The After-Work Drink, Tadgh Byrne Jan 2025

The After-Work Drink, Tadgh Byrne

Stirring Words

"There aren’t many jobs where it’s acceptable to drink in your workplace the second your shift finishes. But for the restaurant and bar trade, it is often the norm. An after-work drink is a nightly team-building exercise..."

The Private Rights Model Of Qui Tam, Sarah Leitner Jan 2025

The Private Rights Model Of Qui Tam, Sarah Leitner

Florida Law Review

Qui tam is a procedural device that has been part of the American legal landscape since well before the founding era. Today, however, qui tam is under attack. Scholars and litigants alike have argued that qui tam is unconstitutional under Article II and that private plaintiffs who bring qui tam suits lack Article III standing. But there is something fundamentally strange about suggesting that this device, which was commonly utilized by the First Congress, is no longer compatible with our modern constitutional doctrines. Something has to give. Drawing on the traditional public–private rights framework of justiciability, this Article seeks to …

Questioning Hearsay's Formalism, Susan E. Provenzano Jan 2025

Questioning Hearsay's Formalism, Susan E. Provenzano

Florida Law Review

The rule against hearsay has a simple premise: a speaker’s out-of-court statement can be inaccurate, misleading, or downright false. This premise is being eroded by a judicial formalism under which second-hand statements now reach the jury unless the statements make assertions in declarative sentences, such as “Sam, I know you sell drugs.” The same belief conveyed by “Sam, do you still have any of those drugs for sale?” is deemed nonhearsay because it is housed in a question. The problem is that this question presents an incriminating presupposition—the speaker’s expressed assumption that Sam is a drug dealer. This belief becomes …

Hitting Back: Methods Of Abolishing Corporal Punishment In The Florida School System, Pressly Pratt Jan 2025

Hitting Back: Methods Of Abolishing Corporal Punishment In The Florida School System, Pressly Pratt

Florida Law Review

The use of corporal punishment against children has fallen more and more out of vogue in the past half-century as research has shown that the practice only harms children. But, despite that research and the growing public distaste for the practice, the use of corporal punishment in schools remains legal in eighteen states, including Florida. A fifty-year-old Supreme Court case, Ingraham v. Wright, upholds the legality of corporal punishment in schools. The Court has not revisited the topic despite changes in public attitudes and research and that it was confronted with the ability to revisit it as recently as …

Ending Arbitrary Invasions By Shielding "Abandoned" Password Protected Phones, Samuel Chan Jan 2025

Ending Arbitrary Invasions By Shielding "Abandoned" Password Protected Phones, Samuel Chan

Florida Law Review

Almost every American carries a cell phone in their pocket. But modern phones do much more than simply send and receive calls. Cell phones in the twenty-first century contain a digital record of one’s entire life. The wealth of private information that can be gathered from a cell phone has led the Supreme Court to recognize the need for increased digital data protections. In Riley v. California, the Court recognized the privacy concerns associated with modern cell phones and curtailed warrantless searches of a phone incident to arrest. In Carpenter v. United States, the Court acknowledged smartphones can …

Creating A Cultural Liturgy Of Intentional Prayer: Leading Grace Lutheran Church Into Greater Understanding And Engagement With The Surrounding Community, Keith Aschenbeck Jan 2025

Creating A Cultural Liturgy Of Intentional Prayer: Leading Grace Lutheran Church Into Greater Understanding And Engagement With The Surrounding Community, Keith Aschenbeck

Doctor of Ministry Major Applied Project

Aschenbeck, Keith D. “Creating a Cultural Liturgy of Intentional Prayer: Leading Grace Lutheran Church into Greater Understanding and Engagement with the Surrounding Community.” Doctor of Ministry. Major Applied Project, Concordia Seminary, 2025. pp. 166

Grace Lutheran Church, like many churches, has historically approached mission and ministry with the consumer-driven approach model of attraction. The result has often had them looking at how to shape and form how the world sees them so that they would be appealing as a place to worship. This way of approaching ministry has become a cultural liturgy that forms many decisions about what ministry programs …

Perceived Loneliness During Covid-19 And Young Adult Mental Well-Being: Testing Socioeconomic Status As A Moderator, Falescia Matlock, Michael Langlais Jan 2025

Perceived Loneliness During Covid-19 And Young Adult Mental Well-Being: Testing Socioeconomic Status As A Moderator, Falescia Matlock, Michael Langlais

KIP Articles

It is not currently known how perceived loneliness during the COVID-19 pandemic was associated with emerging adults’ mental health and whether socioeconomic status (SES) moderated this relationship. The psychosocial development theory states that emerging adults experience a psychological conflict—intimacy versus isolation—where the goal is to seek connections; without connections, emerging adults are likely to experience mental health challenges. These challenges may be exacerbated for those with lower SES. The purpose of this study was to examine the effects of perceived social distancing guidelines on the mental health of emerging adults and if this relationship is moderated by SES. This study …

Breaking Kayfabe, Thomas B. Bennett Jan 2025

Breaking Kayfabe, Thomas B. Bennett

Missouri Law Review

The membership of the Supreme Court affects how it decides cases. This maxim is well accepted among the public. But it is exceedingly rare for Supreme Court opinions to acknowledge this fact, even when it provides the best explanation for the Court’s behavior. And in the unusual instance in which Supreme Court opinions do refer to changes in the Court’s membership, it is jarring. This Article explores two questions that flow from these uncontroversial facts. First, why does it happen so rarely? Second, why does it happen at all? To answer these questions, the Article looks to an unusual source: …

The Clock Is Ticking: Legal Barriers In § 1983 Execution Protocol Challenges, Christian Witte Jan 2025

The Clock Is Ticking: Legal Barriers In § 1983 Execution Protocol Challenges, Christian Witte

Missouri Law Review

At 7:53 p.m. on January 25, 2024, the curtains opened, revealing Kenneth Smith strapped down in the execution room, covered by a white sheet. A respirator mask covered his face, serving as the conduit for nitrogen gas that Smith would soon inhale. The prison warden entered the execution chamber, read Smith’s death warrant, and allowed Smith to share his final words: “Tonight Alabama causes humanity to take a step backwards. I’m leaving with love, peace[,] and light . . . . Love all of you.” Alabama’s Attorney General permitted the warden to continue, signaling no court orders were staying the …

Custom’S Pervasive Role In Law And The Boundaries Of Positivism, James P. George Jan 2025

Custom’S Pervasive Role In Law And The Boundaries Of Positivism, James P. George

Missouri Law Review

Custom is law’s foundation, modulator, and occasional antithesis. This Article explores that relationship, starting with varying insights from some of the few legal philosophers who have examined the custom/law dynamic. The heart of this Article provides examples showing custom’s many influences on the law, set in five functional areas: origin, application, interstitial, rule-source, and oppositional. Although the custom/law interplay spans human behavior, these examples come from law practice where custom is exposed. Many are routine, some are significant, and all show our reliance on behaviors and norms that are not positive law. The conclusion addresses but does not resolve some …

True Threats To First Amendment Protections In The Age Of Voter Disinformation, Taylor Todd Jan 2025

True Threats To First Amendment Protections In The Age Of Voter Disinformation, Taylor Todd

Missouri Law Review

Imagine that in the weeks leading up to a presidential election, the boss of a factory that primarily employs minority workers credibly and repeatedly warns the rank-and-file, “If any of you vote in this upcoming election, we will make sure that you are fired.” If delivered and understood with serious intent, this statement would clearly violate the federal Voting Rights Act of 1965 (“VRA”), which states that “[n]o person . . . shall intimidate, threaten, or coerce, or attempt to intimidate, threaten, or coerce any person for voting or attempting to vote . . . .” Remarkably, however, such a …

A Nation Of Kings: Judicial Overextension Of Official Immunity And The Abdication Of Responsibility For Our Most Vulnerable Citizens, Adam Schexnayder

Missouri Law Review

Imagine a man who cannot speak, cannot walk, cannot feed himself, and cannot clean himself. He has no family to speak of, or if he does, the time and economic burden of his care will jeopardize their own survival. Our society has enacted laws to provide some level of support and care for this man and employs the resources of the state to pursue that goal. Tragically, the man dies in the state’s care due to unquestionable negligence. If his family had the resources to place him in a private facility, basic negligence law tells us the private facility may …

Copper Line Shapes, Gareth R. Eaton Jan 2025

Copper Line Shapes, Gareth R. Eaton

TeachEPR Submissions

The spectrum of Cu2+ has 4 lines, since I = 3/2. Cu has two major isotopes, 63Cu (69.2%) and 65Cu (30.8%). The magnetic moment of 65Cu is 7% larger than that for 63Cu, so the hyperfine coupling is 7% larger. If the lines are narrow enough, one can observe superposition of spectra due to complexes of the two isotopes.

Concentration Effects On Nitroxides, Gareth R. Eaton Jan 2025

Concentration Effects On Nitroxides, Gareth R. Eaton

TeachEPR Submissions

We need to distinguish line broadening due to restricted motion from line broadening due to concentration of the same or other paramagnetic species. For example, if you increase the concentration of nitroxyl to get better S/N, the lines will broaden due to collisions with other nitroxyl molecules.

Does College Guarantee Economic Mobility?: Incorporating Lost In-Kind Benefits Into The Calculation, Amy S. White Jan 2025

Does College Guarantee Economic Mobility?: Incorporating Lost In-Kind Benefits Into The Calculation, Amy S. White

Publications and Research

Average salaries of college graduates are higher than salaries of those without degrees. However, the experience of graduating and out-earning the income requirements for in-kind or entitlement benefits like Medicaid, public assistance, Supplemental Nutritional Assistance Plan, and/or Section 8 housing vouchers are not taken into consideration in any mobility calculation nor are students prepared to lose their benefits. Teaching at an urban commuter school in a financially disadvantage borough, I have identified a gap in the research literature and supportive services for these low-income students. This opinion piece further describes the problem and highlights areas for future action and research.
