The Case For Applying Comcast's Causal Canon To The Pregnant Workers Fairness Act, Taylor Todd
The Case For Applying Comcast's Causal Canon To The Pregnant Workers Fairness Act, Taylor Todd
Missouri Law Review
For as long as there have been employer-employee relationships, there has been the potential for problems in those relationships—some of which are rooted in discrimination. In an ideal world, employees and prospective employees would not face adverse decisions based on protected characteristics. Unfortunately, the world is not always ideal and such decisions can and do happen. That said, the law attempts to bring justice when discrimination claims arise, working to balance the interests and rights of wronged employees while also setting forth standards that require employees to meet certain thresholds when making those claims. Throughout modern history, the United States …
Using Intellectual Property To Regulate Artificial Intelligence, Dennis D. Crouch
Using Intellectual Property To Regulate Artificial Intelligence, Dennis D. Crouch
Missouri Law Review
This Article examines the complex relationship between intellectual property (“IP”) rights and the regulation of artificial intelligence (“AI”). It advances two primary claims: First, while IP plays a role in guiding innovative behaviors in AI development, it does not serve as an effective mechanism for direct regulation of AI. This claim is based on the observation that IP rights, such as patents and copyrights, are primarily designed to incentivize innovation and protect creative works, while lacking the levers necessary to address the broader societal implications of AI technology. The narrow focus of IP rights on rewarding creators makes them ill-suited …

Calvinball In Cole County:State Ex Rel. Fitz-James V. Bailey, Eric Humphrey
Missouri Law Review
In the comic strip Calvin and Hobbes, the titular boy and tiger often play a game called Calvinball. There is only one rule to Calvinball: The game cannot be played the same way twice. In one strip, Calvin and Hobbes try to play football. Hobbes yells, “The center snaps the ball to the quarterback.” Calvin retorts, “No he doesn’t! He’s secretly the quarterback for the other team! He keeps the ball!” The game descends into chaos. At the end of the strip, Calvin says, “Sooner or later, all our games turn into Calvinball.” Much like the rules of Calvinball, the …
A Mixed Method Examination Of Bipositivity As A Factor Protecting Cis, Trans, And Gender Expansive Plurisexual Women Against Harmful Sexual Violence Outcomes, Allison E. Cipriano
A Mixed Method Examination Of Bipositivity As A Factor Protecting Cis, Trans, And Gender Expansive Plurisexual Women Against Harmful Sexual Violence Outcomes, Allison E. Cipriano
Dissertations and Doctoral Documents, University of Nebraska-Lincoln, 2023–
Plurisexual women are more likely to experience sexual violence, post-traumatic stress (PTS), and alcohol use problems compared to women with single gender attraction. Disproportionately high rates of sexual violence may partially explain the prevalence of PTS and alcohol problems experienced by plurisexual women. Yet, research on sexual violence, PTS, and alcohol use problems have rarely specifically investigated these phenomena among plurisexual women. Researchers have identified a positive association between binegative experiences and risk of sexual violence among plurisexual women, suggesting that sexuality-based experiences may be connected to sexual violence victimization for this population. While identifying factors predicting risk of sexual …
Trouble’S Bruen: The Lower Courts Respond, Brannon P. Denning, Glenn H. Reynolds
Trouble’S Bruen: The Lower Courts Respond, Brannon P. Denning, Glenn H. Reynolds
Minnesota Law Review Vols. 106:2 onward (2021-present)
New York State Rifle & Pistol Ass'n v. Bruen revolutionized the understanding of how Second Amendment cases are to be adjudicated. Rejecting the tiered-scrutiny analysis around which the lower courts had coalesced since the 2008 Heller decision, the Court instructed courts to look to history and tradition after it was determined that state or federal regulations limited activities that fell within the protections afforded by the Second Amendment's text. Justice Thomas's opinion, however, left open significant questions about how the history-and-tradition method is to operate in practice. The Court recently held oral arguments in United States v. Rahimi, in which …

Leveraging Machine Learning To Analyze Semantic User Interactions In Visual Analytics, Dong Hyun Jeong, Bong Keun Jeong, Soo Yeon Ji
Management and Decision Sciences
In the field of visualization, understanding users’ analytical reasoning is important for evaluating the effectiveness of visualization applications. Several studies have been conducted to capture and analyze user interactions to comprehend this reasoning process. However, few have successfully linked these interactions to users’ reasoning processes. This paper introduces an approach that addresses the limitation by correlating semantic user interactions with analysis decisions using an interactive wire transaction analysis system and a visual state transition matrix, both designed as visual analytics applications. The system enables interactive analysis for evaluating financial fraud in wire transactions. It also allows mapping captured user interactions …
Application Of Methods To Population-Based Surveys To Reduce Bias In Estimates Of Sars-Cov-2 Infection Burden In The Population, Saba Qasmieh
Dissertations and Theses
BACKGROUND: Population-based surveys designed to randomly sample the population can be a critical and complementary tool to traditional surveillance approaches. Probability-based surveys enable the measurement of SARS-CoV-2 testing and outcomes that avoid issues around self-selection into testing, making them an effective approach to address ascertainment bias in passive surveillance. For surveys to be a useful and reliable surveillance tool for understanding the burden and distribution of SARS-CoV-2 infection, they need to capture prevalence estimates that are both valid and reliable to be optimally informative for public health measures. The dissertation was undertaken to address three main gaps that have implications …

Thyroid Cartilage Metastases From Prostate Cancer On 18f Psma Pet Ct: A Case Series, Poonamjeet Loyal, Samuel Gitau, Khalid Makhdomi
Imaging & Diagnostic Radiology, East Africa
Prostate cancer metastases to the thyroid cartilage is an extremely rare phenomenon. We report three cases of advanced prostate carcinoma with metastases to the thyroid cartilage identified on 18F prostate-specific membrane antigen-1007 (PSMA-1007) positron emission tomography (PET)/computed tomography (CT). The pathophysiology and possibility for under-reporting are also discussed. Prostate cancer metastases to the larynx should be considered in the differential diagnosis of thyroid cartilage lesions in patients with advanced prostate cancer and is associated with poor prognosis.

Low-load resistance exercise (LLRE) to failure can increase muscle mass, strength, endurance, and mitochondrial oxidative capacity (OXPHOS). However, the impact of adding blood flow restriction to low-load resistance exercise (LLBFR) when matched for volume on these outcomes is incompletely understood. This pilot study examined the impact of 6 weeks of single-legged LLBFR and volume-matched LLRE on thigh bone-free lean mass, strength, endurance, and mitochondrial OXPHOS. Twenty (12 males and 8 females) untrained young adults (mean ± SD; 21 ± 2 years, 168 ± 11 cm, 68 ± 12 kg) completed 6 weeks of either single-legged LLBFR or volume-matched LLRE. Participants …

Using machine learning and deep learning methods to analyze text data from social media can effectively explore hidden emotional tendencies and evaluate the psychological state of social media account owners. However, the label noise caused by mislabeling may significantly influence the training and prediction results of traditional supervised models. To resolve this problem, this paper proposes a psychological evaluation method that incorporates a noisy label correction mechanism and designs an evaluation framework that consists of a primary classification model and a noisy label correction mechanism. Firstly, the social media text data are transformed into heterogeneous text graphs, and a classification …

The U.S. Constitution grants Congress the power "[t]o regulate Commerce with foreign Nations," but today the exercise of the foreign commerce power resides primarily with the executive branch. That transfer of control is partly the result of significant delegations of responsibility for managing foreign commerce from Congress to the executive. It is also, however, the result of the securitization of foreign commerce. The executive branch asserts that foreign commerce issues fall under its constitutional powers over foreign affairs, and, thus, that it enjoys authority over foreign commerce that exceeds the scope of congressional delegations.
This Article makes three contributions. First, …

Wireless power beaming from space and energy harvesting were once stories of science fiction, until now. Wireless power transmission (WPT) is a field continually in development to provide energy in situations where energy transfer through wires is impractical or unfeasible. This engineering discipline abandons the use of wire technology for the energy transfer between the power source and a distant device. While various forms of WPT exist, our project focuses on transmission through means of radio frequency (RF), utilizing electromagnetic waves to power devices. Furthermore, WPT technology primarily assists in the elimination of a physical connection between devices, and it …

Multi-Hop And Automated Testing Of Wide-Area Network Radio Systems, Zachary C. Numa, Joseph S. Nuccio
Electrical Engineering
Requests for low-power and versatile wide-area Internet-of-Things (IoT) networks are becoming more prevalent with upcoming research in low-data rate ad-hoc mesh networks. Connections to terrestrial satellites have proven promising methods for increasing range capabilities for wide area networks (WAN). As research in communication with IoT networks and satellites progresses, reliable multi-hop mesh networks for Earth-based communication are still necessary to develop the base for satellite communication. These multi-hop communication mesh networks are being developed to allow communication where Line-of-Sight (LOS) from A to B is incapable due to environmental barriers. Hence, communication is possible without LOS by providing an intermediate …

2-Bit Schiffman Phase Shifter, Tavita Dayton, Enrique Ruiz
Electrical Engineering
Phase shifters are found in microwave/RF applications such as defense or wireless communications for their ability to control the relative phase of a system which allows for alignment of signals to obtain constructive interference. Typical phase shifters are chip level (digital and analog) which require a DC bias therefore restricting PCB use unless allowance for air gaps. The paper analyzes a passive and low-profile 2-bit phase shifter using the Schiffman architecture, which outputs a near-constant 90 degree shift over a wide band of frequencies. The design process initially confirmed a proper 90 degree phase shift over the desired WiFi band, …

Subjective Socioeconomic Status Moderates How Resting Heart Rate Variability Predicts Pain Response, Jacinth Jia Xin Tan, Chin Hong Tan, Michael W. Kraus
Research Collection School of Social Sciences
Higher resting heart rate variability (HRV)—an index of more flexible response to environmental stressors, including noxious stimuli—has been linked to reduced perception of experimentally induced pain. However, as stress responses are adapted to one’s chronic environments, we propose that chronic exposure to threats captured by one’s subjective socioeconomic status (SSS) may shape different adaptations that produce distinct pain responses linked to higher resting HRV. Specifically, lower SSS individuals with more threat exposures may prioritize threat detection by upregulating sensitivity to stressors, such as acute pain. Therefore, higher HRV would predict greater perceived acute pain among lower SSS individuals. In contrast, …

Women who leave abusive relationships generally do so with increased debt, reduced assets, insecure housing and longer-term economic insecurity. Most of these women will be experiencing economic abuse even after the relationship has ended, and many cite financial instability as a key factor driving them back into abusive relationships. So, it is imperative that the tax and transfer system helps rather than hinders (albeit inadvertently) this cohort of financially vulnerable taxpayers. However, this is not always the case, with victim-survivors of economic abuse often liable for tax debts incurred by former partners operating businesses in the victim-survivor's name.

Epigenome-wide association studies (EWAS) are susceptible to widespread confounding caused by population structure and genetic relatedness. Nevertheless, kinship estimation is challenging in EWAS without genotyping data. Here, we proposed MethylGenotyper, a method that for the first time enables accurate genotyping at thousands of single nucleotide polymorphisms (SNPs) directly from commercial DNA methylation microarrays. We modeled the intensities of methylation probes near SNPs with a mixture of three beta distributions corresponding to different genotypes and estimated parameters with an expectation-maximization algorithm. We conducted extensive simulations to demonstrate the performance of the method. When applying MethylGenotyper to the Infinium EPIC array data …
