Cruel And Unusual Punishments And The Constitutional Status Of The Idea Of Progress, R. George Wright Jan 2026

Cruel And Unusual Punishments And The Constitutional Status Of The Idea Of Progress, R. George Wright

FIU Law Review

To this point, we have developed some idea of what progress might have meant to the constitutional Framers, ratifiers, and later judges. We need not attempt the fruitless task of doing any precise head count of the variations of the concrete meaning, perceived likelihood, or value of progress among those parties. Doubtless some persons were more optimistic than others.178 But we need only assume that enough constitutional Framers, ratifiers, and judicial interpreters sufficiently shared any mainstream understanding of progress. Any such constitutional legitimacy of the idea, or the multiple ideas, of progress licenses the language of progress embraced in Trop.

The Making Of Egyptian Cotton: An Alternative Narrative Between Empire And Global Capital, Dina I. Waked Jan 2026

The Making Of Egyptian Cotton: An Alternative Narrative Between Empire And Global Capital, Dina I. Waked

FIU Law Review

Egyptian cotton has become a celebrated brand. Referring to cotton as “Egyptian” signals a certain quality, luxury, and durability. Egyptian cotton has, thus, become its own trademark, a signifier of value, and a symbol of national heritage. This image is carefully curated. It is now protected under a licensing scheme of branding and marketing that assures that fraudulently claimed “Egyptian cotton” does not benefit from the added value this geographic location ascribes to it. The Egyptian Cotton Association was thus created 2005 to license and accredit the brand. Part of the curation of the brand image is a historical narrative …

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

This research outlines a four-step methodology for transforming CO2 into high-purity oxalic acid. CO2 was first sequestered as KHCO3 through its reaction with aqueous KOH, followed by hydrogenation using a supported AgPd/CNT catalyst in a batch reactor at an initial H2 pressure of 60 bar and a temperature of 150°C. The formate yield reached 91.8% at optimum conditions. Potassium formate in the solid state was thermally coupled in the presence of KOH at 400°C under N2 flow, yielding potassium oxalate of up to 76% yield. The final step was the selective precipitation of potassium oxalate with ferrous …

Flow Regime-Independent Two-Group Interfacial Area Concentration Model For Dispersed Gas-Liquid Flows In Large-Diameter Pipes, Hossein Barati, Takashi Hibiki, Joshua P. Schlegel, Naofumi Tsukamoto

Nuclear Engineering and Radiation Science Faculty Research & Creative Works

In many power plants, boiling can result in two-phase flows during normal and accident conditions. Heat and mass transfers through the gas-liquid interface in a two-phase flow process are proportional to the interfacial area concentration (IAC). These calculations for nuclear systems are typically performed using advanced system analysis codes such as TRACE. TRACE uses a two-group (2G) model, where bubbles are divided into two groups according to their drag coefficients. Correlations are used to calculate the group-wise void fractions (VFs) and IACs. This study evaluates the accuracy of the TRACE 2G VF and IAC models for vertically upward dispersed flows …

Modifications to the Computational Fluid Dynamic (CFD) software ANSYS Fluent were done to quantify and characterize tritium transport in gas-liquid contactors (GLCs). A double-slit, Ergun-like equation was employed for the porous media model, with Ergun coefficients validated with Sulzer's Sulcol software. Tritium transport from PbLi within the GLC was verified against analytical models. The geometry of the CFD model was based on the MELODIE GLC experiment. The hydrodynamic CFD pressure drop results align well with Sulcol estimations and fall between the predictions of the analytical Delft-Olujić and Billet and Schultes models. In terms of mass transfer efficiency, traditional mass transfer …

Integrating Literacy Into A High School Climate Change Unit, Bailey Bushman Jan 2026

Integrating Literacy Into A High School Climate Change Unit, Bailey Bushman

Graduate Research Papers

The ability to read is an important skill for members of society. Teaching students to read is often left up to elementary teachers and then secondary English teachers are expected to expand on those skills, but other content areas can help teach the needed literacy skills to students. In addition to typical literacy skills like reading and writing, students need to be able to understand climate science in order to make responsible decisions about the Earth’s future.

One way to ensure that students are getting both literacy skills and disciplinary content would be for science teachers to include a variety …

Beyond Digital Pessimism: How A Focus On Trust Can Enhance Eu Digital Law, Neil Richards, Woodrow Hartzog, Claire Boine, Lea Despotis

Faculty Scholarship

Lawmakers looking to foster technological innovation on the European market are adopting laws they hope will promote consumer trust in digital products. Their strategy can be broken down into three components. First, they aim to empower consumers to choose how much data they want to share with companies through an express consent framework. Second, they seek to avoid harms from digital products through product safety law such as adapting the Product Safety Regulation to digital products or adopting the AI Act. Third, they endeavor to prevent manipulation of consumers through digital means.

In this essay, we argue that while laudable, …

Regulating Crisis Pregnancy Centers After Nifla And Dobbs: Controversies Over When Government Is Imposing An Orthodoxy About Abortion, Linda C. Mcclain Jan 2026

Regulating Crisis Pregnancy Centers After Nifla And Dobbs: Controversies Over When Government Is Imposing An Orthodoxy About Abortion, Linda C. Mcclain

Faculty Scholarship

How does this broader sense of Barnette’s proscription of government from imposing “what shall be orthodox” implicate governmental restrictions on reproductive autonomy? Battles over reproductive freedom centrally implicate objections that government is unconstitutionally imposing a gender orthodoxy. Arguments for a right of personal autonomy embodying an antitotalitarian principle of liberty are arguments for a right to resist governmental imposition of an orthodoxy— for example, an idea about the natural or traditional role of women as mothers together with a view about how best to respect the sanctity of life. Rights to reproductive autonomy, grounded in personal autonomy and equality, …

International Law, The Courts, And The Political Branches Of Singapore: Painting A Complete Picture, Benjamin Joshua Ong Jan 2026

International Law, The Courts, And The Political Branches Of Singapore: Painting A Complete Picture, Benjamin Joshua Ong

Research Collection Yong Pung How School Of Law

In line with Singapore's vision of the separation of powers, the courts' duty is primarily to give effect to domestic law; the political branches take the lead in engaging with international law. A study of Singapore's interface with international law would therefore be incomplete were it to consider only the courts' role and not the political branches' model of international law as primarily a guarantor of Singapore's sovereignty and standing as a participant on the international stage. The political branches have been circumspect in engaging with international law in other areas, such as human rights, preferring a specifically Singaporean vision …

Dollar Challenger? Cbdcs, Complexities, And Monetary Hegemony, Heng Wang Jan 2026

Dollar Challenger? Cbdcs, Complexities, And Monetary Hegemony, Heng Wang

Research Collection Yong Pung How School Of Law

Digitalization is transforming the architecture of the international monetary system, reshaping how currencies function and financial infrastructures evolve. Among the significant developments are central bank digital currencies (CBDCs)—new digital forms of national currencies. While CBDCs promise benefits such as efficiency, they also generate relational, technological, legal, and governance complexities that would profoundly affect the global financial landscape. Against this backdrop, a compelling question arises: will CBDCs, particularly cross-border CBDCs, challenge U.S. dollar dominance?

To address this, this Article adopts a forward-looking approach to examine three interrelated crucial questions: what makes CBDCs complex? What governance complexity is likely to arise? Will …

The Shareholder’S Standing To Challenge The Exercise Of Directorial Power: Tianrui (International) Holding Company V China Shanshui Cement Group Ltd, Pearlie M. C. Koh

Research Collection Yong Pung How School Of Law

An enduring problem with the proper purposes duty is the apparent right of the shareholder to enforce the same despite the duty being owed to the company. The cases on the proper purpose duty have thus far simply assumed the right of the shareholder to do so without dealing with the question of standing. In Tianrui (International) Holding Company Ltd v China Shanshui Cement Group Ltd, the Privy Council dealt with this issue directly and affirmed the shareholder's right to bring the action on the basis of the statutory contract constituted by the memorandum and articles of association of the …

Relevance Between Strict Liability Theory And Banking Crimes In The Transfer Of Customer Funds: Negligence And Intent, Astrid Athina Indradewi, Evi Kongres, Ananda Chrisna D. Panjaitan, Evelyn Hutami Gunawarman

Research Collection Yong Pung How School Of Law

This article discusses the relevance of the Strict Liability theory to banking crimes in the transfer of customer funds involving elements of negligence as well as intent committed by bank managers. Strict liability places responsibility on the perpetrator without the need to prove fault, but rather by establishing a causal relationship between the act and the harm. In the context of civil law, Articles 1365 and 1367 of the Indonesian Civil Code recognize a form of liability resembling this concept through the mechanism of vicarious liability, whereby the bank as employer may be held liable for the unlawful acts of …

The Development Of A Midwifery Specific Tool To Identify The Barriers And Enablers To Change Within The Midwifery Setting, Sara Davis Jan 2026

The Development Of A Midwifery Specific Tool To Identify The Barriers And Enablers To Change Within The Midwifery Setting, Sara Davis

Theses: Doctorates and Masters

Despite being well-positioned to identify service gaps and propose improvements, many midwives lack the knowledge, skills, confidence, or tools to effect practice change. Implementation science (IS) offers a structured approach to moving evidence-based innovations into practice; however, existing IS theories, models, and frameworks do not reflect the unique context of midwifery practice. The first step in the intentional implementation of an evidence-based practice innovation is to conduct a context assessment to identify factors that may facilitate or impede its uptake. There are numerous evidence-based checklists for this, but none capture all the influences on midwifery practice environments.

In this study, …

The Experience Of Homelessness Among Older Adults In Bhutan - A Narrative Inquiry Study, Phuntsho Om Jan 2026

The Experience Of Homelessness Among Older Adults In Bhutan - A Narrative Inquiry Study, Phuntsho Om

Theses: Doctorates and Masters

A shift in the demographics of homelessness started to occur in the 1900s, with a significant increase in the number of middle-aged or elderly men and women being recognised as a part of the homeless population. The rising urgent global concern of homelessness of older adults necessitates a deeper understanding of the lived experience and holistic well-being of these marginalised adults. This thesis aimed to explore the phenomenon of homelessness of older adults in Bhutan, which is an often neglected topic in both national and international gerontological research.

Employing narrative inquiry within the constructivist approach as articulated by Pino Gravidia …

Nasal Polyp With Ossification In The Right Maxillary Sinus: Differential Diagnosis Of Radiopaque Lesions In Maxillary Sinus Region, Ssu-Li Li, Shan-Ju Chou, Yang-Che Wu, Chun-Yu Ho Jan 2026

Nasal Polyp With Ossification In The Right Maxillary Sinus: Differential Diagnosis Of Radiopaque Lesions In Maxillary Sinus Region, Ssu-Li Li, Shan-Ju Chou, Yang-Che Wu, Chun-Yu Ho

Journal of Dental Sciences

Nasal polyps are soft, droplet-like lumps that develop on the inner lining of the nose or sinuses due to long-term inflammation in those areas. Nasal polyps are common lesions, however, the occurrence of osseous metaplasia within them is relatively rare. Besides, without a CT scan, relying solely on plain X-ray films to assist clinical diagnosis can easily be misleading due to the uncertainty of the lesion’s location. In this report, our treatment steps were described as medical image analysis, removing the lesion, confirming the pathological result, and regularly follow-up. The Caldwell-Luc approach rather than endoscopic surgery was performed due to …
