The Return Of The Inextricably Intertwined Verbiage, Or Not? The Seventh Circuit Correctly Applies The Rooker-Feldman Doctrine, Humberto Ochoa Jr.
Seventh Circuit Review
Civil procedure involves a world of difficult obstacles and unknown traps if a person is not well- versed in the beast, and even for those people with professional expertise, the path is not always as transparent. One doctrine which seems to encompass this confusion well is the Rooker- Feldman doctrine. It is well established in the U.S. legal system that only the Supreme Court of the United States has appellate jurisdiction over final state court judgements and that any other federal court does not. As a direct result, one problem which arises quite frequently is when a party gets barred …

The Marks Rule Misses The Mark: How The Seventh Circuit Correctly Determined The Precedential Effect Of The Supreme Court's June Medical Plurality, Andrea Catalano
Seventh Circuit Review
Each new decision added to the Supreme Court abortion jurisprudence confuses the standard of the right to abortion. Even when granting certiorari, the Supreme Court has consistently reaffirmed the fundamental right to abortion while continually altering the right to allow for new limits on an individual’s ability to obtain one, making the standard harder for the lower courts to apply and the circuits to be consistent. For example, the Supreme Court’s latest decision in June Medical v. Russo, the Supreme Court published a plurality decision making consistency and clarity in the constitutional right to access abortion nearly impossible. When the …

Explaining The Whys: Allowing Battered Woman Syndrome In Aid Of A Duress Defense, Samantha M. Musick
Seventh Circuit Review
The United States’ judicial system is firmly rooted in the proposition that all people are innocent until proven guilty. But because of the rampant stigmatization and misconceptions surrounding abuse, women claiming affirmative defenses and proffering evidence stemming from such trauma are tried with the cards stacked against them. As such, courts should allow evidence of mental health conditions like Battered Woman Syndrome when providing affirmative defenses for crimes such as duress to mitigate the pervasive reality of juror bias within the judicial system. In United States v. Dingwall, the Seventh Circuit Court of Appeals joined the District of Columbia, Sixth, …

"Democracy Is Not A Spectator Sport": A Case For Necessary Judicial Intervention In Elections, Zelpha Williams
Seventh Circuit Review
Ordinarily, federal judges should not alter election rules near an election in order to avoid voter confusion, thereby diminishing electoral participation. However, this principal should not apply in unprecedented times, especially while case numbers rise amidst of a novel global pandemic. Federal courts must intervene to prevent injustice in circumstances when the legislature is ill equipped to respond appropriately under time constraints, especially when public health hangs in the balance. The Supreme Court, in Anderson v. Celebrezze and Burdick v. Takushi, established the analytical framework to be applied to challenges to election laws which infringe on constitutional rights: courts must …

"I Always Feel Like Somebody's Watching Me" Prolonged Use Of Warrantless Video Surveillance And The Fourth Amendment, Samantha J. Mchugh
Seventh Circuit Review
As technology innovates, Fourth Amendment protections potentially become weaker and allow law enforcement to surveille in new ways. Because of those expanded options, the notion of a reasonable expectation of privacy shrinks, leading to further surveillance by police without a warrant. It is essential to reevaluate what is deemed acceptable under the Fourth Amendment when it comes to prolonged warrantless surveillance by law enforcement. The Supreme Court has evaluated this issue for decades, attempting to adapt Fourth Amendment search analysis to the changing landscape of technological innovation. In a case of first impression, the Seventh Circuit erred by holding that …

Faculty and Student Publications
The Muon g-2 Experiment at Fermi National Accelerator Laboratory (FNAL) has measured the muon anomalous precession frequency ωam to an uncertainty of 434 parts per billion (ppb), statistical, and 56 ppb, systematic, with data collected in four storage ring configurations during its first physics run in 2018. When combined with a precision measurement of the magnetic field of the experiment's muon storage ring, the precession frequency measurement determines a muon magnetic anomaly of aμ(FNAL)=116 592 040(54)×10-11 (0.46 ppm). This article describes the multiple techniques employed in the reconstruction, analysis, and fitting of the data to measure the precession frequency. It …

Lecture 07: Nonlinear Preconditioning Methods And Applications, Xiao-Chuan Cai
Lecture 07: Nonlinear Preconditioning Methods And Applications, Xiao-Chuan Cai
Mathematical Sciences Spring Lecture Series
We consider solving system of nonlinear algebraic equations arising from the discretization of partial differential equations. Inexact Newton is a popular technique for such problems. When the nonlinearities in the system are well-balanced, Newton's method works well, but when a small number of nonlinear functions in the system are much more nonlinear than the others, Newton may converge slowly or even stagnate. In such a situation, we introduce some nonlinear preconditioners to balance the nonlinearities in the system. The preconditioners are often constructed using a combination of some domain decomposition methods and nonlinear elimination methods. For the nonlinearly preconditioned problem, …

People Leaders And Change Managers: Perspectives From The Middle, John Regier
People Leaders And Change Managers: Perspectives From The Middle, John Regier
Doctor of Education (EdD)
This qualitative study used a phenomenological approach to explore the lived experiences and professional identity formation of four non-academic middle managers from small, private universities in the United States. Given the lack of peer-reviewed research into non-academic middle leaders in the university setting, this study aimed to expand the understanding of the challenges and motivations of the role. Personal interviews were conducted to explore how participants experienced the professional role of middle manager and how they understood their professional identity as they manage and/or lead through significant change in the university context. The research highlighted the participants’ commitment to serving …

Linking Exposure To Political Content On Social Media With Political Polarization: The Mediating Role Of Anger, Audrey Anne Halversen
Linking Exposure To Political Content On Social Media With Political Polarization: The Mediating Role Of Anger, Audrey Anne Halversen
Theses and Dissertations
Previous research has detailed concerns that exposure to both pro- and counter- attitudinal content on social media can result in outcomes of ideological polarization (e.g. Bail et al., 2018; Lu & Lee, 2018). However, further research is needed in order to understand the conditions under which this polarization may take place. To investigate this issue, this study utilizes a sample of 414 social media users in the U.S. to investigate the mediating effects of a) anger toward political opposites and b) anger toward oppositional social media content on the relationships between various types of political content exposure and the outcome …

Geology Faculty Publications and Presentations
In 2015, the Olympic Mountains contain 255 glaciers and perennial snowfields totaling 25.34 ± 0.27 km2, half of the area in 1900, and about 0.75 ± 0.19 km3 of ice. Since 1980, glaciers shrank at a rate of -0.59 km2 yr-1 during which 35 glaciers and 16 perennial snowfields disappeared. Area changes of Blue Glacier, the largest glacier in the study region, was a good proxy for glacier change of the entire region. A simple mass balance model of the glacier, based on monthly air temperature and precipitation, correlates with glacier area change. The mass …

Over two-thirds of integral membrane proteins of known structure assemble into oligomers. Yet, the forces that drive the association of these proteins remain to be delineated, as the lipid bilayer is a solvent environment that is both structurally and chemically complex. In this study, we reveal how the lipid solvent defines the dimerization equilibrium of the CLC-ec1 Cl

Heart Health: Lifestyle Factors That Influence Cardiovascular Well-Being, Holly K. Sawyer
Honors College Theses
Each year, one in every four deaths in the United States is a result of heart disease. As the leading cause of death among women and men from various ethnicities, heart disease may be overlooked when making everyday life decisions. As a group of genetic and behavioral conditions, heart disease is the number one killer of Americans. This may be due to the typical Western diet and daily life choices such as drinking alcohol or smoking tobacco. Heart diseases including atherosclerosis and coronary artery disease kill ten times more women than breast cancer (Lewis, et al., 2017). White men have …

Cadaveric Endoscopic Gastrocnemius Recession Procedures To Identify Vital Anatomical Structures And Limit Intraoperative And Post-Operative Complications, Austin Combs
Undergraduate Distinction Papers
Gastrocnemius equinus contracture plays a role in a multitude of patient pathologies, conditions, and deformities seen in podiatric medicine (Barrett, 2011). Equinus deformity is associated with over 96% of the biomechanically-related foot and ankle pathologies including hallux valgus, metatarsalgia, capsulitis, pes planus, plantar fasciitis, tendonitis, and others (Deheer, 2015). These pathologies are linked with a decreased range of motion in the ankle joint specifically in dorsiflexion. Corrective approaches can be taken to reduce pathology if the patient presents prior to any major deformity. The aim of this study is to better define the location of the small saphenous vein and …

Vertebrates harbor recognizably orthologous gene complements but vary 100-fold in genome size. How chromosomal organization scales with genome expansion is unclear, and how acute changes in gene regulation, as during axolotl limb regeneration, occur in the context of a vast genome has remained a riddle. Here, we describe the chromosome-scale assembly of the giant, 32 Gb axolotl genome. Hi-C contact data revealed the scaling properties of interphase and mitotic chromosome organization. Analysis of the assembly yielded understanding of the evolution of large, syntenic multigene clusters, including the Major Histocompatibility Complex (MHC) and the functional regulatory landscape of the Fibroblast Growth …
From Memory To Present To An Uncertain Future: An Analysis Of History And Policy On Chinese Food Security, Justin Mascarin
From Memory To Present To An Uncertain Future: An Analysis Of History And Policy On Chinese Food Security, Justin Mascarin
Honors Projects
This paper seeks to analyze China’s historical relationship to famine to better understand contemporary Chinese policy on food security. The historical analysis focuses both at the political level and the level of the peasantry, with a particular focus on the Great Chinese Famine. This Chinese specific analysis in conjunction with an understanding of food security history helps to better understand two white papers on food security from the Chinese Government in 1996 and 2019. This paper finds these white papers to be response to deep rooted doubts in the ability for the Chinese Government to logistically support such a massive …
Physics-Guided Neural Network For Predicting Chemical Signatures, Cara Murphy, John Kerekes
Physics-Guided Neural Network For Predicting Chemical Signatures, Cara Murphy, John Kerekes
Articles
Achieving high classification accuracy on trace chemical residues in active spectroscopic sensing is challenging due to the limited amount of training data available to the classifier. Such classifiers often rely on physics-based models for generating training data though these models are not always accurate when compared to measured data. To overcome this challenge, we developed a physics-guided neural network (PGNN) for predicting chemical reflectance for a set of parameterized inputs that is more accurate than the state-of-the-art physics-based signature model for chemical residues. After training the PGNN, we use it to generate a library of predicted spectra for training a …
