Property And Information, Jeanne L. Schroeder, David G. Carlson Jan 2025

Property And Information, Jeanne L. Schroeder, David G. Carlson

Articles

The article proceeds as follows. As the information theory is a reaction to legal realism, Part I explores its antecedents in the work of Wesley Newcomb Hohfeld and Ronald H. Coase. Part II presents the information theory as arising from Professor Smith’s interpretation of the Coase theorem.11 In the imaginary world of TC0, we are supposedly indifferent to organizing by property and organizing by contract. Property eclipses contract as the organon of the economy because property reduces the cost of delineation and processing—of speaking and comprehending. We show that this theory is founded on a misunderstanding of Coase. Part III …

Guided Autonomy: A Research-Based Approach To Improving Students' Wellbeing And Decision-Making In The Development Of Problem-Solving Skills, Jonathan E. Moore

Akron Law Faculty Publications

Law schools and the legal profession face a wellbeing crisis. Law students and lawyers suffer from high rates of depression, substance abuse, and job dissatisfaction. Research shows that cultivating autonomy—the sense of control over one’s own decisions and actions—is key to wellbeing and success in legal education and practice. Yet, fostering autonomy in new law students is challenging, as too much independence too soon can overwhelm learners and increase stress. This article introduces a “guided autonomy” approach for law students, with a focus specifically on legal writing courses. The article combines insights from Self-Determination Theory and Cognitive Load Theory to …

Harvesting The Grand Jury’S “Lay Expertise” In Officer-Involved Shootings, Michael Gentithes Jan 2025

Harvesting The Grand Jury’S “Lay Expertise” In Officer-Involved Shootings, Michael Gentithes

Akron Law Faculty Publications

Officer-involved shootings put prosecutors in a bind. While prosecutors normally dominate the pretrial investigation and charging process, these tragedies force prosecutors to change their approach. The incident often pits the victim’s family and community, who feel the case symbolizes a biased and unjust system, against officers and departments, who feel attacked for following their training in a high-stress situation. Prosecutors seek a result that preserves their support from both groups. To resolve this quagmire, prosecutors pass the buck, asking grand jurors to make charging determinations despite their tenuous understanding of the system, their powers, or their role. Many scholars have …

A View Of The Restaurant Script Through The Lens Of Hierarchical Planning, Jamie C. Macbeth, Mark Roberts, Boming Zhang, Sharmin Badhan, Molly Neu, Tanush Garg, Yining Hua, Manushaqe Muco, Mackie Zhou

Computer Science: Faculty Publications

The flexible nature of human cognition and of the structures it uses is well known, as is the difficulty of building cognitive systems that exhibit transfer and use the same structures for radically different tasks. In this paper, we perform a close examination of Schank-Abelsonian scripts, picking apart the goal- and plan- oriented nature of low-level acts and high-level reasoning inherent in them. We then view scripts through the lens of hierarchical planning systems and construct the well-known restaurant script as a hierarchical goal network planning domain. These are evidence in support of a claim that some, if not all, …

Business ETD Collections

The global streaming video-on-demand (SVOD) industry has undergone rapid transformation in recent years, with Disney+ emerging as a major competitor following its launch in 2019. Despite achieving exceptionally fast subscriber growth in its early stages, the platform now faces increasing retention challenges in mature and saturated markets such as Ireland, where competition and subscription fatigue have become key constraints on further expansion. Evidence from the Irish market indicates high levels of subscription penetration alongside stabilising or declining growth rates, with increasing patterns of subscription cycling and service cancellation driven by cost sensitivity, underuse, and the availability of multiple competing platforms. …

Optimising Student Recruitment And Brand Awareness At Icot College Through Culturally Targeted Advertising And Social Media Strategies., Uchral Ganbold

Business ETD Collections

In today’s competitive higher education landscape, institutions increasingly rely on digital marketing strategies to attract and retain international students. ICOT College, an English Language Training provider in Ireland, faces challenges in recruiting and engaging a diverse international student base due to limited culturally tailored advertising and underutilisation of social media platforms. The global education sector has become more competitive following COVID-19, with students adopting more selective and research-driven approaches when choosing institutions. However, ICOT’s current marketing approach remains largely generic, lacking localisation, targeted messaging, and interactive digital engagement. This reduces its effectiveness in connecting with key international markets and weakens …

Fares On Fairness: Using A Total Error Framework To Examine The Role Of Measurement And Representation In Training Data On Model Fairness And Bias, Patrick Oliver Schenk, Christoph Kern, Trent D. Buskirk

Data Science Faculty Publications

Data-driven decisions, often based on predictions from machine learning (ML) models are becoming ubiquitous. For these decisions to be just, the underlying ML models must be fair, i.e., work equally well for all parts of the population such as groups defined by gender or age. What are the logical next steps if, however, a trained model is accurate but not fair? How can we guide the whole data pipeline such that we avoid training unfair models based on inadequate data, recognizing possible sources of unfairness early on? How can the concepts of data-based sources of unfairness that exist in the …

Transunion, Vermont Agency, And Statutory Damages Under Article Iii, Randy Beck Jan 2025

Transunion, Vermont Agency, And Statutory Damages Under Article Iii, Randy Beck

Scholarly Works

The Supreme Court concluded in TransUnion LLC v. Ramirez that a plaintiff may not sue to collect statutory damages under a statute like the Fair Credit Reporting Act (FCRA) simply because the defendant violated a right Congress conferred on the plaintiff. Instead, Article III requires the plaintiff to show that the statutory violation resulted in a “concrete” injury with “a ‘close relationship’ to a harm ‘traditionally’ recognized as providing a basis for a lawsuit in American courts.” The TransUnion Court made no effort to explain how its conclusion could be reconciled with Vermont Agency of Natural Resources v. United States …

ABSTRACT

Closing racial and ethnic disparity gaps in pediatric asthma follow up care - A quality improvement initiative

Ayodele Ayeko

Introduction/Background: Inadequate management of asthma significantly contributes to poor asthma control, poor quality of life (QOL), and high hospitalization rates among pediatric patients. The Global Initiative for Asthma (GINA) guidelines offer recommendations designed to enhance asthma control and improve the quality of life for those affected (2015), including recommendations for close follow up care. At WVU Medicine Children’s Hospital (WVUMCH), insufficient asthma control has been associated with lower clinic follow-up rates and an increase in hospitalization. Although educational initiatives …

Reclaiming Revolutionary Relics: How Nineteenth-Century Americans Used George Washington’S Objects To Understand The Civil War, Abbi E. Smithmyer

Graduate Theses, Dissertations, and Problem Reports (ETD)

By combining cultural, memory, and material culture studies, this dissertation examines the ways objects associated with George Washington became instruments within the proxy war over whether the United States or the Confederacy best represented the American Revolutionary era’s principal values of liberty and equality. Exploring monuments, statues, historic homes, relics, and mementoes, as well as antebellum speeches and schoolbooks, letters, diaries, military orders, newspapers, and memoirs, this work demonstrates how the relics linked to Washington and the nation’s founding shaped how the Civil War generation thought about America’s past.

The 250th anniversary of the founding of the United States has …

Opening The Channels And Speeding The Game: A Short History Of Transactional Forms, Laura M. Scott

Faculty Scholarship

Citators, digests, annotated codes. These standard legal research tools, developed by generations of lawyers and now adapted for the online era, tend to be the province of litigators. Transactional lawyers may also occasionally use these tools, but for the practitioner making and documenting commercial, corporate, real estate, or securities deals, legal forms are often a more useful tool. Used judiciously, these sample documents make drafting more efficient, guide junior business lawyers through unfamiliar transactions, and help identify legal issues to be researched.

For today’s dealmakers, online transactional forms are essential research and drafting tools in their own right, but examining …

Empowering Women On Screen: Exploring The Influence Of Female Protagonists On Contemporary Culture And Gendered Enjoyment In Film, Fokiya Akhtar, Azmat Rasul

All Works

A prevalent notion in the film industry across the globe suggests that female-led films may underperform, leading producers to avoid casting women as leads. This fear of alienating male audiences perpetuates patriarchal ideologies, objectifies female bodies, reinforces gender stereotypes, and alters perceptions of femininity. Examining this perception, the present study investigated the impact of the gender of the protagonist on the audience preference, challenging the misconception that exists in the film industry globally that films starring females as protagonists are less commercially successful. The study conducted an online experiment of 434 participants who were assigned different movies starring male and …

The Convention on the Conservation of Antarctic Marine Living Resources (CAMLR Convention) was negotiated in the late 1970s in the shadow of the Soviet Union’s expanding interest in Antarctic krill fisheries. The development of a management regime for the krill fishery in the remote Southern Ocean vividly reflects geopolitical changes of the world at that time. The Commission for the Conservation of Antarctic Marine Living Resources (CCAMLR) is similarly being affected by geopolitical forces from the wider international system today. This chapter therefore first reviews the historical background for the establishment of the CCAMLR. It then provides an overview of …
