Doctor of Nursing Practice Projects: College of Nursing

Purpose: To evaluate the effectiveness of a mobility aide on a medical-surgical inpatient unit to improve patients’ surgical outcomes, decrease hospital length of stay, and decrease the number of falls.

Design: A retrospective review was conducted to determine the effects of a mobility aide implemented on a medical-surgical unit. The intent was to ensure the utilization of the Enhanced Recovery After Surgery (ERAS) protocol for early mobilization before and after implementation. Two-month periods were analyzed before and after implementation.

Findings: The results demonstrated clinical significance for patients when implementing a mobility aide. The mean length of stay was 1.044 days …

Navigating The Tension Between The Rule Of Law And Judicial Discretion Without Robot Judges, Michael H. Simon May 2026

Navigating The Tension Between The Rule Of Law And Judicial Discretion Without Robot Judges, Michael H. Simon

Mercer Law Review

The rule of law is a multifaceted concept about which there is no generally accepted understanding of what that phrase precisely means or all that it includes or excludes. It is, however, something that is widely praised and that almost all governments and officials claim to follow. One of the few areas in which there appears to be consensus is that the rule of law requires that like cases be treated alike. When a substantive legal rule directs only one correct answer, it is not difficult to treat like cases alike. There are many disputes, however, that come before trial …

Federal Income Taxation, Andrew Todd May 2026

Federal Income Taxation, Andrew Todd

Mercer Law Review

In 2025, the United States Court of Appeals for the Eleventh Circuit issued a handful of published opinions involving U.S. federal income tax issues. One of those cases, United States v. Schwarzbaum, presented an issue of first impression in the Eleventh Circuit: whether civil penalties for a U.S. citizen or resident’s willful failure to file a Report of Foreign Bank and Financial Accounts (commonly known as the “FBAR”) are “fines” within the meaning of the Eighth Amendment and, therefore, are subject to the constitutional prohibition on excessive fines. This Article surveys that opinion.

Children, Clicks, And Constitutional Blind Spots: The First Amendment And The Regulation Of Social Media For Minors, Pepper Miller May 2026

Children, Clicks, And Constitutional Blind Spots: The First Amendment And The Regulation Of Social Media For Minors, Pepper Miller

Mercer Law Review

“A fundamental principle of the First Amendment is that all persons have access to places where they can speak and listen, and then, after reflection, speak and listen once more.” This oft-quoted maxim from Packingham v. North Carolina has become a touchstone for the wave of litigation challenging state laws that restrict minors’ access to social media platforms. But, in the rapidly advancing age of social media, should the principle still stand that all persons, specifically minors, are entitled to unfettered access to such novel spaces where they can speak and listen? Underpinning the discussion of this issue lies “a …

Real, Not Rhetorical: Children’S Rights As The Strongest Constitutional Defense Of Obergefell Against Religious-Liberty Challenges, Tanya Washington May 2026

Real, Not Rhetorical: Children’S Rights As The Strongest Constitutional Defense Of Obergefell Against Religious-Liberty Challenges, Tanya Washington

Mercer Law Review

Justice Kennedy’s decision to center adults’ rights in the Obergefell majority opinion—despite his awareness of children’s legal vulnerabilities—created space for Justice Thomas, in his Davis statement, to ignore children altogether and to reframe the constitutional question as a clash between adults’ rights: the right to marry and to be free from discrimination versus the right to exercise one’s religious beliefs and to refuse to engage in conduct that abrogate those beliefs. This distorted constitutional framing eclipses entirely the rights of children in same-sex families and the concrete harms they will face if their parents are barred from marrying—harms that provide …

All Rights Reserved . . . For Disney: Corporate Mouse Traps, A Frozen Public Domain, And How A.I. May Usher In A Whole New World For Copyright, Matthew A. Shatto May 2026

All Rights Reserved . . . For Disney: Corporate Mouse Traps, A Frozen Public Domain, And How A.I. May Usher In A Whole New World For Copyright, Matthew A. Shatto

Mercer Law Review

Copyright, as a body of law, is a recent development in the human consciousness, originating in 1710 with England’s Statute of Anne. Nevertheless, in the three hundred years that followed, more copyright laws were enacted than murder statutes throughout recorded history. With these successive statutes, corporations have effectuated the largest land grab ever seen. Modern copyright law is the elephant in the room in discussions of wealth inequality, perpetuating evil inside and between countries. Moreover, it has deprived humanity of cultural roots, locking ideas behind a paywall that funnels wealth to the few and stymies ingenuity through the sterilization of …

No More Guessing Games: Rebuilding Clarity In Georgia’S Ante Litem Notice Statute, Ethan Debruicker Terrell May 2026

No More Guessing Games: Rebuilding Clarity In Georgia’S Ante Litem Notice Statute, Ethan Debruicker Terrell

Mercer Law Review

Imagine a child’s shape sorter toy—the kind with square, circle, and triangle-shaped holes and equivalent pegs in the same shapes. The toy forms a foundation in a child’s development because, among other things, it teaches the child to problem-solve by (1) recognizing the problem (different-shaped pegs that must go in the sorter a certain way) and (2) solving it (placing each peg in the correct hole to sort the pegs). For simplicity’s sake, let us imagine the toy only has a square and circle-shaped hole with square and circle-shaped pegs. As the child intuitively learns the “rules” of the toy, …

What Attorneys “Ott” To Do: The Supreme Court Clarifies Judgmental Immunity In Georgia, Valeria Notte May 2026

What Attorneys “Ott” To Do: The Supreme Court Clarifies Judgmental Immunity In Georgia, Valeria Notte

Mercer Law Review

The Supreme Court of Georgia dealt a swift blow to the Court of Appeals of Georgia’s interpretation of judgmental immunity in a recent decision. For over three decades, the court of appeals recognized a subjective defense that shielded attorneys from liability for mistakes made while representing a client. Under this interpretation of judgmental immunity, attorneys prevailed on motions for summary judgment by demonstrating that they had exercised their honest professional judgment in making the challenged decision. Now, in Cox-Ott v. Barnes & Thornburg, LLP, a unanimous opinion by the supreme court held that attorneys are no longer entitled to the …

From “Filed Under Seal” To “Frivolous On Appeal”: Potts V. Richardson And Georgia’S Movement Toward Enforceable Professionalism, H. Walker Purvis May 2026

From “Filed Under Seal” To “Frivolous On Appeal”: Potts V. Richardson And Georgia’S Movement Toward Enforceable Professionalism, H. Walker Purvis

Mercer Law Review

Potts v. Richardson marks a turning point in Georgia’s professionalism movement. On its face, the case involved an application of Georgia’s anti-SLAPP statute and the privilege afforded to communications made in connection with judicial proceedings. But the Court of Appeals of Georgia did more than resolve a defamation dispute. By imposing a $2,500 sanction under Rule 7(e) for what the court deemed a frivolous appeal, it in effect sanctioned a lawyer for conduct that violated the Georgia Lawyer’s Creed and Aspirational Statement on Professionalism.

Georgia has been a leader in the modern professionalism movement for decades. Central to that commitment …

Communication Through Connection And Identity: Songwriting With People Living With Dementia, Sean Connolly May 2026

Communication Through Connection And Identity: Songwriting With People Living With Dementia, Sean Connolly

Expressive Therapies Theses

Dementia is a progressive neurodegenerative condition associated with significant changes in communication, which can have profound effects on an individual’s autonomy, self-identity and quality of life. Rising global dementia rates underscore the urgent need to address these issues and expand approaches to care. This literature review examines current research on songwriting methods in music therapy for those living with dementia and investigates how songwriting might support communication for that population. The review explores a variety of music-based approaches, including both neurologic and music-centered frameworks, and highlights a range of songwriting techniques. The findings suggest that songwriting may facilitate communication beyond …

From Demolition To Digital: Using Virtual Reality To Interpret Hamilton House, Hannah R. Miller May 2026

From Demolition To Digital: Using Virtual Reality To Interpret Hamilton House, Hannah R. Miller

Graduate Final Projects

This master’s project investigates the potential of digital reconstruction as a tool for documenting and interpreting demolished historic resources, using Hamilton House as a case study. Employing a mixed-methods approach, the research integrates archival analysis with digital modeling to recreate the spatial context of the house. By grounding the digital model in historical evidence, this study examines how virtual reconstruction can be used to interpret social relationships, patterns of use, and lived experiences that are not fully captured through traditional means of documentation. This project also considers the interpretive implications of reconstructing using fragmentary historical data, addressing the possibilities and …

The Impact Of The Science Of Reading Initiative On Reading Test Scores Among Rural Elementary Students In Arkansas, Julie A. Ferguson May 2026

The Impact Of The Science Of Reading Initiative On Reading Test Scores Among Rural Elementary Students In Arkansas, Julie A. Ferguson

ATU Theses and Dissertations 2021 - Present

This study examines changes in reading achievement among rural elementary students in Arkansas following the statewide implementation of the Science of Reading initiative. Beginning in 2019, Arkansas required educators in kindergarten through sixth grade to receive training in evidence‑based literacy practices emphasizing phonemic awareness, phonics, fluency, vocabulary, and comprehension. Despite these efforts, rural districts continue to face challenges related to staffing, access to professional development, and instructional resources, raising questions about whether statewide reforms have produced measurable improvements in reading outcomes.

Using a quantitative, longitudinal, quasi‑experimental design, this study analyzes ACT Aspire reading assessment data collected from rural Arkansas schools …

Sull'essere Umani "On Being Human", Benjamin S. Woodard May 2026

Sull'essere Umani "On Being Human", Benjamin S. Woodard

Master's Theses

The thesis describes the essential parts of the compositional process and how music expresses the individual philosophies of the composer. The goal is not to describe an overarching, and therefore overbearing, ruleset for what makes the compositional process human, but to describe it in relation to personal experience, with the rise of large language models in mind—sprouting from this research, composing a piece of music that reflects both the new electronic music that has now been embedded academically and the centuries-old tradition of performing on analog instruments. “Sull’essere Umani,” the English translation being "On Being Human", was the piece that …

College of Health Professions Faculty Papers

BACKGROUND: "Nudges" embedded in the electronic health record (EHR) facilitate desired decisions while preserving autonomy and may provide a scalable strategy to overcome the common implementation barrier of lack of knowledge about a best practice. We sought to test whether EHR-based nudges targeting two intensive care unit (ICU) clinician groups would safely increase evidence-based use of low tidal volume ventilation.

METHODS: We performed a stepped-wedge, cluster randomized, hybrid type 3 effectiveness-implementation trial in 12 ICUs from February 2021 to May 2023 to test three nudges targeting clinicians responsible for order entry and respiratory therapists responsible for operationalizing orders and documentation. …

Party, Place, And Pocketbooks: What Shapes Americans’ Trust In Political Institutions, Hwayong Shin May 2026

Party, Place, And Pocketbooks: What Shapes Americans’ Trust In Political Institutions, Hwayong Shin

Weidenbaum Center Survey (WCS) Reports

Evidence from the Weidenbaum Center Surveys (Waves 6–8) suggests that trust in institutions has not simply evaporated. Instead, it is being sorted along several cleavages, such as partisanship, geography, and personal economic security. While trust in the federal government remains relatively low yet stable from May 2025 to March 2026, trust in specific institutions varies across partisan, geographic, and economic cleavages. This fragmentation of trust points to a potential challenge to the stability of American democracy.

A Critical Analysis Of The Influence Of Ideology On Education Governance In An Urban, Midwestern School District, Carl Bryan May 2026

A Critical Analysis Of The Influence Of Ideology On Education Governance In An Urban, Midwestern School District, Carl Bryan

Dissertations, Theses, and Projects

This study examines how ideology operates within local education governance through a critical theoretical lens. As state and national education policies, accountability mandates, and partisan political discourse increasingly shape local school governance, this research investigates how power relations, ideological influences, and equity concerns are embedded in school board decision-making processes and public discourse. Addressing a gap in existing scholarship on ideology in education governance, the study employs a qualitative case study of an urban public school district in the Midwestern United States. Data sources include individual interviews with school board members, critical discourse analysis of school board meetings, and analysis …

Self-Rated Mental Health As A Predictor Of Five-Year Incidence Of Heart Conditions, Cancer, And Dementia, In Post-Menopausal Women From Nshap Rounds 2 And 3, Annelie M. Persson

Gerontology Theses, Dissertations, and Student Creative Activity

Population aging is accompanied by a rising incidence of chronic disease, highlighting the need to identify early indicators of disease risk to support prevention and delay onset. Mental health has gained attention as a potential predictor of health outcomes. Self-rated mental health (SRMH) has emerged as a validated measure capturing resilience, social support, and overall outlook. Few studies in older adults have examined the relationship between SRMH and incident chronic disease. Although mental health is associated with behavioral and psychosocial factors such as physical activity and happiness, these pathways have rarely been examined as mediators. Self-rated physical health (SRPH) is …

Risky Business: Uncertainty, Trade Policy, And The Impact On Mergers & Acquisitions, Talia E. Levine May 2026

Risky Business: Uncertainty, Trade Policy, And The Impact On Mergers & Acquisitions, Talia E. Levine

Mercer Law Review

“If there’s one thing that’s certain about life, it’s uncertainty.” It’s closing day for a deal. Executives, lawyers, and advisors surround the boardroom table. Diligence is complete, financing is secured, and the goals of the buyer and target are aligned. Then, a midnight executive order rolls through, imposing a 10% tariff on half the target’s supply chain. Uncertainty ensues. Negotiations stall. The deal does not close.

The rise of trade-related uncertainty has become a significant disruptor in mergers & acquisitions (“M&A”) and private equity (“PE”) transactions. Uncertainty impedes the flow of strategic transactions in the M&A and PE markets by …

Title Ix Without Tenure: The Eleventh Circuit Bars Sex Discrimination Suits By Educational Employees In Joseph V. Board Of Regents, Lily Kachmar

Mercer Law Review

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” In just thirty-seven words, Title IX of the Education Amendments of 1972 ushered in a transformative era of protections for gender equality in higher education. Yet, courts remain split on the overall scope of those protections.

In Joseph v. Board of Regents of the University System of Georgia (“Joseph II”), the United States Court of Appeals for the Eleventh Circuit became the latest …

The Curtains Aren’T Just Blue: The Decline Of Media Literacy Within Pop-Culture, Kaia Divisconti

Honors Theses

This paper explores the relationship between the growing belief that media like film, television and advertisements “aren’t that deep” and the decline of English departments within education. This study explores how pillars of English departments, like analysis and rhetorical awareness, are pivotal for students to learn to understand the vast number of digital media that they are faced with every day. Through pop-culture moments of American Eagle “good genes” advertisement campaign, media trends like “red pill” content and stereotypical representation in film, this paper examines how this content is pushed onto students and how departments like English and humanities can …

Manufacturing A Confederate Martyr: John Yates Beall, John Wilkes Booth, And The Politics Of Postwar Memory, Corin M. Fyrdrian May 2026

Manufacturing A Confederate Martyr: John Yates Beall, John Wilkes Booth, And The Politics Of Postwar Memory, Corin M. Fyrdrian

Student Papers (History)

John Yates Beall, a Confederate naval officer and privateer executed by the United States in 1865, has often been remembered through a Lost Cause framework that casts him as a chivalric martyr and “victim of honor.” This thesis challenges that interpretation by situating Beall’s life, wartime actions, trial, execution, and postwar memory within competing ideas of honor, legality, violence, and Confederate nationalism. Through analysis of Beall’s military activities, legal arguments, newspaper coverage, personal writings, and later narratives, this thesis argues that his postwar image was not merely preserved but actively constructed. Lost Cause writers transformed his execution into a moral …

Brachial Macroparasite Loads In Estuarine Young-Of-Year Striped Mullet (Mugil Cephalus), Triston Rice May 2026

Brachial Macroparasite Loads In Estuarine Young-Of-Year Striped Mullet (Mugil Cephalus), Triston Rice

Honors Theses

Climate change is a growing threat to marine habitats globally. One ecological impact that warming water temperatures poses is the increased metabolic rate of many parasite species. Their promoted reproductive and feeding rates could pose a threat to the stability of many host populations. Parasites of the gills, or brachial parasites, are especially concerning to fish populations globally. As parasitism is not limited to a specific taxon and comprises a large diversity of ecomorphs and behaviors, geographically distinct areas may be differentially affected by the changing prevalence of parasites. This study aimed to survey current brachial parasite abundance and prevalence …
