The Supreme Court's Pragmatic Turn On The Separation Of Powers: Refining Appointments Clause And Nondelegation Doctrine, Peter Margulies
The Supreme Court's Pragmatic Turn On The Separation Of Powers: Refining Appointments Clause And Nondelegation Doctrine, Peter Margulies
DePaul Law Review
Pragmatism is the hallmark of two recent Supreme Court
decisions on the separation of powers, Kennedy v. Braidwood
Management, Inc., and Federal Communications Commission
(FCC) v. Consumers’ Research. These cases, which dealt with the
Appointments Clause and the nondelegation doctrine (public and
private) respectively, reject a rigid, literalist approach. Instead,
these decisions strive to make government workable, in the process
facilitating implementation of Congress’s plans.
Both Braidwood and Consumers’ Research decline to require
Congress to recite “magic words” or lock in future executive branch
officials with mechanical formulas or caps on fees. Instead, each
decision looks at legislation …
Does Reporting Of Israeli Organ Harvesting Constitute Blood Libelous Folklore, And Why Does It Matter?, Simon J. Bronner
Does Reporting Of Israeli Organ Harvesting Constitute Blood Libelous Folklore, And Why Does It Matter?, Simon J. Bronner
Jewish Folklore and Ethnology
Global news reporting of “organ harvesting” by Israeli soldiers for medical institutions in the twenty-first century is analyzed as “newslore,” defined by folklorist- journalist Russell Frank as “folklore that comments on, and is therefore indecipherable without knowledge of, current events.” Built on hearsay, the reports, especially in the Arab press during the Israel-Hamas War, begun in 2023, have connections to a complex of antisemitic “blood libel” narratives in Europe about Jews violating the bodies of Christian children. The accusations of organ harvesting invoked a number of antisemitic tropes that were visually conveyed globally through memes and posts on the internet, …
Words Of War: The Rhetorical Weapons Of Folklore After October 7, Steve Siporin
Words Of War: The Rhetorical Weapons Of Folklore After October 7, Steve Siporin
Jewish Folklore and Ethnology
The chant “From the river to the sea, Palestine will be free” became well known after the beginning of the Israel-Hamas War (October 7, 2023) due to its widespread use at anti-Israel demonstrations and on news broadcasts, social media, and YouTube videos. A retort that mocked the inability of demonstrators who espoused the slogan to answer the questions “Which river? Which sea?” also circulated widely. Noncombatants on the domestic front relied on these two items of folklore (among others), a chant and a retort, to support their aims and satisfy their emotions. This essay traces the origins of each of …
Folk Narratives Of “The Wandering Jew” (Atu 777) In Latvian Folklore, Svetlana Pogodina
Folk Narratives Of “The Wandering Jew” (Atu 777) In Latvian Folklore, Svetlana Pogodina
Jewish Folklore and Ethnology
This essay reports field-collected texts of “The Wandering Jew” (ATU 777) recorded in the twentieth century in Latvia to determine if they are distinctive within the global tradition of the folk narrative. The Archives of Latvian Folklore (Latviešu folkloras krātuve) collection contains versions of the narrative recorded in the 1920s and 1930s. These texts have not previously been published in English translation. An interpretation is made that the narratives borrow elements from Jewish stereotypes that exist in a local folklore tradition. Comparing the Latvian material to the European and Slavic versions of the story of the Eternal Jew, a major …

Mapping Media Literacy Assessment: A Systematic Review To Connect The Dots, Lara Azar, Casey Frechette, Hafsa Zia, Joy Amulya
Journal of Media Literacy Education
The goal of this study was to address persistent challenges in assessing media literacy by reviewing assessments developed between 2011 and 2020. We combined landscape analysis, research synthesis, and grounded theory to select assessments, identify key attributes, iteratively code, analyze, and create an integrated synthesis of approaches to media literacy assessments. The analysis classified media literacy constructs by learning dimension (knowledge, skills, attitudes, behaviors) and participation mode (consumption, engagement, creation). The results showed that while most assessments focused on consumption-oriented constructs, engagement- and creation-oriented constructs were also included. Assessments primarily served three research purposes: evaluating media literacy levels in populations, …
How To Incorporate Media Literacy Into General Education Curricula, Dennis O. Frohlich, David Magolis
How To Incorporate Media Literacy Into General Education Curricula, Dennis O. Frohlich, David Magolis
Journal of Media Literacy Education
Media literacy scholars have long championed the inclusion of media literacy courses in all levels of education, from K-12 to collegiate levels. Universities’ general education curricula are one possible site for inclusion of a media literacy course. However, with each discipline vying for a spot in a university’s general education system, a course in media literacy can easily be overlooked or excluded. In this paper, we detail our efforts to successfully incorporate several media literacy courses into our university’s general education curriculum. This is a process we went through twice under two different general education systems. This paper will detail …
Too Close For Comfort: Indigenous ‘Genre’ Film As Impactful In Pedagogies Of Reconciliation, Brendan M. Burrows
Too Close For Comfort: Indigenous ‘Genre’ Film As Impactful In Pedagogies Of Reconciliation, Brendan M. Burrows
Journal of Media Literacy Education
This article examines the pedagogical potential of Indigenous-created genre film—specifically, Jeff Barnaby’s Rhymes for Young Ghouls (Barnaby, 2013)—in promoting critical engagement with the legacies of colonial violence in Canada. Drawing on Susan Dion’s (2009) concept of the perfect stranger and film activist Ariel Smith’s analysis of Indigenous horror cinema, the study examines how three educators responded to the film and reflected on its curricular applications. Using constructivist grounded theory and cultural studies frameworks, the research reveals both the transformative promise and institutional constraints of integrating emotionally intense media into classroom settings. Findings suggest that while the film evokes affective responses …

Journal of Media Literacy Education
This research aims to explore students’ perspectives on their use of ChatGPT during a media analysis project in a media literacy (ML) course. Additionally, it investigates what the assigned media literacy project has contributed to them. Qualitative analysis results from 48 students indicated that they believed their media analysis positively contributed to their media awareness of messages, media genres, social justice, technical aspects, and analytical skills, such as inquiry and creativity. Many students appreciate ChatGPT, noting that it encourages learning across disciplines through deep searches and dialogues with the tool. They especially appreciate its contribution when they compare the results …

Demographic Context Of Media And Information Literacy (Mil) Skills Among Senior High School Students In Ghana, Patience Emefa Dzandza Ocloo, Aurelia Ayisi, Abena Animwaa Yeboah-Banin, Annie Oye
Journal of Media Literacy Education
This paper explores the media and information literacy (MIL) competencies of young Ghanaians in senior high schools. It is premised on the rising spate of misinformation, online security breaches, and the avalanche of content young people must navigate. Together, these factors demand young persons to be new media savvy in order to use the affordances of the current media ecology to their benefit. To advocate for comprehensive MIL education in senior high schools in Ghana, the study adopts a comparative analysis logic to examine demographic differences that attend young people’s media and information literacy. A nationwide survey of 1200 senior …
