All Decisions
In this owner's use holdover proceeding brought by the non-profit landlord, the court granted the landlord's motion for summary judgment after the tenant defaulted in opposing. The court rejected the tenant's argument that a deceased prior occupant was a rent-stabilized tenant to whose tenancy the tenant, as a non-traditional family member, could succeed. The court found that under the 2019 HSTPA amendments, the prior occupant was at most a "tenant" in name only for the non-profit housing accommodation exempt from rent regulation, not an actual rent-stabilized tenant. As the tenant was at best a licensee, he could not claim rent-stabilized …
Shu Ming Wang V. Moises
All Decisions
Wang v Moises is a Holdover-Lease Expiration case in the Civil Court of the City of New York, Kings County. The landlord sought possession of the property alleging lease expiration, while the tenants argued for de facto rent stabilization due to a disputed sixth unit in the basement. The court, after weighing evidence including testimony and documents, found in favor of the landlord, ruling that the basement did not constitute a separate housing unit and thus denying the tenants' rent stabilization claim. The court also upheld the validity of the termination notice issued by the landlord. This judgment highlights the …

In situ transcriptomic techniques promise a holistic view of tissue organization and cell-cell interactions. There has been a surge of multiplexed RNA in situ mapping techniques but their application to human tissues has been limited due to their large size, general lower tissue quality and high autofluorescence. Here we report DART-FISH, a padlock probe-based technology capable of profiling hundreds to thousands of genes in centimeter-sized human tissue sections. We introduce an omni-cell type cytoplasmic stain that substantially improves the segmentation of cell bodies. Our enzyme-free isothermal decoding procedure allows us to image 121 genes in large sections from the human …

Targeting the mitogen-activated protein kinase (MAPK) cascade in pancreatic ductal adenocarcinoma (PDAC) remains clinically unsuccessful. We aim to develop a MAPK inhibitor-based therapeutic combination with strong preclinical efficacy. Utilizing a reverse-phase protein array, we observe rapid phospho-activation of human epidermal growth factor receptor 2 (HER2) in PDAC cells upon pharmacological MAPK inhibition. Mechanistically, MAPK inhibitors lead to swift proteasomal degradation of dual-specificity phosphatase 6 (DUSP6). The carboxy terminus of HER2, containing a TEY motif also present in extracellular signal-regulated kinase 1/2 (ERK1/2), facilitates binding with DUSP6, enhancing its phosphatase activity to dephosphorylate HER2. In the presence of MAPK inhibitors, DUSP6 …

Optimizing Training To Effectively Mitigate The Human Risk Of Cyberattacks: A Critically Appraised Topic, Christine Davis
Optimizing Training To Effectively Mitigate The Human Risk Of Cyberattacks: A Critically Appraised Topic, Christine Davis
Engaged Management ReView
Employees are an organization’s greatest defense against cyberattacks; however, traditional cybersecurity training falls short of developing this protection. Failing to properly train employees to prevent a cyberattack becomes a vulnerability that attackers exploit. Can organizations optimize employee cybersecurity training to effectively mitigate the human-related risks of cyberattacks? Findings indicate that optimized cybersecurity training can indeed mitigate this risk. In this topic paper, the author reviewed the research to recommend strategies for optimizing such training, highlighting the importance of embracing cybersecurity company-wide, at all levels. Furthermore, the lessons in the training must be reiterated, updated, and reinforced—thus promoting a culture of …

"The First Man To Plant The Holy Gospel In Florida:" A New Biography Of Francisco Lopez De Mendoza Grajales (1527-1586), David Arbesu
Florida Historical Quarterly
Francisco Lopez de Mendoza Grajales, the secular priest from Jerez de la Frontera who sailed across the Atlantic with Pedro Menendez de Aviles in 1565, can truly be considered one of the "founding fathers" of Florida. Apart from being a key figure in Menendez' expedition, he served as the first vicar of St. Augustine and San Mateo, helped establish the first permanent mission in the United States, and, as Michael Gannon reminds us, celebrated "the first mass in America's first city." An eleven-foot tall statue of the chaplain erected in 1958 on the grounds of Mission Nombre de Dios marks …

This comprehensive review delves into the complexities surrounding the education of students with autism spectrum disorder (ASD). The exploration begins by addressing educator, parental, and paraprofessional perspectives. It reveals challenges related to a lack of autism competence among teachers, managing student behavior, and the pursuit of alternative placements by parents seeking tailored educational experiences. Examining the historical context of ASD, considering its neurodevelopmental nature, emphasizes the importance of continuously evolving teacher preparedness to meet the diverse needs of students. The studies draw attention to the multifaceted challenges educators face, particularly in the absence of consistent training in evidence-based practices (EBPs) …

A Network Meta-Analysis Comparing Traditional Acupuncture Points And Ashi-Points: Dealyed Onset Muscle Soreness, Yufang Shao
Theses and Dissertations
Delayed onset muscle soreness (DOMS) is a type of muscle injury that can occur following moderate-to-high intensity physical activity. More recently, acupuncture has been considered as an alternative treatment method for muscle injury, which includes DOMS. However, there have been no specific investigations into potential differences when using traditional acupuncture (points based on traditional Chinese medicine theory), Ashi-acupuncture (points not on Chinese meridian, also known as tender points), or sham-acupuncture (superficial points, or points neither on the Chinese meridian nor the tender points) for treatment of DOMS. PURPOSE: To investigate the effectiveness of acupuncture treatment with traditional acupoints, Ashi points, …

On November 6, 1938, Charles T. Dashiell, Jr, was driving south through Maryland. Around 5.30 or 6, Dashiell picked up two 19-year- old hitchhikers, J. Reginald Moore and Reginald Porter. Moore and Porter had been dropped off by Moore’s older brother and were now seeking to rejoin him several miles further on. The two boys got into Dashiell’s one-seat coup, with Moore sitting in the middle and Porter sitting on the right. It was a clear day, and the road was dry. Dashiell’s car lights were turned on and in good working condition.

Anharmonicity strongly influences the absorption and emission spectra of polycyclic aromatic hydrocarbon (PAH) molecules. Here, IR–UV ion-dip spectroscopy experiments together with detailed anharmonic computations reveal the presence of fundamental, overtone, as well as 2- and 3-quanta combination band transitions in the far- and mid-infrared absorption spectra of phenylacetylene and its singly deuterated isotopologue. Strong absorption features in the 400–900 cm−1 range originate from CH(D) in-plane and out-of-plane wags and bends, as well as bending motions including the C≡C and CH bonds of the acetylene substituent and the aromatic ring. For phenylacetylene, every absorption feature is assigned either directly or …

Turkish Journal of Earth Sciences
The turbiditic succession containing exotic blocks of various sizes deposited in the Çüngüş Basin, has been previously identified as the Çüngüş Formation in front of the Southeast Anatolian Suture Belt, Türkiye. These turbiditic sediments, dated as Eocene-Early Miocene, were interpreted as the lowermost allochthonous tectono-stratigraphic unit thrust over the Lice Formation during the Miocene within the Çüngüş-Hakkari nappes. In this study, the stratigraphical, sedimentological, palaeontological, and structural features of the Çüngüş and Lice formations are examined and reinterpreted within a basin model. Both formations consist of sandstones, siltstones, mudstones, and subordinate conglomerates, indicating ramp-fringe palaeochannel, submarine fan, and basin-floor turbidite …
