency is set at an economically efficient level whereby the tightness of the regulation is increased up to the point where the incremental benefits equal the incremental costs. Setting regulatory standards to achieve the efficient degree of pollution control does not fully discourage entry into polluting industries, provide compensation to those harmed by pollution, or establish meaningful incentives for effective enforcement. In this issue, Professors Elliott and Esty expand on their original proposal and respond to critics.2 They apply their perspectives as practitioners, as well as academics, to develop their vision for environmental law in the 21st century. They establish three legal duties that should apply to entities that release potentially harmful materials into the environment. The Role Of Corporations In Solving The Illegal, Unregulated, And Unreported (Iuu) Fishing Crisis, Hunter F. Donovan

This article examines the current domestic and international legal framework that provides protections against the effects of IUU fishing as well as the social, economic, and environmental effects of those activities. Domestically, this article examines the Magnuson-Stevens Act for its lack of efficacy in managing IUU fishing in US-controlled waters. Internationally, this article examines a variety of UN resolutions and treaties that seek to manage this crisis but have a minimal effect. Additionally, this article proposes various ways policies could be amended or adopted to best serve the communities that are most impacted by the effects of IUU fishing. Finally, …

The study of speculative designs (such as futures, critical design alternatives, or catalysts for reflection) is well documented in the design research community but the literature lacks attention to speculative designs in the service of a pedagogical practice. This paper reports on a two-year cross European research project investigating speculative designs in higher education contexts. We reflect on a broad data set including interviews, surveys, case studies and workshops involving educators and students. This dissertation presents three individual studies that collectively explore the concept of urban sustainability. The research is grounded in the recognition that many cities worldwide are striving to achieve sustainable development, yet existing sustainability frameworks often lack comprehensive definition and consideration. Moreover, the existing sustainability frameworks and methods are often not clearly structured to allow for their replication and adaptation to meet the unique needs of diverse local settings. To address this gap, the dissertation utilizes the Social-Ecological-Technological Framework, with particular emphasis on equity, to investigate key issues in urban sustainability, such as indicators, stakeholder engagement, tradeoffs, and assessment. The Real Energy Burden: Exploring The Intersection Of Equity And Home Energy Efficiency In Vermont, Nathaniel G. Roe

This thesis quantifies the financial burden induced by a home energy efficiency and electrification project through a new metric, the real energy burden (REB). REB captures the percentage of income allocated to the annualized capital cost and the annual energy expenditure of an energy efficiency project. To characterize and demonstrate the use of REB, I draw data from the National Renewable Energy Laboratory ResStock Housing Stock tool to simulate a 2023 energy efficiency and electrification project for three Vermont household archetypes: low, moderate, and high incomes. This research explores the hypothesis of using international human rights law to protect the human right to live in a healthy and clean environment, and four legal methods will be addressed to attempt to achieve it, which are integrating environmental aspects into the current human rights system, formulating a new objective right to live in a clean and healthy environment, litigations of public interest, and justice between generations. Environmental sociology, SOCI 346, is the study of how social systems interact with ecosystems. As such, it is a very broad course that is tasked with understanding complex and often controversial questions about the social causes, consequences, and responses to environmental disruption. In this teaching portfolio, I enumerate how I use a backward design for crafting assessments that cater to my specific teaching goals and learning objectives for the course. Alessandra Bergamin is an award-winning Australian investigative journalist who divides her time between Melbourne and Los Angeles. Bergamin covers the intersection of environmental conflict and human rights around the world. Her work has appeared in The Baffler, In These Times, Harper’s Magazine, National Geographic, and The New Yorker.com, among others. In 2022, Bergamin was honored as a Distinguished Journalist by the Society of Professional Journalists, Los Angeles in the newspaper/print (smaller circulation) category. She has received fellowships and grants from many entities to investigate environmental and human rights issues.

On April 4, 1946, The Potters Herald, a Thursday weekly dedicated to labor and union news, published an editorial warning readers of pending legislation “which may seriously affect labor” despite not containing a “single word about labor” in its text. This legislation would empower “anti-labor judges” to overturn decisions by the National Labor Relations Board. Despite its neutral appearance, it was in reality designed to “kick [labor and the NLRB] in the teeth” and would result in “a field day for the corporation lawyers.”

There are three notable areas in the City of Santa Clara in which limited access to sustainable transportation infrastructure coincides with a more socially vulnerable local population according to demographic and other data. These are:
1.The area near Lafayette Street and Montague Expressway
2.The area of Koreatown near El Camino Real and Lawrence Expressway
3.The area near Washington Street and Newhall Street
The identification of these areas should represent an additional layer of context in the planning and decision-making process. Importantly, the expansion of such infrastructure in any location advances the climate and equity goals of the City.

Climate change is a global phenomenon. Therefore, globalization is the necessary hermeneutical horizon to develop an analysis of the metamorphosis climate change could cause at a political, social, and economic level. Within this horizon, this Article shows how the relationship between the concept of the Anthropocene epoch and the request for justice allows for framing a climate-justice and intergenerational equity–focused political interpretation of the effects of climate change. In order to avoid reducing such an interpretation to merely an ideological critique of capitalism, the conception of climate justice needs to be grounded in a rational, ethical model. To avoid the most catastrophic impacts of climate change, most of the world’s oil and gas reserves must remain in the ground. In the United States, this would require a dramatic phaseout of oil and gas extraction nationwide over the coming decades. How could we accomplish this? While recent legal scholarship emphasizes the importance of a just transition away from oil and gas extraction, little work has been done to navigate the legal, political, and equity hurdles associated with phasing out oil and gas extraction.

This paper examines the ways in which historical planning practices have contributed to the unequal vulnerability of marginalized communities to extreme heat, resulting in thermal inequity. Historical planning practices including discriminatory policies and uneven resource allocation, have intensified the effect of the urban heat island (UHI), leading to increased exposure to extreme heat and its associated health risk. Understanding the correlation between planning practices and the UHI effect is crucial for developing effective strategies to mitigate extreme heat impacts and improve thermal equity. Globally, hydroelectric dams are increasingly considered to be a sustainable source of renewable energy. Many countries have invested in hydroelectric projects to boost the local and national economies. The findings of recent hydroelectric projects are mixed. Even though the construction of these dams has provided immediate benefits to surrounding communities, long-term negative implications of hydroelectric development have called into question the true sustainability of hydroelectric projects. These negative impacts of hydroelectric dams include the resettlement of marginalized communities, in addition to significant alterations to the local environment and economy.
