Should Copyright Protect Racist Works? A Review Of Intellectual Property And Immorality: Against Protecting Harmful Creations Of The Mind By Ned Snow, Cathay Smith Jan 2025

Should Copyright Protect Racist Works? A Review Of Intellectual Property And Immorality: Against Protecting Harmful Creations Of The Mind By Ned Snow, Cathay Smith

Texas A&M Journal of Property Law

This Essay reviews Ned Snow’s provocative book, Intellectual Property and Immorality: Against Protecting Harmful Creations of the Mind, and critically examines the intersection of copyright law and morality. It explores the ethical dimensions of copyright protection and examines whether works which fail to advance societal progress, as defined by Snow, should be ineligible for copyright. Drawing parallels between pornography and offensive and racially insensitive classic children’s literature and films, this Essay considers the broader implications of denying copyright to immoral works, including the potential for increased dissemination of harmful content, the challenge of aligning copyright with evolving moral standards, …

Incentivizing Bad Behavior Through Copyright, Ned Snow Jan 2025

Incentivizing Bad Behavior Through Copyright, Ned Snow

Texas A&M Journal of Property Law

This Essay comes in response to the comments of Professors Margaret Chon, Cathay Smith, and David Taylor as part of the Texas A&M Journal of Property Law’s Symposium featuring a discussion on my book Intellectual Property and Immorality: Against Protecting Harmful Creations of the Mind. In this Essay, I argue that the law should refrain from copyrighting pornographic content. This conclusion is based on a factual assumption and a moral principle. The factual assumption is that pornographic content is harmful to society. The moral principle is that applying law to incentivize harmful conduct undermines the effectiveness of law. My argument, …

The Purpose Of Progress? A Response To Professor Ned Snow’S Intellectual Property And Immorality, Margaret Chon Jan 2025

The Purpose Of Progress? A Response To Professor Ned Snow’S Intellectual Property And Immorality, Margaret Chon

Texas A&M Journal of Property Law

In Intellectual Property and Immorality, Professor Snow fearlessly puts forth the proposition of morality in the consideration of IP’s social welfare goals. By doing so, he invites important conversations about the underlying purposes and values of an area of law that powerfully shapes our knowledge-based economies and societies. Towards this end, this Response has three propositions: (1) expansion of the foundational justifications for IP to include the key insights of human development (sometimes referred to as human flourishing) theory; (2) recognition not just of harms to individuals but also harms to communities and societies; and (3) imbuing of greater …

Durable Oxyfluoride Waste Forms For Salt Wastes From Molten Salt Reactors, Alevtina A. Maksimova, Jake W. Amoroso, Matthew Page, Gregory Morrison, Hans Conrad Zur Loye Jan 2025

Durable Oxyfluoride Waste Forms For Salt Wastes From Molten Salt Reactors, Alevtina A. Maksimova, Jake W. Amoroso, Matthew Page, Gregory Morrison, Hans Conrad Zur Loye

Faculty Publications

Molten salt reactors (MSRs) are promising technology to replace traditional light and heavy water reactors in the near future. Waste management for MSRs, however, remains a pressing concern that needs to be resolved prior to realizing deployment of MSRs. Specifically, the generated salt waste needs to be safely sequestered, a task made difficult by the high solubility of the salt waste that can cause the release of radionuclides into the environment. This work demonstrates a new approach to immobilize multiple fluoride salts into a single waste form by converting highly-soluble fluorides to durable and stable oxyfluorides. Notably, we report a …

Neighborliness Vs. Car Culture: Traffic Violence, Pedestrian Deaths In Philadelphia, And Vision Zero's Concept Of Equity, Regina Austin Jan 2025

Neighborliness Vs. Car Culture: Traffic Violence, Pedestrian Deaths In Philadelphia, And Vision Zero's Concept Of Equity, Regina Austin

Journal of Law and Mobility

Vision Zero (VZ) is a transportation policy adopted by major cities like Philadelphia that aims to reduce or eliminate traffic violence, primarily through improvements in the transportation infrastructure. VZ prioritizes engineering (over enforcement), community engagement, and perhaps most importantly, equity. In the battle for superiority among users of land-based travel modes in America, automobile drivers have benefited from arterial highways that speed traffic flows around and through urban enclaves to reach center city business districts and from a car culture that encourages dominant behavior behind the wheel. Pedestrians have been among the losers.

In Philadelphia, as elsewhere, pedestrians who are …

Before Boone V. Lightner: The Lost History Of Pro-Veteran Canon, Eric Hughes Jan 2025

Before Boone V. Lightner: The Lost History Of Pro-Veteran Canon, Eric Hughes

MC Law Review

The pro-veteran canon, a long-standing principle of statutory construction, has deep historical roots dating back to ancient times, as reflected in religious, legal, and historical texts. This principle, which favors a liberal interpretation of laws to benefit veterans, has evolved as societies sought to recognize and compensate the sacrifices of military service members. From the biblical era’s division of spoils to the Magna Carta’s contractual liberties, and through early English statutes and the American Revolution, this canon has shaped legal frameworks and influenced governance. Notably, U.S. jurisprudence, including foundational decisions like Marbury v. Madison, upheld the pro-veteran canon as …

The History Of Policing And The Impact On Minority Communities: The Case Against Police Abolition, F. Lee Francis Jan 2025

The History Of Policing And The Impact On Minority Communities: The Case Against Police Abolition, F. Lee Francis

MC Law Review

This article critically examines the implications of former FBI Director James Comey’s assertions regarding the rise in violent crime and the phenomenon known as “The Ferguson Effect,” which posits that law enforcement officers are increasingly hesitant to engage in proactive policing due to fear of public backlash and viral scrutiny. Comey’s comments, made in a 2015 speech, sparked significant debate about the psychological impact of heightened scrutiny on police behavior and the potential consequences for public safety.

Through a multi-part analysis, the article first traces the historical development of policing in ancient civilizations and its evolution in the United States …

Mapping The Tren Maya’S Mark On Mérida, Diego Tamayo

Pitzer Senior Theses

Mapping the Tren Maya’s Mark on Mérida investigates whether the Tren Maya railway is ushering in new sustainable development which provides economic and social benefits for the residents of Mérida, Mexico. The Mexican government has spearheaded the megaproject’s construction in a mere four years with the goal of boosting economic growth in an environmentally and socially conscious manner. The following investigation highlights where this vision, articulated in technocratically-constructed public documents and amplified in reporting, has been fulfilled in Mérida. Through geospatial, physical, and journalistic investigations and analysis, it is revealed the Tren Maya has brought a host of impacts upon …

Marijuana Use And The Health Of The Mother: Factors Relating To Marijuana Use Around Pregnancy, Grace Schroeder Jan 2025

Marijuana Use And The Health Of The Mother: Factors Relating To Marijuana Use Around Pregnancy, Grace Schroeder

Schultz-Werth Award Papers

This study examines data reported from SD PRAMS during the years 2018 to 2022 to understand the relationship between demographic and health factors and marijuana use before and during pregnancy. As the use of marijuana increased in the general population within the last few years, it also increased among women of childbearing age, both pregnant and not pregnant (Alshaarawy & Anthony 2019) (NIDA, 2023). The SD PRAMS questionnaire included questions on health care utilization, substance use, mental health, pregnancy-related care, and other related topics. We controlled for responses relating to demographic factors such as race, age, marital status, living in …

A Bioethical Analysis On The Allowance Of Physician-Assisted Death In Cases Of Mentally Declined Patients, Megan Nelson Jan 2025

A Bioethical Analysis On The Allowance Of Physician-Assisted Death In Cases Of Mentally Declined Patients, Megan Nelson

Schultz-Werth Award Papers

As advancements are continually made in science, there is an increase in ethical issues that the world needs to address. When deciding where the law should fall on these new issues, it is important to use different ethical theories to view the issues from all sides. This is where the growing field of bioethics comes into play. “Bioethics is the study of ethical, social, and legal issues that arise in biomedicine and biomedical research” (Resnik, 2023). One of these bioethical issues that has become increasingly prevalent in society is physician-assisted death, which is sometimes referred to as euthanasia. This paper …

Alexander Glazunov: Patriarch Of Students, Levi Gebhard Jan 2025

Alexander Glazunov: Patriarch Of Students, Levi Gebhard

Schultz-Werth Award Papers

Amid shifting empires, political turmoil, cultural reform, famine, and immense poverty, few individuals have asserted themselves as boldly as Alexander Konstantinovich Glazunov. Glazunov lived through the end of the Tsarist Russia era and the uprising of the Soviet Union. The transition between those two powers consisted of hostile political pressure, brutal winters, revolts, and famine. What ultimately kept Glazunov from succumbing to the darkness of his times were his students and his compositions. As a teacher he was protective of his students’ academic success and their physical wellbeing. Not only did Glazunov live during the transition of one great political …

The Wonder Is Scripture, Jared Halverson

BYU Studies

It’s an honor to be associated in any way with this institute, as it’s my second-favorite thing named after Elder Neal A. Maxwell. The first is my eldest son, whose middle name was an obvious choice, largely because my wife loves Elder Maxwell even more than she loves me, which might be a problem were it not for the fact that I agree with her. I once spent so much time in this library creating a compilation of Elder Maxwell’s talks that by the time I was finished, my wife had called the police to report a missing person. When …

A Moderated Mediation Model Of Perceived Control, Fairness, And Leader–Member Exchange In The United States And South Korea, Nari Kim Jan 2025

A Moderated Mediation Model Of Perceived Control, Fairness, And Leader–Member Exchange In The United States And South Korea, Nari Kim

Publications and Research

Drawing on the two-factor model of organizational justice and social exchange theory, this study investigates the mediating roles of procedural and distributive justice in the relationship between work locus of control (WLOC) and leader–member exchange (LMX). Using data collected from two cultural contexts – the United States and South Korea – this research further examines whether culture moderates the indirect relationship between WLOC and LMX through perceived justice. The findings indicate that subordinates with an internal WLOC tend to report higher-quality LMX relationships, and that both procedural and distributive justice partially mediate this relationship. Moderated mediation analyses reveal that the …

“There Is Law” Joseph Smith’S Use Of Arbitration To Protect The Book Of Mormon, Jeffrey N. Walker, Andrew H. Hedges, Gerrit J. Dirkmaat Jan 2025

“There Is Law” Joseph Smith’S Use Of Arbitration To Protect The Book Of Mormon, Jeffrey N. Walker, Andrew H. Hedges, Gerrit J. Dirkmaat

BYU Studies

This case marks the first time Joseph Smith invoked his legal rights to safeguard work connected with his prophetic calling from abuse or exploitation. The case arose from Abner Cole’s1 January 1830 efforts to publish Book of Mormon excerpts in his newspaper The Reflector, which he printed on the same Palmyra, New York, press that the Book of Mormon was being printed on. The case was evidently settled in Joseph Smith’s favor through arbitration, an out-of- court option for adjudication that New York law considered legally binding.2

Paediatrics and Child Health, East Africa

Introduction: Academic proficiency is crucial for advancing learning goals, school advancement, and future economic security. Children with sickle cell anemia (SCA) in sub-Saharan Africa (SSA) may be at risk of disease-associated learning difficulties. Limited data exist on this topic among school-age children in the region. We aimed to assess academic proficiency in a sample of children with SCA in Uganda compared with unaffected controls.

Methods: This cross-sectional study was conducted in Kampala, Uganda. Participants were school-going children with SCA, aged 6–12 years, attending Mulago Hospital SCA Clinic, and age-matched sibling controls without SCA. Academic proficiency was assessed by the Wide …

Hero Or Zero? Meta-Opinion In Terrorist Motivation, Clark Mccauley, Sophia Moskalenko Jan 2025

Hero Or Zero? Meta-Opinion In Terrorist Motivation, Clark Mccauley, Sophia Moskalenko

Psychology Faculty Research and Scholarship

What is the relationship between public opinion and political action? Drawing on cases where shifts in public opinion coincided with changes in the frequency of terrorist attacks, we argue that this connection stems from the normative power of public opinion. This power is evident in the bandwagon effect, where popular opinions tend to gain even more support over time. Governments and corporations signal their belief in this power by attempting to shape public opinion with tools like bots, sockpuppets, and troll farms. Importantly, the impact of public opinion does not depend on its actual distribution, but rather on how …

Stakeholder Perspectives On Acceptability Of Implementing A Child Mental Health Intervention In Child Welfare Services: A Pilot Study, Kerry Lee, Caterina Pisciotta, Geetha Gopalan

Graduate School of Social Work and Social Research Faculty Research and Scholarship

This study examined the acceptability of a modified 4Rs and 2Ss behavioral parent training intervention within a Child Welfare (CW) placement prevention service. Twelve child welfare staff (caseplanners, supervisors, administrators) and 12 CW-involved families completed surveys, interviews, and a focus group. All quantitative benchmarks for high acceptability were met (e.g., treatment satisfaction, acceptability and appropriateness). Staff valued the intervention’s content and support, but noted concerns about consultation time, training, and role conflict. Families appreciated recruitment, logistical support, group environment, and child/ family wellbeing, but cited barriers with parent-child separation during sessions, group size and duration, certain activities, and the program’s …

Indigenous Sovereignties In The Wife Of Bath’S Tale, Jamie K. Taylor Jan 2025

Indigenous Sovereignties In The Wife Of Bath’S Tale, Jamie K. Taylor

Literatures in English Faculty Research and Scholarship

This essay examines Chaucer’s Wife of Bath’s demand for “sovereyntee,” a central term around which both her Prologue and Tale rotate. Critics have long disagreed whether Alison’s demand for sovereignty is met, and this essay seeks new ways of thinking about the theoretical contours of her demand. It argues that turning to heretofore unrecognized structures of sovereignty articulated via Indigenous Studies can help us review the feminist politics of the Wife of Bath’s Tale. By reading the Tale’s temporal alternatives to settler timeframes, this essay shows how the Tale revises the structures of justice that seem to exonerate …

Empowering Youth Aging Out Of Foster Care: A Needs Assessment To Improve Transitions To Independent Living, Parker Brady, Amy Six-Means, Julia Durante, Anubha Sood, Philip Day, Nora Gimpel, Jill Mcleigh, Kimberly Stone

Health Status, Outcomes, and Literacy and Healthcare Utilization

We aimed to assess the health literacy (HL) of youth transi- tioning out of foster care and how they interact with health information. The Newest Vital Signs survey was administered online to 26 youth who experi- enced foster care. Seven youth and 15 stakeholders also com- pleted focus groups discussing how youth handle health infor- mation. Results indicate that 42% of youth may have lim- ited HL, which places them at risk for poor health outcomes. Future studies should further characterize this population’s HL and study physician and technology-based interventions to address limited HL.
