Digital Frontiers In Aesthetics: Applying Dewey's Insights To Generative Ai, Malcolm F. Lathrop-Allen
Digital Frontiers In Aesthetics: Applying Dewey's Insights To Generative Ai, Malcolm F. Lathrop-Allen
Student Publications
The last few years have seen the emergence of ‘artificially intelligent’ systems en masse, which perform tasks which had previously only been possible by human intelligence. Arguably, the impact of ‘AI 2.0’ has been felt most prominently in the art world — artists have panicked as DALL-E, Midjourney, and other image generation algorithms manufacture pieces which previously required weeks of painstaking labor to create. This project seeks to develop a more critical framework for this novel mode of artistic creation and propose better ways of thinking about, using, and “becoming with” artificial intelligence in the domain of artistry. The first …

Presentation Of Culture: Framing History In Us And Italian Museums, Fiona G. Cheyney
Student Publications
National legacies drastically impact museum work and archaeological ethical practices in the US and Italy. My research question asks, to what extent and how are ethical considerations of museum professionals shaped by nationalism and evolving perceptions of how museums should serve the public in these two different national contexts? Data collected from semi-structured interviews with academics in the field reflects that museums must be transparent about the history of the topics exhibited and their methodological practices; this is supported by many findings suggested in previous scholarship (Garoian 2001; Gazi 2014; Falcucci 2021). Particular moments in US and Italian national histories, …
Mythos And Logos: Foucauldian Subjectivities Of Virginia Woolf's Orlando, Hayley R. Cisney
Mythos And Logos: Foucauldian Subjectivities Of Virginia Woolf's Orlando, Hayley R. Cisney
Student Publications
Virginia Woolf’s Orlando: A Biography details a centuries-long battle between Orlando and the sexual structures of repressive power in England. The biographical framework of the novel implies its contribution to objective, historical fact, while the miraculous nature of Orlando’s sexual transformation directly conflicts with constituted epistemologies of being. This paper examines these contrasting forces through Michel Foucault’s post-structuralist considerations of knowledge, power, and sexuality, in addition to the incorporation of other scholarship on Woolf’s conceptions of gender. I specifically follow the timeline of Foucault’s interpretation of the repressive hypothesis as it unfolds throughout the course of Woolf’s novel. By establishing …
A Latter-Day Disease: Mormons And Cholera In The Nineteenth Century, Alexandra L. Wein
A Latter-Day Disease: Mormons And Cholera In The Nineteenth Century, Alexandra L. Wein
Student Publications
Nineteenth-century America saw the emergence of two seemingly parallel entities - the epidemic disease of cholera and the Church of Jesus Christ of Latter-day Saints, better known as the Mormon faith. To understand the intersection of Mormons and cholera, one must look within the interdisciplinary framework of Civil War-era history, religion, and epidemiology. Cholera epidemics in 1832 and 1849 coincided with the mass Mormon migration west, causing great suffering and death for Mormons traveling by land and sea. While their westward exodus exposed them to cholera, their religious teachings also contributed to why they contracted the disease. The Word of …
Improving Data Accuracy, Completeness, And Efficiency In The Pediatric Congenital Heart Surgery Registry, Kelly Brown
Improving Data Accuracy, Completeness, And Efficiency In The Pediatric Congenital Heart Surgery Registry, Kelly Brown
Translational Projects (Open Access)
Clinical patient registries, such as the pediatric congenital heart surgery registry, are designed to collect large amounts of varied clinical, administrative, and demographic data on specific patient populations. Data from these registries are used for multiple purposes, such as reporting, national benchmarking, research, quality improvement activities, and accreditation. Therefore, organizations must have accurate, complete, and timely data to meet these demands. However, manual data abstraction is the predominant method for populating a clinical patient registry. This method utilizes paid data abstractors, clinicians, and administrative staff and can be inefficient, incomplete, inaccurate, and costly.
The aim of this project was to …
Fixing Disparate Prosecution, Shima Baradaran Baughman, Jensen Lillquist
Fixing Disparate Prosecution, Shima Baradaran Baughman, Jensen Lillquist
Minnesota Law Review Vols. 106:2 onward (2021-present)
America's system of public prosecution is broken. Prosecutors who charge harshly or disparately are shielded from any consequences or recourse, and defendants are left with few options. This asymmetry in power results in prosecutors singlehandedly maintaining mass incarceration in the United States and leads to some states incarcerating more people per year than entire countries. Prosecutors in the United States are permitted to charge with little supervision or guidance other than to follow the law and “seek justice.” Many choose to charge the highest number of crimes possible, while others choose to exercise restraint and label themselves as “progressives.” But …

Modern Statutory Interpretation: Correcting Court-Made Deficiencies In Title Vii Law, Jordan Boudreaux
Minnesota Law Review Vols. 106:2 onward (2021-present)
Title VII of the Civil Rights Act of 1964 is a monumentally important piece of legislation that ensures all Americans can enjoy a fair workplace, free of discrimination. Even so, the federal circuits remain split on a significant aspect of Title VII's interpretation. Notably, in some circuits, employees can still be scheduled or transferred based on their protected class, with minimal redress under Title VII. In Hamilton v. Dallas County, the Fifth Circuit upheld an employer's explicitly sex-discriminated schedule as unactionable under the court's standard. In doing so, the Fifth Circuit temporarily validated explicit discrimination in a key aspect of …

Accommodations And Resources For Audiologists With Hearing Loss, Joseph Thomas Kraus
Doctoral Scholarly Projects & Capstones
Hearing loss affects millions of people worldwide. The audiology profession strives to help all individuals achieve their communicative goals and needs, providing support and expertise to a deserving population. Audiologists themselves are not immune to the challenges of hearing differences themselves. This project has two main objectives to identify and discuss needs and challenges faced by audiologists, both within their professional field, as well as their educational upbringing, and to highlight specific accommodations that can enhance their professional success. The research phase of this project aims to develop a resource guide tailored to the needs of audiologists with hearing loss …

Assessing Bottlenose Dolphin (Tursiops Truncatus) Behavioral Responses To Discriminative Stimulus During Dolphin Interaction Programs (Dips), Megan Davis, Hannelore Tampipi
Posters - 2024
Dolphin-human interaction programs (DIP) References have become a popular experience offering humans an opportunity to interact or swim with cetaceans, most often bottlenose dolphins (Tursiops truncatus).
● Previous studies on dolphin-human interactions have been centered on therapeutic results for humans (Brensing et al., 2005), guests’ future conservation efforts, and educational efficacy (Miller et al., 2013) rather than welfare or outcomes for dolphins (Smith, 1981).
● Under human care, trainers request behaviors from dolphins typically via a hand signal as a discriminative stimulus (SD).
● Resulting behavioral responses to these SDs during interaction programs may suggest willingness to participate (WTP), and …

Rewilding The Danube Delta; How Rewilding Can Revitalize Ecosystems And Restore Biomes, Antonio Martinez
Posters - 2024
The Danube Delta and the surrounding area harbors a variety of ecosystems and biodiversity from Romania to Ukraine. The 580,000-hectare delta is particularly well known for its abundance of birdlife, with the presence of 312 important bird species, many of which use the Delta as an important stopover and breeding area such as the Dalmatian Pelican (UNESCO et al.,1998). Here, also lie some of Europe’s very few remaining grazed mosaic landscapes, the beautiful wetlands. The delta region includes extensive examples of unaltered rivers, lakes, reed beds, marshes, steppes, dunes, sandbars, coasts, lagoons, salt marshes and climax forests (Rewilding Europe n.d.).This …

Yun-chien Chang’s Property Law: Comparative, Empirical, and Economic Analysis, is an impressive piece of scholarship. Ten years in the making, Yun-chien has developed the most comprehensive comparative analysis of property law ever undertaken. The effort involved was herculean. He consulted codes in eight different languages and translations into these languages of dozens of others, enlisted the assistance of a small army of research assistants, and solicited the assistance of scholars and lawyers from around the world. The result is nothing less than revelatory. Anyone interested in property law, even if only from the perspective of their own legal system, …
The Beauty Of A Good Appetite In A Social Media Age, Megan Heeder
The Beauty Of A Good Appetite In A Social Media Age, Megan Heeder
Dissertations (1934 -)
This dissertation provides a theological response to eating disorders, disordered eating, and body dissatisfaction, particularly in light of social media’s influence on women and girls. Theologically, eating disorders may be thought of as conditions produced by a debased version of beauty, a self-transcending rather than self-negating conception of kenosis, and a distorted pursuit of goodness or “misguided moralism” that results. Paying particular attention to the feminine thin ideal and its influence on Western beauty standards, this dissertation engages Hans Urs von Balthasar’s theological aesthetics and presentation of kenosis alongside virtue ethics to respond to society’s impoverished vision of beauty and …
Beyond Basic Vital Signs And Cultural Idiosyncrasies: Does Ai Shape Fast And Frugal Clinical Judgment?, Olga Kozlova
Beyond Basic Vital Signs And Cultural Idiosyncrasies: Does Ai Shape Fast And Frugal Clinical Judgment?, Olga Kozlova
Dissertations (1934 -)
What motivates clinicians to trust Artificial Intelligence, even in the presence of well-adopted traditional information as an alternative? Should there be differences in the capacity to trust AI influenced by the state of market adoption and cultural phenomena? This study seeks to supply possible answers gained through an experiment with AI in clinical judgment in mature and emerging markets. It applies a well-established theory, heuristics-based decision-making, in demonstrating how the AI cue is recognized and utilized in clinical judgment, as compared to traditional cues such as basic vital signs. It tests the AI cue for dominance against traditional cues. To …

Investigating The Dynamic Response Of Surrogate Energetic Systems With Variable Geometric Complexity, Rafee Mahbub
Dissertations (1934 -)
The goal of this research is to understand the dynamic behavior of functional meso-structures fabricated with a surrogate energetic material, sugar and binder, polydimethylsiloxane (PDMS) in order to control the sensitivity of the system. The approach begins with investigating the dynamic response of PDMS and generating an Equation of State (EOS) model. Experiments were performed in a one-dimensional reverse plate impact configuration at velocities ranging from 29 m/s to 377 m/s. A linear shock velocity, particle velocity fit was applied to the Hugoniot data which resulted in a Hugoniot slope of 2.17 and Hugoniot intercept of 1112 m/s. The calibration …
Monitoring Hydrocarbons In Air Using Adaptive Multivariate Sensor Signal Processing And Analysis Of Humidity Effects, Sakin Sarwar Satter
Monitoring Hydrocarbons In Air Using Adaptive Multivariate Sensor Signal Processing And Analysis Of Humidity Effects, Sakin Sarwar Satter
Dissertations (1934 -)
Volatile organic hydrocarbons such as BTEX (benzene, toluene, ethylbenzene, xylenes), commonly released into the ambient environment from sources such as gasoline or household products, are known to be hazardous to human health. As a result, real-time monitoring of such compounds in ambient environments is required for safety. Gas sensors with high sensitivity, sufficient selectivity, and fast response times are needed for effective monitoring of the environment. This dissertation addresses some challenges in environmental monitoring using gas sensors, especially with multi-analyte mixtures in the presence of humidity. This work uses sensor arrays with multivariable sensing parameters (sensitivity and response time constant) …
Situation Awareness Preparation And Prebriefing: Fostering The Cognitive Processes Of Thinking Like A Nurse In Simulation, Amanda Lynn Potter
Situation Awareness Preparation And Prebriefing: Fostering The Cognitive Processes Of Thinking Like A Nurse In Simulation, Amanda Lynn Potter
Dissertations (1934 -)
Situation awareness (SA) is linked with actionable decision-making and clinical judgment in nursing practice. The cognitive processes used in developing SA, outlined in Endsley’s (1995) model, is the framework underpinning this study and are interwoven into the National Council of State Boards of Nursing Clinical Judgment Measurement Model (NCJMM). Cultivating these cognitive processes through prebriefing and simulation designed to intentionally develop SA, is a recommended practice currently seen in aviation and military training. There is a lack of vigorous research testing whether a specific intervention during clinical simulation can develop SA in nursing students. In addition, fostering SA in the …

Religious Security: Its Essence And Main Factors (Ukrainian Context), Olena Predko, Denys Predko
Occasional Papers on Religion in Eastern Europe
Religious security is the protection of the religious space from internal and external threats, which is a particularly important issue in Ukraine today. In the premodern era, the idea of security was formed, which ensured, on the one hand, the development of a certain system of practices as auxiliary factors of neutralizing fear, insecurity, etc., and on the other hand, contributed to strengthening the protective function of various gods and forces as a means of preserving human integrity. In contrast, in the Christian worldview, chain interdependence is built between the concepts of “prayer,” “religious faith,” and “religious freedom,” the totality …

Restorative Constitutionalism, David E. Landau, Rosalind Dixon
Restorative Constitutionalism, David E. Landau, Rosalind Dixon
Washington and Lee Law Review
Cass Sunstein and other scholars have distinguished between two forms of constitutionalism: preservative constitutionalism, which looks to maintain the status quo, and transformative constitutionalism, which aims to transcend a flawed constitutional history and achieve a better future. In this Article, we introduce a third, undertheorized mode of constitutionalism, which we call restorative. Restorative constitutionalism seeks a return to a lost, more authentic constitutional past, whether real or imagined. Restorative discourse in modern United States constitutionalism is dominated by conservative calls for originalist judicial interpretation. But originalism is only one subset of restoration, and indeed restorative discourse has been present at …
Illegal Contracts And Agreements: A New Standard For Prostitution And Marijuana Agreements, Doug Rendleman
Illegal Contracts And Agreements: A New Standard For Prostitution And Marijuana Agreements, Doug Rendleman
Washington and Lee Law Review
Agreements exchanging sex for money and those involving marijuana may encounter illegality defenses in court. Granting a legal remedy for breach of an agreement that exchanges seriously illegal consideration would lower the court’s public standing and endanger its legitimacy. On the other hand, the spectacle of a buyer claiming its own illegality to escape paying its seller troubles courts.
Lord Mansfield stated the illegality defense in Holman v. Johnson: “No Court will lend its aid to a man who founds his cause of action upon an immoral or an illegal act.” Yet he rejected the illegality defense in that case …

Supporting Healthy Futures: Capitalizing On Medicaid’S Epsdt Medical Necessity Standard, Teressa Colhoun
Washington and Lee Law Review
Youth mental health is in crisis. Children report increased rates of suicidal ideology, depression, and anxiety. Diagnosis rates soar. Pediatric mental health care remains difficult to access. When services are accessible, they are costly—often sending families into medical debt.
This Note discusses Medicaid’s Early and Periodic Screening, Diagnostic, and Treatment (“EPSDT”) benefit. Specifically, it studies the EPSDT benefit’s creation, structure, and administration. This Note focuses on the context in which the EPSDT benefit operates, particularly how health care financing models impact benefit administration. It suggests that the EPSDT benefit has the capacity to address crucial gaps in pediatric mental health …

Over the decades, LGBTQ+ media has had a long history of, despite getting better, more popular, more powerful each time, being canceled, delayed, even simply never seen again. This has led to justified anger, sorrow, + distress from the queer fandom communities, who, already inspired by the sense of activism that their community is founded on, have created over 8 years of online fan campaigning to fight back, maybe even bring the shows from the grave to a new life. This case study will examine 6 of those campaigns, ranging from the birth of modern queer fandom in We Deserve …

A Performative Model For Conducting Critical Race Analysis: Josephine Baker, Modern Dance, And Utilizing Narrative To Transform Legal Doctrine, Patrick C. Brayer
Faculty Works
This article proposes a performative model for analyzing the relationship between race and law by integrating narrative, modern dance, and performance as interpretive tools. Focusing on Josephine Baker’s activism and her 1952 return to St. Louis, the paper demonstrates how storytelling and artistic expression can expand legal scholarship and transform understandings of racial injustice. By bridging legal studies with performance, African American history, and cultural analysis, the work illustrates how embodied expression provides new pathways for confronting structural racism, transgenerational trauma, and the pursuit of social justice.

Imagine this: you are a dedicated orthopedic surgeon who loves her work. You perform a total knee replacement, albeit on a high-risk patient. The patient does not heal properly and complains of an unsteady gait. Upon further analysis, you begin to become concerned that his inability to heal may be due to an improperly placed implant. A corrective surgery will be required. You are distraught by the unanticipated outcome and wish to express your deepest apologies to the patient and his family. Not so fast! Be aware that your moral compass could be leading you into expressing an apology that …
