Transnational Legal Practice In A North American Common Market, Cheryl Lynn Virta

Florida Journal of International Law

This comment discusses the possibility of attorneys practicing transnational law, without the normal barriers, in a North American Common Market (NACM). In particular, this article discusses the possibility of Canada, Mexico and the United States liberalizing their rules on who may practice law within their borders upon the creation of a NACM. Additionally, this article explores problems of international practice which attorneys in the European Community (EC) encounter and suggests an alternative solution to the EC model for including legal services as part of a NACM.

Civil Resistance: The Dictates Of Conscience And International Law Versus The American Judiciary, Matthew Lippman

Florida Journal of International Law

This essay traces the evolution of civil resistance in the United States and argues for judicial recognition of the applicability of the necessity defense for civil resisters. Initially, the history of civil disobedience in the United States and the theory of Gandhian civil disobedience are outlined. The response of courts in rejecting attempts to justify such protest activities is then described; and American courts’ rejection of the necessity defense to justify formally illegal acts of protest is criticized.

Garcia And Judicially-Imposed Constitutional Protections Of State Sovereignty: The Australian Experience, John E. Eichhorst, Ronald C. Mccallum

Florida Journal of International Law

This article addresses the question of what part courts should play in preserving the states’ role in the federation by focusing upon Australia’s experience in this regard. The High Court of Australia’s efforts to confine federal legislative powers in order to protect areas of state sovereignty is relevant to American constitutional law in that the relationship between federal and state powers in the Australian Constitution is similar to that created by the U.S. Constitution. The influence of the American model upon the constitutional structure of the Australian federation is confirmed by evidence of the intent of the Australian constitutional framers …

An Assessment Of Information Literacy Competence Of Doctoral Students In Universities In Ogun State, Adesola Adekunle, Ezinwanyi Madukoma

Library Philosophy and Practice (e-journal)

Information is the foundation upon which all academic activities are built. The quality of teaching, learning and research is a function of the quality of information available to practitioners. While the current information landscape is characterized with information adequacy made possible by the application of ICTs to information handling, the sheer magnitude of available information tending towards overload is itself a challenge in the current technology-driven world we live in. In response to this challenge, academic institutions all over the world came up with what is known as information literacy described as an intellectual framework which enables individuals to identify, …

An Investigation Into Academic Self-Efficacy, Peer Influence And Examination Anxiety As Correlates Of Academic Achievement Drive Of Library And Information Science Students, Emmanuel Chidiadi Onwubiko

Library Philosophy and Practice (e-journal)

In any institution of learning, the true prove of any student’s performance is the level of academic achievement grade which may be a product of many independent variables. On the other hand, an impaired academic achievement motivation more often than not may portend danger on the learning outcome and intellectual well being of such student(s). This study therefore investigated the relationship between academic self-efficacy, peer group and examination anxiety with academic achievement drive of library and information science students. The study used descriptive survey research design and guided by three research questions as well as three formulated and tested hypothesis. …

Trauma-Informed Practices In Early Childhood Education, Michelle King Jun 2022

Trauma-Informed Practices In Early Childhood Education, Michelle King

Graduate Teacher Education

Young children who have experienced trauma risk falling behind peers academically, and socially, and may have lifelong mental and physical impairments (Bartlett, 2021). Half of the young children in the United States have been victims of early childhood trauma (Bartlett, et al., 2017). Findings analyzed for this paper show that trauma-informed care (TIC) can increase children’s chance of recovering and thriving, despite trauma (Bartlett, 2021). The following studies showed how early childhood teachers can best prepare themselves for students of trauma in their classrooms. Preparation included TIC that focused on strong social-emotional development (SED), helping build resilience, and preparing for …

There Was Confusion, Carter Cumbo Jun 2022

There Was Confusion, Carter Cumbo

Stonecoast MFA Theses and Capstones

This collection is about a young man with an overactive mind trying to make sense of life in early recovery from alcoholism. It focuses on the reckoning of his past, how it appears to go with him into the present, and the relationships that exist on the periphery of his adamant self- examination. It is about the realization that his obsessive process of self-examination, and desperation for answers to life’s universal questions, pale in comparison to the wisdom of his own lived experience. It is a journey through current and past life and the reckoning of a confused mind.

Parent Distress, Parent-Child Interactions, Child Distress And Child Cooperation During Cancer Treatment-Related Port Starts: A Caring Perspective, Jinbing Bai

Dissertations

Children reported more suffering from cancer treatment-related painful procedures than cancer itself. Appropriate parent interaction behaviors can help children cope with these painful procedures. Swanson's Theory of Caring provides a framework to formulate parent interaction behaviors. This dissertation consisted of three separate papers to investigate parent-child interactions during cancer treatment-related port starts.

We Eat, We Live, We Repeat: Reimagining Food Heritage Through Foodways And Sustainable Food Practices, Caitlin L. Crain, Amy L. Roznos, Britt L. Tate Beaugard, Darius L. Williams Jun 2022

We Eat, We Live, We Repeat: Reimagining Food Heritage Through Foodways And Sustainable Food Practices, Caitlin L. Crain, Amy L. Roznos, Britt L. Tate Beaugard, Darius L. Williams

Dissertations

The purpose of this co-authored, mixed methods descriptive research study was to examine how the intersection of foodways and sustainable food practices helps define the food heritages of St. Louis area residents. While prior research examines these concepts separately, and even shows connections with other factors such as health and discrimination, none look at all of these concepts together—a gap this research fills. To that end, this dissertation describes the intersection of cultural foodways and connection to sustainability in seeking a definition of food heritage and a path towards sustainable food heritage for St. Louis residents. Purposeful sampling using the …

Efficient And Adaptive Decentralized Sparse Gaussian Process Regression For Environmental Sampling Using Autonomous Vehicles, Tanner A. Norton Jun 2022

Efficient And Adaptive Decentralized Sparse Gaussian Process Regression For Environmental Sampling Using Autonomous Vehicles, Tanner A. Norton

Theses and Dissertations

In this thesis, I present a decentralized sparse Gaussian process regression (DSGPR) model with event-triggered, adaptive inducing points. This DSGPR model brings the advantages of sparse Gaussian process regression to a decentralized implementation. Being decentralized and sparse provides advantages that are ideal for multi-agent systems (MASs) performing environmental modeling. In this case, MASs need to model large amounts of information while having potential intermittent communication connections. Additionally, the model needs to correctly perform uncertainty propagation between autonomous agents and ensure high accuracy on the prediction. For the model to meet these requirements, a bounded and efficient real-time sparse Gaussian process …

High Quality, Equity, And Assessment: An Analysis Of Variables Impacting English Learner Standardized Science Test Performance And Implications For Construct Validity, Maria Del Carmen Salazar, Joanna K. Bruno, Melissa P. Schneider

Curriculum and Instruction: Faculty Scholarship

In the United States, assessment is seen as a lever that can facilitate high-quality education. This study on English learners, students whose native language is not English, was based on data from eighth-grade English learners’ performance on science general and content-specific (physical, life, and earth science) standardized exams and an English language proficiency exam. The researchers utilized regression analysis to examine factors (i.e., socioeconomic status, home language, English language proficiency, and receptive and productive elements of language) that are predictive of English learner performance in general and content-specific science standardized assessments to identify implications for construct validity of high-stakes science …

A Critical Discourse Analysis Of How Youth In Care Describe Social Support, Jared Israel Best Jun 2022

A Critical Discourse Analysis Of How Youth In Care Describe Social Support, Jared Israel Best

Dissertations and Theses

There are nearly 422,000 youth in foster care in the United States with 20,000 aging out each year. Youth who age out of care demonstrate worse outcomes in all areas (education, employment, homelessness, justice system involvement, and social support) compared to the general population. These outcomes represent an ideological production, or a production of knowledge regarding the discursive youth in care. Thus, dominant discourses of youth are informed and constitutive of these problematic outcomes. Similarly, youthhood is dominantly defined by risk and informed by peer groups and social relationships. This study presents findings from interviews with 22 youth preparing to …

Practical Efficient Microservice Autoscaling With Qos Assurance, Md Rajib Hossen, Mohammad A. Islam, Kishwar Ahmed Jun 2022

Practical Efficient Microservice Autoscaling With Qos Assurance, Md Rajib Hossen, Mohammad A. Islam, Kishwar Ahmed

Association of Computing Machinery Open Access Agreement Publications-Archive

Cloud applications are increasingly moving away from monolithic services to agile microservices-based deployments. However, efficient resource management for microservices poses a significant hurdle due to the sheer number of loosely coupled and interacting components. The interdependencies between various microservices make existing cloud resource autoscaling techniques ineffective. Meanwhile, machine learning (ML) based approaches that try to capture the complex relationships in microservices require extensive training data and cause intentional SLO violations. Moreover, these ML-heavy approaches are slow in adapting to dynamically changing microservice operating environments. In this paper, we propose PEMA (Practical Efficient Microservice Autoscaling), a lightweight microservice resource manager that …
