The Implication Of Permanence: Indigenous Water Rights In The State Of Arizona V. Navajo Nation, Collin Powell

In the State of Arizona v. Navajo Nation, the Supreme Court asked the Navajo to accept a contradiction. In light of disagreements over water rights between Arizona and the Navajo Tribe, members of the Navajo pointed to the Treaty of Bosque Redondo. The Treaty was a compromise between the Navajo and US Officials to reparate the Navajo after “The Long Walk”: a series of forced relocations against the Natives that resulted in over 2,500 deaths. Among these reparations was the guarantee of a “permanent home” on US federal lands. For over a century, case law defined a “permanent home” to …

Book Clubs And Young Adult Literature: Preparing Preservice Special Educators In Inclusive Literacy Practices, Marie Tejero Hughes, Juana Abarca, Marta Mohammad

Reading Horizons: A Journal of Literacy and Language Arts

The study presented in this article explored how book clubs centered on young adult (YA) literature supported 67 preservice special educators (PSEs) in developing inclusive literacy practices. The study examined PSEs’ reflections on social, cultural, and personal themes in YA narratives and how these informed their planning for students with disabilities. Using a qualitative descriptive approach, researchers analyzed online discussion posts collected over a 6-week book club course component. Findings reveal that PSEs engaged with themes such as identity, resilience, systemic inequities, and disability representation, often connecting literature to their own positionalities and future teaching roles. Reading Horizons: A Journal of Literacy and Language Arts

This article builds on existing scholarship by analyzing the use of home visits as a tool to learn about families’ funds of knowledge—their viewpoints, beliefs, and critical understandings—while also examining families’ own complex views of their linguistic and cultural assets. Through the lens of culturally sustaining pedagogy, the article discusses how home visits were used as a family/school partnership practice that celebrated and built on first grade students’ unique cultural and linguistic assets, as well as how families’ insights were shared with and taken up by first-grade students through classroom activities and projects.

Thinking Ahead: Ranking Substantive Canons To Protect Loper Bright, Tanner Macdonald

After forty-two years, the Supreme Court overturned Chevron deference in their decision Loper Bright Enterprises v. Raimondo (2024). The decision suggested a rising inclination towards legal formalism in cases of statutory interpretation. This Note argues that if the Court intends statutes to be interpreted in accordance with formalism, clarification is needed. Loper Bright was not sufficient to clear up the inconsistencies in statutory interpretation that the Court used to overrule Chevron. Without a strong prescription, Loper Bright will eventually collapse on itself. A formal ranking of substantive canons is one type of structure that would support Loper Bright and enable …

Artificial intelligence, a new phenomena embedding itself in every aspect of public life, is advancing at unprecedented rates with potentially catastrophic consequences. While fragmented and reaction regulation frameworks are currently in place, based primarily on tort cases, this paper calls for a hybrid regulatory solution that combines federal administrative law and streamlined international policy. This paper assesses proposed regulatory solutions - tort law, an industry-drafted “AI Constitution,” a Communications Decency Act-style immunity framework, a domestic federal agency, and an international regulatory body. How Can Librarians In Developing Countries Apply Evidence-Based Information Practices To Enhance Library Services In The Digital Era? A Scoping Review, Jackline Estomihi Kiwelu, Martha Lyaka, Patrick Ngulube

This scoping review maps existing literature on how librarians in developing countries apply evidence-based information practice (EBIP), identifying key themes and evidence gaps for future research. The review followed Arksey and O’Malley’s five-stage framework and applied the Preferred Reporting Items for Systematic Reviews and Meta-Analyses 2020 checklist alongside the Critical Appraisal Skills Programme for appraising study quality. From 6,693 records retrieved, ten studies met the inclusion criteria. The mapped studies suggest that librarians apply EBIP in diverse professional activities such as collection development, advocacy, reference services, information literacy instruction, decision-making, evaluation, monitoring performance, and enhancing service quality. Over the past decade, there has been an increase in political polarization across the United States. National symbols such as the American flag, the national anthem, the Pledge of Allegiance, and the military have become disputed markers of unity and identity. This study explores the following research question: How does political party affiliation influence Americans’ perceptions of key symbols of American pride and patriotism, and further, what do these perceptions reveal about national unity and political polarization? How Many Supreme Court Justices Can Stand On The Point Of A Needle? Originalist Scholarship, Political Neutrality, And Other Constitutional Nonsense, Stephen M. Feldman

In the 1935 article, "Transcendental Nonsense and the Functional Approach," Felix Cohen compared formalist legal reasoning, as practiced by traditional legal scholars and Lochner-era Supreme Court justices, to the philosophical musings of scholastic theologians. Unconnected to empirical reality, formalist legal reasoning was as nonsensical as a disquisition on “‘[h]ow many angels can stand on the point of a needle?’” Nowadays, originalist scholars are similarly engaged in nonsense. These scholars defend, refine, and practice originalist methods of constitutional interpretation as if the Supreme Court justices truly decided cases in accordance with the theory. To Compete Or Noncompete: Lessons On The Impact Of Unenforceable Noncompete Agreements In The Entertainment Industry, Guy Mannick

Economic and legal literature has increasingly focused on how the American legal system fails workers. One way it does so is through employee noncompetition agreements (“NCA” or “noncompete”) that limit a worker’s ability to join another company, often for better compensation and/or more responsibility. Some states enforce NCAs if they are reasonable in scope, geography, and duration; others either prohibit their application to certain types of workers or (as in California) outright prohibit them in most circumstances. More narrowly, new empirical literature about the behavioral effects of unenforceable noncompete agreements raises new questions about the behavioral impact on workers.

This Note examines geofence warrants and their ongoing threat to constitutionally protected rights such as privacy, speech, and assembly. Part I will provide background information on geofence warrants and examine the prominent justifications for the use of the warrants. Part II will examine how law enforcement’s use of geofence warrants threatens citizens’ constitutionally protected fundamental rights like privacy and reproductive rights. Claiming this duality—a civilized militancy—from their patron goddess Athena, an ancient Athenian citizenry could rationalize imperial conquest as democratic goodwill. Millennia later, the United States, seeking subtle proclamation of classical succession, crafted their national personification Columbia from the mold of Athena. From the Civil War until the First World War, Americans called on Columbia to symbolically sanction and spectacularize their own imperial ascent. The Sentience Of The Horse And The Philosophy Of Natural Horsemanship: Implications For Hrd Leadership, Rob E. Carpenter

This paper advances a biologically grounded philosophy of leadership through the lens of Natural Horsemanship. It reframes leadership as an embodied, sentient process rather than a purely cognitive or behavioral construct. Drawing from neuroscience, affective biology, sociology, and human resource development (HRD), it proposes that the horse–human relationship provides a living model for relational intelligence. The horse’s exquisite attunement to human emotion— mediated through limbic regulation and bio-behavioral synchrony—reveals that influence arises not from authority but from coherence. Leadership, like horsemanship, is a reciprocal act of co-regulation in which trust, safety, and communication are revealed through physiology before language. By …

The title of this collection, Totality: An Eclipse, and the titles of each of its three sections (“First Contact,” “Second Contact,” and “Third Contact”) combine to help illustrate my experience with grief as a solar eclipse: totality is the maximum phase of a total solar eclipse; first contact is when the sun just begins to disappear in the sky; second contact is when there is complete darkness in the sky; and third contact is when daylight finally returns. Business Roundtable (BRT) firms have faced intense scrutiny from investors, media, and the public following their 2019 “Statement on the Purpose of a Corporation,” which marked a shift from shareholder-centric governance to a stakeholder-focused approach. This shift has sparked debate over whether BRT firms are genuinely committed to social responsibility or merely using it as a branding strategy without implementing meaningful changes. This paper contributes to the debate by empirically examining a key dimension of social responsibility—corporate tax behavior. Using a difference-in-difference analysis covering 2004–2022, we find that BRT firms engage in higher levels of tax avoidance than other publicly …

Child Custody Presumptions: From Fault And Gender To Equal Time, Thomas James

For most of history, judges have applied fault- and sex-based presumptions to decide the kinds of custody arrangements that are in children’s best interests. Now that those have been eliminated, courts have no clear guidance for deciding the custody of children other than a vague directive to do what is “best.” Legislatures have enacted non-exclusive lists of suggested factors to consider, but these statutes are frequently as vaguely worded as the “best interest” directive. Because precatory words inserted into statutes with the intention of guiding a judge’s discretion are not binding, they do not provide a basis for appellate review. …

Comparative Effectiveness Of Radiofrequency Or Microwave Ablation And Chemotherapy For The Treatment Of Large (>5 Cm) Hepatocellular Carcinoma Tumors, Artem Boyev, Nirav Thosani, Putao Cen, Jennifer M Bailey-Lundberg, Julie Rowe, Curtis J Wray

Background and objectives

Treatment of hepatocellular carcinoma (HCC) >5 cm is problematic, as patients are often outside transplantation criteria, and cirrhosis compromises curative resection. The purpose of this study was to evaluate survival following treatment with ablation compared to chemotherapy in large HCC.

Methods

This was a retrospective cohort study of the National Cancer Database (NCDB) Participant User File from 2004 to 2017. Patients with HCC >5 cm in diameter treated with ablation versus chemotherapy alone were compared. Inverse probability-weighted propensity scores were used to model treatment assignments in the Cox proportional hazards model.

This dissertation contributes to the field of Cultural Economics by exploring the relationship between cultural transmission and economic outcomes. Across three distinct essays, this research investigates how mass media narratives shape economic preferences and labor decisions, and conversely, how economic fundamentals drive the evolution of cultural markers like language.   The first two chapters focus on the cultural and economic impact of television in Latin America, utilizing a novel dataset of telenovelas aired between 1960 and 2024.
