Aquinas, Wilson, And Continuity On Crime And Punishment, Brian M. Murray

This Article compares the legal thought of James Wilson, a leading jurisprudential figure during the American Founding, and Thomas Aquinas, perhaps the most well-known medieval philosopher, on crime and punishment. It argues their theories are closer than the historical gulf between them suggests would be the case. Both limit the definition of crime to morally culpable acts involving public harm. Each considers redressing the public disorder crime causes as the primary justification for punishment. While Wilson defers to the English common law to emphasize protecting certain natural rights and to prevent crime, Aquinas points to his understanding of natural law …

Is there any value in children’s horror literature and film? Literary theorists have shown that children’s horror is uniquely positioned to be not only captivating and accessible, but also educational and hopeful for some young audience members. Like most fictional monsters, those presented in children’s horror can be read as metaphors for the fears and experiences people face in real life. Scholars have argued that engaging with this type of frightening media may help people confront challenging ideas and feelings from a place of safety. The ministerial exception is generally seen as safeguarding the autonomy of religious institutions in employment decisions, but does it also serve as a roadblock to religious freedom? The recent dismissal of the gender discrimination lawsuit by Rev. Dr. Eboni Marshall Turman against the historic Abyssinian Baptist Church calls into question whether the breadth of the exception promotes religious freedom in all contexts. This article argues that the ministerial exception, although designed to protect religious autonomy, may paradoxically undermine that very autonomy when applied to faith communities, like Abyssinian, that have voluntarily embraced anti-discrimination as part of their theology and praxis. …

Frozen Identity: How Rigid Conceptions Of Sexuality Endanger Lesbian Asylum Claims, Mariajose De La Hoz

Bias, stereotypes, and antiquated conceptions of sexual orientation erect systemic barriers for lesbian women seeking asylum in the United States. Decision-makers with a limited understanding of LGBTQI+ identities impose expectations that reinforce stereotypes while discrediting applicants’ lived experiences. This results in adverse credibility determinations that distort evidentiary burdens and deny relief to applicants with legitimate claims. This Note examines how fixed conceptions of identity endanger the asylum process for lesbian women fleeing persecution based on their sexual orientation. “As Though You Could Never Sink”: Gender Euphoria Through Aquatic Embodiment In The Sun Also Rises, Devan Edwards

Recent scholarship in disability studies and queer theory (2007-2024) reveals that Jake Barnes's war wound in Hemingway's The Sun Also Rises functions as something more complex than tragic loss. This paper argues that Jake's swimming and fishing scenes constitute moments of gender euphoria, a term borrowed from contemporary transgender studies, enabled specifically by aquatic embodiment. In these scenes, water functions as the physical and symbolic medium through which Jake's war-wounded body transcends the performative demands of 1920s heteronormative masculinity. Originalism requires interpreting the Constitution by reference to a provision’s original public meaning. But there is very little evidence of original public meaning for some constitutional provisions, most notably the Free Exercise Clause. Originalists have splintered into several different methodological approaches toward the Clause. Justices Scalia and O’Connor staked out opposing originalist views on the Clause thirty years ago in Employment Division v. Smith and City of Boerne v. Flores. In the Roberts Court, some of the conservative justices have attempted to apply a simple textualist interpretation of the Clause, but those efforts have not attracted most of the …

The traditional summary judgment standard across state and federal courts has long been that facts are viewed in the light most favorable to the nonmovant; this has developed as both a baseline measure to test whether the claims are even fit for a trial, but also as a measure of fairness – it is the movant who wants to dispose of the case before trial, so this standard gives the nonmovant a more level playing field. Third-party litigation funding (TPLF) has opened the courtroom doors for many Americans who may otherwise not be able to afford to seek justice in America’s civil court system. The democratization of the civil court system has benefitted many Americans but the lack of transparency as to the true identities of those behind the litigation has sparked concerns that America’s foreign adversaries may weaponize TPLF to harm America’s national security interests through lengthy and costly litigation. Introduction: Glucagon-like peptide-1 receptor agonists (GLP-1 RAs) are increasingly prescribed for glycemic control and weight reduction in patients with Type 2 Diabetes Mellitus (T2DM). Patients with T2DM exhibit elevated fracture risk despite preserved bone mineral density due to impaired bone quality and microarchitectural compromise. Whether GLP-1 RA therapy exacerbates or mitigates skeletal risk remains clinically relevant to podiatric care.

Hypothesis: We hypothesized that GLP-1 RA therapy is not associated with increased lower extremity fracture risk and may demonstrate protective trends influenced by age and duration of therapy.

The Impact Of Prior Abusive Dating Experiences And Gender On Romance Scam Victimization And Monetary Loss, Trevor Rowe

Online romance scams are a rapidly expanding cybercrime that affects millions of people each year, financially and emotionally. This study examines an underexplored question: Will individuals with a greater number of abusive partners be more vulnerable to romance scam victimizations and lose more money? Adult dating app users (N = 518) completed an online survey. After controlling for being approached for relationships, those with a greater number of past abusive partners were more likely to be victims and lost more money. In addition, men reported a higher frequency of romance scam victimizations and more money loss.

Both the Iliad and the Heike monogatari have received scholarly attention throughout the years, though rarely in comparison with one another. A few scholars, such as Tyler Creer and Naoko Yamagata, have attempted to examine the two side by side, but very little work has been done beyond their respective analyses. This is unsurprising as a cursory glance at the two texts suggests that they are too separated by time and space to warrant closer examination. Gratitude journaling interventions have repeatedly been shown to enhance wellbeing when conducted in participants’ first language (Emmons & McCullough, 2003; Sansone & Sansone, 2010), yet no studies to date have examined these practices in second language (L2) contexts. This mixed-methods quasi-experimental study investigated the effects of a six-week gratitude journaling intervention on adult L2 English writers enrolled in an intensive English program. Eleven writing classes (N = 183) were randomly assigned to either a gratitude journaling group or a neutral-events control group, with 123 participants completing all four stages of data collection. Visual impairment greatly restricts an individual's ability for perception and interaction with the environment, making everyday activities challenging without the availability of appropriate assistive technologies. One major barrier is the inability to perceive visual scenes, which are essential for spatial awareness, wayfinding, and situational knowledge. Dual Language Immersion (DLI) programs are commonly recognized for supporting the development of oral proficiency; however, persistent challenges with grammatical accuracy, particularly subject-verb agreement, remain common among elementary-aged learners. This mixed-methods study focuses on third-grade students in a Portuguese DLI program and examines how they use present-tense verb forms in different classroom contexts. Drawing on classroom observations, instructional materials, and students’ oral and written production, the study analyzes the nature of the input learners receive and the types of errors that persist during oral communication. This thesis analyzes the dynamics of the Planar (2+2)-Body Problem which consists of two asteroids moving under the gravitational force of each other and of two larger primaries. We use the McGehee blow up technique to remove the singularities in the dynamics associated with a triple collision with one of the primaries by introducing a new set of variables. Additional variables are introduced to reduce the dimension of the problem. We then derive the dynamics for these new variables.
