Revisiting “Of Arms And The Militia: Gun Regulation By Legislatively Defining ‘Ordinary Military Equipment’”, Edward J. Curtis ,Jr.

Touro Law Review

In 2021, I published an article arguing that semi-automatic rifles and semi-automatic handguns, among other weapons, could be most effectively regulated by defining the “ordinary military equipment” that the states’ militia members were expected to produce in the event they were called to service. I based my argument on the rationale employed by the United States Supreme Court in its 1939 decision in United States v. Miller, which upheld the National Firearms Act of 1934.

High Stakes And Random Rewards: A Critical Look At Loot Boxes And Illegal Gambling, Brian T. Wersan Jan 2026

High Stakes And Random Rewards: A Critical Look At Loot Boxes And Illegal Gambling, Brian T. Wersan

Touro Law Review

Since their inception in the mid-2000s, loot boxes have been legal and virtually unregulated in the United States. Ever-growing mountains of evidence demonstrate the harms of loot boxes, but their structure has not yet been found to be in violation of any current U.S. gambling law, leading to a complete lack of recovery for victims. Certainly, if people experience harm, a legal avenue providing justice must exist. While other avenues are referenced, this Note ultimately argues that loot boxes can be interpreted by courts to satisfy the elements of, and thus, violate multiple state gambling laws, revealing a path to …

If I Only Had The Words (To Tell You): Billy Joel Lyrics In Legal And Medical Scholarship, Seuli Bose Brill, Christian H. Brill Jan 2026

If I Only Had The Words (To Tell You): Billy Joel Lyrics In Legal And Medical Scholarship, Seuli Bose Brill, Christian H. Brill

Touro Law Review

Law and medicine are often considered to be among the least accessible professions, partly because of the heavy use of non colloquial jargon. This article examines more than 150 instances in which Billy Joel’s lyrics have been used to improve the accessibility of legal and medical scholarship. Legal and medical professionals have used the words of the “Piano Man” to discuss a variety of topics—everything from civil procedure to property rights and the COVID-19 pandemic to colorectal surgery. Nontraditional communications techniques of this type do not just contribute to the body of legal and medical scholarship; they also help professionals …

One Step Forward, Two Steps Back: How The New York Appellate Division Slowed The Progress Of Judge Cardozo’S Effort In Macpherson V. Buick Motor Co. To End Privity’S Stranglehold Over Negligence Claims In Product Injury Cases, Jeffrey A. Van Detta Jan 2026

Van Detta

Touro Law Review

This article aims to tell the story of how the various Departments of the New York State Appellate Division sometimes helped—and just as often hindered—the development of the product injury law in the wake of MacPherson v. Buick Motor Co. (1916). Hailed for loosening the privity requirement that barred persons injured by products from suing manufacturers and suppliers for negligence, MacPherson has become the stuff of legal legend. No one put it more picturesquely than Dean William L. Prosser, who in a justly famous law review article described privity as a “citadel” and presented MacPherson’s author, Judge Benjamin Nathan Cardozo, …

The Role Of Legal Uncertainty, Risk, Institutional Size, And Mission In Presidential Selection: Is The Trend To Lawyer-Presidents An Unmitigated Good?, Nora V. Demleitner

Touro Law Review

This Article builds on Patricia Salkin’s May It Please the Campus which documents the extent to which legally trained persons have led U.S. institutions of higher education since colonial times. It explains the perennial attraction of lawyer-presidents despite substantial changes in legal training, in the professional formation of attorneys, and the transformation of higher education, especially with the rise of the modern research university, governmental investment, and heightened regulation of colleges and universities. Governing boards are increasingly attracted to the skills ascribed to lawyers and their personal characteristics, including the common law appreciation for slow change. This Article highlights how …

A Matter Of Life And Death: Give Me All Of Your Money And I'Ll Give You Healthcare, Shilanka I. Lewis

Marquette Law Review

The Medicaid Estate Recovery Program (MERP) is a federal mandate requiring states to recover costs of long-term care and related services provided to Medicaid beneficiaries from their estates after death. This Article explores the core arguments supporting and opposing MERP, offering a balanced analysis of its ethical, legal, and economic dimensions. Proponents argue that estate recovery ensures fiscal responsibility by recouping taxpayer dollars and preventing wealth transfer from those who received public assistance to their heirs. Proponents contend that MERP upholds the principle that Medicaid is a need-based program and a payor of last resort. Conversely, critics argue that MERP …

Sports And Corporate Innovation, Bing Qin Jan 2026

Sports And Corporate Innovation, Bing Qin

Dissertations and Theses Collection (Open Access)

Driven by the digital economy and intensifying global competition, corporate innovation has become a core driver of sustainable growth. Topmanagement members are key strategic decision-makers, and their individual characteristics critically influence the formulation and implementation of innovation strategies. While existing studies have examined the impact of topmanagement’s cognitive and psychological traits on innovation performance, significant gaps remain in understanding how their routine behavioral preferences—particularly running, a globally prevalent exercise—affect innovation performance through psychological mechanisms. The systematic relationship between running preferences, top management’s psychological traits, and organizational innovation outcomes remains underexplored.

Against this backdrop, the study investigates the mechanismthroughwhich top management’s …

Inside Out: Improving Large Model Safety, Wei Zhao Jan 2026

Inside Out: Improving Large Model Safety, Wei Zhao

Dissertations and Theses Collection (Open Access)

While Large Language Models (LLMs) and Multimodal Large Language Models (MLLMs) are at the frontier of current advancements in artificial intelligence, demonstrating remarkable capabilities across diverse applications, there are growing concerns about their reliability and security. LLMs remain vulnerable to adversarial attacks through carefully crafted prompts that circumvent safety mechanisms, while MLLMs face additional security challenges stemming from their multimodal nature. Despite considerable efforts in reinforcement learning from human feedback (RLHF) and supervised fine-tuning, existing safeguards have proven inadequate in addressing these critical vulnerabilities. This inadequacy stems from the fact that these models are inherently blackboxes that do not provide …

Loma Linda University Research Reports

Menstrual irregularities and dysmenorrhea are common in reproductive-age women and can affect quality of life. This study examined whether seed cycling could improve menstrual health in women with irregular cycles or menstrual discomfort. In this single-arm intervention study, women aged 18 - 45 consumed flax and pumpkin seeds during the follicular phase and sesame and sunflower seeds during the luteal phase for three menstrual cycles. Cycle length and symptoms were tracked monthly using smartphone health apps and the Menstrual Health Symptom Questionnaire (MHSQ). Sixteen participants completed the study. Repeated measures across baseline and 1-, 2-, and 3-month follow-ups were analyzed …

Comparing Perceived Ideal Protein Intake In Plant-Based Versus Meat-Based Diet Consumers, Gysel Avendano, Saya Iwanaga Jan 2026

Comparing Perceived Ideal Protein Intake In Plant-Based Versus Meat-Based Diet Consumers, Gysel Avendano, Saya Iwanaga

Loma Linda University Research Reports

High-protein diets have gained significant popularity in both social media and public discussion and more recently, a significant rise in protein consumption has been observed. Existing research has reported differences in actual protein intake across dietary patterns, with animal-based diets generally associated with higher total protein intake compared to plant-based diets. This growing focus on protein raises important questions about perceived ideal protein intake and the factors that shape it.

The primary objective is to compare perceived ideal protein intake among Southern California adults consuming meat-based versus plant-based diets. Additionally, we explored the influence of protein-related knowledge, beliefs, values, information …

Exploring The Relationship Between Bmi Classification And Levels Of Food Noise, Edmarie Billosillo Jan 2026

Exploring The Relationship Between Bmi Classification And Levels Of Food Noise, Edmarie Billosillo

Loma Linda University Research Reports

Rising rates of obesity in the United States necessitates an understanding of the multitude of factors that contribute to it. Recently, “food noise” has emerged as a topic of interest in this space. The current survey-based observational study aimed to understand the relationship between Body Mass Index (BMI) and levels of food noise. The results indicate a significant association between BMI and food noise levels and a connection between a history of disordered eating and food noise levels. Additionally scores on the Food Noise Questionnaire (FNQ) and the Food Cravings Questionnaire - Trait – reduced (FCQ-R-r) were found to be …

Mosaics: An Artist’S Thesis Of Identity Through Memory And Belonging, Sofia I. Menco Jan 2026

Mosaics: An Artist’S Thesis Of Identity Through Memory And Belonging, Sofia I. Menco

Honors Theses

Conceptually, this thesis engages visually with Magical Realism as pioneered by Colombian writer, Gabriel Garcia Marquez, as well as the symbolic color fields of Colombian painter Alejandro Obregon, and the narrative portraiture of Spanish illustrator, David de las Heras, by situating my personal narratives within broader themes of memory, color symbolism and faith-based art. Having this visual research in mind, I drew a lot of inspiration from Colombian Artisan Practices such as Mochilas Wayuu and the folkloric colors of such. At the same time, I explored the sociological and religious lens coming from a theoretical approach of George Hebert Mead’s …

Paradise Lost And Character Motivation: Sinful Behavior Or Inferiority Complex?, Esperanza Barrios Jan 2026

Paradise Lost And Character Motivation: Sinful Behavior Or Inferiority Complex?, Esperanza Barrios

Honors Theses

Sin is a concept that is always viewed through a religious perspective. But, through Paradise Lost, John Milton was able to bring further understanding towards human nature and one’s own sense of committing what’s perceived as sinful behavior without the veil of religion glazing over academics' understanding. In religious terms, sinful behavior is the idea of defying God’s commandments, but for this research, sinful behavior may be described as abnormal behavior that damages our best interests and relationships, usually for selfish gains. Each of Milton’s main characters, Satan, Adam, and Eve, fell from grace because all three damaged their relationship …

“Wandering Between Two Worlds”: From One Marshall To Another, Robert Ellison Jan 2026

“Wandering Between Two Worlds”: From One Marshall To Another, Robert Ellison

English Faculty Research

This personal essay chronicles my journey from Marshall, Texas, where I lived for 14 years, to Marshall University, where I have taught for 17 years. I discuss not only the move itself, but a pivot from Victorian studies to Appalachian studies, a change I made so I could focus on the region in which I live. The essay’s central question is mentioned in the title: how long do I have to live here before I can call myself a West Virginian, and before others will regard me that way as well? Is 17 years enough? If not, will I eventually …

The First Amendment Right To Privacy, Alex Chemerinsky Jan 2026

The First Amendment Right To Privacy, Alex Chemerinsky

Marquette Law Review

The First Amendment is often considered to be in tension with privacy. This

Article is about the contexts in which it is not.

Although freedom of speech can pose challenges for privacy governance,

privacy is a core First Amendment value. Many important First Amendment decisions were motivated more by intuitions about privacy than any other interest. For each primary First Amendment liberty—the rights to speak, listen, associate, and practice religion—the Supreme Court has recognized not only a

substantive liberty but also the right to exercise it privately.

But although expressive privacy is an important First Amendment value, it

remains underrecognized, …

Exploring Shared Experiences As Citizen Sport Diplomats: A Collaborative Self-Ethnography, Randall J. Griffiths, Jacob K. Tingle, Angela Breidenstein

School of Business Faculty Research

Research purpose: This study was a critical analysis of the lived experiences of three American university professors who served as volunteer citizen diplomats in a bi-lateral U.S. State Department sport exchange program with North Macedonian volleyball coaches.

Research methods: With the aim of capturing the experience of serving as citizen sport diplomats and making sense of it to inform future practice, this research utilized a collaborative self-ethnography approach. This reflexive approach brings together: (a) analytic autoethnography as individuals themselves are engaged in the ethnography and study, and (b) collective ethnography as a team collects and makes sense of shared data …

Stolen Childhood: Picture Book Stories Of Indian Residential Schools, Maughn Rollins Gregory

Picture Books

In the nineteenth and twentieth centuries American and Canadian government agencies and Christian churches established Indian residential schools where hundreds of thousands of children were “reeducated” in English and Christianity. They were not allowed to use their native languages or given names, to practice their religions, or to communicate with their siblings or parents. They were made to work in crop fields, kitchens, laundries, and industrial workshops. Many were physically and sexually abused. Many never saw their families again. The nine picture books reviewed here are accounts of survivors of residential schools from eight different Indigenous nations. In addition to …
