On October 27, 2023, Cleveland State Law Review hosted an in-person Symposium to convene academics, legal practitioners, community advocates, and judges for a robust and timely conversation about democracy’s promise and the fight for its future. This Symposium piece will reiterate some of the conversations by panelists discussing the use of law to become Guardians of Justice, the relationship between education and democracy, and the Ohio Constitution as a tool for recapturing the state’s democratic values.

Improper Indeterminate Incarceration: Navigating The Constitutional Quandaries Of The Reagan Tokes Law's Powers And Procedures, Sophie M. Piteo

This Article advocates for an amendment to the statutory provisions that make up Ohio’s indefinite sentencing scheme to better protect offender’s constitutional rights. Through an analysis of the Reagan Tokes Law and the Ohio Supreme Court’s ruling in State v. Hacker, this Article traces the evolution of Ohio’s indefinite sentencing framework, which was reinstated in 2019. It contrasts the current scheme with the previously invalidated, but very similar, Bad Time Law, which was struck down in 2000 for violating the separation of powers clause and due process rights. This Article is an expansion of comments by Steven H. Steinglass at a Symposium on Democracy sponsored by the Cleveland State Law Review and held on October 27, 2023. The Symposium looked broadly at threats to democracy, but the panel on which he participated focused more narrowly on the Ohio Constitution and Democracy. The Article reviews the history of direct democracy in Ohio with an emphasis on the constitutional initiative. This Thesis develops a one-step predictive run-to-run controller (R2R-MPC) for automating a mechanical serial sectioning (MSS) system. MSS is a destructive material analysis process that iteratively removes slices of material and captures 2D images, reconstructing them into 3D representations. Commonly used in material science for characterizing materials and failure analysis, MSS typically operates in an open-loop fashion, which experiences high variability in material removal due to system disturbances. To address this, a robust closed-loop R2R-MPC is presented, modeling MSS process uncertainty using a linear differential inclusion identified from operational historical data. Many countries worldwide recognize a right to health and provide legal recourse for securing that right. By contrast, for many Americans, there is no legal right or remedy that enables them to access healthcare if they cannot afford it. While there are some statutes and measures in place, such as the Emergency Medical Treatment and Active Labor Act (EMTALA) and Medicaid, coverage remains piecemeal and access to healthcare is not guaranteed. In a district where only 5% of ELLs were deemed language proficient, the problem was the need to understand teacher perceptions of best practices to increase English language learner (ELL) achievement in reading and writing. The purpose of this qualitative study was to examine teacher perceptions of best practices to support ELLs in improving their reading and writing in a heterogeneous high school classroom in a Mid-Atlantic school district. How Wildfires Threaten Water Resources: A Case Study Following The Largest Wildfire Recorded In New Mexico, Eric A. Joseph

Wildfire disturbance propagation along fluvial networks remains poorly understood. We use incident, atmospheric, and water-quality data from the largest wildfire in New Mexico’s history to quantify how this gigafire affected surface runoff processes and mobilized wildfire disturbances into fluvial networks after burning 1382 km2. Surface runoff post-fire increased compared to pre-fire conditions, and precipitation events that are frequently observed in the affected watershed (<2-year recurrence) and fell during the post-fire first rainy season resulted in uncorrelated, less frequently observed runoff events (10-year recurrence). Wavelet coherence analysis highlighted that water quality disturbances propagated variably along the network, even at sites located >160 km downstream of the burn perimeter. Our findings emphasize the need to incorporate spatially resolved longitudinal sampling designs into wildfire water quality research and highlight the spatiotemporal co-dependency among atmospheric, terrestrial, aquatic processes …

As extreme ultraviolet lithography tools with higher image numerical apertures are introduced, the range of angles at the mask multilayer are increased. This represents a challenge for maintaining through-angle mask reflection using the current periodic mask multilayer structures. In addition to reflectance amplitude, the phase of reflected light, which plays an important role in imaging, is also strongly influenced by increasing angles. The propagation of light through each bilayer in the stack imparts a phase shift based on incidence angle. The physical mechanisms usually applied to explain the relativistic electron enhancement have been delved into to elucidate non-adiabatic electron acceleration resulting in the ultra-relativistic electron population observed in the outer radiation belt. We considered multisatellite observations of the solar wind parameters, magnetospheric waves, and particle flux to report an unusual local acceleration of ultra-relativistic electrons under a prolonged high-speed solar wind stream (HSS). A corotating interaction region reaches the Earth’s bowshock on August 3, 2016, causing a minor geomagnetic storm. Maternal mortality in the United States is significantly higher than in most developed nations and has been increasing since 2000. Persistent between-group disparities among White, Black, and Hispanic women occur in terms of maternal mortality; however, the reason for this is largely unknown. Using the intersectionality theory, this quantitative study examined if racial groups predicted maternal mortality and to what extent relationships were moderated by geographic area and health risk factors. This nonexperimental correlational historical research design addressed three research questions. The Healthcare Cost and Utilization Project dataset was used for the analysis. Purpose: BRAFV600E-mutated colorectal cancer exhibits a strong correlation with DNA hypermethylation, suggesting that this subgroup of tumors presents unique epigenomic phenotypes. Nonetheless, 5-azacitidine, which inhibits DNA methyltransferase activity, is not efficacious in BRAFV600E colorectal cancer in vivo.

Experimental design: We randomized and treated mice implanted with patient-derived tumor xenografts harboring BRAFV600E mutation with control, 5-azacitidine, vemurafenib (BRAF inhibitor), or the combination. Comprehensive epigenomic profiling was conducted on control and 5-azacitidine-treated tumor samples, including DNA methylation, histone modifications, chromatin accessibility, and gene expression. Combinations of epigenetic agents were explored in preclinical BRAFV600E colorectal cancer models.

Cyclin E is a regulatory subunit of CDK2 that mediates S phase entry and progression. The cleavage of full-length cyclin E (FL-cycE) to low-molecular weight isoforms (LMW-E) dramatically alters substrate specificity, promoting G1-S cell cycle transition and accelerating mitotic exit. Approximately 70% of triple-negative breast cancers (TNBC) express LMW-E, which correlates with poor prognosis. PKMYT1 also plays an important role in mitosis by inhibiting CDK1 to block premature mitotic entry, suggesting it could be a therapeutic target in TNBC expressing LMW-E. BACKGROUND: Accurate variant classification and relaying reclassified results to patients is critical for hereditary cancer care delivery. Over a 5- to 10-year period, 6%-15% of variants undergo reclassification. As the frequency of reclassifications increases, the issue of whether, how, when, and which providers should recontact patients becomes important but remains contentious.

METHODS: The authors used inductive thematic analysis to analyze open-ended comments offered by oncologists and genetic counselors (GCs) from a large national survey.

RESULTS: Of the 634 oncologists and cancer GCs, 126 (20%) offered substantive free-text comments. Four thematic areas emerged: 1) ambiguity over professional responsibility to recontact, 2) …

Understanding the performance of wideband modulated signals under noise jamming conditions is important for advancing W/V-band military satellite communications. This research developed and validated models to predict performance degradation of a communication channel in the presence of wideband noise jamming. Channel models were developed that included both modulated communication signals and jammer signals. Integrated models included environmental link factors and practical implementation factors. Integrated models were verified and validated using outdoor radio frequency environments utilizing two W/V-band transceivers, a portable W-band jammer, and software defined radios. Cryoconite has been demonstrated to be an efficient accumulator of some classes of contaminants on glaciers in both mountain and polar environments, however the accumulation of contaminants in cryoconite in Iceland has received very little attention to date. To understand the spatial variability of natural and anthropogenic fallout radionuclides and metals on glaciers in Iceland, we present the first study of this region including both cryoconite from three glaciers: Virkisjökull; Skaftafellsjökull; and Falljökull, together with moss balls (‘glacier mice’) from Falljökull. Retained surgical items can lead to patient frustration and prolonged hospital stays. They remain the top reason for reoperation despite the tools that are used to maintain accurate counts. Minimizing disruptions and distractions in the operating room may be one way to assist circulating nurses in obtaining correct and consistent counts.
