Impacts Of U.S. Environmental Regulations On Industry, Xiao Ji, Mengyu Wang, Tianyi Zhang Sep 2025

Impacts Of U.S. Environmental Regulations On Industry, Xiao Ji, Mengyu Wang, Tianyi Zhang

Sim Kee Boon Institute for Financial Economics

This paper analyzes the impacts of U.S. environmental regulations on industry, focusing on command-and-control environmental regulations (CCER) and market-based environmental regulations (MBER). Drawing on empirical data from the Environmental Protection Agency (EPA) spanning over four decades, we examine key legislation such as the Clean Water Act (CWA), Clean Air Act (CAA), and the Resource Conservation and Recovery Act (RCRA), while also discussing more recent frameworks like the Inflation Reduction Act (IRA). Our findings suggest that although penalties under CCER contribute to immediate compliance, they often fail to elicit long-term changes in corporate behavior. In contrast, MBER, exemplified by the IRA, …

Eliminating The Malice Requirement For Fourth Amendment Malicious Prosecution Plaintiffs, Sabrina Huang Sep 2025

Eliminating The Malice Requirement For Fourth Amendment Malicious Prosecution Plaintiffs, Sabrina Huang

University of Chicago Law Review

Someone who has been wrongfully prosecuted in violation of their Fourth Amendment rights can sue a government actor, such as a police officer, for malicious prosecution under 42 U.S.C. § 1983. Malicious prosecution arises when a government actor initiates a criminal case without probable cause, the prosecution leads to the accused’s seizure, and the accused is ultimately not convicted. Fourth Amendment malicious prosecution claims are critical to holding officers and prosecutors accountable for misconduct. Official misconduct is common: more than half of the people exonerated since 1989 were incarcerated due in part to misconduct by the police or prosecutors.

Fourth …

A Test Of The Abundant-Center Hypothesis For Stream Fishes, Matthew L.W. Zink, Brandon K. Peoples, Julian D. Olden, Lily M. Thompson, William K. Annis, Stephen R. Midway Sep 2025

A Test Of The Abundant-Center Hypothesis For Stream Fishes, Matthew L.W. Zink, Brandon K. Peoples, Julian D. Olden, Lily M. Thompson, William K. Annis, Stephen R. Midway

Faculty Publications

The abundant-center hypothesis (ACH) provides a conceptual model for predicting range-wide distributions of species abundance, suggesting that abundance peaks in the center of the geographic range and declines towards range edges. Empirical studies testing the ACH and its subsequent derivations predominantly occurred in terrestrial systems and reported mixed support. Moreover, none of these models consider the possibility of multiple geographic areas of elevated abundance (which we refer to as ‘abundant cores'). Naturally dispersal limited species may exhibit multiple abundant cores, requiring refinement of the ACH. We used fish species abundances from 29 206 community monitoring surveys and weighted geospatial kernel …

Fiscal Federalism And The Fall Of Inheritance Taxes In The United States, Safia Sayed Sep 2025

Fiscal Federalism And The Fall Of Inheritance Taxes In The United States, Safia Sayed

ACTEC Law Journal

Modern scholars of American wealth transfer taxation underappreciate the system’s history—characterized at its incipience by a broad patchwork of state inheritance taxes rather than current law’s federal estate tax. Moreover, this history is not only neglected but incompletely recounted; in the last four decades of the twentieth century, a majority of states in all parts of the country suddenly and voluntarily dispensed with their inheritance taxes. This Article seeks for the first time to understand why, and in doing so, offers lessons to those attempting to optimally design a transfer tax system within a federalist system of governance. Through original …

Performance Evaluation Of Kytc Bridge Deck Overlays Used For Maintenance Activities, Sudhir Palle, Christopher Goff Sep 2025

Performance Evaluation Of Kytc Bridge Deck Overlays Used For Maintenance Activities, Sudhir Palle, Christopher Goff

Kentucky Transportation Center Research Report

State departments of transportation use bridge deck overlay systems to prolong bridge deck service lives. Consisting of a thin layer of material applied to a concrete bridge deck surface, overlays form a protective barrier that improves ride quality, protects embedded reinforcement from harsh environmental conditions, enhances structure durability, and improves deck drainage. Over the past 20 years, the Kentucky Transportation Cabinet has made significant investments in overlays, rehabilitating nearly 5,000 bridge decks with them — roughly 1/3 of all bridges statewide. Given the significant investment in overlays, and the fact they degrade over time — eventually re-exposing bridge …

Formation Of A Prism-Focused Working Group To Address Mcrs Issues And Expanded Prism Requirements, Brian Howell, Robin Baskette, Jennifer Walton Sep 2025

Formation Of A Prism-Focused Working Group To Address Mcrs Issues And Expanded Prism Requirements, Brian Howell, Robin Baskette, Jennifer Walton

Kentucky Transportation Center Research Report

This study, sponsored by the International Registration Plan (IRP), Inc. in partnership with the Kentucky Transportation Center (KTC), examined systemic challenges and opportunities to strengthen two critical safety oversight mechanisms in U.S. commercial vehicle operations—the Motor Carrier Responsible for Safety (MCRS) and the Expanded Performance and Registration Information Systems Management (PRISM) program. The research traced the evolution of federal and state data systems used to identify and monitor carriers, emphasizing the modernization role of the IRP Data Repository (IDR). The IDR now provides a secure, centralized platform for daily vehicle registration data and financial transactions, facilitating the exchange of carrier …

Individual Confidence To Collective Strength: Advancing Nebraska Reading Achievement Through Efficacy, Katherine Bean Sep 2025

Individual Confidence To Collective Strength: Advancing Nebraska Reading Achievement Through Efficacy, Katherine Bean

Educational Leadership Theses, Dissertations, and Student Creative Activity

The University of Nebraska Omaha Early Literacy Workshop aims to train 7,000 teachers in the “Science of Reading” by 2030, strengthening Nebraska educators’ knowledge and skills in evidence-based literacy instruction. This study examines the relationship between full participation in the five-session workshop and teachers’ self-reported efficacy. A total of 356 educators completed Pre and Post Surveys, enabling analysis of growth in knowledge and practice and highlighting sessions with the greatest impact. Open-ended responses further revealed areas of development. A distinctive feature of this model is its flexibility. Content was adapted to district curricula, demographics, and local needs, ensuring a responsive, …

Act On Principal: Identifying The Importance Of Hexaflex Processes On Self-Reported Stress In Educational Leaders, Andrew Prine Sep 2025

Act On Principal: Identifying The Importance Of Hexaflex Processes On Self-Reported Stress In Educational Leaders, Andrew Prine

Educational Leadership Theses, Dissertations, and Student Creative Activity

Acceptance and commitment therapy (ACT) is a behaviorally derived treatment approach with broad application to psychological distress. A key outcome for an ACT-based intervention is psychological flexibility, derived from six core processes known as the hexaflex. (present moment, identification of values, committed action, defusion, acceptance, and self-as-context). ACT is a process-based approach with strong literature support, though it is unknown which, if any, of the six core processes are differentially protective against stress and burnout. The present study investigated if and how the hexaflex processes are correlated with self-reported stress and burnout among educational leaders. Personal accomplishment was found to …
