To Go Boldly, Betsy Ceraso Jan 2024

To Go Boldly, Betsy Ceraso

Duquesne Law Review

It was an honor and a privilege working for Chief Justice Max Baer, whom I and most others in our chambers referred to as "the Judge." As a jurist, the Judge came to the Supreme Court of Pennsylvania from the family court, and he brought with him an immediate and heartfelt sense of how the judicial system affects the vulnerable, particularly children. The Judge was the ever-dedicated public servant who thought it important not only to serve the people, but to give back by engaging with students and young lawyers to help shape the next generation of litigants and judges. …

Just Call Me Max, Maureen Lally-Green

Duquesne Law Review

Soon after Justice Max Baer was elected to the Supreme Court of Pennsylvania in 2003, he met my husband, Stephen Ross Green, Esq. Ross greeted him with the traditional title lawyers use in professional gatherings: "Justice." Max would have none of that and collegially said, "With you, I'm not Justice Baer. Just call me Max." From that day on whenever Ross and I were with him, he was careful to "call" him "Max."

The Phillie Phanatic Hits Free Agency: An Analysis Of Phillies V. Harrison And The Application Of Copyright Law To Mascots As Characters, Olivia C. Giles

Duquesne Law Review

Wacky, chaotic, lovable. These are just a few words used to describe mascots of all types, especially the Phillie Phanatic. The Phanatic is arguably one of the most well-known and recognizable mascots in sports. Its taunting of opposing teams and goofy yet aggressive personality have shifted the mascot landscape; as the way mascots are perceived continues to change, so does the number of teams hoping to use them.1 The Phanatic's antics at games have led to trouble more than a few times, gaining it the title of the mostsued mascot in sports.2 Nonetheless, the Phanatic is a cherished …

Punitive Damages As A Deterrent To Distracted Driving: Where The Statutory Penalties Fall Short, The Supreme Court Of Pennsylvania Must Fill The Gap, Abagail Hudock Jan 2024

Punitive Damages As A Deterrent To Distracted Driving: Where The Statutory Penalties Fall Short, The Supreme Court Of Pennsylvania Must Fill The Gap, Abagail Hudock

Duquesne Law Review

Punitive damages have always been one of the more controversial remedies available for tort harms.1 While a minority of states prohibit punitive damages altogether,2 the majority of jurisdictions embrace them not only as a means of punishment on those tortfeasors who commit especially heinous, callous, or irresponsible acts, but also as a deterrent to others from committing such conduct.3 They function, therefore, as a societal protection against behavior that poses a great risk to the public that criminal penalties and compensatory damage awards might not be able to prevent or attenuate on their own.

The Ersatz Of The Plain-Meaning Rule Of Statutory Construction In Sackett V. Epa (Ii), Dana Neacsu Jan 2024

The Ersatz Of The Plain-Meaning Rule Of Statutory Construction In Sackett V. Epa (Ii), Dana Neacsu

Duquesne Law Review

This essay uses the United States Supreme Court second decision in Sackett v. EPA,1 or Sackett (II), to stress the obvious: judges are tasked with decoding the nation's laws for everyone's understanding. Or, in the words of John Marshall: "It is emphatically the province and duty of the judicial department to say what the law is."2 Later that century, Justice Oliver Wendell Holmes, Jr. further clarified that judicial duty: "Thereupon we ask, not what this man meant, but what those words would mean in the mouth of a normal speaker of English, using them in circumstances …

Not Everything Has To Be A Taking: Tyler V. Hennepin County, Maryann Herman Jan 2024

Not Everything Has To Be A Taking: Tyler V. Hennepin County, Maryann Herman

Duquesne Law Review

In Tyler v. Hennepin County, we see the United States Supreme Court's continuation of the strengthening of individual property rights. The Court endeavored to address two issues in this case: 1) whether the seizing and selling of property to satisfy a tax debt without returning the surplus violates the Takings Clause; and 2) whether the forfeiture of the surplus resulting from a tax sale is an excessive fine under the Eighth Amendment. The Court answered the first question in the affirmative and, thus, did not address the second question.

Workplace Implications For Female Leaders: Exploration Of Stereotype Threat Within Video Conferencing., Roisin Donnelly, Anthony Ryan Jan 2024

Workplace Implications For Female Leaders: Exploration Of Stereotype Threat Within Video Conferencing., Roisin Donnelly, Anthony Ryan

Journal Articles

A significant body of research has documented the effect to which stereotype threat can be triggered by both the physical environment and by the use of various technology media. However, there is a dearth of research exploring the relationship between stereotype threat, defined here as “the concrete, real-time threat of being judged and treated poorly in settings where a negative stereotype about one’s group applies” (Steele, Spencer & Aronson, 2002, p.385), and video conferencing software features - specifically virtual backgrounds. This literature review suggested that this feature might, in certain circumstances, negatively affect the performance of groups not stereotypically associated …

The Impact Of Community-Based Programs And Restorative Justice On Reducing Black Youth Involvement In The Juvenile Justice System, Carla Victoria Alves

Undergraduate Review

What are the contributing factors that lead Black youth into the juvenile justice system? This inquiry aims to delve into the experiences of Black males categorized as juvenile delinquents. With arrest and conviction rates significantly higher among Black youth compared to their White counterparts, it is crucial to assess whether their experiences are comparable and to identify the underlying reasons for these racial disparities. The researcher is tasked with uncovering evidence-based practices to address and rectify these racial inequities within the juvenile justice system in the United States. This paper concentrates on adolescents aged 13 to 19, specifically Black youth, …

The Grand Ethiopian Renaissance Dam: Impacts At Play For Egypt, Chemp Carpenter Jan 2024

The Grand Ethiopian Renaissance Dam: Impacts At Play For Egypt, Chemp Carpenter

Undergraduate Review

As fresh water is required for human survival, access to water resources greatly benefits human societies. Over the last 50 years, there has been an increase in dam construction around the world. Dams are built to store water and regulate a river's flow, as well as to raise the water level upstream to facilitate flow into a channel. Furthermore, they offer numerous benefits, including controlling floods, improving irrigation, acting as storage, being a water supplier, and generating electricity. Nonetheless, dams also pose serious hazards. Ethiopia began construction on a 6000-megawatt dam called The Grand Ethiopian Renaissance Dam (GERD) in 2011, …

Left Out: Chronic Absenteeism In Elementary Schools, Catarina Morrissette Jan 2024

Left Out: Chronic Absenteeism In Elementary Schools, Catarina Morrissette

Undergraduate Review

In Massachusetts in 2022, approximately 33,000 students were chronically absent (missing ten percent of the 180- day school year) students (Buyinza, 2022). The purpose of this research project was to learn what strategies and programs work to support elementary students who are chronically absent, and why students are missing school. Chronic absenteeism impacts all academics but particularly reading levels; social skills and future career opportunities are also negatively impacted (DESE, 2022). Having resources to support educators and their students during these trying times is important for the success of a child’s educational future. As part of this project, teachers, administrators, …

The Consequences Of Colonization: A Meaningful Convergence Of Identity, Reality, And Nature In Wide Sargasso Sea, Alyssa Aguiar Jan 2024

The Consequences Of Colonization: A Meaningful Convergence Of Identity, Reality, And Nature In Wide Sargasso Sea, Alyssa Aguiar

Undergraduate Review

Jean Rhys’ Wide Sargasso Sea provides insight into the consequences of colonization through a fractured narrative that details the life of Antoinette Conway, a multicultural white Creole woman. Antoinette is the protagonist of the tale, but rifts in her account become increasingly severe as Antoinette’s sense of self begins to dissolve. As an adolescent, she remains an outcast in the social hierarchy of Jamaica, subsequently growing up surrounded by the effects of colonialism, but belonging to no specific group. This displacement becomes deeply ingrained in Antoinette, worsening as she grows older and loses those closest to her. When Antoinette marries, …

The Marketable Me: A Personal Branding Exploration, Amanda Prichard Jan 2024

The Marketable Me: A Personal Branding Exploration, Amanda Prichard

Mahurin Honors College Capstone Experience/Thesis Projects

The concept of personal branding was introduced in 1997 by Tom Peters in an essay entitled “The Brand Called You”. Since that term was introduced, there has been an explosion of media written about it and many different perspectives formed. In this social media driven age, much of the public understands personal branding as something for influencers and celebrities, when in reality it can, and should, be used by everyone. This project was created to be an intrinsic case study of my own personal branding experience as a college student looking to create a smooth transition into the post-graduation world. …

Mental Health Portrayals In Video Games And Their Impacts: Horror Games And Their Reliance On The Mentally Ill, Jordan Hightower Jan 2024

Mental Health Portrayals In Video Games And Their Impacts: Horror Games And Their Reliance On The Mentally Ill, Jordan Hightower

Mahurin Honors College Capstone Experience/Thesis Projects

This thesis seeks to address the representation of mental illnesses within the video game genre, specifically within horror video games. Horror video games have a history of relying on the mentally ill to increase the “fear factor” of games, though often do not seem to do proper research, as the portrayals often rely on stigmas and misconstruals on the mental illness being portrayed. This can lead to those who play aforementioned video games to develop subconscious stigmas and biases towards those who are mentally ill. Through a literary analysis of Danganronpa: Trigger Happy Havoc and Omori, examples of negative and …

I Am Gay And Catholic: An Analysis Of Identity Integration In Lgbtq+ Members Converting To Catholicism, Maria Julian

Mahurin Honors College Capstone Experience/Thesis Projects

This article examines the negotiation of sexual and religious identities among Catholic members of the LGBTQ+ community. I explore context-specific identity negotiation to determine how and why, in a time of “cultural warfare” within the Catholic Church surrounding the acceptance of LGBTQ+ participants, LGBTQ+ members choose to convert to Catholicism. Through semi-structured interviews conducted with members of the LGBTQ+ community, I identify and discuss several themes based on the identity integration process of these individuals: (1) Experiencing “The Call” (the initial interest in Catholicism), (2) Encountering the Religious “Other” (association with a welcoming and enduring Catholic LGBTQ+ Community), (3) Immersion …

The Influence Of School Policies On Black Students' Mental Health, Ama Ogyaa Boateng Jan 2024

The Influence Of School Policies On Black Students' Mental Health, Ama Ogyaa Boateng

Mahurin Honors College Capstone Experience/Thesis Projects

When educators target Black students’ hair through school policies, they inadvertently target their racial identity, causing harm to their mental health (Joseph- Salisbury & Connelly, 2018). While previous research has looked at the relationship between a school’s racial climate and Black students’ mental health (Mattison & Aber, 2007), this research study explored the mental health of Black adults who have experienced racial discrimination or racial microaggressions, in relation to hair and dress codes, as Black students in the K-12 school system.

A retrospective survey was used to explore the experiences that Black young adults had in the K-12 school system …

Detriments To Effective High School Teaching In Kentucky, Christopher Wallace

Mahurin Honors College Capstone Experience/Thesis Projects

This quantitative study examines Kentucky public high school teachers’ perceptions regarding the detriments they and their students face when striving to effectively educate and learn. Data was collected by surveying public high school teachers from across the Commonwealth (n=453). Using Likert-style scales, the survey captures the barriers most detrimental to their students’ assessment outcomes. Concluding questions sought additional personal experiences to elaborate findings. 2023 Kentucky American College Test (ACT) scores represent the dependent variable in the ordinary least squared regression models. Further information regarding administrative effort and points of view was gathered through interviews with four Commonwealth Superintendents. This study …

Two Stories, One War: Arturo Barea, George Orwell, And The Spanish Civil War, Autumn Howard Jan 2024

Two Stories, One War: Arturo Barea, George Orwell, And The Spanish Civil War, Autumn Howard

Mahurin Honors College Capstone Experience/Thesis Projects

While studying abroad in Spain, I learned the Spanish Civil War is a controversial, even taboo, subject not broached outside the classroom, and this sparked a curiosity to know the truth. Both Arturo Barea and George Orwell wrote books about the Spanish Civil War based on their personal experiences in order to portray the truth as they lived it. This essay analyzes Spanish author Barea's La llama and George Orwell's Homage to Catalonia individually and comparatively. Both authors were immersed in similar experiences on paper, but their portrayal differs greatly. I discuss how various literary tools employed - insider versus …

A Self-Defeating Prophecy: Democratic Ideology After The Cold War, Nathaniel Aaron Brooks Jan 2024

A Self-Defeating Prophecy: Democratic Ideology After The Cold War, Nathaniel Aaron Brooks

International ResearchScape Journal

This paper analyzes the historiography of a scholarly debate on democratic ideology. Using the end of the Cold War as its epoch, it details the debate on the subject of “Whig history”, an interpretation of the past that argues that Western liberal democracy is the inevitable conclusion of world history. Analysis demonstrates that the end of the Cold War solidified two intellectual camps—one that believed in the interpretations and predictions of Whig history, and one that believed this ideology was incorrect and had potentially dangerous consequences. The end of the Cold War revitalized the dormant Whig interpretation of history within …
