The Seventh Amendment Right To Jury Trial In The Administrative State: Recognizing The Dangers Of The Constitutional Moment, Martin H. Redish, Samy Abdelsalam
The Seventh Amendment Right To Jury Trial In The Administrative State: Recognizing The Dangers Of The Constitutional Moment, Martin H. Redish, Samy Abdelsalam
Notre Dame Law Review
One prominent constitutional scholar has sought to legitimize this constitutional transformation through resort to a strange and controversial analytical model he describes as the “constitutional moment.” In this Article, we plan to establish two important points: (1) there exists no principled mode of analysis of the Seventh Amendment right to jury trial that justifies the Court’s categorical dichotomy between Article III and non–Article III forums for purposes of the right’s applicability, and (2) while the theory of the “constitutional moment” would in fact justify the Court’s insulation of the administrative state from Seventh Amendment applicability, reliance on such a theory …

Whose Equity? Interpreting Statutes Authorizing Equitable Remedies, Drew Garden
Whose Equity? Interpreting Statutes Authorizing Equitable Remedies, Drew Garden
Notre Dame Law Review
The role of equity in federal law has sparked significant recent debate. Much ink has been spilled over the appropriate role of the general equity power in federal jurisprudence. Less attention has been paid to the interpretation of statutes explicitly authorizing equitable remedies. Equity, by its very nature, is a shifting field. In fact, equity came into being precisely because of this need for flexibility, and the role it has played throughout English and American history has been possible solely because of its ability to adapt. Thus, when a statute authorizes equitable remedies but does not specify which remedies, the …
Comparing Two Transitioning Strategies To Paliperidone Palmitate Once-Every-6-Months, Martha Sajatovic
Comparing Two Transitioning Strategies To Paliperidone Palmitate Once-Every-6-Months, Martha Sajatovic
Faculty Scholarship
Background A double-blind, randomized, active-controlled, parallel-group, noninferiority trial (NCT03345342) demonstrated that paliperidone palmitate once-every-6-months (PP6M) was noninferior to paliperidone palmitate once-every-3-months (PP3M) in preventing relapse in clinically stable adults with schizophrenia. This post hoc analysis assessed efficacy and safety following transition to PP6M from paliperidone once-monthly (PP1M) versus PP3M. Methods Adults with schizophrenia who were clinically stable on moderate/high doses of PP1M or PP3M were randomly assigned 1:2 to dorsogluteal PP3M or PP6M treatment for 12 months. The primary efficacy measure was time to relapse during the 12-month DB phase. Secondary endpoints included change from DB baseline to endpoint in …

Perceptions Of Faculty And Students In Online Learning: Lessons From The Covid-19 Pandemic, Sumita Sarma, Sharmin Attaran, Mohsen Attaran
Marketing Department Faculty Journal Articles
The COVID-19 pandemic significantly changed how universities provide education -- teachers switched to online teaching methods, while students quickly adapted to the online learning environment. This study adopts the Community of Inquiry (CoI) framework to examine differences in student and faculty perceptions of online learning due to the impact of the COVID-19 pandemic. Student and faculty perceptions can be used to evaluate and ultimately improve the quality of education. This study used survey methods and data collection instruments with a Likert scale sample of 150 students and 150 faculty from a US university. This study’s results indicate a significant difference …
Statutory Religious Accommodation In Employment And The Problems Of Judicial Intent And Outcome, George Wright
Statutory Religious Accommodation In Employment And The Problems Of Judicial Intent And Outcome, George Wright
Texas A&M Law Review
The Groff v. DeJoy case unhappily, but inevitably, generates a variety of realistically unresolvable fundamental problems in typical statutory religious accommodation cases. Perhaps even more important, though, are the unintended and perverse results of Groff’s placing a generally heavier burden of religious accommodation on employers. The Groff standard indeed incentivizes the bringing of more religious discrimination cases, and both the winning and losing of such cases by religious claimants. But our adversarial cultural circumstances, including the typical inseparability of religion, politics, and culture, crucially affect the actual, but unintended, results of judicial reforms. The Groff rule is likely to …

Background/objectives: Kaposi sarcoma (KS) is a common lymphatic endothelial cancer among children with and without HIV in central and eastern Africa. Despite its clinical heterogeneity, its various clinical phenotypes are often grouped together in staging and treatment algorithms. Patients with KS tumor-associated edema, referring to hard, non-pitting lesions which often lead to chronic disability, represent a unique, understudied subgroup of children with KS. To continue our work defining the distinct phenotypes of pediatric KS, this study aimed to assess the clinical progression and outcomes of KS edema in children.
Methods: A retrospective cohort study was conducted at Kamuzu Central Hospital …

The Importance Of Including Maternal Immune Activation In Animal Models Of Hypoxic-Ischemic Encephalopathy, Bailey Collins, Elise A. Lemanski, Elizabeth Wright-Jin
Department of Medicine Faculty Papers
Hypoxic-ischemic encephalopathy (HIE) is a perinatal brain injury that is the leading cause of cerebral palsy, developmental delay, and poor cognitive outcomes in children born at term, occurring in about 1.5 out of 1000 births. The only proven therapy for HIE is therapeutic hypothermia. However, despite this treatment, many children ultimately suffer disability, brain injury, and even death. Barriers to implementation including late diagnosis and lack of resources also lead to poorer outcomes. This demonstrates a critical need for additional treatments for HIE, and to facilitate this, we need translational models that accurately reflect risk factors and interactions present in …

This thesis makes three contributions. First, via a substantial corpus of 1,419,047 comments posted on 3,161 YouTube news videos of major US cable news outlets, we analyze how users engage with LGBTQ+ news content. Our analyses focus both on positive and negative content. In particular, we construct a fine-grained hope speech classifier that detects positive hope speech, negative, neutral, and irrelevant content. Second, in consultation with a public health expert specializing on LGBTQ+ health, we conduct an annotation study with a balanced and diverse political representation and release a dataset of 3,750 instances with fine-grained labels and detailed annotator demographic …

Multi-Organ Gene Expression Analysis And Network Modeling Reveal Regulatory Control Cascades During The Development Of Hypertension In Female Spontaneously Hypertensive Rat, Eden Hornung, Sirisha Achanta, Alison Moss, James S. Schwaber, Rajanikanth Vadigepalli
Department of Pathology, Anatomy, and Cell Biology Faculty Papers
Hypertension is a multifactorial disease with stage-specific gene expression changes occurring in multiple organs over time. The temporal sequence and the extent of gene regulatory network changes occurring across organs during the development of hypertension remain unresolved. In this study, female spontaneously hypertensive (SHR) and normotensive Wistar Kyoto (WKY) rats were used to analyze expression patterns of 96 genes spanning inflammatory, metabolic, sympathetic, fibrotic, and renin-angiotensin (RAS) pathways in five organs, at five time points from the onset to established hypertension. We analyzed this multi-dimensional dataset containing ~15,000 data points and developed a data-driven dynamic network model that accounts for …
The Impact Of Hearing Aid User Speech On Environment Classification And Own Voice Listener Preferences, Robert Andrew Budinsky Iii
The Impact Of Hearing Aid User Speech On Environment Classification And Own Voice Listener Preferences, Robert Andrew Budinsky Iii
USF Tampa Graduate Theses and Dissertations
Hearing aids (HA) have improved over the past few decades with advanced signal processing, such as environment classification and background noise reduction, but are still limited by challenges related to when the user is speaking. These challenges include the potential interference a HA user’s voice has on device environment classification and the potential influence a HA has on own voice (OV) sound quality. However, the effects of OV on HA environment classification and signal processing are not well established, nor are the desired HA program settings regarding OV listening preferences. In this study, a combination of electroacoustic and behavioral methods …
The Monsters In Twentieth And Twenty-First Century Illustrated Adaptation Of Beowulf For Children And Young Adults, Johanna Katharine Burton
The Monsters In Twentieth And Twenty-First Century Illustrated Adaptation Of Beowulf For Children And Young Adults, Johanna Katharine Burton
USF Tampa Graduate Theses and Dissertations
I examine how some authors and illustrators of children’s and young adult literature adapt the old English Beowulf, how critics receive their works, and the functions these adaptations serve. My focus is on how the interplay between the visual and verbal text modifies or amplifies the overall story as well as how theories of translation/adaptation, monster, gender, and post-colonialism provide insight and aid in analysis. My ultimate objective is to demonstrate the significance of children’s and young adult adaptations of Beowulf and how these texts contribute to a rich and varied corpus. I argue that the adapter’s social/cultural context affected …

COVID Long Haul (CLH) is an emerging chronic illness for which the healthcare system continues to seek a common understanding of symptoms, diagnosis, and treatment. CLH experiences can differ drastically, necessitating personalized care plans. Because patients interact with different clinicians during their CLH journey, it becomes important to ensure interoperability and understand clinical relevance of different data that can support clinicians in making appropriate recommendations. We conducted qualitative research where we interviewed 13 patients, conducted a focus group with 8 clinicians, and analyzed care plan follow-up records. We report patient and clinician expectations from and interactions with clinic data. We …

Our field is requiring ever more courage from us as we face challenges to our bedrock beliefs in free access to information and the value of diverse viewpoints, of representation of different ways of being and living, of higher education, and of imagination itself. Where can we find inspiration to keep going? In order to meet the challenges we face with creativity and courage, we need both the ability to imagine a better world and the determination to work to bring this world into being. I’ll talk about some inspirational examples of the pairing of courage and creativity in my …

Pancreatic ductal adenocarcinoma (PDAC) is a lethal disease soon to become the second leading cause of cancer deaths in the US. Beside surgery, current therapies have narrow clinical benefits with systemic toxicities. FOLFIRINOX is the current standard of care, one component of which is 5- Fluorouracil (5-FU), which causes serious gastrointestinal and hematopoietic toxicities and is vulnerable to resistance mechanisms. Recently, we have developed polymeric fluoropyrimidines (F10, CF10) which unlike 5-FU, are, in principle, completely converted to the thymidylate synthase inhibitory metabolite FdUMP, without generating appreciable levels of ribonucleotides that cause systemic toxicities while displaying much stronger anti-cancer activity. Here, …

This study introduces a novel three-dimensional (3D) pavement macrotexture measurement technique using ISO 25178 Surface Volume Parameters (SVP). The method calculates pavement material volume and texture height using cutoff thresholds based on the cumulative probability density function of measured heights. The research aims to optimize these cutoff thresholds for accurate 3D analysis of pavement macrotexture. The study evaluates the performance of various 3D and 2D parameters—assessing their repeatability, reliability, and accuracy—across thirty pavement samples with diverse macrotexture conditions. Findings show that the 3D SVP method, with optimized cutoff thresholds, strongly correlates with sand patch mean texture depth (MTD) and exhibits …
